AGREEMENT WITH WORKSITE SPONSOR BETWEEN THE CITY OF BUFFALO AS"SPONSOR"AND THE ERIE COUNTY DEPARTMENT
OF SOCIAL SERVICES"SOCIAL SERVICES DISTRICT"
The Social Services District is charged with receiving and administering federal Temporary Assistance for Needy Families (TAN F) funds, State
Safety Net funds, Food Stamp Employment and Training (FSET) funds and other funds to be used for work activities in accordance with State
Social Services Law and implementing regulations. The funds are to be used for the establishment of work experience projects (in useful public
purposes such as health,social services,environmental protection,education,urban development and redevelopment,welfare,recreation,operation
of public facilities, public safety or child day care, etc.) that can facilitate individual worker self-sufficiency. Under the proposed Agreement With
Worksite Sponsor,the Social Services District will assign eligible workers/participants to the City of Buffalo for work experience purposes.The Buf-
falo Employment Training Center(BETC)and/or similar organizations is(are)expected to assist the City of Buffalo in administering the objectives,
compliance and monitoring components of the subject work experience program.
A copy of the proposed Agreement with Worksite Sponsor is attached for review and approval by Your Honorable Body.
I am requesting that your Honorable Body (i) authorize me to execute the Agreement with Worksite Sponsor, and (ii) authorize pertinent City
personnel to facilitate the Agreement with Worksite Sponsor and take all such steps and execute such documents and enter into such agreements
and arrangements as are necessary to implement the objectives set forth above and in the Agreement with Worksite Sponsor.

The Office of Strategic Planning, Division of Real Estate has received a request from La Kicia M. Hughes-Roach,of 237 Stevens Avenue, Buffalo,
New York 14215 to purchase 107 Edison.Ms. Hughes-Roach would like to purchase the property to rehab and reside.Ms. Hughes-Roach has
estimated the cost of the renovations to be Nine Thousand Two Hundred and Fifty Dollars($9,250).The renovation proposal has been reviewed by
the Division of Real Estate.Ms. Hughes-Roach has provided proof of financial ability to complete the purchase and repair to the property.
The Office of Strategic Planning Land Use Planning Committee, Division of Permit and Inspection Services and the Division of Collections have no
objections to the sale of these properties.
There are no building code violations,taxes or other liens owed to the City of Buffalo by the purchaser.An appraisal was performed by KLW
APPRAISAL GROUP, Inc.,and subsequently approved by the Appraisal Review Board,which determined the value of the property to be at Eleven
Thousand Dollars($11,000.00).
Ms. Hughes-Roach has agreed and is prepared to pay Eleven Thousand Dollars($11,000)for the above referenced property.She has also agreed
to pay for the cost of the transfer tax and recording fees.
I am recommending that Your Honorable Body approve the sale of 107 Edison for the amount of Eleven Thousand Dollars($11,000)to La Kicia M.
Hughes-Roach. I am further recommending that the Office of Strategic Planning prepare the necessary documents for the transfer of title and that
the Mayor be authorized to execute the same.

The Office of Strategic Planning, Division of Real Estate has received a request from Buffalo Erie Niagara Land Improvement Corporation (BENLIC)to
transfer the above referenced properties to their organization for rehabilitation and transfer to a qualified buyer.
BENLIC has received funding through a grant award made by the New York State Office of the Attorney General's(OAG)Community Revitalization
Initiative to rehabilitate five(5)distressed residential properties in the City of Buffalo. BENLIC has identified and obtained title to three(3)of the five(5)
properties. BENLIC has identified two(2)city owned properties 72 Schauf and 179 Westminister as the other two(2)properties they would like to
rehabilitate.
The Office of Strategic Planning Land Use Planning Committee, Division of Permit and Inspection Services and the Division of Collections have no
objections to the transfer of title.There are no building code violations,taxes or other liens owed to the City of Buffalo by the purchaser.
Pursuant to Section 1608 of the Land Bank Act,the Office of Strategic Planning, Division of Real Estate is recommending that Your Honorable Body
approve the transfer 72 Schauf and 179 Westminster to BENLIC for a token dollar providing the following conditions are met:
1. BENLIC will repay the City of Buffalo from the future sale proceeds an amount that is consistent with the 2015 City of Buffalo Proceeds Distribution
Policy.
2. BENLIC agrees to waive Section 4(iii)(c)of its Rules and Procedures regarding
the requirement of the municipality(Buffalo)to submit Standardized Inspector Report forms and Maintenance, Disposition and Reuse plans for the above
mentioned properties,for the purpose of expeditiously acquiring the above mentioned properties.
3.The Board of Directors of BENLIC approves a resolution to acquire and authorize
the acceptance of 72 Schauf and 179 Westminster with the above conditions.
4. BENLIC agrees to pay for all closing costs,recordation fees,transfer tax,etc.in
addition to the repayment from future sale proceeds and if necessary any all title search costs,survey costs,etc.
5. BENLIC agrees to any other terms and conditions deemed necessary by the City of Buffalo Corporation Counsel's Office.
I am further recommending that the Office of Strategic Planning prepare the necessary documents for the transfer of title and that the Mayor be authorized
to execute the same

Dear Councilmembers:
I am in receipt of your letter dated March 24,2016(Re."Request for Detailed Report on BMHA Money Owed to the City)
Per your request, I have attached a detailed report of the outstanding balances BMHA owes to the City, including$1.9 million for natural gas,$1.7 million
due to the Buffalo Water Board,$433,334 for police services,and$159,502 for indirect costs,for a total of$4.2 million.
I have also contacted Corporation Counsel Timothy Ball for his opinion on whether there are any legal issues surrounding the money owed to the City,per
your request.
Please note that, according to the City Charter§3-24, only the Common Council "by resolution and by a two-thirds majority vote of its membership may
compromise or release any liability to the city"and that"any such compromise or release must have a clearly tangible benefit to the City of Buffalo."

Dear Councilmembers:
I am in receipt of your letter dated March 24,2016(Re."Request for Information on Money Owed).
Per your request,please find attached a report listing the unpaid balances in accounts receivable. Please note this report was generated using MU2xTIS,
which can be accessed by any department at any time in order to receive the most up-to-date information.Any billings not entered into the MUNIS system
are not included in this report.
Your letter also requested "a report of all aging accounts receivable that you recommend can be written off from current ledgers. "This department does
not have the authority to recommend such action. The Buffalo City Charter § 10-15 empowers the Director of the Treasury and Collections with the
supervision of management of these accounts:
Buffalo City Charter §10-15: "The director under the supervision of the commissioner shall be charged with the supervision and management of the
collection of all moneys and accounts, due and owing to the city which have been billed by a department, agency, division or board of the city and which
have not been paid to the city on a timely basis in accordance with the terms of such bill. The director shall immediately proceed with the collection of all
such claims reported to him or her."
I have attached§10-15 of the City Charter in its entirety,as it outlines the current process for collections. I have contacted the Departments of Law and
Administration, Finance, Policy and Urban Affairs,per your request,in order to obtain suggestions on legislative changes that would better facilitate
collection operations.
One potential legislative change would be to return collections operations to the Comptroller's office,as it was prior to the revision of the City Charter in
2000.

Mr.John Wingfelder,an Architect acting as agent for HES Properties,the owners of 363 Grant Street,has requested permission to encroach city right of
way at said address.
The project is a new build three story mixed use brick building.The first floor will be retail and the second and third floors will house eleven apartments.
The encroachments include a cornice at the top of the building,5 awnings,and 5 bay windows.The bay windows begin at the second floor level and are
approximately 14'above the sidewalk.
The Department of Public Works, Parks and Streets has reviewed this request with regards to the encroachment issue pursuant to Chapter 413 Section
56(Awnings,Canopies and Marquees)and Section 67(Encroachment Regulations)of the City Charter and recommends that Your Honorable Body
authorize the Commissioner of Public Works Parks and Streets to issue a"Revocable License"for said encroachment provided the following conditions

of the leagues that currently play football in the City of Buffalo.
1.All leagues must perform criminal background checks for coaching and league staff.
2. Each team must designate a Field Marshall to attend preseason meetings with Buffalo Police and to be present at all games for direct communication
with the Buffalo Police.
3.All leagues must adopt a Code of Conduct for the members of the organization,players and parents as provided by Buffalo Police and Division of Parks
and Recreation
Adopting these rules will help in uniformity between the leagues and law enforcement for the safety of players and staff.

The Department Police is requesting that your Honorable Body allow our Department to accept a donation of Ten(10)bicycles from the new Walmart
Super Store,located at 2500 Walden Avenue.We have been working with Walmart as they have been the provider of the various bicycles(following the
City's regular procurement process)that we have purchased under the GIVE II(Gun Involved Violence Elimination)Grant as part of our required
procedural justice community connection activities. Procedural justice is a key component of our move towards community-based,problem-oriented hot
spot policing and BPD is committed to ensuring that the community it serves is treated fairly and shown respect during all interactions.
These four(4)bikes will then become part of our inventory to be given away at various upcoming scheduled GIVE events over the next couple of months.
These informal gatherings will allow community members to interact with police officers from their district,and other GIVE partners: Probation Officers,
Sheriff's Deputies,and Assistant District Attorneys from the DA's office.We are also working with Back to Basics Outreach Ministry who oversees the
Peacemaker and SNUG Programs to help facilitate these community gatherings,allowing everyone to come together under positive circumstances. It is
our hope that such gatherings will start the process of rebuilding confidence in the judicial system,and better establish police legitimacy in areas where
there has historically been a culture of suspicion and mistrust.To build bridges and create an atmosphere of trust with the younger members of the
community,we give away bicycles at these events.

Dear Councilman Pridgen,
I am writing you today in support of two landmarking applications for buildings that are in your council district.The buildings share common attributes in
that they both reflect our common Buffalo history and both are threatened with demolition. I hope the value of preserving these two buildings becomes
apparent.
The Bachelor Apartments were built in 1886 with a specific purpose in mind,to create a full service apartment house for single gentlemen.An unmet need
must have been perceived-that men just starting out in their adult lives were in need of more housing options than rooming and boarding houses.This
option,built within walking distance of downtown and in a vibrant area,offered just that. Designed by Green&Wick,two of Buffalo's most significant
architects,it could be argued that The Bachelor was one of the first mixed use buildings as it provided dentist and doctor offices and a small store on the
first floor.
'The Public',an independent local publication,mentions The Bachelor in its January 6,2016 issue:
'A list of former residents of the Bachelor includes James Parker Hall,the first permanent dean of the University of Chicago Law School;William Bennet
Colburn,secretary and treasurer of the Pierce Cycle Co.;and Henry Hale Seymour,an attorney who argued at least one case before the US Supreme
Court and authored a book titled Ceramic Art in Egypt.Claude Bragdon,an architect who designed Rochester's New York Central Railroad station and
First Universalist Church,among others...'
How do we justify the further destruction of character at the intersection of West Tupper and Franklin Street?With the Delaware Asbury United Methodist
Church, Buffalo Proper and the Rue Franklin restaurants,and the still intact streetscape along Franklin going north,we can still get a sense of what was
existent in that area and how lovely it must have been. In fact,The Bachelor has already been deemed eligible for listing on the coveted National Register of
Historic Places.
During the public hearing held by the Buffalo Preservation Board it was notable how many persons who currently reside in The Bachelor came to speak in
favor of this building. It is the place they call'home'and they took time to let the rest of us know that it is worth the effort of saving it. I stand with these
persons and ask that you'throw your hat in'with us and act to save this disguised gem of Buffalo history by voting to landmark this building.
Regarding the Crosby complex of buildings found at the Pratt Street Industrial Heritage Area,the sheer number of inventions and innovations founded in
Buffalo is staggering.Our industrial heritage defines Buffalo and Buffalonians-the grand big old ventures that helped build not only this city but the nation
and is a point of pride for its citizens.
At what point do we determine what fails in the realm of what should be saved and what can go?Is evidence of only the grand industries worth saving or is
it worth saving malt houses,distillery buildings,industrial lofts and powerhouses from the mid-1800's to the 1920's also?What if these buildings were
designed by Lansing&Beierl and famed engineer R.J. Reidpath or if these building housed one of the first metal stamping industries in the United States-
the Crosby Co.?Proceeds from this venture were given by William H.Crosby to The University of Buffalo and whose name still graces one of its buildings.
Furthermore,these buildings have already been deemed eligible for listing on the National Register of Historic Places.All of this informs us that we have
something special.
The Crosby buildings have been left to deteriorate. It is certain that they are in sad condition but this is not reason to allow demolition when 1)this
deterioration was a result of 30 years of continued neglect and,2)it represents a portion of our smaller scale industrial heritage.The City is ripe with
possibility and growth,if there ever was a time that this complex could again be fully exploited for the good of the owners and the City it is now. Endowing
this complex of buildings with the protections offered by local landmark status will afford time while an application for National Register status is pursued
and eligibility for the attendant tax credits to assist with its reclamation and reuse are secured.
I urge you to lead your colleagues on the Common Council in approving the application of The Bachelor and the Crosby buildings for the local historic
designation so their individual histories may be preserved into the future.

Dear Councilman Feroleto;
I am writing this letter to encourage you to support the application for local historic designation of The North Park Library,building and grounds.
The North Park was designed by City architect, Howard Beck. Built in 1928-29,this civic building provided library and community resources to the
neighborhood and local public and parochial students for 80 years.
Though Mr. Beck was City architect from 1904 through the early 1930's and was responsible for the design of many firehouses,libraries and schools,the
North Park Library was the only one was built in the Tudor Revivalist style.
Built into preexisting gardens the North Park Library offered grounds that featured over 30 species of bushes and trees and offered a restful place for
contemplation.Moving into the building,the interior first floor featured a bank of leaded glass windows and a fireplace.The lower level offered an
auditorium and stage,ready for community events.
The period of time that Mr. Beck served the citizens of Buffalo was a time of great civic works,a time of growth and opportunity within the city. Public
spaces like the North Park Library were deemed necessary for the promotion of the common good-this is evidenced by the sheer number of civic
buildings constructed at that time. Even the naming of these buildings as'civic buildings'marks them as set aside and built for all of us.The purpose of
providing these buildings was to create a publically available space that encouraged civic engagement,discussion and action.
Currently our city is going through a resurgent time of growth;wouldn't it be fitting to return this building to its best use as the newest community civic
building.
I urge you to support the landmarking of the North Park Library Building and Grounds.

Dear Judge Carney:
I am writing you with respect to two properties in the historic Cobblestone District,which I believe are coming before you in regard to building code
violations cited by city inspectors.The properties are 110 and 118 South Park Avenue,the former structure built in the 1850's,and the latter after the Civil
War during the Industrial Revolution.
Unfortunately the owner of the structures,Mr. Darryl Carr,who is scheduled to appear before you on May 5,2016,has allowed these historic structures to
deteriorate at an alarming rate.The Cobblestone District is the genesis of Buffalo's industrial past and has been given historic district status to incentivize
the exciting redevelopment of Buffalo's waterfront for recreational and other purposes.
City records show that 110 South Park was written for 13 violations in December of last year and 118 South Park cited for four violations in March 2016.
Despite years of decline,Mr.Carr appears unwilling or unable to complete these repairs,and in fact,seems to be engaging in demolition by neglect.
I am asking you employ the powers of the bench to ensure Mr.Carr's compliance with city code to repair these structures immediately,or endure the
penalties the court may levy for willful non-compliance with city building codes. Perhaps a receivership model with a responsible party could place these
structures in more responsible and capable hands to promote their revitalization and repair.

Although this may sound petty, I assure you it isn't for many Buffalo residents that count on bus transportation.The NFTA Metro Bus service apparently
have a shortage of drivers so their solution is to skip scheduled runs.Today,4/11/16 the#32 was scheduled to be at Buff State at 4:05pro.After being 10
minutes late I decided to call,and the customer service rep informed me they skipped that run because of no driver. It is important to note that this is not an
isolated incident for myself as well as numerous riders I have talked to.After all we have appointments and classes we need to attend,on time!When are
they going to hire more drivers?This is honestly unacceptable!

Dear Buffalo City Council Members:
The purpose of this Request is to bring to your attention a longstanding severe,and intolerable problem.
The nature of the problem is excessive,ongoing and debilitating noise from soccer games at McCarthy Park which substantially interferes with the sleep
and quiet enjoyment of the William Price Parkway homeowners.
As you already know,the average home in the William Price Parkway is assessed on the Buffalo Property Tax Rolls at$212,500.
What may not be known,however,is that Soccer Field#1 is approximately 65 feet and Soccer Field#2 is about 394 feet from the fence of 131 William
Price Parkway where Mr. Benton and his family reside.
Further,you should know that he and the Homeowner's Association have complained numerous times over a three-year period to the Parks Commissioner
to no avail.
This has been exacerbated by soccer balls flying over his fence into his yard;by players and guests parking their cars in front of his house and in the circle
near his house;and the incessant disturbing noise.
Yes,this is a serious nuisance. But we have not come to complain only.We would like to propose a few well-researched solutions.
#1:Acoustic Fences
We are sure you have seen these kinds of fences as you drive from Buffalo to Rochester on the 90E.They are very effective.They tend to reduce the
noise pollution by about 80%.
It is estimated that it would cost about$30k to reduce and abate satisfactorily the noise nuisance using acoustic fences.
#2: Berms
This method involves building mounds of earth.This method will be effective but more expensive than the acoustic fencing.
#3: Rotating the Soccer Fields 90'
Rotating the Soccer Fields 90 degrees requires more will than money.The amount of money required is miniscule. It is estimated that it would cost no
more than$5,000 or$6,000,if not less.
CONCLUSION
We have done the leg work for you to assist you in more clearly understanding the noise dilemma,please note that this problem does not exist in any other
city park,not Delaware Park,not LaSalle Park,nor the Shoshone playground,and not MLK Park.
It is worthy to note that the baseball diamond at McCarthy Park is approximately 390 feet from the Camelot Apartments.These apartments are owned by a
corporation,not by hardworking taxpaying citizens.
Finally,we have attached to this proposal our Soccer Field Presentation Research Document(prepared by an engineer)and our Petition signed by every
Homeowner in the William Price Parkway Homeowners Association.
Present in the audience are some of the Association Members.We invite you to visit McCarthy Park and the William Price Parkway during Soccer Season.
It will allow you to see and hear firsthand the loss of quiet enjoyment that the Homeowners are suffering.

3-4 addition positions,to an approximate cost to be determined after further discussion with the Mayor's Office,the Office of Administration and Finance,
and the Department of Law.
2. Encourage the Buffalo Employment Training Center(BETC)to work with MWBE firm owners to facilitate the enrollment and participation in specific
trade programs trainings that are already offered and in many cases,paid for by federal and state funding they receive to serve the community.
3. Engage the Small Business Development Center(SBDC)to establish foundations for MWBE business owners and solicit their assistance in creating
an ongoing central list of subcontractors. Utilization of the Beverly Gray Exchange Center can be a haven for these interactions with SBCD and MWBE
business owners as well as the list development.
4. Record and broadcast MWBE Task Force meetings through the Public Access Channel.
5.Submission of Utilization Plans and associated forms should be required at the time of bidding and if they are not after a period for addressing the
deficiency,the proposal will not be reviewed for consideration.
6. Use of Joint Ventures and Teaming Agreements where applicable.
7.Compliance Officer and Department Head should conduct a mandatory pre-bid meeting,walk through or conference call prior to submission of bids to
review the MWBE requirements specifically. Request for Proposals(RFP)respondents cannot submit a bid if they do not participate in mandatory meeting
or take mandatory action.
8. Utilize pre-qualified bidders list,a standard bit review process which includes pre-bid meetings,bid opening,and reporting success.
9. Incorporate liquidated damages language into all contract documents signed with prime contractors and enforcement if they do not properly comply with
MWBE mandates and payments.
10. Review policies,procedures,goal setting strategies and use of new technology from other similar sized cities(Rochester,Cleveland,etc.)and budget
for implementation of new resources.
11. Use of the data provided by the Partnership for Public Good report on Race&Inequality as a standard and justification for the basis of change that
needs to occur in policy and guidelines.
12. Routinely provide information on training programs and resources available via Public Access(i.e., Buffalo Urban Renewal Agency Ready to Work
Programs, Dress for Success, BETC Training Opportunities,etc.)
13. Regular meetings with Executive Chamber and Chief Diversity Officer for consistency flow of information and legislative actions to be taken.
14. Further deliberations on the feasibility of a Disparity Study in the City of Buffalo.

(one side only);Virginia Street between Delaware Avenue and Franklin Street(one side only);and Edward Street between Elmwood Avenue and Delaware

2.Approval Process.Only art and craft exhibitors approved in accordance with the Allentown Village Society's application and selection process will be
permitted to participate in the event area defined above, No more than 465 art and craft exhibitors will be permitted. Exhibitors engaged in the exhibition or
sale of so-called"pseudo"art and commercial exhibitors not engaged in the exhibition or sale of arts and/or crafts shall not be included in that total.
3. Food Concessionaires and Vendors.Only food concessionaires and vendors approved in accordance with the Allentown Village Society's application
and selection process will be permitted to participate in the event within the area defined above.Such approved food concessionaires and vendors shall be
located in an area determined by the Allentown Village Society in accordance with the recommendation of the Commissioner of Police or his designee and
the Commissioner of Fire or his designee. Food concessionaires and vendors will not be permitted to operate outside of the event area.
4. Promotional Items.The Allentown Village Society may also select and designate a single vendor to produce and sell Art Festival T-shirts,sweatshirts or
similar merchandise in the event area.The Allentown Village Society,in accordance with rite recommendation of the Commissioner of Police or his
designee and the Commissioner of Fire or his designee shall locate such vendors.
5.Compliance with Existing Laws. Not Withstanding the above. Participants,concessionaires,and vendors are required to comply with all applicable city,
county,and state licensing and health cede requirements. Nothing herein is intended to limit the lawful operation of sidewalk cafe's operating in accordance

each is an authorized participant in the event. Except as herein provided,there shall be no other participants within the event area during the event whether
on public streets or out-of-doors on adjacent private property,including,but not limited to,exhibitors,concessionaires,vendors,and performers,individuals

Article XVI:SD Special Zoning Districts
§511-70.GATES CIRCLE SPECIAL ZONING DISTRICT.
A.Gates Circle,including the location of the former Millard Fillmore Gates Circle Hospital,as hereafter limited and described shall be known as the"Gates
Circle Special Zoning District."
B. LIMITS AND DESCRIPTION.The Gates Circle Special Zoning District shall include 3 Gates Circle and 1277 Delaware Avenue,bounded by Lafayette
Avenue to the North, Linwood Avenue to the east,and Delaware Avenue to the west,and the southernmost parcel line for 1277 Delaware Avenue to the
south.
C. LEGISLATIVE INTENT
(1)This Common Council finds that,the parcel at 3 Gates Circle is no longer viable as a large hospital and is proposed for redevelopment.Thoughtful
redevelopment of the Site would enhance the existing neighborhood and contribute to the quality of life for residents in the area. Pursuant to§511-54 of the
Charter and Code of the City of Buffalo,the Common Council finds it appropriate to create a Special Zoning District for the Site to protect the health,safety
and welfare of the nearby residents and ensure the orderly development of the site.
(2)The Common Council therefore finds that future development shall be controlled by the creation of a special zoning district.
D. PERMITTED USES
(1)Any of the uses which presently are permitted pursuant to§511-24"R5 Apartment Hotel Districts,"of the Code of the City of Buffalo or which may be
established or extended as a matter of right pursuant to said Code shall be permitted uses in the Gates Circle Special Zoning District.
Additionally,any of the following listed uses or any combination thereof may be established or extended in,this district as a matter of right,if in compliance
with all of the regulations of this chapter:
Any neighborhood retail business or service
Bank,business or professional office
Restaurant,tearoom or café,including those with a State Liquor Authority restaurant license
Public Parking Area
Health and Wellness Center
Data Center
(2)For purposes of this section,a"health and wellness center"shall be defined as an establishment that offers health services for the body and mind
including,but not limited to exercise and fitness,swimming,personal training,physical therapy,skin care services nutrition consulting,chiropractic
alternative medicine,acupuncture,or holistic medicine.A"data center"shall be defined as a facility containing a group of networked computer servers
typically used by organizations for the remote storage,processing,or distribution of large amounts of data.
E. RESTRICTED USES.
(1)Any of the following listed uses may be established or extended,separately or in combination with other uses permitted in this District,if in compliance
with all regulations of this Chapter,but only upon the issuance by the Common Council of a Restricted Use Permit pursuant to§511-55 of this Chapter:
Any individual Retail business or restaurant,excluding a grocery store and/or a health and wellness center,in excess of 14,000 square feet
A grocery store in excess of 25,000 square feet
A health and wellness center in excess of 50,000 square feet
Total Retail businesses and/or Restaurants within the District(inclusive of a grocery store or health and wellness center)exceeding 136,000 square feet
Retail businesses or restaurants which have a main pedestrian entrance on Linwood Avenue
(2)Any person seeking to establish or extend a use restricted by Subsection E of this section shall file an application for a restricted use permit as
provided by§511-55 of this chapter.
F. HEIGHT AND BULK DENSITY. Height and bulk density regulations shall be as follows:
A. Height:
(1)No building shall be taller than 10 stories:and
(2)No building along Linwood Avenue may be taller and 3.5 stories for the first 60 feet of depth from the property line along Linwood Avenue.
B. Lot,area and yard requirements
(1)Lot area not less than 5,000 square feet.
(2)Front yard for commercial building:none along Delaware Avenue, Lafayette Avenue,or any public or private road internal to the Site.The minimum
setback along Linwood Avenue is 10 feet.
(3)Side and rear setbacks shall be no less than 3 feet.
C.All approvals granted for development prior to the enactment of this Special District shall be grandfathered and exempt from any of these restrictions or
requirements.
G.SEVERABILITY CLAUSE.The provisions of this section are severable. If any provision paragraph,subparagraph,sentence,clause,phrase or word of
this section or its application to any person or circumstance is held invalid,said invalidity shall not affect any other provision paragraph,subparagraph
sentence,clause,phrase or word or application which can be given effect without the invalid provision,paragraph,subparagraph,sentence,clause,phrase
or word or application of this section.
I.This Ordinance Amendment shall take effect once it is duly ratified pursuant to City Charter§3-19.

dependence opioid treatment facility in the residential section at 254 Virginia Street;and
Whereas,The Common Council is concerned with reported actions to potentially increase clients at the facility.This would amplify issues of parking,
increased crime,reports of children waiting at bus-stops with addicts,littered heroin needles,and the claim that residents are still not notified of monthly
clinic community meetings that only accommodate a select group;and
Whereas, NYS is facing an epidemic of heroin and opioid abuse with an alarming increase in patient admissions to the treatment programs. Because this
epidemic is increasingly prevalent in our society,clinics of this description are necessary to our community. However,as stated in previous Buffalo
Common Council resolutions,a more suitable location such as commercially zoned or established medical facilities should be considered to properly
provide the necessary care to the growing numbers of substance abusers;and

preparation or assembly of foods or beverages may take place on or in vehicle,however the heating of pre-cooked foods is allowed utilizing a cooking
apparatus or grill top so long as it complies with State regulations;
Whereas,Owners of brick and mortar food service establishments are concerned with MCTs,like Mobile Food Vehicle Vendors(MFVVs)before them,
parking in front their establishments and restricted areas;
Whereas,The City of Buffalo parking and vehicle traffic laws,ordinances,rules and regulations should be followed at all times by MCTs;
Whereas, Provisions laid out in our City Charter for MFVVs regarding keeping a one-hundred-foot radius from the nearest edge of any building or section
of a building comprising a licensed food establishment or any licensed hot dog vendor should also be followed by MCTs;and
Whereas, It is necessary to prevent litter and debris therefore,MCTs must be equipped with trash receptacles that shall be changed as necessary to
prevent overflow and may not place signage outside the MCTs as to not block pedestrian passage: Now,Therefore Be It
Resolved that The City of Buffalo Common Council--
1)Believes that Mobile Canteen Trucks need to be regulated to the same degree as Mobile Food Vehicle Vendors.

Whereas,with the inclusion of solar panels being introduced to The City of Buffalo's rooftops,-definite policies and procedures should be in place for the
protection of our firefighters. It is our duty to evaluate the potential risks to our firefighters to include electrical shock,solar panel weight issues and flash
threats;
Whereas,after receiving numerous requests from firefighters for information on how to best protect themselves against solar panels,the NFPA's Fire
Protection Research Foundation received funding from the U.S. Department of Homeland Security Research.Their report issued in 2OL0,outlined the
risks and best practices for emergency responses;
Whereas,policies and procedures should be enacted that requires the specifications of the PV(photovoltaic)system be filed with the local fire department.
This would grant firefighters immediate access to information they need regarding system shutoff locations and number of solar panels,etc;
Whereas,the City code should be amended to reflect the updated National Electrical Code and Uniform Construction Code that require external shutoff
mechanisms. It is also essential for the creation of identifying emblems for buildings that have the systems or are served by them;and
Whereas,utility companies are installing solar panels on telephone/electric poles throughout their service area: Now,Therefore Be It
Resolved that The City of Buffalo Common Council--
1)Deems it essential to protect firefighters from potentially hazardous encounters with solar panels not covered by FCNYS by modifying The City
ordinances;
2)Requests Corporation Counsel to incorporate the NFPA's findings with the Fire Department to amend Chapter 103 of the city code;
3)Requests continual training for our first responders in the disarmament of solar panels;and

Whereas, In his teens,Thomas left his hometown and took a job in Birmingham where he worked at a factory,finishing cement,but after being subjected
to workplace inequalities,he found the necessary motivation to move on;and
Whereas,Thomas found himself in Erie. PA where he took a job at a local steel mill for seven years before moving to Buffalo. NY to work at Worthington
Plant,leading to a friendship with a local businessman who encouraged him to start his own commercial janitorial business:and
WHEREAS,Thomas started Thomas Maintenance,a janitorial service and quickly established himself as a successful entrepreneur in Buffalo:and
WHEREAS,After extensive traveling around the world,Clara was reunited with Roy later in life and they were married in January 1981 and without
hesitation,she was eager to learn all there was to know about running his business:and
WHEREAS,A Trailblazing sign would be an appropriate honor for Roy and Clara Thomas,to recognize their healthy balance of faith,sacrifice and
dedication to the community
Now,Therefore, Be It Resolved,
1)That The City of Buffalo Common Council hereby approves the installation of Trailblazing signage proclaiming the corners of 371 N. Hampton&
Jefferson and 411 N. Hampton&Pershing as"Roy&Clara Thomas Way."
2)That the Department of Public Works. Parks and Streets is directed to erect the signs to this effect once all fees associated with the posting of the
Trailblazing Signs have been satisfied.

LAUNCH AN EXPLORATORY BOARD TO EXAMINE THE FEASIBILITY OF PROVIDING CHILD CARE
FOR CITY HALL EMPLOYEES THROUGH AN ON-SITE DAY CARE CENTER
Whereas: Providing on-site child care for employees of City Hall would be beneficial for many people working in the building;and
Whereas:The function of the Exploratory Board would be to investigate the feasibility of having an on-site child care center located within City Hall;and
Whereas:ASFCME Local 650 estimates that approximately one third of its members are eligible to retire in the next five years.Vacancies left by these
retirements will need to be filled,and benefits such as on-site child care could serve as an enticement for a younger workforce to take civil service exams
and apply for jobs within the City of Buffalo;and
Whereas: In the 1980's,Councilmember Rose LoTempio worked in conjunction with the Erie County Legislature to create a similar board that worked on
creating a daycare cite for government employees.Their work resulted in the creation of the Children's Place of Buffalo and Erie County,located in the
Rath Building-95 Franklin Street,which is still operating today;and
Whereas:The successful model provided by Children"s Place of Buffalo and Erie County indicates that a daycare facility could be successful within City
Hall;and
Therefore, Be It Resolved:
That the Buffalo Common Council Members each appoint one person to City Hall Child Care Center Exploratory Board;and
Be It Further Resolved:
That the Buffalo Common Council work in conjunction with the Department of Public Works to appoint a representative from the department to assist with
the City Hall Child Care Center Exploratory Board;and
Be It Finally Resolved:
That the City Clerk forward a copy of this resolution to the Commissioner of the Department of Public Works.
