This report is available as a public record for inspection by all interested parties.
Pursuant to Section 35 of the General Municipal Law,the Common Council of the City of Buffalo may,at its discretion,prepare a written
response to the report of external audit and file such response with the City Clerk as a public record for inspection by all interested parties not

CONSTITUENT CONCERNS FENCE AROUND ST.ANN'S CHURCH&SHRINE
Dear Mayor Brown&Common Council President Pridgen,
This letter concerns the placement of the fence around the front of St.Ann's Church&Shrine at Broadway and Emslie St. Half a decade ago
the Buffalo Catholic Diocese lobbied for this by telling everyone that the towers were falling apart and would come down at any moment,(upon
entering church if you saw a votive candle burning,it doesn't mean that the church is going to burn down).This hasn't happened after five(5)
years and will not happen anytime soon.
The past two(2)years has been extremely harsh as far as the"Freeze&Thaw Cycle"is concerned.The F&TC tends to wreak havoc in the
northeast and in Buffalo in particular.When moisture gets into a wall and is allowed to freeze,thus expanding,followed by a thaw it can
weaken a wall.Given the construction of the tower walls(no less than three(3)feet thick),this cycle has occurred for a short period of time
during the century plus that the church has stood.The structure has held up remarkably well considering the lack of maintenance the diocese
has provided.
We the parishioners were prepared to pay for the work once our new bishop, Bishop Richard Malone"signed off'on us spending"our
money".That didn't happen seeing as they were prepared to demolish this magnificent structure.They would just as soon the"DEMOLITION
by NEGLECT PROCESS play out,as it has around the corner with the synagogue on Jefferson Ave.As a footnote, I would say to you that
we have more than replaced the money that they confiscated,with more pledged.That should not concern you,other than to fortify what we
say.We are prepared to do what we have to.
Also a couple of years ago,they successfully closed down the parking lane and one(1)drive lane in the east bound direction of Broadway
heading out of the city.The snow and the plows took care of that situation.Some of the remnants of the barricades can still be found almost
back to Jefferson Ave.
In the interest of protecting the public,they have accomplished just the opposite by putting the fence right out to the curb,some 25-30 into the
city right of way.With(NO SNOW)people have to walk in the street.With(SNOW)it requires a walk somewhere into the middle of the
street.Try telling the many people walking that stretch that they should cross to the other side of Broadway.
The fence should he completely removed from the City Right of Way.
A second item to be considered would be the rear of the convent building on Emslie St.This would be a perfect example of when freeze and
thaw is allowed to run its course to"demolition by neglect".More than three(3)years ago we notified the diocese about replacing gutters at
the rear of the convent and also a couple locations on the school.Well at present the only thing they've done was to roll out an orange snow
fence some six(6)months after a small section of the brick wall collapsed to the ground. Had the downspout been reinstalled,the wind
wouldn't have pushed the rainwater into the wall,thus accelerating the F&TC with this result.The school fairs better because the wind tends
to blow somewhat parallel to the building's walls,thus slowing the process.
While the situations I've delineated do in fact exist, I do realize the separation between church&state also exists.The difference though is
that they are property owners and landlords too.As owners and landlords they should be accountable for the safety of their buildings with
regard to the public.The public has a right to safely navigate the city R.of W.AGAIN MOVE THE FENCE COMPLETELY OFF OF THE
CITY RIGHT of WAY. Fix the gutters and downspouts and the brick wall of the convent.
Your prompt attentions to these matters would be greatly appreciated.

SAFETY CONCERNS ON WEST FERRY FOR THE WINTER
Dear Pastor Pridgen,
My husband and I live on West Ferry Street on the Delaware to Linwood block.We love our home and take great care in maintaining it but the
residents on our block face a unique situation in the summer and mainly winter months because we are the only block on West Ferry that
does not have alternate street parking.This creates huge backup issues because the plows cannot adequately clear our portion of West
Ferry and the residents cannot see the many speeding cars that run the light on Delaware or the light on Linwood. Last winter,our neighbor
backed out of her driveway and could not see because the cars were pushed out so far that she was hit by an oncoming car and was injured
and her car was totaled.My neighbors are also elderly and often need my help backing out in the winter months because no one can see over
the many parked cars surrounding our driveways. I recently sent a request to the City's 311 and was told to contact your office and ask for
you to request notification serials from the Dept.of Public works'in order to find out why our block is the only block without alternate street
parking and see if a possible solution can be reached to change this,at least in the winter months,for the resident's safety. Please let me
know if there is anything we can do as homeowners to help with this process.There are now children on our block and we would like to make
sure everyone is as safe as possible.Thank you for your time.

These residents from neighborhoods surrounding the former Millard Fillmore site,including the Ellicott and Fillmore Common Council
Districts share a belief that"Gates Circle deserves thoughtful redevelopment and zoning.We applaud efforts to revitalize our neighborhood
and seek sane,measured change."
Gates Circle is a historically significant location and represents one piece of Frederick Law Olmstead's vision.
Commercial Zoning has no place at Gates Circle. Individual or small-scale retail is a reasonable alternative to Commercial zoning for the
entire 6.7 acre plot.
This parcel can be substantially and thoughtfully redeveloped without bringing in Commercial zoning.One way to bring about long-term,
community-supported redevelopment for this site is to establish an Overlay Zone for the parcel.
We propose the Common Council and the Office of Strategic Planning work to bring about an"Overlay Zone"to the 6.7 acre plot at Gates
Circle.
What is an Overlay Zone?
An overlay zone is a zoning district which is applied over one or more previously established zoning districts,establishing additional or stricter
standards and criteria for covered properties in addition to those of the underlying zoning district.
Overlay Zoning can tailor regulations to the Gates Circle property while meeting specific City and community goals.An Overlay Zone for the
Gates Circle parcel can be an example of how residents,developers,and City government can work in unison toward improvement.Overlay
Zoning is also a smart alternative to costly and lengthy litigation.(This last sentence might be going too far).

J.GILES-PEACEMAKERS PROGRAM
Dear Common Council President Pridgen,
The Buffalo Peacemakers need your support now!
As President of the Buffalo Common Council,you know the work of the Buffalo Peacemakers Youth Violence and Gang Intervention
Program.These men and women are the yellow shirts that secure safe passage for children and teens at key street comers every day.They
mentor at-risk youth and provide them with recreational and learning activities.They make large events like Juneteenth or smaller events like
high school football games safe for the community to enjoy.Most important,they build relationships with gang members and are often able to
prevent shootings by creating truces when violence threatens to break out.They save lives.
What you might not know is that the funding for this program is in serious jeopardy. It is very possible that by the end of January 2016,the
Peacemakers program will have no funds left in its budget.The Peacemakers financial year runs from August 1s`to July 31s` With Mayor
5rown's leadership and the Common Council's support,the City of Buffalo is providing$125k to the Peacemakers budget. But that money is
running out fast and we have no guarantee of more income. In our first two years the Oishei and Wendt Foundations supported the program,
but they have let us know that they cannot do so indefinitely and that they need to see a willingness from the City and the County to take
greater responsibility in the future if they are to continue for another year.
To address this problem we want to organize a meeting with Mayor Brown,County Executive Poloncarz,School Superintendent Cash,
leaders from the foundations and other community leaders.At that meeting we will discuss a plan to stabilize our funding for 2016 and create
an expanded and even more effective program for 2017.We are confident that this plan will not only save more lives,but save taxpayers
many millions of dollars.The case we are making for an expanded and improved Peacemakers programs attached to this email.
You might not know that our 11 staff members are paid half-time but routinely work 40-60 hours per week. Because of cash flow problems
they have twice worked for six weeks or longer without being paid.Yet their dedication to our young people keeps them showing up day after
day.
Now,we need your support. Please read the attached case and let Mayor Brown know that you want to expand the Peacemakers program
and the support the City offers it. Please help us gain the long term funding we need to drastically reduce gang-related homicides and
shootings.

The Department of Assessment and Taxation remains committed to the production of fair and equitable assessments and tax burdens
throughout the City of Buffalo.
In compliance with special provisions of state law notices are being mailed on all properties with changes in assessed value,whether an
increase or decrease.As in past years the notice explains to the owners that they may appeal the proposed assessment by filing a complaint
form(RP-524)with the Board of Assessment Review(BAR)by the deadline of December 31 2015.The forms,instructions,sales information
and property information are all available on the City's website under the Department of Assessment and Taxation.Sales information books
have also been placed in each city branch of the Buffalo and Erie County Public Libraries as well as the Central Library location.The BAR will
meet during January and the first week of February to hear the challenges,deliberate and render their decisions and those changes are then
recorded on the City's 2016 Final Assessment Roll published March 1 2016.
The printout accompanying this letter lists in alpha order by address each property that experienced an increase or decrease in assessment
and/or tax status The assessed value of the property as of the March 2015 Final Assessment Roll is compared to the December 2016
Tentative Assessment Roll and the amount of change is noted. Please note where no amount appears in the 2015 Assess Value column
means the parcel did not exist as that time and was recently created either by a division or a combination.

APPROVAL OF CONTRACT WITH EZ TAG CORPORATION FOR THE SUPPLY OF AN ELECTRONIC WRITER SYSTEM FOR
THE CITY OF BUFFALO
Attached for your Honorable Body's review and approval is a contract with EZ TAG Corporation to supply the City of Buffalo with an
electronic ticket writer system to be used for issuing tickets.Such services shall be provided at the rate$0.47 per ticket,all inclusive.
The Division of Parking Enforcement is requesting that approval be granted to allow the Commissioner of Parking to execute the attached
extension agreement, which will allow services to continue through March 31, 2016. Your Honorable body previously extended the
contract on September 2, 2014, however the extension expired on March 9, 2015. The Division of Parking requests a retroactive
extension dated from March 10,2015 through March 31,2016.
A Request for Proposal(RFP)for an Automated Hand Held Ticket Writer System was prepared,following the previous extension of this
contract,however the Division of Parking delayed issuing the RFP.The Division of Parking has since issued an RFP to acquire pay-by-
cell service.This RFP was issued on October 19,2015.The Division of Parking Enforcement delayed issuing the RFP for an Automated
Hand Held Ticket Writer System,because the pay-by-cell software must be compatible with the ticket-writer software.The Division of
Parking Enforcement is currently selecting a vendor for the pay-by-cell service.Once a vendor is selected and approved,an RFP will be
issued for an Automated Hand Held Ticket Writer system.The Division of Parking is requesting that you approve an extension agreement
with EZ TAG Corporation to supply the City of Buffalo with an electronic ticket writer system until a new vendor is selected and approved.

REQUEST FOR AUTHORIZATION OF SUPPLEMENTAL PAYMENT TO
DANIEL TADUSZ
Pursuant to Article XIII of the Collective Bargaining Agreement between the City of Buffalo and AFSCME Local 264,
Employees who are absent from work because of injuries received in the service of the City and who receive compensation benefits may
receive a supplemental sum equal to the difference between their wages and their compensation benefits for a maximum period of six(6)
months, upon authorization and approval by the Common Council.The City agrees to recommend to the Common Council the payment of
such wage differential.
Daniel Tadusz currently holds the position of Parking Enforcement Officer with the City of Buffalo, and was injured during the course of
his employment on 1/28/13.Mr.Tadusz was granted workers'compensation benefits and subsequently returned to work on September 7,
2015.
Based on the above, it is respectfully requested that your Honorable Body authorize payment to Mr.Tadusz in the amount of$2,377.88,

The Common Council of the City of Buffalo,in the County of Erie, New York,hereby resolves(by the favorable vote of not less than two-
thirds of all the members of said Common Council)as follows:
Section 1.The Comptroller of the City of Buffalo,in the County of Erie, New York,is hereby
authorized and directed to issue General Improvement Bonds of said City in the total principal amount of One Million Two Hundred
Nineteen Thousand Eight Hundred Dollars ($1,219,800), pursuant to the provisions of the Charter of said City and the Local Finance
Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York(the"Law"), to finance the City's share of the cost of
acquisition of land and roadway improvements constructed thereon located in the Highland Park Project Phase I residential development
area, being part of Lot 44, Township 11, Range 8 of the Holland Land Company's Survey as described in the attached "Proposed

by this resolution are to be issued, including preliminary costs and costs incidental thereto and the financing thereof,is$1,219,800 as set
forth in the duly adopted 2015 Capital Improvements Budget of said City,as amended.
Section 2 The proceeds of the sale of the bonds authorized by this resolution,or any bond
anticipation notes issued in anticipation of the sale of said bonds shall be deposited in the Capital Projects Fund to the credit of the
Department of Public Works, Parks and Streets, Division of Engineering, "Highland Park Road Construction Phase 1, Purchase of
Improved Land-2015", Bond Authorization Account No. 3000-31,and shall be used for the objects or purposes specified in Section 1 of
this resolution.
Section 3.The City intends to finance,on an interim basis,the costs or a portion of the costs of said objects or purposes for which bonds
are herein authorized,which costs are reasonably expected to be incurred by the City,pursuant to this Bond Resolution,in the maximum
amount of$1,219,800.This Resolution is a declaration of Official Intent adopted pursuant to the requirements of Treasury Regulation
Section 1.150-2.
Section 4.The following additional matters are hereby determined and stated:
(a)The period of probable usefulness applicable to the specific object or purpose for which
the bonds authorized by this resolution are to be issued within the limitations of Section 11.00 a.21 of the Law,is thirty(30)years.
(b)Current funds are not required by the Law to be provided as a down payment prior to the
issuance of the bonds authorized by this resolution or any bond anticipation notes issued in anticipation thereof in accordance-with
Section 107.00 d.9.of the Law.
Section 5. Each of the bonds authorized by this resolution and any bond anticipation notes issued
in anticipation of the sale of said bonds and the renewals of said notes shall contain the recital of validity prescribed by Section 52.00 of
the Local Finance Law. Said bonds and said notes shall be general obligations of the City of Buffalo payable as to both principal and
interest by a general tax upon all the taxable real property within said City without limitation as to rate or amount. The faith and credit of
said City are hereby irrevocably pledged for the
punctual payment of the principal of and interest on said bonds and said notes, Provision shall be made annually by appropriation by said
City for the payment of interest on and for the amounts required for the amortization and redemption of said bonds and said notes.
Section 6.The validity of the bonds authorized by this resolution or any bond anticipation notes issued in anticipation of the sale of said

and a Draft Environmental Impact Statement will not be prepared.
Reasons Supporting This Determination: Potential environmental impacts associated with the action were identified in the Environmental
Assessment Form to assess potential adverse environmental impacts compared to the criteria for determining significance identified in 6
NYCRR§617.7(c)(1)and in accordance with§617.7(c)(2)(3).
The project will not have a significant impact on air quality.This action involves the addition of heating and cooling units,however,based

surfaces related to the construction of the project. However,the project will be required to retain or detain storm water on-site which would
limit any potential impacts.

current traffic levels or generate additional demand for new transportation services.The project is located near and serviced by public bus
routes around the site.
The project will not have a substantial adverse change in noise levels. During construction, this project will create noise, however, the
property is located in an urban area;therefore,this project will not contribute significantly to an increase in noise levels.
The project will not result in the removal or destruction of large quantities of vegetation or fauna;substantially interfere with the movement
of any resident or migratory fish or wildlife species; impact on a significant habitat area; impact a threatened or endangered species of
animal or plant,or the habitat of such a species;or other significant adverse impacts to natural resources.
The project is located in an urban area and is not within or adjacent to a Critical Environmental Area and will therefore,not impair the
environmental characteristics of a Critical Environmental Area.

The project will not create a hazard to human health.A site to the south along Ellicott has been undergoing remediation. However,
cleanup is underway and will not produce a significant impact to the project itself.

resources,or in its capacity to support existing uses.
The project will not encourage or attract a large number of people to a place or places for more than a few days,compared to the number
of people who would come to such place absent the action.
The project will not create a material demand for other actions that would result in one of the above consequences.
The project will not involve changes in two or more elements of the environment,neither of which has a significant adverse impact on the
environment,but when considered together result in a substantial adverse impact on the environment.
The project does not include two or more related actions undertaken,funded or approved by an agency,none of which has or would have
a significant impact on the environment, but when considered cumulatively would meet one or more of the criteria in 6 NYCCR

Dear Council President Pridgen:
Thank you for your leadership in protecting residents of the Fruit Belt from the negative impacts of speculation and gentrification.The
Open Buffalo High Road Economic Development Table unites a diverse array of 19 stakeholder groups,representing Fruit Belt residents,
business owners,non-profit groups,and other community organizations committed to economic development that puts people and
neighborhoods first.
We are writing today with several requests regarding land use planning for the Fruit Belt,and,in particular,the disposition of city-owned
lots.
Most importantly,we ask that,prior to any disposition of city-owned lots in the Fruit Belt,there be a community planning process to decide
the use of the land in the neighborhood.Similar to participatory budgeting,a facilitated community planning process allows Fruit Belt
residents and stakeholders to turn their vision and goals for the neighborhood into concrete plans,criteria,and guidelines that will
ultimately decide the future of the neighborhood.A good example of the process we are requesting is the community planning that PUSH
Buffalo did for the Green Development Zone,which has won international awards and has led to dramatic increases in private investment
while also realizing the residents'goals for sustainable,affordable housing,-community-gardens-and-green-spaces,-and-community-
centers.
Based on work that Fruit Belt residents and stakeholders have already done to identify their priorities,we think that such a community
planning process and,ultimately,the disposition of city-owned lots,should reflect the following vision and principles:
The Fruit Belt remains a mixed-income community with the creation of new,affordable owner-occupied and rental housing that matches
with the existing fabric of the neighborhood and gives preference to existing Fruit Belt residents.
Neighborhood homeowners,residents,and business owners are:
Not forced to relocate because of increased gentrification and resultant property tax increases;
Granted first access,coupled with financial assistance,to acquire city-owned lots adjacent to their homes and businesses;
Provided improved access to repair programs that support the preservation of existing housing and building stock,specifically for low-to
moderate-income homeowners and renters.
Creative solutions are found to preserve the neighborhood,such as the creation of a land trust,supported in part by local member
institutions and developers,that would preserve housing and rental prices for existing residents and business owners.
New development activity includes adequate off-street parking to avoid further burdening residents.
Redevelopment of commercial corridors is mixed-used in design,with current Fruit Belt business owners and residents given priority and
input on the use of the commercial space as well as access to the sites.
Existing,designated green spaces are preserved,and new green spaces are created.
Infrastructure improvements(streets,sidewalks,trees,lighting)are made to improve the health and safety of residents,bike-riders and
walkers.
New community centers are created not only for recreation and programming,but also as a means to provide emergency shelter/warming
centers for vulnerable residents in the event of seasonal emergencies.
We are eager to work closely with you in helping to create a truly inclusive and comprehensive community planning process that helps the
Fruit Belt realize its great potential.Thank you again for considering these concerns.

Cleanup Action Completed at Brownfield Site
Action has been completed to address the contamination related to the 3 Gates Circle Site("site")located at 3 Gates Circle, Buffalo, Erie
County under New York State's Brownfield Cleanup Program. Please see the map for the site location.
The cleanup activities were performed by Gates Circle Holdings, LLC("applicant)")with oversight provided by the New York State
Department of Environmental Conservation(NYSDEC).The applicant has submitted a draft Final Engineering Report for NYSDEC
review which states that cleanup requirements have been or will be achieved to fully protect public health and the environment for the
proposed site use.
Highlights of the Site Cleanup:
1. Excavation and off-site disposal of approximately 1,520 cubic yards of soils contaminated with No.6 fuel oil to achieve Restricted
Residential Soil Cleanup Objectives(RRSCOs).
2. Excavation and off-site disposal of approximately 1,090 cubic yards of soils/fill contaminated with polycyclic aromatic hydrocarbons
(PAHs)and mercury to achieve RRSCOs.
3. Placing a site-wide cover system.The cover system consists of soil,crushed stone,asphalt covered areas,and concrete building
slab/foundations.The soil and/or stone cover system has a minimum 2-foot thickness of soil meeting the Part 375 restricted residential
use cover requirements.The soil cover and crushed stone were placed over an orange mesh demarcation layer where contamination
remained below the cover system.
4.An Environmental Easement was placed on the property to restrict land use to restricted residential/commercial/industrial operations
and prevent future exposure to any contamination remaining at the Site.
5. Implementation of a Site Management Plan(SMP)detailing requirements for management of remaining contamination as required by
the Environmental Easement.
6. Implementation of an Excavation Work Plan to assure that future intrusive activities and soil/fill handling at the site are completed in a
safe and environmentally responsible manner;and
7.Certification that the institutional and engineering controls are still in place and effective will be made annually.
Next Steps
When NYSDEC approves the Final Engineering Report,it will be made available to the public(see"Where to Find Information"below).
NYSDEC then will issue a Certificate of Completion which will be announced in a fact sheet that is sent to the site contact list.
The applicant would be able to redevelop the site after receiving a Certificate of Completion. In addition,the applicant:
• would have no liability to the State for contamination at or coming from the site,subject to certain conditions;and
• would be eligible for tax credits to offset the costs of performing cleanup activities and for redevelopment of the site.
A Certificate of Completion may be modified or revoked if,for example,an applicant does not comply with the terms of its Brownfield
Cleanup Agreement with NYSDEC.
Background
Location:The site property is located at 3 Gates Circle in the City of Buffalo. It consists of approximately 6.9 acres and encompasses the
former Millard Fillmore Gates Circle Hospital complex.The property is bounded by Delaware Avenue and commercial properties to the
west; Linwood Avenue and a mix of commercial and residential properties to the east; Lafayette Avenue and a mix of commercial and
residential properties to the north;and commercial properties to the south.
Site Features:The site consists of two buildings,cleared areas from demolition of buildings,debris from demolished buildings,and
parking areas.
Current Zoning and Land Use:The site is currently zoned R5-residential.
Past Use of the Site:The site was initially developed for residential use and was partially used for tricycle manufacturing pre-1900. By
1916 the site was beginning to undergo use as a hospital facility,with continued expansion of the hospital complex(Millard Fillmore Gates
Circle Hospital)through the early 1970's.
Site Geology and Hydrogeology:The subsurface soils generally consist of non-native soil/fills in the upper four feet overlying native soil.
The fill materials consist of sands,gravels,cinders,bricks,and slag.The native soil is very hard,medium plasticity,reddish brown lean
clay present at varying thicknesses and overlying reddish brown sandy silt.The bedrock is approximately 30 feet below ground surface
and is described as gray cherty limestone.Groundwater is approximately 11 feet below ground surface and flows northerly towards
Scajaquada Creek.

Justice for 9 Year Old School Bus Assault Victim
ERIE COUNTY, NY-On November 25,2015 the Buffalo News reported that a nine year old boy was physically and sexually assaulted on a
school bus in South Buffalo.The News reported that the assault happened while no bus aide was in attendance.As the Legislative
representative of this district,and as a father to a 9 year old boy who also takes the bus, I am shocked and saddened.This requires a vocal
community response and those responsible,mainly the Buffalo Board of Education, First Student and the assailants,should be held
accountable.This isn't to imply that this is a new issue,the quality of bus aides,and bus drivers has been a historic problem.
When I was a child in the Buffalo Public School system,we had a carousel of terrible bus aides who never lasted long.One was an admitted
drug dealer,one was a large man who would make us sit on our hands and then sit on us for long periods of time,and some were meek and
allowed unruly students to treat them terribly.What nearly all of them had in common was that they had no business over seeing the safety of
children. In retrospect,some of them were downright abusive.
This is the cost our children pay when we choose to cut corners.The drivers and aides we rely on to safely transport our children have to
work in an incredibly stressful and often hostile environment.The pay they receive for protecting our children is miniscule.There are obviously
clear challenges to attracting and retaining quality people to a job that pays so little,and comes with so many stressors.
There will be calls to do away with busing all together and go back to neighborhood schools but for this specific situation,that argument is not
germane.We have young children suffering traumatic events in what is supposed to be a protected environment.We cannot get away from
that point to fit someone's political or policy narrative.We have to punish the people responsible for this heinous act and commit the
resources necessary to protect our children in the future.
Right now,busing is a reality for a broad scope of reasons,and walking to school just isn't an option for some of our children,let's first make
sure our kids are safe and then we can debate whether busing or school choice policies should be amended.

regarding this deficiency. It could be a matter of life and death.On a voluntary basis, Buffalo Police Officers should have this weapon made
available to them.

That the Common Council hereby approves the application of Ellicott Development,which is the owner of the property located at 905
Elmwood,to encroach the City right-of-way with an excavation protection system that is integral to the construction of a proposed building.
The proposed encroachment is as follows:excavation protection system on Elmwood and West Delavan for the purpose of supporting the
City right-of-way during construction.The excavation protection system will be construction of soldier piles and timber lagging.The soldier
piles and timber lagging will be installed around the foundation of the building,generally five feet into the right-of-way.At the end of
construction,the soldier piles and timber lagging that is within five feet of the surface will be removed.All other materials will be abandoned
in place.
That the Common Council hereby authorizes the Department of Public Works, Parks and Streets,pursuant to Chapter 413-67
(Encroachment Regulations)of the City Charter to permit the installation,provided that the following conditions are met by the applicant:
1.That the applicant obtain any and all other City of Buffalo permits necessary.
2.The final construction documents are approved in writing by the Department of Public Works, Parks and Streets prior to construction
commencing.
3.That the encroachments are installed as shown on the final approved construction documents.
4.That any revisions to the final construction documents be submitted to the Department of Public Works, Parks and Streets for review
and written approval prior to closing.
5.That the applicant submit final as-built drawings to the Department of Public Works, Parks and Streets and the New York State Dig
Safely Commission of all buried encroachments that are to permanently remain in the right-of-way.
6.That the applicant agree in writing to be responsible for any and all maintenance and/or problems,liabilities,costs and/or damages
associated with the encroachments into perpetuity and further that said obligations shall run with the land known at 905 Elmwood Avenue
and that said obligations shall be binding upon the applicant and all of the applicant's successors and assigns and all successive owners
having title to the land known as 905 Elmwood Avenue.
7.That the applicant agree in writing to restore all disturbed surfaces,structures,facilities,utilities and/or appurtenant materials of the
right-of-way to match or improve the existing condition in accordance with the City of Buffalo Department of Public Works, Parks and
Streets standard specifications and/or details.
8.That the applicant supply the Department of Public Works, Parks and Streets with appropriate indemnities and with certificates of
insurance deemed appropriate by the Corporation Counsel,which will indemnify and save harmless the City of Buffalo against any and all
loss and damage arising out of the construction,maintenance,use and removal of approved encroachments.
That the Common Council hereby authorizes the Commissioner of the Department of Public Works, Parks and Streets to enter into this
Right-of-Way Encroachment Agreement subject only to such clarifications as are recommended by the Corporation Counsel in finalizing

Whereas this moratorium on sales of City property in the Fruit Belt is to last until the establishment of a duly approved strategic plan
intended to protect area residents from the adverse effects of development as well as encourage their input concerning Fruit Belt
revitalization;
Whereas for the purpose of restriction of sales, CCP Item No. 2354 Nov 12, 2014 defined the Fruit Belt as an area enclosed by Cherry
Street, Best Street,Main Street,and Jefferson Avenue;and
Whereas,using these streets alone does not make a completely closed in geographical area,leaving several blocks in its southern

Whereas,delinquent homes in foreclosure due to failure to pay taxes,water bills,sewer rents and other user fees are sold as-is at the
Buffalo In-Rem Public Auction to the highest bidders each year in October;
Whereas,in recent years,the City Auction prices have made a dramatic increase in closing bids,sometimes which far exceed the value of
the back taxes and fees owed by the delinquent homeowners;
Whereas,the City of Buffalo is only entitled to the back taxes and fees owed on delinquent homes in foreclosure,and surplus amounts are
rightfully owed to the former owners,lienholders or judgment creditors;
Whereas,the City of Buffalo's In-Rem Auctions have raised a surplus amount of approximately$11.6 million from the sale of 1,211
properties on more than 500 streets across the City;
Whereas,the average In-Rem Auction surplus is about$9,600 and the largest is almost$150,000;
Whereas unclaimed surplus funds are transferred to the County Comptroller, and after five years the unclaimed surplus funds are
transferred to the State Comptroller's general fund;
Whereas the City of Buffalo currently follows state guidelines, which do not address surplus funds regarding In-Rem Auctions or notify
former property owners of the surplus money that they are rightfully owed;
Now,Therefore Be It Resolved that The City of Buffalo Common Council
1)Calls on the Office of Strategic Planning and the Division of Real Estate to notify all property owners in writing of their rights when their
properties are sold in future City auctions;

Whereas Currently, the parks are not equipped with wheelchair accessible swings and equipment. Individuals in wheelchairs and those
with limited mobility have been excluded in many playground activities;and
Whereas It is the mission of the Commission on Citizens Rights and Community Relations of The City of Buffalo to encourage equal
treatment of persons with disabilities;and
Whereas The local parks system should be held to the same standards,to permit constituents equal access and opportunity for
recreational enjoyment.
Now,Therefore Be It Resolved—
That the Department of Public Works conduct a study to determine the need and most practical locations, to incorporate wheelchair
swings and equipment in all parks within the City of Buffalo accessible to individuals in wheelchairs and those with other physical
disabilities;and

Whereas,on November 29,2015,a car crashed through the same guardrails and landed in the path of high-speed traffic on NY 33;
Whereas the traffic patterns of our growing city are changing the use of roadways that cut up dense neighborhoods;
Whereas NYS has recently set a precedent for quick response to issues of traffic safety,following an incident on Scajaquada Expressway
(NY 198);and
Whereas State and local officials have an interest in ensuring the safety of the people travelling through Buffalo on NY 33: Now,Therefore

WHEREAS:South Buffalo native Patricia Quinlivan has had a lifelong passion for reading,which she has gladly shared with just about
everyone she encounters;and
WHEREAS:While raising her four children: Kathleen,Mary,John,and Nora,Mrs.Quinlivan made sure they went to the Cazenovia Library
twice a week to take out books.She and her husband continued to visit the library regularly,even long after their children had grown;and
WHEREAS: Although a secretary in her early years, through her willingness to volunteer, she eventually became the librarian at St.
Thomas Aquinas School.Although she retired, her heart never left the school and she eventually returned,where she continued working in
the library until the school closed in 2006;and
WHEREAS: It was during her time at St.Tommy's that she was able to inspire thousands of children, many of whom as adults,still credit
her with instilling in them a true love for reading;
and
WHEREAS: Mrs. Quinlivan epitomizes the word community. In addition to her time spent at the school,she's been an active parishioner at
St. Thomas Aquinas Church since 1954, particularly as a member of the Rosary Altar Society. In 2009,she became a volunteer at Mercy
Hospital which she continues to enjoy today,and is a proud member of the Lucky Ladies Bowling Team;and
WHEREAS: Mrs. Quinlivan is rightfully so,one of the most beloved members of the South Buffalo Community.She continues to touch the
lives of anyone she encounters,as she has been doing for her entire life;and
WHEREAS:To honor and thank Mrs. Patricia Quinlivan for her decades of service to the community,specifically in regards to reading,it is
the desire of many members of the community to formally rename the Cazenovia Library the Patricia Quinlivan Library;and
Now,Therefore, Be It Resolved:
Section 286-3 of the Buffalo City Code authorizes a member of the Common Council,by resolution,to request the Common Council to
consider the renaming of a public building;and
Be It Further Resolved:
That this Honorable Body:
1)Approves the request to rename Cazenovia Library the"Patricia Quinlivan Library"
2)Request that the City Clerk be directed to file a notice of intention,which directs a public
hearing on the proposed naming in accordance with Chapter 286-3 of the Buffalo City Code;
3)That the City Clerk forward copies of this resolution be sent to the Department of Public Works and Corporation Counsel.

URGE THE BUFFALO BOARD OF EDUCATION AND FIRST STUDENT TO
IMMEDIATELY STAFF EVERY SCHOOL BUS WITH A MINIMUM OF ONE BUS AIDE
WHEREAS,The Buffalo Public School District is tasked with providing transportation for approximately 37,000 students(including
parochial and charter)each day;and
WHEREAS,With dozens of students of varying ages filling a single bus,it is not uncommon for incidents to occur ranging from
disciplinary issues,to medical emergencies,to criminal activity;and
WHEREAS, It is outrageous to expect a single adult who is tasked with driving the bus,which involves a significant level of concentration
and attention to detail, to also supervise the students and properly interfere when dangerous situations arise (i.e. physical altercations) ;
and
WHEREAS, For the safety of every child who relies on a bus for transportation to and from school, it is imperative that a minimum of one
aide be assigned to each and every school bus providing transportation to city residents, for the purpose of supervising the students,
keeping the students safe,and allowing the driver to focus their complete attention to the road;and
WHEREAS, No student should ever have to fear for their safety during their district provided commute to and from school;and
WHEREAS,Although the Buffalo Public Schools are a separate entity from the City of Buffalo, as representatives of the residents of the
city,it is our duty and responsibility to get involved when the safety and well-being of our children is very much at risk;and
NOW,THEREFORE, BE IT RESOLVED,
That the Buffalo Common Council urges the Buffalo Board of Education to work collaboratively with First Student to immediately staff each
school bus in the City of Buffalo with a minimum of one aide;and
BE IT FURTHER RESOLVED,
That this Honorable Body requests a representative of the Board of Education appear before the Buffalo Common Council to report on their
progress;and
BE IT FINALLY RESOLVED,
That the City Clerk forwards copies of this resolution to each member of the Buffalo Board of Education,Superintendent Kriner Cash,and
Associate Superintendent Will Keresztes.
