SINQLE SOURCE PURCHASE OF INOVA LIGHTLINK FOR CITY OF BUFFALO
The Division of Citizen Services is requesting permission from your Honorable body to waive the requirement for competitive bidding for an
upgrade to the existing software from a single source provider for Buffalo's 311 Call and Resolution Center digital signage and wallboarding
software. Inova Solutions currently provides the City of Buffalo 311 Call and Resolution Center with real-time metrics and information so that we
can better serve the citizens of Buffalo. The Cisco data and queue information, along with real-time service request statistics from the Lagan
(CRM)database,is displayed on LCD screens in the call center using the broadcaster software.
Improving call center productivity is a matter of getting the best information to your agents so that they can adjust their activities to enhance
performance. If a call center agent knows that the wait time is high,he or she can try to move his calls along more quickly to reduce the wait time.
Windows 2003(current version)has become unsupported by Microsoft in July of 2015.
Starting over with a new vendor would be a major disruption to the very busy 311 call center which relies on this information being broadcasted to
the operators.
This software solution allows operators and managers to work together to meet performance goals each day.
Multiple sources of information can be integrated into one centralized newsfeed so that operators and managers can easily digest the information.
Current broadcaster that we are using was moved to EOL(end of life)in 2014.
The Division of Citizen Services would like to upgrade this system to continue being a leader for municipalities with technologies and processes
that we have in place.
Funding is available from Department of Justice (JAG)grant managed by the Division of Citizen Services for an upgrade to the existing Inova
Solutions system which encompasses configuration, maintenance, operating/software system upgrades, and training. The cost to upgrade the
current system is$22,816.
This procurement has been reviewed by the Division of Purchase and Departments of Law.

That the Common Council hereby authorizes the Division of Citizen Services to waive formal bidding procedures for the single source purchase

PRESERVATION BOARD DENIAL OF NEW SINGLE FAMILY STRUCTURE AT 728 LINWOOD AVENUE,LINWOOD HISTORIC
PRESERVATION DISTRICT.
The Buffalo Preservation Board unanimously denied the plans for the construction of a new single family structure at
Mr Zambito and Mr Sick,owners of the property,had presented their designs to the Preservation Board on three separate occasions at official
board meetings,April 30,2015,May 14,2015 and finally on June 11,2015.The property in question is in the Linwood Preservation District at the
corner of West Delavan and Linwood and by City Charter any work requiring a building permit is subject to review by the Preservation Board to
ensure that it be compatible with historic fabric of the neighborhood it resides.
Mr Zambito and Mr Sick presented the Board with a one story slab on grade(no basement)house with an attached garage.The Board
determined that the design of the house was incompatible for a number of reasons.The scale of the house did not match surrounding homes for
floor heights,specifically the height of the first floor above grads.The attached garage being located on a primary elevation was also seen as not
being suitable either.Mr Sick stated that this design was necessitated by his desire to create a handicapped accessible house.Although this may
be laudable,the design chosen would not fulfil those requirements anyway.
The designs were denied by the Board on 3 separate occasions and changes made by the owners were minor and did not address the boards
concerns. Board members even visited with the owners on site to try to assist them in creating a suitable design to no avail.
According to Mr.Steve Niemec,president of the Linwood neighborhood association,Mr Zambito and Mr Sick were to reach consensus with
neighbors,according to him this never happened. Numerous residents approached the Board opposing the contract and none supported it.
The Linwood Preservation district was recently expanded so that homes in this area could receive the same protection and increased housing
values their neighbors to the south have received and to provide a public discourse for renovations and new construction based on preservation
standards....They have that now and the process has played out.We therefore ask that the Common Council uphold the Preservation Boards
denial.We are open to review any new designs the owners may have that meet the standards of the neighborhood.

realignment at Utica St. and Fillmore Avenue, the project exceeded the expected construction period by several months. This increase is
necessary to fund additional design, construction management and inspection services needed for this project. This increase specifically deals
with the realignment of curb and drainage at the intersections of Fillmore Ave.and Utica St.to increase safety and meet City of Buffalo standards.
Details of the design and inspection work are attached.This is a federally funded project.

Permission is hereby requested from Your Honorable Body to authorize the Department of Public Works, Parks,and Streets(DPW)to enter into
agreement with Amherst Paving Inc. for the resurfacing of the west half of South Park Avenue from Dorrance Avenue to Nason Parkway
including associated ADA ramp improvements.
The DPW previously received authorization from Your Honorable Body to provide betterment funds and enter into agreement with the City of
Lackawanna for the subject project.Subsequent discussions between the DPW and the City of Lackawanna led to the determination that it was in
the best interest of all parties for the City of Buffalo to enter into agreement directly with Amherst Paving Inc.
The terms of the proposed agreement between the City of Buffalo and Amherst Paving Inc. will be for improvements to be made the City of
Buffalo owned portion of South Park Avenue utilizing the unit prices procured by the City of Lackawanna. The City of Lackawanna procured the
work by request for bids and awarded to Amherst Paving Inc.as the lowest responsible bidder in accordance with NYS General Municipal Law.
The agreement will be entered into with a not-to-exceed amount of$175,000. Funds are available in 32000006-445100 and or an account to be
named at a later date.
All agreements will be subject to approval as-to-form by Corporation Counsel.

Permission is hereby requested from Your Honorable Body to authorize the Department of Public Works, Parks,and Streets(DPW)to enter into
all necessary agreements with the County of Erie for the County of Erie to perform Buffalo River Habitat Restoration at various locations within the
Buffalo River.The agreement will be limited to permission for the County,and its consultants/contractors,to access sites along the Buffalo River
that are owned by the City of Buffalo for the purpose of installing plantings,including pre-construction survey and testing,to attempt to restore the
natural underwater habitat. In addition the City would be prohibited from allowing the purposeful removal of the habitat restoration plantings for a
period of time specified by the USEPA who is the major funding source on the project.
There is no cost to the City for entering into this agreement.
All agreements will be subject to approval as-to-form by Corporation Counsel.

of Public Works, Parks&Streets to enter into an agreement(s)with Energizing Co.to prepare a$250,000 feasibility study for updating and
expanding the City's District Heat system as a modem district energy system to maximize infrastructure efficiencies,reduce energy costs,and
support of downtown revitalization efforts.
Energizing Co.responded to the City's competitive request for proposals for Feasibility Study services.$100,000 of the study cost will be funded
by NYSERDA under its NY PRIZE program award to Buffalo.$75,000 of the study will be funded under the NYPA 5 Cities Formula Grant to the
City.The remaining$75,000 will be provided in-kind by Energizing Co.in exchange for the City's agreement to allow Energizing Co.the right of
first refusal to prepare the necessary engineering studies should the Feasibility Study indicate a viable project effort.The Feasibility study must be
completed by February 28,2016 in accordance with the NYSERDA PRIZE funding.
I hereby request that Your Honorable Body authorize the Commissioner of Publics to execute the Agreement and related documentation and
agreements as shall be required or useful.

Request for Bids.The cost of the used system is$9,958.27 vs.purchasing new at an estimated cost of$14,612.00.The used
equipment has been inspected and would be an acceptable cost saving to the DPW. In addition,the new vendor,Waste

The City of Buffalo's Police Department(the"Department")is positioned to enter into a one-year agreement with PAL to facilitate
proper utilization of up to$125,000 per year,from the Police Department Budget to assist with creation/implementation of the
Buffalo Peacemakers Program.The PAL in turn is expected to enter into an agreement with Back to Basics Outreach Ministries,
Inc.for the proper administration of funding for the Buffalo Peacemakers Program.The Buffalo Common Council previously
approved funding for this program to be funded in 2013.Said contract has since expired,and the City seeks to support funding for
the program for another year.
The Buffalo Peacemakers program provides mentoring,violence prevention,and life enhancement services to City residents.The
Peacemakers provide proactive intervention in the lives of gang-involved or at-risk youth,ages 13-21.The Peacemakers redirect
youth into healthy lifestyles while responding to violent assaults and shootings. Peacemakers will work in concert with law
enforcement officials to build safe neighborhoods in the City of Buffalo.
Accordingly,the Department requests your Honorable Body to:
1.Grant the Commissioner and the Department the specific authority to enter into a one year agreement in form and substance
similar to the agreement attached hereto and expend up to$125,000 to achieve these objectives,
2.Authorize the Department and or other appropriate City staff to take all such steps and actions and to execute and or process
such additional documentation,agreements and or modifications thereto as shall be necessary to facilitate and implement the
terms and provisions of these objectives and the agreement,and
3. Direct the Corporation Counsel and other appropriate City and Department personnel to negotiate to finalization said agreement
and other necessary documentation and agreements wherever necessary for execution and actual implementation of the above
tasks and objectives.

MEMORANDUM
On July 14,2015,Mr.Timothy Sick filed an appeal of the Preservation Board's denial of his proposed construction at 728 Linwood
with the Common Council.Mr.Sick relied on a February 5,2014 memorandum of law from former Assistant Corporation Counsel
Alan Gerstman,which determined
A one-family or two-family dwelling may be constructed on any lot that was of record at the time of the adoption of the City's 1950
zoning ordinance if such use conforms with the current zoning district,and if the new dwelling house meets yard and set-back
requirements of the zoning ordinance. It does not matter whether the lot was always vacant,or if a building had been constructed
on the lot previously.
The opinion relied on Section 511-114,subd.A of the zoning code.
A. Lot width and area exceptions for lots of record.A one-family dwelling or two-family dwelling may be constructed on any lot or
parcel of land of record at the time this amended chapter becomes effective,if located in a district where such use is permitted,
regardless of the area or width of such lot,provided that the yard and other requirements prescribed in this chapter are complied
with.Vacant lots in the same ownership having in the aggregate a continuous frontage of more than 120 feet shall not be subject to
this exception.(emphasis added)
While the plain language of the code would allow Mr.Sick to build a one-family dwelling at 728 Linwood,the property is located
within the Linwood Preservation district. Per Section 337-18 of the City Code,all construction within a preservation district must be
referred to the Buffalo Preservation Board for its action. By Code,the Board must make its decisions based on the guidelines set
by the current edition of the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic
Buildings.At its June 11,2015 meeting,the Preservation Board referred to these standards as the reasoning behind its denial of
Mr.Sick's application.
Mr.Sick has offered no compelling reason why the Preservation Board's decision should be'overturned,therefore his appeal
should be denied.

More easily addressed is a change in the street name of the street in front of our Park-Marine Drive.Currently two(2)streets are named Marine
Drive,the street in front of our Park and the ring road around the Marine Drive Apartment is also called Marine Drive.This ring road is one way
and connects twice with Marine Drive-creating the totally absurd two 12)intersections of Marine Drive and Marine Drive.

Dear Mr.Whitfield:
Rural Metro has routinely come under scrutiny for slow response times in the City of Buffalo. Last month Rural Metro and the City of Buffalo
agreed on a new ambulance service contract that puts more ambulances on the streets and provides more oversight to ensure better response
times.
I have been receiving numerous complaints from residents and I would like to know if the complaints are legitimate.On August 25,2015 a young
Riverside High School athlete suffered a serious leg/ankle injury during a practice at the Riverside High School football field in Riverside Park.
The accident occurred around 6:30 pro.A call for an ambulance was immediately placed and an ambulance didn't arrive at the scene until 7:35
pro.This lengthy response time is totally unacceptable.
When the City of Buffalo and Rural Metro agreed to a new contract several new provisions were added to ensure faster response times,including
more ambulances during peak hours and a requirement giving the Fire Commissioner access at all times to information on ambulances and their
locations.
What changes have been made to ensure that residents of the City of Buffalo are receiving ambulance services by Rural Metro as stated in the
new services contract?
This is not an indictment on the individuals working for Rural Metro but a concern as to the staffing and availability of emergency personnel and
equipment.
Please provide my office with your response. I am available to meet with you to further discuss the details of this incident and the new provisions
of the Rural Metro Ambulance contract with the City of Buffalo at any time.

area).The project development will be coordinated by Saving Grace Ministries, Inc.,with support from True Community
development Corporation and Gateway-Longview, Inc.
The building plan calls for eight(8)units on the second floor and third floor(three efficiencies,two 1-bedroom units and three
2-bedroom units on each floor). Each unit will have its own private bathroom and kitchen with Energy Star appliances.The first
floor will be restored as a community center and program services site,not only for 347 East Ferry residents,but for the
surrounding community.The building renovation includes installation of an elevator and addition of a side entrance to be used
by tenants.The building plans will include proper Green Building features to promote energy efficiency for both the tenant and
the owner.The target population is low-income individuals and families(with and without children),ages 18 and over.All
occupants will be low-income;30-45%will be eligible for SSI/SSD,and approximately 90%will receive Section 8 rental
assistance vouchers. Units can accommodate unaccompanied individuals,as well as single-parent households or two-parent
families.
Saving Grace Ministries, Inc.anticipates that thirty-five(35)jobs will be created during the renovation/construction phase of the
project,with thirteen(13)new permanent jobs created upon completion of the renovation phase.Jobs will include
janitorial/maintenance staff for the facility,case management staff positions,and administrative/secretarial staff.
The amount of the PILOT payments were calculated based upon the City's PILOT policy that provides for payments in the
amount of five percent(5%)of the total income of the proposed budget,assuming a five percent(5%)vacancy. Payments will
increase by three percent(3%)per year for the duration for the 15 year PILOT.

Whereas:This event will host a ceremonial keg tapping,German dancers,and five entertainment for the community;and
Whereas:The Blackrock Oktoberfest event will include many Oktoberfest themes,and is sure to be a fun-filled day for all who attend.
Now,Therefore Be It Resolved:
That the Common Council hereby requests that the City stage/Band shell application Fee be waived for the September 26,2015
"Blackrock Oktoberfest"event located at 200 Amherst Street in the City of Buffalo.
Be It Further Resolved:

floods,droughts,crop failures,disease,water and food shortages;and
Whereas:the climate crisis is a moral crisis that requires,as Pope Francis has said,justice for the earth and for the poor,"and
Whereas:the climate crisis is caused by the rapid increase of greenhouse gases through burning of fossil fuels and there is a fierce
urgency to act.As Martin Luther King,Jr.warned us and there is such as a thing as being too late.
Now,Therefore be it Resolved:
That the City of Buffalo Common Council calls on all of its elected and civic leaders to advance the energy transition to renewables
through policies and practices,and to ensure that the transition is democratic and just;

POLICE APPLICANT PSYCHOLOGICAL EVALUATION DEMOGRAPHICAL INFORMATION
Whereas,The process by which an applicant joins the Buffalo Police Department involves several steps including submitting an
application,taking a recruitment exam,a physical fitness test,a medical examination,an oral exam and taking a psychological evaluation;
and
Whereas,Along with several other possible reasons,the psychological examination can be the reason for rejection from employment with
the Buffalo Police Department;and
Whereas,Applicants are not given specific reasons for failing the psychological examination or allowed an opportunity to retake the
evaluation;and
Whereas, Public information regarding the psychological examination is minimal and
statistics such as race,gender,age and the name of the doctor administering the exam of the applicants should be made available to the
public;and
Resolved that the City of Buffalo Common Council-
1)Calls on The Buffalo Police Department to release the demographical information of Police candidates who passed or failed the
psychological examination portion of the application process,including applicant race,gender and age and the name of the doctor
administering the exam from 2013-2015;and
2)Request that the Buffalo Police Department outline the process of both the psychological evaluation and the appeal process for an
applicant;and
3)That a copy of this resolution be sent to the Buffalo Police Department and Corporation Counsel.

WHEREAS: Board members and participants of the Kids"I Read It"Run have always respected the use of Cazenovia Park in the past;
and
WHEREAS:The Kids"I Read It"Run helps kids keep both their bodies and mind active through their participation in this event;and
