Your Honorable Body is hereby requested to approve the attached PILOT agreement between the City of Buffalo, the County of Erie,
and Saving Grace Ministries, Inc. a NEW York Corporation with offices at 2025 Bailey Avenue, Buffalo, New York 14211, (The
"Taxpayer").
The proposed project will consist of renovating the existing three-story masonry building located at 347 East Ferry Street,between
Jefferson and the Kensington Expressway.The building is currently occupied by Gateway-Longview, Inc.and is used as a community
resource center.The building does not currently include residential housing(the second and third floors currently house empty offices,
classroom space and a kitchen area).The project development will be coordinated by Saving Grace Ministries, Inc.,with support from
True Community Development Corporation and Gateway-Longview, Inc.
The building plan calls for 8 units on the second floor and third floor(three efficiencies,two-1 bedroom units and three-2 bedroom
units on each floor). Each unit will have its own private bathroom and kitchen with Energy Star appliances. The first floor will be
restored as a community center and program services site,not only for 347 East Ferry residents but for the surrounding community.The
building renovation includes installation of an elevator and addition of a side entrance to be used by tenants.The building plans will
include proper Green Building features,to promote energy efficiency for both the tenant and owner.The target population is low-income
individuals and families(with or without children),ages 18 and over.All occupants will be low-income;30-45%will be eligible for
SSI/SSD,and approximately 90%will receive Section 8 rental assistance vouchers. Units can accommodate unaccompanied
individuals,as well as single-parent households or two-parent families.
Saving Grace Ministries, Inc.anticipates that 35 jobs will be created during the renovation/construction phase of the project,with 13 new
permanent jobs created upon completion of the renovation phase.Jobs will include janitorial/maintenance staff for the facility,case
management staff positions,and administrative/secretarial staff.
The amount of the PILOT payments was calculated based upon the City's PILOT policy that provides for payments in the amount of five
percent(5%)of the total income of proposed budget,assuming a five percent(5%)vacancy. Payments will increase by three percent
(3%)per year for the duration of the 15-year Pilot.

Mr.Jonathan White, President of the Allentown Association,has requested permission to install a Historical Marker within city right of
way abutting the George Coit House at 414 Virginia Street.The Historical Marker will designate the Colt House as the oldest home still
standing in the city.
The Historical Marker text has been verified by the Buffalo History Museum.The current property owner has approved the proposed
location.
The Department of Public Works, Parks and Streets has reviewed this request with regards to the encroachment issue pursuant to
Chapter 413 Section 8(obstructions restricted;historical markers)of the City Charter and recommends that Your Honorable Body refer
this item to the Planning Board for the necessary site plan review and approval. If approved by the Planning Board and Your Honorable
Body the Commissioner will issue a"Mere License"as for said encroachment provided the following conditions are met:
1.That the marker installer notifies Dig Safely New York(1-800-962-7962)two working days before installation as required by New York

My name is Anthony Baney and I help volunteer with the Buffalo Cannabis Movement.We are asking that the Buffalo Common
Council vote on,and pass the Buffalo Medical Cannabis Act. I am asking that the city clerk put the Buffalo Medical Cannabis Act
on the schedule to be introduced to the Buffalo Common Council. Below is the proposed bill,thank you for your time,and hope to

Buffalo Medical Cannabis Act.
"This Act would allow the DEA to be involved in overseeing the medical patient registry. The DEA would print up Smart Card
Technology cards for Doctors Recommendations.
Buffalo Doctors would attend Compassionate Care Act(CCA)seminars to be properly certified to recommend medical cannabis.
For patients under 21 the Buffalo Medical Cannabis Act(BMCA)calls for 2 Doctors to recommend medical cannabis with 1
Guardian's signature.2 caregivers can be assigned to pick up medical cannabis,
For Patients over 21,the BCMA calls for 1 Doctor to recommend medical cannabis and 2 caregivers can be assigned to pick up
medical cannabis.
The BCMA calls for only Licensed practitioners that have been trained at CCA seminars to Recommend medical cannabis.
The ECMA calls for a Committee to be set up in the Buffalo Council.The committee shall oversee the implementation of the
BCMA.
The committee shall be comprised of 5 members.A representative from the DEA shall be appointed,a Doctor shall be appointed,a
representative from the Buffalo Police Department shall be appointed,a representative from the local academic community shall be
appointed,and a community,or parent advocate shall be appointed.
This Committee shall set up subcommittees as it sees fit to report back on the implementation process of the BCMA.
This Committee shall have authority to oversee applications for permits to who sets up dispensaries,distribution centers,
manufacturing facilities,and growing facilities. The BCMA calls for medical patients to possess medical cannabis flowers of up to
75 grams(which is equivalent to a months supply for a medical patient)
The BCMA calls for no arrests or fines for medical patients possessing up to 75 grams of medical cannabis flowers.
The BCMA calls for the dosage to be in milligrams,and that each dose shall not contain over 10 milligrams of THC.
The BCMA calls for a Compassionate Exemption" which allows for clinical trials for patients in hospitals. The BCMA calls for
concentrates derived from medical cannabis to be in accordance with CCA standards. The BCMA calls for medical patients in
possession of concentrates derived from medical cannabis to be in accordance with the CCA."

Buffalo Cannabis Movements Public Comment to the Buffalo Police Oversight Committee
Dear Committee members,we are coming to speak to you on the major issue of arrests for cannabis in the City of Buffalo.We are
disappointed with the sheer number and the disproportionate amount of arrests on minorities for cannabis in the City of Buffalo.
From January to May of 2015 there have been 164 arrests for low level possession of Marijuana in the City of Buffalo.Out of these,
131 arrests were black,and 18 were white(1).That means that 79%of the recorded low level Marijuana arrests in the City of
Buffalo,were blacks.This continues the overwhelming evidence that these laws are enforced in a racial bias. From 1977-2015
there have been 10,175 recorded low level Marijuana arrests in the City of Buffalo.Out of these 7,163 were blacks,while whites
only accounted for 2,445 arrests(1).That means from 1977-2015,blacks accounted for 70%of all low level marijuana arrests in
the City of Buffalo.Why was cannabis made illegal?Why did we switch from calling it Cannabis as cited in the Pharmacopoeia
prior to 1937 to Marijuana?Harry Anslinger was the Commissioner of the Federal Bureau of Narcotics when the Marijuana Tax Act
was passed in 1937. He was a huge racist and even targeted famed anti prohibition singer Billie Holiday.The movie"Reefer
Madness"was also a huge propaganda tool for the prohibition of cannabis.These laws come at a huge cost to the state,city,
taxpayers,and those who will be limited in their financial career. Housing inmates has a financial burden on Buffalo and Erie
County,but also over crowds the holding center.Trial fees should also be taken into account with the extra hours of Judges,
Attorneys,and court staff going towards cannabis crimes,which could go to more serious matters of law. Policing hours could go
from arresting and investigating for cannabis crimes,towards violent crimes and sex crimes.The average lime to process an arrest
for low level marijuana possession is 2.5 hours(according to(drugpolicy.org).Those who are arrested face harder times finding
good paying careers,and become dependent on social safety nets.These social safety net programs could provide better services
towards those with severe debilitating diseases,as opposed to going towards those who were caught with small amounts of
cannabis.We believe it would be better to use these police resources towards crimes other than cannabis.Taxpayer money
shouldn't go towards criminalizing people.These laws deprive people of the ability to live and maintain a healthy lifestyle. Former
President Jimmy Carter summed up perfectly in a speech on Drug Abuse to Congress on August 2, 1977."Penalties against
possession of a drug should not be more damaging to an individual than the use of,the drug itself;and where they are,they should
be changed. Nowhere is this more clear than in the laws against possession of marijuana in private use."

Institutional Control:
•Institutional Controls including an Environmental Easement with controls for groundwater use and limiting Site use to
commercial or industrial use subject to local municipal approval;
•Implementation of a Site Management Plan that includes provisions for a Site-wide inspection program to assure the
institutional/engineering controls(IC/ECs)have not been altered and remain effective;d.Site Management Plan:
•Excavation Work Plan to assure that future intrusive activities and soil/fill handling at the Site are completed in a safe and
environmentally responsible manner;

On behalf of the University District Community Development Association, I request that you take immediate action to bring about
the re-design of the Main Street between Hertel Avenue and Niagara Falls Boulevard in Buffalo's University District.
The changes in the design of Main Street that were implemented several years ago have resulted in a more dangerous,less
attractive thoroughfare in our area for pedestrians to cross.Our agency serves the at-risk populations of children and seniors at the
Gloria J. Parks Community Center at 3242 Main Street.The median with the cement planters has reduced the width of the street,
so that vehicles have less room to navigate than before the median was installed.The speed of most traffic has not been reduced
by these"traffic calming"median structures.Seniors often avoid patronizing businesses and facilities by foot because crossing
Main Street is so treacherous with high speed traffic and limited room for vehicles to maneuver given the parking on the street.The
median were intended to be filled with green plants but never included irrigation to keep plants alive in this asphalt environment,so
the cent plants are ugly and look abandoned.
Therefore,we ask you, as our elected City representative, to advocate to the powers that be in the New York State Department of
Transportation, to re-design our section of Main Street.We ask that the new design of Main Street include more accommodations
for pedestrians to move safely cross the street; new traffic flow design with stripping that includes bike lanes; and the removal of
the cement median planters.
We believe that a re-design of Main Street that takes into account the concerns we have outlined above will foster more pedestrian
traffic on Main Street,and thereby re-vitalize the economy of businesses and non-profit agencies in this commercial sector.

and families who are marginally housed or struggling with homelessness.Of the 50 total units,fifteen(15)will be supportive
housing units.The 15 supportive units will come fully furnished as the residents of these units will be those who were previously
homeless and will not be able to provide home furnishings.
The Evergreen Foundation of WNY, Inc.will be the support services provider to those tenants who require assistance,will act
as property manager,will see to all daily management issues,will see to maintenance issues,will be responsible for rent
collections and the execution of lease agreements.Southern Tier Environments for Living, Inc.will be responsible for all tenant
income certifications and other compliance issues and will remain the primary interface between the project and its capital
funding agencies,investors and lenders.
The amount of the PILOT payments were calculated based upon the City's PILOT policy that provides for payments in the
amount of three percent(3%)of the total income of the proposed budget,assuming a five percent(5%)vacancy. Payments will
increase by three percent(3%)per year for the duration for the 15 year PILOT.

Whereas:The hundreds of Meals on Wheels volunteers provide clients with not only healthy and nutritious meals,but also
companionship and a watchful eye for individuals that are homebound and without family or close friends;and
Whereas:Meals on Wheels relies on charitable donations to fund a portion of its operations;and
Whereas: Each year Meals on Wheels hosts Plate Expectations,the major fundraiser for the organization and the Meals on
Wheels Foundation;and
Whereas:This year's Plate Expectations event will take place on Wednesday,September 2nd from 5:00-9:00 pm at the historic
Silo City site.

Whereas: Ducherme Muscular Dystrophy(DMD)is form of muscular dystrophy that causes muscular degeneration and affects
approximately 1 in 3,600 males. Progression of the disease begins at a very young age and by the age of 10 usually
results in paralysis and dependency on a wheelchair for mobility;and
Whereas:Matthew Murray is a young man who unfortunately suffers from this life-altering affliction;and
Whereas:Matty is a positive young man whose strong spirit spreads to those around him,who lives life selflessly and truly values
life;and
Whereas:Vincent Giovino and Eric Chiazza are two of Matthew's friends that have been inspired by Matthew's zest for life to
create the Miles for Matty Softball Charity Event,in order to raise funds to increase awareness for Duchenne Muscular
Dystrophy;and
Whereas:The event will feature a softball tournament to be held Sunday,August 301h at the baseball diamonds of Houghton Park
and Franczyk Park in the City of Buffalo.

Whereas:The Habitat for Humanity volunteer work force continues to rehabilitate older homes and build new ones to strengthen
the City of Buffalo by increasing home ownership and creating additional property tax revenue;and
Whereas:Waiving permit and license fees for the fiscal year 2015-16 will directly reduce their overhead costs and free up
construction dollars that can be used to complete additional projects.
Now,Therefore, Be It Resolved:
The Common Council of the City of Buffalo hereby requests the Department of Permit and Inspection Services and the Department of

ANNUAL ALLENTOWN FALL FESTIVAL
WHEREAS,The Allentown Association, Inc.,has requested permission to conduct the Annual Allentown Fall Festival on Saturday,the
3rd of October 2015;and
WHEREAS,The purpose of the festival is to promote Allentown and the City of Buffalo as a walkable family-friendly destination for
cultural institutions,arts and crafts and local music and to provide activities for children along with support for those talented individuals
who create such music and artwork;and
WHEREAS,The Allentown Association seeks to heighten public awareness of the regional cultural institutions,the talented local
musicians and fine arts and crafts and to heighten public awareness of all that the Allentown District of the City of Buffalo has to offer;
and
WHEREAS,The Allentown Fall Festival will attract thousands of people to the City of Buffalo,including dozens of local bands and
talented artists and craftspeople;and
WHEREAS,The Special Events Advisory Committee,a committee established pursuant to Chapter 414 of the Charter&Code of the
City of Buffalo:will meet to consider the application of the Allentown Association to hold the Annual Allentown Fall Festival,
NOW,THEREFORE, BE IT RESOLVED,This Common Council hereby grants to the Allentown Association, Inc.permission to
conduct the Annual Allentown Fall Festival subject to the terms and conditions contained herein as well as any additional terms and
conditions established by the Special Events Advisory Committee.
BE IT FURTHER RESOLVED, Date and Time of Event.The event shall take place Saturday,October 3,2015,between the hours of
10:00 AM and 7:00 PM and Allen Street from Delaware Avenue to Main Street and Virginia Place, Franklin Street and North Pearl
Streets from Virginia Street to North Street will be closed to general traffic from 7:00 AM Until 9:00 PM.
BE IT FURTHER RESOLVED, Event Area.The event area shall be defined as follows:The area bounded by North Street on the north
(both sides), Elmwood Avenue on the West(both sides),Virginia Street on the south(both sides),and Main Street on the East(both
sides).
BE IT FURTHER RESOLVED, Event Participants.The following terms and conditions shall apply to the event area:
1.Musicians.Musicians shall be permitted on the portable stage to be positioned on North Pearl Street at Allen Street and in the
parking lot of 641 Delaware Avenue only.
2.Art and Craft Exhibitors.Art and/or craft exhibitors shall be permitted at the following locations only:Allen Street between Delaware
Avenue and North Pearl Street(north and south sides);and North Pearl Street 300 feet to the north and south of Allen Street(west
side)and Franklin Street 300 feet to the north and south of Allen Street(east and west sides).
3.Approval Process.Only musicians approved in accordance with the Allentown
Association's application and selection process will be permitted to participate in the event area defined above.Music shall be allowed
only in the two stage areas defined above. No more than 90 art and craft exhibitors will be permitted.Only art and craft exhibitors
approved in accordance with the Allentown Association's application and selection process will be permitted to participate in the event
area defined above. Exhibitors engaged in the exhibition or sale of so-called"pseudo"art and commercial exhibitors not engaged in the
exhibition or sale of arts and/or crafts shall not be included in that total.
4. Food and Beverage Concessionaires and Vendors.Only food and Beverage concessionaires and vendors approved in accordance
with the Allentown Association's application and selection process will be permitted to participate in the event within the area defined
above.Such approved food concessionaires and vendors shall be located in an area determined by the Allentown Association in
accordance with the recommendation of the Commissioner of Police or his designee and the Commissioner of Fire or his designee.
Food concessionaires and vendors will not be permitted to operate outside of the event area.
5.Sale of Beer and Wine.Only the Allentown Association may sell beer and wine within the area defined above.The Allentown
Association,at its sole discretion,may select and designate a single vendor to sell beer and wine within the area defined above.Only
beer and wine products produced by or sold wholesale by the event beverage sponsor(s)designated by the Allentown Association may
be sold within the area defined above.
6. Promotional Items.The Allentown Association,at its sole discretion,may select and designate a single vendor employing a
reasonable number of persons to vend balloons in the event area.The Allentown Association may also select and designate a single
vendor to produce and sell Fall Festival T-shirts,sweatshirts or similar merchandise.The Allentown Association in accordance with the
recommendation of the Commissioner of Police or his designee and the Commissioner of Fire or his designee shall locate such
vendors.
7.Amplified music.Amplified music shall be projected from the stage areas defined above.The projection of amplified music shall not
begin before 12:00 PM and shall end no later than 7:00 PM.
8.Compliance with Existing Laws. Not Withstanding the above. Participants,concessionaires,and vendors are required to comply with
all applicable city,county,and state licensing and health code requirements. Nothing herein is intended to limit the lawful operation of
sidewalk cafe's operating in accordance with Section 413-59 of the Charter&Code of the City of Buffalo.
BE IT FURTHER RESOLVED,
1. Remote Broadcasts. Radio and television broadcasts from remote broadcast units located outside of a building regularly occupied by
a radio or television station may be permitted within the event area at the discretion of the Allentown Association. No such remote
broadcast or telecasts will be permitted on the public streets or out-of-doors on adjacent private property without the permission of the
Allentown Association. Promotional activities other than those permitted by the Allentown Association are strictly prohibited.
2.Vendor and Exhibitor Identification.The Allentown Association shall provide all participants with suitable identification expressly
indicating that each is an authorized participant in the event. Except as herein provided,there shall be no other participants within the
event area during the event whether on public streets or out-of-doors on adjacent private property,including,but not limited to,
exhibitors,concessionaires,vendors,and performers,individuals engaged in promotional activities,fundraising activities,displays of
goods or otherwise. Performances are prohibited within the festival area.
3. Inflatable Devices.All temporary inflatable devices used to advertise or direct attention to a business,service,product and/or activity
shall also be excluded from the event area.

1.)That the Common Council hereby requests the street closing fee and Special Event fee for the October 2015 Allentown Fall Festival
event be waived;and

TRAILBLAZING SIGN IN HONOR OF MATTHEW(MATT)COMERFORD
WHEREAS, Trailblazing Signs,otherwise known as honorary street names,are generally assigned to honor and commemorate
noteworthy persons associated with the City of Buffalo;and
WHEREAS, The Common Council has received a request for a Trailblazing Sign to honor Matthew(Matt)Comerford;and
WHEREAS,Matthew(Matt)Comerford,the fourth of five children to Jim and Cathy Comerford,was born and raised in South Buffalo;
and
WHEREAS, Matt attended St. Martin of Tours grammar school before going on to Bishop Timon-St.Jude High School where he played
football and served as Senior Class President. He was very proud alum, staying active in the school community long after graduating in
2002;and
WHEREAS,After graduating from Timon,Matt went on to attend Erie Community College and Hilbert College,where he graduated with a
Bachelor of Science degree with a major in political science. Throughout college, Matt worked at Wegmans, for the Buffalo Bisons as a
Clubhouse Manager and as a ticket taker for the Buffalo Bills. He was loved by his coworkers at each job, especially for his overall
friendliness and great sense of humor. It was in 2014 that Matt found his true calling when he joined the South District Council office.
Residents looked forward to speaking with Matt,who was always friendly,polite and willing to help;and
WHEREAS, In his spare time, Matt was an avid runner. In 2010, he completed the New York City half marathon with his long time
girlfriend, Julie. It was McKinley Parkway, however, that was Matt's favorite running route. He was arguably the most popular runner in
South Buffalo,smiling,waving,and stopping to chat with all of those he passed.These runs down McKinley often took significantly longer
than they should have because he always made time to stop and visit with neighbors;and
WHEREAS,There was nothing more important to Matt than faith,family and friends. He was an intricate part of South Buffalo and loved
by the entire community,always willing to help his neighbors;and
WHEREAS, To honor the memory of Matthew(Matt) Comerford and to thank him for making South Buffalo an even friendlier place to
live,it is the desire of many members of the community to formally designate a street sign in his name on McKinley Circle;and
NOW,THEREFORE, BE IT RESOLVED,
That the Common Council of the City of Buffalo hereby approves the installation of Trailblazing Signage proclaiming McKinley Circle
"Matt Comerford Way"and

Whereas On July 28,2015,a meeting was held by the University Heights Business Association in regards to the removal of medians on
Main Street between Hertel and Bailey Avenues; moreover we have received feedback of support from the University District Community
Development Association and the University Heights Collaborative organizations;and
Whereas, The Main Street medians are dangerous to traffic and have led to many reported and unreported incidents. The visual risks
they cause are blockage of the street lines for both pedestrians and motorists. Funds for the medians are seemingly non-existent for
repair and there is a lack of interest by residents to maintain them and serve as eyesores and contribute to urban blight;and
Whereas, During the winter weather, the medians present challenges for city plows in clearing the snow by serving as barriers and
reduce the road area needed for vehicles.They make it difficult to properly store snow and remove snow by their narrow entrance and exit
way for large vehicles which in turn poses potential risk to the median being damage;and
Whereas, The businesses of the University Heights Business Association have submitted in writing their recommendations for changes
for Main Street without the medians make it a prosperous walkable pedestrian and bike friendly community similar to Elmwood and parts
of Delaware and Hertel Avenues;and
Whereas, In a unanimous vote to remove the Main Street medians the University Heights Business Association recommended the
following changes; install center turn lane to provide jersey left hand turn and oasis for crossing pedestrians;maximized on street parking
with combined bike land or designated separate lane if room; one lane in each direction with the prudent driver setting the speed; bus
stops installed beyond intersections;reset time for traffic signals;additional sidewalk lightings;and
Whereas, Residents and businesses believe that improvement to Main Street will enhance the Rails To Trails project,link Shoshone and
McCarthy parks and revitalize the corridor and entrance to the neighborhoods
and City of Buffalo of Buffalo: Now,Therefore, Be It
