As the authorities designated to appoint a Chief Information Officer under Section 9 -2 of the City Charter, the undersigned officials hereby unanimously
designate Kenneth Barnes as the Acting Chief Information Officer, while we commence the process for the hiring of a permanent Chief Information
Officer to be transmitted to the Common Council upon appointment.
Mr. Barnes meets the qualifications to act as the Chief Information Officer. As this designation is only temporary and places Mr. Barnes in an acting
capacity, your Honorable Body need not take any further action on this Communication, as it is simply a notification of the same.

APPROVAL OF CONTRACT WITH EMPIRE STATE DEVELOPMENT CORPORATION FOR A RESTORE ILL GRANT AWARD OF UP TO
$100,000 TO ASSIST WHITE'S LIVERY HOUSING DEVELOPMENT FUND COMPANY, INC. (WLHDFC) IN THE RENOVATION OF A VACANT
PROPERTY INTO 14 AFFORDABLE RESIDENTIAL UNITS
The City of Buffalo, through the joint efforts of (and application materials submitted by) OSP /BURA personnel, obtained grant funding commitments
from the Empire State Development Corporation for 14.32 million of Restore III awards, including $100,000 to assist White's Livery Housing
Development Fund Company, Inc. (WLHDFC) in the rehabilitation and renovation of a vacant, dilapidated structure at 430 Jersey Street, Buffalo, into
fourteen affordable residential units.
The project utilizes the historic front and rear facades and distinct tower of the former three -story, 15,896 - square -foot White Bros. Livery & Boarding
Stables (the "Livery"). Constructed in 1889,and once one of Buffalo's finest stables, the Livery had been vacant for over ten years; in 2008, the
structure underwent a partial demolition after a roof collapse. WLHDFC purchased the Livery in August, 2012, after which construction began to
convert the dilapidated, vacant structure into a 14 -unit, affordable and handicapped adaptable residential structure.
Construction on this project is now complete and all construction costs have been verified. Thirteen of the fourteen units in the structure are occupied.
The WLHDFC, a subsidiary of West Side. Neighborhood Housing Services of Buffalo, Inc., was formed in 2011 to own and operate the White's Livery
development.
I respectfully request that your Honorable Body authorize the City of Buffalo to contract with the Empire State Development Corporation to accept the
Buffalo RESTORE III - White's Livery (W895) Project grant funds.
The Office of Strategic Planning is requesting that Your Honorable Body hereby:
1. Authorize the Mayor to execute the necessary grant funding agreements (in substantially the same form attached hereto) and related documentation
as shall be required or useful in facilitating the City of Buffalo's receipt and utilization of the Grant funds;
2. Authorize other City personnel to take all other steps and to enter into and execute such agreements and such further related project documentation
and arrangements as are appropriate and /or necessary to facilitate and implement the City's receipt and utilization of the grant funds, as well as all
related reporting, monitoring, and follow -up functions associated with the grant.
Mr. Smith moved:
That the above item be, and the above communication from the Executive Director of the Office of Strategic Planning, dated October 22, 2014, be
received and filed;
That the Common Council hereby authorizes the Executive Director oft -he Office of Strategic Planning to enter into a contract with the Empire State
Development Corporation to accept the Buffalo RESTORE [II- White's Livery (W895) Project Grant funds to assist White's Livery Housing
Development Fund Company, Inc. to rehabilitate and renovate a vacant, dilapidated structure at 430 Jersey Street, Buffalo, New York into fourteen (14)
affordable residential units: and
That the Common Council hereby authorizes the Mayor to execute the necessary funding agreements and related documentation as shall be required
or useful in facilitating the City of Buffalo's receipt and utilization of the grant funds; and that the Common Council hereby authorizes other City

In the above referenced item Your Honorable Body approved the sale of 1606 Jefferson Avenue to Phyllis N. Caver, 254 Brunswick Blvd., Buffalo, New
York 14209.
Ms. Caver never responded to our letter advising she had outstanding debt owed to the City of Buffalo. The Division of Real Estate is recommending
that Your Honorable Body approve to rescind the sale of 1606 Jefferson, forfeit the deposit of One Hundred Ninety Dollars ($190) and return the
property to our inventory for future sale

The Office of Strategic Planning, Division of Real Estate has received a request from Mr. And Mrs. Augustus Merriweather, 40 Edna, Buffalo, New
York 14209 to purchase 32 and 42 Edna. Mr. and Mrs. Merriweather own property in the surrounding area. They would like to purchase the above
referenced properties for additional yard space.
The Office of Strategic Planning Land Use Planning Committee, Division of Permit and Inspection Services and the Division of Collections have no
objections to the sale. There are no building code violations, taxes or other liens owed to the City of Buffalo by the purchaser.
A market analysis performed by the Division of real Estate showing similar sales in the area range from Forty Cents ($240) to One Dollar Twenty Cents
($1.20) per square foot.
Mr. and Mrs. Merriweather have agreed and are prepared to pay Forty Cents ($.40) per square foot for the parcels for a total of Two Thousand five
Hundred Dollars ($2,500) for the above referenced properties. They have also agreed to pay for the cost of the transfer tax and recording fees.
I am recommending that Your Honorable Body approve the sale of 32 and 42 Edna for the amount of Two Thousand Five Hundred Dollars ($2,500) to
Mr. and Mrs. Merriweather. I am further recommending that the Office of Strategic Planning prepare the necessary documents for the transfer of title
and that the Mayor be authorized to execute the same.

The Office of Strategic Planning, Division of Real Estate has received a request from Mrs. Parul Golder, 121 Miller, Buffalo, New York 14212 to
purchase 119 Miller Street. Mrs. Golder owns property in the surrounding area. She would like to purchase the above referenced property for additional
yard space.
The Office of Strategic Planning Land Use Planning Committee, Division of Permit and Inspection Services and the Division of Collections have no
objections to the sale. There are no building code violations, taxes or other liens owed to the City of Buffalo by the purchaser.

The City of Buffalo, through its Office of Strategic Planning and in conjunction with Mark Goldman and /or The Friends of the Buffalo Story Inc., applied
for (and are about to receive) a $100,000 Grant Award from the National Endowment for the Arts (NEA).
The Office of Strategic Planning requests that your Honorable Body ratify the grant application steps and further hereby authorize the City of Buffalo to
enter into a contract agreement with the NEA to receive the Our Town grant in the amount of $100,000.
The Grant would support the Ferry Street Corridor Project, which will provide Ferry Street area residents of all ages with the opportunity to work with
local visual and performing artists to create artistic expressions of the culture and history of this diverse neighborhood.
The City of Buffalo would be the Grantee for this award; Friends of the Buffalo Story, a non - profit arts organization headed by Executive Director Mark
Goldman, would be the beneficiary.

The City of Buffalo Urban Renewal Agency (Agency) staff reviewed the real property inventory of the Agency to determine parcels that are better
suited, due to the property's character or use, to be transferred to the City of Buffalo (City).
This item is a request for authorization to convey title to three (3) Agency owned properties to the City for One Dollar ($1.00) each and no more.
The Agency Board approved the transfer of the properties on September 11, 2014 and is requesting that your Honorable Body approve the transfer to
the City the following three (3) Agency properties and the following conditions:
1. 770 Ellicott - This property is a walkway adjacent to the Kevin Guest House that connects Ellicott to Washington. The transfer is subject to the City
of Buffalo Department of Public Works being in a position to accept title to the property and maintain it in the manner that is safe to the general public.
2. 225 and 252 Allen Street - These properties are currently being used as public parking lots. The transfer is subject to the establishment of a
necessary account to receive from the net sale of the properties. These lots will be managed by the City's Dept. of Parking. 225 and 252 Allen were
either acquired or improved with CDBG funds- Therefore, the City will be required to comply with all CDBG regulatory requirements under 570.504 and
570.505 as to continued use, including but not limited to public notice of any proposed change of use.
Authorization is therefore requested to transfer the above properties from the Agency to the City and authorization is given for the City to enter into any

city right of way at said address. The fiberoptic cable would connect the main office at 872 Main Street with a building across the street at 847 Main Street. This
link would enable Zepto Matrix Corporation to establish unified computer network, phone, and monitoring systems. The fiberoptic cable would be installed using
the directional bore method with very little disruption to the pavement area.

unmarked vehicle is also lower than anticipated, thus allowing the Department to purchase additional vehicles, without any increase in funding.
The Buffalo Police Department and the Purchase Department will follow local procurement guidelines and will obtain the best possible price for the make and
model vehicles that are decided upon.

Attached for Your Honorable Body's review and approval is a one month contract extension with La Salle Ambulance, Inc., d /b /a /Rural Metro Medical
Services to serve as the City of Buffalo's Emergency Medical Services (EMS) provider.
The Buffalo Fire Department is requesting that approval be granted to allow the Mayor of the City of Buffalo to execute the attached emergency
extension agreement until December 9, 2014. The Agreement continues the contractual relationship under the same terms as the extension that
expires October 31, 2014.
The City issued a comprehensive Request for Proposals (RFP) for this service, and on January 27, 2014, received three proposals in response. A
review committee consisting of the Fire Commissioner, the Law Department, and a representative of the EMS Board conducted an extensive review
and examination of the proposals, in order to select the provider that insures the best service for the City of Buffalo.
On June 24, 2014, Your Honorable Body granted permission to enter into contract negotiations with the selected provider, Rural Metro. After careful
negotiations, the Fire Department, with the assistance of the Law Department, is now finalizing the technical details of the contract to be presented to
the Council for its consideration, and request an extension until December 9, 2014 to accomplish the same.

The City of Buffalo Office of Contract Administration, Office of Community Services, and Office of Strategic Planning received approval to grant a five -
month contract extension for ESG sub - recipients on April 29, 2014. This action extended the funding year from April 30 to September 30, 2014; and
provided sub - recipients with additional funding of up to 40 percent of their 2013 (Year 39) award. All ESG extensions are being paid with ESG - not city
- funding.
In the initial approval, an extension in the amount of $20,700 for Crisis Services was omitted. Approving this extension will not result in any increase of
requested city funds, as sufficient unexpended ESG budget lines have been identified to cover this extension.
The Department of Community Services respectfully requests that your Honorable Body approve the allocation of $20,700 in unexpended ESG funding
to cover this extension for Crisis Services, and authorize all necessary parties to execute the contract amendment on the city's behalf.

This is a copy of an email that I sent to each Common Council member in support of expanding the Linwood Avenue Historic Preservation District.
Dear Councilmembers,
I am writing to express my support of the extension of the Linwood Avenue Historic Preservation District
to include those blocks of Linwood from West Ferry to West Delavan Avenue. I live on Linwood Avenue near West Delavan.
Given the rapid pace of development in this section of Buffalo, it is critical that we protect ourselves from developers who are motivated purely by financial matters,
and do not care what form new buildings take.
This part of the City has experienced a revival in recent years, partly due to the lovely architecture and pleasant sweeps of lawn. Development is not always a good
thing for a city. And I personally believe that plans for future development due to the establishment of the Medical Corridor are overly zealous.
The Preservation District currently ends at West Ferry, although there are many buildings of historic significance that continue to Delavan. This causes hardship
for those homeowners and residents that live in the blocks that are not currently included in the Linwood Historic Preservation District. We do not have the tools
and laws that would help us protect the historic nature of our architecture and our neighborhood. Our neighbors south of West Ferry currently have laws and
ordinances that allow them to preserve and protect those parts of Linwood. I am asking you to end this inequity and allow us all to have the same laws and
protections that are provided to preserve our historic.
I hope that you are able to support efforts to extend the district and make the Linwood Preservation District
whole.

The Michigan Broadway Commercial area was left out of the Better Buffalo Fund sponsored by the Buffalo Billions Program of the ESDC.
This is unfortunate because this area is the heart of the State's Michigan Street
Revitalization Historic Preservation would be Corridor benefitted, and the Michigan Street Preservation Area where the current efforts for
Both the State Historic Commission and Michigan Street Design revitalization plans for the Michigan Broadway area propose transit oriented and mixed use
residential and commercial redevelopment. This more than meets the criteria for the Better Buffalo Fund and including the area in the targeted program will make
available needed resources for the struggling cultural district.
Another consideration to include the Michigan Broadway commercial area s its proximity to the medical campus and downtown. The historic Willert Park
Community stands to benefit greatly from the emerging prosperity surrounding it if included. Adding the Michigan Broadway commercial areas to the existing
targeted areas of the Better Buffalo Fund program will be the beginning of the long awaited connections needed.

Sunset Reception at City Hall to be held on Saturday, November 29, 2014.
A preliminary description of this event follows:
Take Another Look, is a sunset reception at City Hall. We are inviting all Buffalonians to bring the family and friends who come to town to celebrate Thanksgiving to
our fabulous City Hall on Saturday, November 29 from 4:00- 6:OOpro to Take Another Look at Buffalo and celebrate the resurgence. Cranes on the Buffalo Niagara
Medical Campus. HARBORCENTER. Canalside and the re- watered canals. Larkinville. There is so much progress to see.
And it is all visible from the City Hall Observation Decks on both the 25 and the 28 floors. A reception with light refreshments and art and music by our talented
public school students will grace the Lobby. Videos showcasing every
aspect of our resurgent Buffalo will be screened in the elegant Council Chambers on the 13 floor where some of those most responsible for fueling this
renaissance will be recognized. Aspire's award winning Buffalo's photographs will be exhibited in the 25 floor handicap- access Windows on Buffalo with
panoramic views of the city. Others may Take in Another Look from the 28 floor Observation Deck. Docent -led aerial tours of Buffalo from both of these vantage
points will be available, as will tours of the magnificent building itself. All guests will witness the sun setting Over Lake Erie.
This event that showcases Buffalo for those of us who choose to live here, as well as for those who do not but wish they did, Some of those who attend may be
inspired to find a way to come home, or to invest in their home town from
wherever they now reside.

I support the extension of the preservation district to include those blocks of Linwood north of West Ferry to the end of Linwood Avenue at Delevan Avenue
Currently the Preservation district arbitrarily ends at West terry while Linwood Avenue and the historic nature of the street and the significant historic homes and
buildings of Linwood continue to the end of the Street at Delevan. This causes hardship for those homeowners and residents that live in the blocks that are not
currently included in the Linwood Historic Preservation District. We do not have the tools and laws that would help us protect the historic nature of our architecture
and our neighborhood. Our neighbors south of West Ferry currently have laws and ordinances that allow them to preserve and protect those parts of Linwood. We
ask that this inequity be ended and allow us all to nave the same laws and protections that are provided to preserve our historic residential neighborhood.
Linwood began as a significant trade road to and from Buffalo and allowed farmers and tradesmen access to the burgeoning new city of Buffalo this road did not
end at Wes— Ferry. Because of this the preservation district should be extended to include all of Unwood and end the unequal situation that 8wes part of the street
a legal privilege that should be provided to the whole of Linwood Avenue.
I hope you are able to support our efforts to extend the district and make the Linwood Preservation District whole. Than you and your staff for all you hard work on

Avenue and West Ferry Street (The Expansion) We sought to help ensure that the narrative description of the new district boundaries accurately reflected the
LPDF's intent to exclude parcels associated with the Project'(at 3 Gates Circle and 1277 Delaware Avenue)

I am writing on behalf of a substantial number of concerned citizens in regard to the Conditional Operating Certificate which was granted by NYS OASAS to
PROMESA, Inc. allowing said organization to operate a Part 822 -5 chemical dependence opioid treatment service at 254 Virginia Street in Buffalo, New York
effective August 20, 2014.
1 have two primary comments I make to seek to avoid the need to commence litigation on this matter. They are:
1. It appears that PROMESA is not in compliance with the term that they were to obtain all necessary governmental approvals and are now operating an illegal
operation at the site: and
2. It appears the Permit was issued based upon "mistake of fact ", and "arbitrarily and
capriciously" when it relied upon the applicants misrepresentation that it held some 60 community meetings on this issue.
1. PROMESA IS CURRENTLY OPERATING UNLAWFULLY, AND IS OUT OF COMPLIANCE WITH THE CONDITIONAL PERMIT TERM THAT THEY
OBTAIN ALL OTHER NECESSARY GOVERNMENTAL APPROVALS
In Village of Nyaek, v. Daytop Village, 1he., 78 N.Y.2d 500; 583 N.E.2d 928; 577 N.Y.S.2d 215; (1991) the Court of Appeals specifically found that legislatively
granted State oversight powers as to the location and operation of sub - stance abuse facilities pursuant to the Mental Hygiene Law did not preempt the operation of
local zoning laws. Here, pursuant to City

The City of Buffalo's adoption of the provisions were designed for a recognized legitimate purpose of protecting communities already having an oversaturation of
regulated facilities from further oversaturation and also depriving the users of more widespread access. In Order to determine if the host neighborhood already has
an oversaturation of community service facilities the City zoning scheme requires the applicant to go before the City of Buffalo's Zoning Board of Appeals and seek
a regulated use permit, before they operate.
It appears the permit holder has opened in disregard of your permit requirement, and the City of Buffalo's the local law that they first go before the City of Buffalo's

treatment service in this location was arbitrary and capricious. Specifically, it appears that your agency issued a conditional approval of the license for this treatment
service based on a false premise that PROMESA, Inc. conducted significant community outreach in the form of more than 60 community meetings held to discuss
this proposal.
Attached are affidavits which contain the signatures of 63 neighbors of the treatment program site attesting that they were not notified or made aware of any
community meetings regarding this treatment center. A map is attached displaying the relative location of each individual's residence or business in proximity to
254 Virginia Street.
The City of Buffalo Common Council Meeting Investigation of the applicant's representation found it to be utterly baseless. Attached is also a copy of the
Resolution of the Common Council of the City of Buffalo containing their findings.
Based on this documentation, we ask that you immediately revoke the license for PROMESA, Inc. to operate a Part 822 -5 treatment center at this location.
Further, the group I represent is requesting a meeting with yourself and any other person instrumental in the application and licensing
review and /or approval process. If your office does
have any documentation concerning representations of public meeting's trod, it would be helpful to review before we move forward. This request for all records,
documents, and emails, and other communications concerning any representations, or documentations of the holding of public meetings by Hispanics United or
PROMESA concerning the siting of the facility at issue is made pursuant to §84 et seq. of New York State Public Officer's Law (i.e. the Freedom of Information

"North Buffalo Rails to Trails - 2014 ", Bond Authorization Account No. 3000 -31, and shall be used for the specific object or purpose specified in
Section 1 of this resolution.
Section 3. The City intends to finance, on an interim basis, the costs or a portion of the costs of said specific object or purpose for which bonds are
herein authorized, which costs are reasonably expected to be incurred by the City, pursuant to this Bond Resolution, in the maximum amount of
$428,000. This Resolution is a declaration of Official Intent adopted pursuant to the requirements of Treasury Regulation Section 1. 150 -2.
Section 4. The following additional matters are hereby determined and stated:
(a) The period of probable usefulness applicable to the specific object or purpose for which the bonds authorized by this resolution are to be issued
within the limitations of Section 11.00 a. 19(c) of the Law, is fifteen (15) years.
(b) Current funds are not required by the Law to be provided as a down payment prior to the issuance of the bonds authorized by this resolution or any
bond anticipation notes issued in anticipation thereof in accordance- with Section 107.00 d. 9. of the Law.
Section 5. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds and the
renewals of said notes shall contain the recital of validity prescribed by Section 52.00 of the Local Finance Law. Said bonds and said notes shall be
general obligations of the City of Buffalo payable as to both principal and interest by a general tax upon all the taxable real property within said City. The
faith and credit of said City are hereby irrevocably pledged for the punctual payment of the principal of and interest on said bonds and said notes.
Provision shall be made annually by appropriation by said City for the payment of interest on and for the amounts required for the amortization and
redemption of said bonds and said notes.
Section 6. The validity of the bonds authorized by this resolution or any bond anticipation notes issued in anticipation of the sale of said bonds may be
contested only if:
(a) Such obligations are authorized for an object or purpose for which the City of Buffalo is not authorized to expend money, or
(b) The provisions of law which should be complied with at the date of the publication of this resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication,
or
(c) Such obligations are authorized in violation of the provisions of the constitution.

BUFFALO BILLION JOB FAIR FOR INNER CITY RESIDENT
Whereas: The City of Buffalo is currently experiencing a renaissance with development in many sectors of the City. This is a tremendous benefit for
city residents by providing job opportunities like never before. Governor Cuomo has made a tremendous commitment to restore Buffalo's past allure
within New York State with the addition of a State of the Art Research & Medical Campus, Harbor Center, Canalside and the Solar City projects; and
Whereas: In March of 2014, Governor Cuomo announced funding for the Buffalo Billion Projects. This investment is designed to create thousands of
new, sustainable jobs while setting the foundation for economic opportunities for future generations; and
Whereas: Recent reports continue to show our Buffalo Public School system in distress with declining graduation rates. A Buffalo News report shows
the detrimental effect of the lack of education and job training on minorities relative to the poverty rate, which shows 50.6% (under 18), 27.2% (age 18-
64); and
Whereas: If inner city residents who are living in poverty are to benefit from the Buffalo Billion projects, there needs to be greater community outreach
to the impacted areas of our city, to overcome some of our current obstacles. This is possible through inner city job fairs, interviews, and, if necessary,
on -site training sessions to engage the community and ensure city residents who have stayed the course by living in Buffalo, can benefit from Buffalo's
recent and future economic expansion; and
Whereas: The Buffalo Employment and Training Center provides exceptional services to youths with over 30 partners, including the NYS Department
of Labor, Erie County Department of Social Services, Erie Community College, Buffalo Urban League, and off -site partners Buffalo Municipal Housing
Authority, Community Action Organization, Everywoman Opportunity Center, Native American Community Services and Title II Adult Education
Providers
Now, Therefore Be It Resolved:
1.) The City of Buffalo Common Council seeks the support of the Buffalo Employment & Training Center and our elected WNY Delegation, to provide
job fairs for our inner city residents of the University District at our local community centers, churches, etc., to ensure that residents can take advantage
of Buffalo's prosperity.
2.) Encourage prospective employers to provide inner city job training opportunities as well as providing inner city access to the job application process
to those residents who may be hindered by transportation, libraries and internet services.
3.) Within 90 days, provide a written plan of action to be presented to the Common Council before January 27, 2015. At that time, we are requesting
the Buffalo Employment Training Center representative to appear at the Common Council meeting of February 3, 2015 to discuss the written plan.

Whereas, According to statistics published recently in the Buffalo News the overall rate of poverty in the city is currently at 31.4 %, and our alarming
youth rate of 50.6 %: Coupled with Buffalo Public Schools extremely high dropout rate of 40.6% calls for immediate intervention to provide youth with
opportunities to overcome poverty and to avoid violence.
Whereas, While October marks the beginning of afterschool programs for students, the University District Council Office and Apollo Media Center
have created a Multi- Media Youth Program that encourages young men and women to explore, invent and create, using state of the art media
production equipment; and
Whereas, The University District Youth Academy of Media Arts is designed to engage our students in television production, including the television
process, where they learn several different responsibilities, such as director, audio technician, and floor manager; and
Whereas, The University District Youth Academy of Media Arts will provide the participants a behind the scenes look at television broadcasting,
offering classes of journalism, broadcasting editing and production; and
Whereas, The weekly afterschool workshops will provide the participate hands on experience regarding media production driven by their own curiosity
to tell a story and ultimately assisting students in producing a high quality video production to hopefully speak to their issues: Now, Therefore, Be It
Resolved that The City of Buffalo Common Council
1) Department Telecommunications to conduct and oversee the University District Youth Academy of Media Arts at the Apollo Media Center to provide
guidance for youth who may have an interest for media.
2) The organization will provide a quarterly report to show the impact on the youth.
