Fontana President of the Council, and Council Members Franczyk, Golombek, Pridgen, Rivera, Russell, Scanlon, Smith — 8 Absent: LoCurto — 1 NO. 1 CALL FOR SPECIAL SESSION August 20, 2013 Dear Mr. Chwalinski: Pursuant to Section 3.9 of the Charter of the City of Buffalo, upon the written request of Five Councilmembers, dated August 20, 2013 presented to you herewith, I hereby call a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on August 21, 2013 at 11:00 A.M. and hereby waive the 24 hour notice for the following purpose: To receive and take appropriate action on : Agreement - Say Yes To Education - $400,000 Yours very truly, Richard A. Fontana President Common Council 1315 City Hail Buffalo, New York Dear Sir: WE, the undersigned, members of the Common Council, hereby request that you call a Special Meeting of the Common Council and waive the 24 hour notice, pursuant to Section 3.9 of the Charter of the City of Buffalo, for the following purpose: To receive and take appropriate action on Agreement - Say Yes To Education - $400,000 We request that this Special Meeting be held on August 21, 2013 at 11:00 A.M. FONTANA, President of the Common Council, has called a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on August 21, 2013 at 11:00 A.M. for the following purpose: To receive and take appropriate action on all items relating to Agreement - Say Yes To Education - $400,000 Yours very truly, Gerald A. Chwalinski City Clerk NO. 2 AGREEMENT — SAY YES TO EDUCATION - $400,000 The Mayor's Proposed Agreement with SAY YES TO EDUCATION, INC. (SAY YES), for the administration and monitoring of funding to restore the Buffalo Public Schools' Music Program for the 2013 -2014 School Year. Please accept this Communication as an official request from the Mayor to the President of the Common Council to call to order a Special Session of the Common Council, during its August recess, to consider the within item, which will finance the restoration of the Instrumental Music Program to Buffalo Public Schools for the 2013 -2014 School Year. As Mayor, with your Honorable Body's approval, I am positioned to enter into a one -year agreement with SAY YES to facilitate proper utilization and monitoring of up to $400,000.00 from the City of Buffalo's General Fund, to restore the Buffalo Public Schools' Instrumental Music Program for the 2013- 2014 School Year. SAY YES, in turn, is expected to enter into an Agreement with the Buffalo Public Schools. With this restoration of funding, the foundations have indicated that they will continue their support for the Buffalo Public Schools' Instrumental Music Program. This funding could not come at a more opportune time, as instrumental music programs have been proven to enhance and insure academic achievement. According to research conducted by the National Association for Music Education (NAME), graduation rates in schools with music programs were higher than in schools without music programs. Another NAME study found that students who participated in high - quality music programs scored 22% better on English and 20% better on math standardized exams than their non - participating peers, regardless of socioeconomic status or school district. SAY YES has agreed to accept the $400,000 grant as specified in the attached contract, and to help develop and facilitate the restoration of the Buffalo Public Schools' music program. SAY YES has agreed to: distribute funding to the Buffalo Public schools on a bi- annual basis, design performance metrics to insure that goals are being met and exceeded, monitor the effectiveness of the music program in enhancing academic achievement, and oversee the responsible disbursement and management of funds. Accordingly, I request that your Honorable Body: 1. Grant me, as Mayor, the specific authority to enter into a one -year agreement in form and substance similar to the agreement attached hereto and to expend up to $400,000 during the current fiscal year to achieve these objectives; 2. Authorize my Office and or other appropriate City staff to take all such steps and actions and to execute and or process such additional documentation, agreements and or modifications thereto as shall be necessary to facilitate and implement the terms and provisions of the agreement, and 3. Direct the Corporation Counsel and other appropriate City and Department personnel to negotiate to finalization said agreement and other necessary documentation and agreements wherever necessary for execution and actual implementation of the above objectives. Funds for this program have been identified by the Commissioner of Administration and Finance as eligible and available for this purpose. Mrs. Russell moved: That the Common Council hereby: grants the Mayor specific authority to enter into a one -year agreement, in form and substance similar to the agreement filed with the City Clerk, to expend up to $400,000 during the 2013 -2014 fiscal year to achieve the objectives of such contract; authorizes the Mayor and appropriate City staff to take all steps and actions needed to execute or process all additional documentation, agreements or modifications thereto as shall be necessary to facilitate and implement the terms and provisions of the contract; directs the Corporation Counsel and other appropriate City personnel to negotiate to finalization said contract and other necessary documentation and agreements, wherever necessary for execution and implementation of the contract objectives; and directs that any agreement with Say Yes to Education require inclusion of music programs at Riverside High School.
