In Item #6, C.C.P. July 22, 2008 Your Honorable Body approved the sale of 64 Hayes to
Niagara Ceramics Corporation, Mr. Bob Lupica, 74 Hayes Place, Buffalo, New York
14210.
Item #11, C.G.P. June 26, 2012 requested that Your Honorable Body authorize
rescinding the sale of 64 Hayes to Niagara Ceramics Corporation due to their failure to
respond to several notices sent to them to close on the transfer of title. This item also
requested the forfeiture of the Eight Hundred Dollar ($800) deposit and the return of the
property to the Division of Real Estate's inventory for future sale.
Pursuant to Item #98, C.C.P. March 19, 2013 the Council voted to receive and file the
communication presented as Item #11, C.C.P. June 26, 2012.
Therefore, I am recommending that Your Honorable Body approve rescinding the sale
of 64 Hayes Place to Niagara Ceramics Corporation, forfeit the Eight Hundred Dollar
($800) deposit and return the property to the Division of Real Estate's inventory for
future sale.

The Office of Strategic Planning, Division of Real Estate has received a request from Mr. Bob Lupica, Niagara Ceramics
Corporation, 75 Hayes Place, Buffalo, New York 14210, to purchase 64 Hayes, a City owned vacant lot. Mr. Lupica
plans to use this vacant lot for future expansion and create additional parking for Niagara Ceramics Corporation.
The Office of Strategic Planning Land Use Planning Committee; Division.of Permit and Inspection Services and the
Division of Collections have no objections to the sale. There are no building code violations, taxes or other liens owed to
the City of Buffalo by the purchaser.
The Division of Real Estate has investigated the sale of similar lots in the subject area. Sales range from Thirty -Two
Cents ($.32) to One Dollar and Sixteen Cents ($1.16), per square foot.
The results of our negotiations are that Mr. Lupica has agreed and is prepared to pay Eight Thousand Dollars ($8,000),
the equivalent of Seventy -Five Cents ($75) per square foot for the subject property. Mr. Lupica has also agreed to pay
for the cost of the transfer tax and recording fees.
I am recommending that Your Honorable Body approve the sale of 64 Hayes in the amount of Eight Thousand Dollars
($8,000). 1 am further recommending that the Office of Strategic Planning prepare the necessary documents for the
transfer of We and that the Mayor be authorized to execute the same.
Mr. Fontana moved:
That the above communication from the Office of Strategic Planning dated July 11, 2008, be received and filed; and
That the offer from Mr. Bob Lupica, Niagara Ceramics Corporation, 75 Hayes Place, in the sum of eight thousand
dollars ($8,400.00) for the purchase of 64 Hayes, be and hereby is accepted; and
That the transfer tax, recording fees and cost of legal description shall be paid by the purchaser, and
That the Office of Strategic Planning be authorized to prepare the necessary documents far the transfer of title and that
the Mayor be authorized to execute the same, in accordance with the terms of sale upon which the offer was submitted.

In the above referenced item Your Honorable Body approved the sale of 64 Hayes Place to Mr. Bob Lupica of Niagara Ceramics
Corporation, 75 Hayes Place, Buffalo, New York 14210.
Several notices have been mailed to Mr. Bob Lupica to finalize the sale and close on the transfer of title. Final notice was sent on April
25, 2012 advising that failure to respond would result in rescinding the sale, forfeit the deposit of Eight Hundred Dollars. ($800.00) and
return the property to our inventory for future sale. Mr. Lupica has not responded to any of our notices.
Therefore, I am recommending that Your Honorable Body approve to rescind the sale of 64 Hayes {dace to Mr. Bob Lupica of Niagara
Ceramics Corporation, the deposit be forfeited and the property be returned to our inventory for future sale.

Buffalo, New York, and that the property be returned to inventory for sale.
