The successful proposal was from Buffalo Legacy Project (Legacy). The Law Department, after consultation with the City DPW, has negotiated th, Inc. e basic provisions of a proposed agreement with Legacy to implement and facilitate the Legacy proposal. The proposed agreement calls for substantial improvements to be made to the subject site by Legacy and thereafter Legacy would manage, maintain and operate the site for a five year term with the opportunity to extend for up to an additional two periods of one year each. It is anticipated that the City will undertake certain site infrastructure improvements in the value and cost range of up to approximately $400,000. A copy of the proposed agreement (with the City's RFP and the Legacy Proposal attached thereto) is attached for your reference. The total project cost is in the range of approximately $9,751,892 as set forth in the Legacy Proposal Improvement Plan Sources and Uses Appendix F. The. The properties, located across the street from the Westminster Community Charter School (WCCS), provide 22,000 square feet of land space to construct The Center. Purpose: The Center's purpose is to serve high poverty families within the BPN neighborhood. The Center will be wholly owned by the Westminster Foundation. The proposed new 12,000 square foot center will be located at 3149 -3259 Bailey Avenue. The Center will include childcare rooms for 150 children ages 0 -5, administrative offices and a community activity area. The remaining 10,000 square feet of land space is expected to be used for playground and green space. Relevance to BPN Strategy: The Center will provide BPN with community visibility and credibility with neighborhood residents, BPN partners and The United States Department of Education (USDOE) --the sponsors of the Promise Neighborhoods grant. The Center will operate as a distribution hub delivering services to the community by providing high quality /affordable child.care, preparing children for Kindergarten, and creating capacity for other local child care facilities with waiting lists. The Center would establish a strong Infrastructure of community providers that support early education and families. Research shows that aggressive and early intervention with young children greatly enhances their chances of success later on in life. For example, the High /Scope Perry Preschool study in Ypsilanti, Michigan tracked the long -term performance of low - income children from black families who completed the Perry School program and compared their performance to a control group. According to Rolnick and Grunewald "Investment in human capital breeds economic success not only for those being educated, but also for the overall economy... investment in early childhood development yields an extraordinary return, far exceeding the return on most investments, private or public."' Westminster Foundation Background: In 1993, M &T Bank adopted one of Buffalo Public Schools' low - performing schools to improve education and rally community involvement. Seventeen years later that school is now known as the Westminster Community Charter School (WCCS) and it's among the City of Buffalo's high - performing schools. The partnership of M &T Bank and WCCS created the Westminster Foundation. The Westminster Foundation helps raise funds and provide assistance in achieving the partnership's goals of high - quality education and positive community outreach. Recently, the Westminster Foundation led a consortium of partners, applied for and won a USDOE Promise Neighborhood Planning Grant that seeks to break the cycle of poverty through the tenets of the Promise Neighborhoods Program: a full continuum of academic and family and community supports, a college -going culture, and seamless integration of services along the entire continuum from cradle to college /career. (Watts) is please to provide documentation in support of the Site Plan Review process. For the last two months we have been working closely with Buffalo Promise Neighborhood, the Westminster Foundation, M & T Bank SLR Contracting and Service Company, Inc., and City of Buffalo officials to develop a plan to deliver the Buffalo Promise Neighborhood Early Childhood Education Center for an anticipated September 2013 opening. The Center is intended to accommodate up to 150 children from infant to pre - kindergarten age within a new 12,000 square foot facility to be located on a 22,000 square foot site at the northeast corner of Bailey Avenue and East Amherst Street within the City of Buffalo. The proposed building is a single story pre - engineered steel structure housing eleven (11) classrooms, a multi - purpose space, administrative offices, prep kitchen, toilet rooms and storage, along with a 5,500 square foot playground for outdoor play and discovery. Significant building materials include architectural metal panels, ground face masonry, and storefront glazing system including colored glass panels as illustrated on the exterior elevations and rendering provided in the submittal package. The proposed building is to be built to the street property line, requiring 5% of lot area dedicated to landscaping. This landscaping is to be provided in foundation plantings along Bailey Avenue as well as in the playground. Other features of the site include a lay by on the north side of East Amherst Street to accommodate dropoff /pick up of children, and the placement of two (2) parking spaces on East Amherst Street east of the lay by to accommodate deliveries. Additional parking (eight spaces) is to be provided remotely, on the existing Westminster Foundation campus located across East Amherst Street, and (22 spaces) in the theatre property located just north of the project site on Bailey Avenue. SLR Contracting and Service Company, Inc. has been brought onto the development team to handle Construction Management Services. SLR has worked diligently with Buffalo Promise, M & T Bank, and Watts to clear the site of deteriorated buildings. That work is now complete. It is anticipated that the groundbreaking for the construction of the Early Childhood Education Center will commence on or around September 12, 2012, with construction completion on or around June 1, 2013. (� My client Pushpa Gunatilake has recently purchased the above noted property in Buffalo's University District. This 1265 square foot building is currently vacant and in need of major repair to the structural, mechanical, plumbing, electrical and finish systems. The Occupancy class is Ml for commercial merchant operations. The construction type of the building is VB (type 5 with no protection). To remove the current code violations and subsequent court proceedings related to this property, a complete overhaul of the building must be performed. The floor, walls and roof framing, as well as the interior partitions, plumbing, HVAC and electrical systems must be completed replaced. In order to obtain a building permit, the property must have an asbestos inspection, while the changes to the exterior require planning board review and approval. The enclosed submission of the proposed architectural plans portraying the new building and its materials are a per - requisite to beginning this project. St. John CDC intends to use the subject properties to construct 17 Townhomes as part of an overall proposal to build 49 Townhomes. The Office of Strategic Planning Land Use Planning Committee, Division of Permit and Inspection Services and the Division of Collections have no objections to the sale. There are no building code violations, taxes or other liens owed to the City of Buffalo by the purchaser. The fair market value of the subject properties is $80,500.00, Fifty Four Cents ($.54), per square foot, based on a market analysis performed by the Division of Real Estate. The value reflects the assessed amount of the parcels. St. John CDC has agreed and is prepared to pay $80,500.00 for the subject properties. They have also agreed to pay for the cost of the transfer tax and recording fees. I am recommending that Your Honorable Body grant the authority to sell the attached list of properties to St. John Community Development Corporation Inc. in the amount of $80,500.00 pursuant to terms and conditions substantially similar to those outlined in the attached Land Disposition Agreement. A The fees to be charged and collected by the Commissioner of Parks for the use of oollf courses and other recreational facilities under his jurisdiction are hereby fixed as provided in Chapter 175, Fees. B. The fees to be charged for all resident and non - resident users of Pierce Field in MulM Park shall be equal to or less than those set forth in Chapter 175, Fees, provided that there shall be at no charge of any kind no fewer than 140 hours per year of ci y resident commpnLty groLi use of the improved synthetic surface playing field, and there shall be, at no charge of any kind, 431 hours per year of city resident community group use of the improved practice field.
