Request for Authorization to Enter into Agreement with respect to the Management Maintenance, Operation & Improvement of Mulroy Park, Pierce
Field
PRIOR COUNCIL REFERENCE: Item No. 16 of Common Council Proceedings held on March 6, 2012
The City's Department of Public Works, Parks & Streets (City DPW) issued a Request for Proposals for the Management, Maintenance, Operation
and Improvement of City -owned Mulroy Park, Pierce Field. The successful proposal was from Buffalo Legacy Project, Inc. (Legacy). The Law
Department, after consultation with the City DPW, has negotiated the basic provisions of a proposed agreement with Legacy to implement and
facilitate the Legacy proposal. The proposed agreement calls for substantial improvements to be made to the subject site by Legacy and thereafter
Legacy would manage, maintain and operate the site for a five year term with the opportunity to extend for up to an additional two periods of one year
each. It is anticipated that the City will undertake certain site infrastructure improvements in the value and cost range of up to approximately
$400,000.
A copy of the proposed agreement (with the City's RFP and the Legacy Proposal attached thereto) is attached for your reference. The total project cost is
in the range of approximately $1,751,812 as set forth in the Legacy Proposal Improvement Plan Sources and Uses Appendix F.
The Law Department, after consulting with City DPW, requests that Your Honorable Body:
1. Authorize the Mayor to execute an agreement in form and substance as set forth in the attachment to this communication, said agreement
to be negotiated to finalization and approved to form by the Law Department to facilitate the Mulroy Park, Pierce Field project, and
2. Authorize pertinent City personnel to take such steps and actions and to execute such documents and agreements as shall be necessary
to implement and facilitate the Mulroy Park, Pierce Field project.

THE NEIGHBORHOOD
The Buffalo Promise Neighborhood initiative is concentrated in a one square -mile area with nearly 12,000 residents, encompassing Highgate
Heights Elementary School, Westminster Community Charter School and Bennett High School.
COLLABORATIVE PLAN
Buffalo Promise Neighborhood has identified and developed services that will improve the education, health, safety and stability of our neighborhood.
Strong schools will be at the center supporting academic achievement, healthy development and college and career success.
A MODEL FOR SUCCESS
In 1933, M &T Bank adopted a low performing Buffalo public school, now known as Westminster Community Charter School. As a result, the school
has become a top academic performer and a valued asset in the community. That adoption created a partnership called the Westminster
Foundation.
A PROMISE FOR A BRIGHTER FUTURE
Buffalo Promise Neighborhood was one of only five U.S. communities, out of more than 35 applicants, to receive the U.S. Department of Education
Promise Neighborhood implementation grant. In 2010, the Westminster Foundation was one of 21 national recipients of a federal Promised
Neighborhood.

SCOPE OF WORK -3292 MAIN STREET
Dear Mr. Grunzweig,
My client Pushpa Gunatilake has recently purchased the above noted property in Buffalo's University District. This 1265 Square foot building is
currently vacant and in need of major repair to the structural, mechanical, plumbing, electrical and finish systems. The Occupancy class is M1 for
commercial merchant operations. The construction type of the building is VB (type 5 with no protection).
To remove the current code violations and subsequent court proceedings related to this property, a complete overhaul of the building must be
performed. The floor, walls and roof framing, as well as the interior partitions, plumbing, HVAC and electrical systems must be completed replaced.
In order to obtain a building permit, the property must have an asbestos inspection, while the changes to the exterior require planning board review
and approval. The enclosed submission of the proposed architectural plans portraying the new building and its materials are a per- requisite to
beginning this project.
Upon successful completion of the architectural requirements, a certificate of occupancy will be granted by the City of Buffalo. The property can
then be rented to a wide range of possible tenants. Therefore the client would like to proceed with the effective repair and restructuring of this
property.

APP. CONTRACT- BUFFALO NIAGARA CONVENTION BUREAU
Approval of contract in the amount of $100,000 with the Buffalo Niagara Convention & Visitors Bureau Foundation ( "CVB ") for Program assistance
to the Buffalo Niagara Film Commission. This contract is effective as of July 1, 2011 to June 30, 2012.
The City of Buffalo Department of Community Services & Recreational Programming(the "Department ") is positioned to fund $100,000 to the CVB
for purposes of funding a portion of the Buffalo Niagara Film Commission's ( "BFNC ") mission in 2011/2012 to develop and assist in film, television
and video production throughout the City of Buffalo and Western New York.
Accordingly, the Department requests your Honorable Body to:
1. Grant the Commissioner and the Department the specific authority to enter into an Agreement (the Agreement to be drawn up by the City
of Buffalo's Law Department in substantially that form as is attached hereto) and fund $100,000 from the Department to CVB pursuant to
the terms and provisions of the Agreement for purposes of partially funding BNFC's 2011 -2012 mission to facilitate and expand film,
television and video production in the City of Buffalo.
2. Authorized the Department and /or other appropriate City staff to take all such steps and actions and to execute and /or process such
additional documentation and /or modifications thereto as shall be necessary to facilitate the terms and provision of the Agreement.
3. Direct the Corporation Counsel and other appropriate City and Department personnel to negotiate to finalization said Agreement and other

COMMON COUNCIL DISCRETIONARY FUND POLICY
Attached please find the Common Council's Discretionary Fund Policy.
This policy contains general guidelines which must be adhered to by all Common Council Members in awarding discretionary grants.
The City Comptroller is in receipt of these guidelines and his office will be resuming the processing of payments for discretionary grants pursuant to
this Council policy, thereby ending the temporary suspension of payments which the Comptroller referenced in his July 5, 2012 memo to this
Honorable Body.

Common Council Discretionary Fund Policy
General Guidelines
1.) Grants are to be designated for purposes that have a public benefit. The programs funded must be open and available to all individuals on
a nonsectarian basis.
2.) Grants are to be provided in support of services and activities that have a benefit to the city.
3.) Grants are only to be designated for Not - For - Profit Organizations, Municipalities, or their affiliated departments /agencies, or School
Districts.
4.) Grants are available solely for activities and programs conducted for residents of the City of Buffalo.
5.) Grants are not to be redistributed unless the end recipient is identified and the grant to the end recipient complies with these guidelines.
6.) Grants are to be used only for the purpose stated in the funding request.
7.) Grants are not to be used to fund Loan Programs or Scholarships.
8.) Funds cannot go to organizations that employ or otherwise compensate a member of the Council Member's family, or a member of the
Council Member's Staff for services or labor rendered.
9.) Council Members are not to designate grants to an organization if the Council Member, a member of the Council Member's Family or a
member of the Council Member's Staff is involved with the operations of the organization in a decision - making capacity including, but not
limited to working on an unpaid, volunteer basis.
10.) Grants are not to be the only significant source of funding for the organization. Organizations must have all required permits and licenses
necessary to operate any program funded by the grant.
11.) Grants are subject to review by the City Comptroller. At the end of the Fiscal Year, upon request, the pass through agency shall submit a
report to the Comptroller's Office with a detailed accounting of the funds distributed. This shall include bank statements, receipts and
proof of the projects being completed.
12.) Procurement of goods shall include an informal (bidding) process to ensure the taxpayers are paying a fair cost for goods. If reasonable,
preference can be given to City of Buffalo or Western New York Companies.
13.) Request for funding shall be in writing to the pass through agency.
14.) Provisions of this policy may be amended pending the outcome of the Comptroller Audit regarding discretionary funds.

STOP CEDAR STREET EXTENSIONPROJECT
Whereas: Today at approximately 9:15 am Council Member Darius Pridgen, Erie County Chairwoman Betty jean Grant, and Legislator Tim Hogues
joined concerned residents from the surrounding areas of Cedar Street to oppose the reopening of the street to traffic; and
Whereas: The residents here are upset that they have not been included, consulted or considered in a major project that will bring pollution and a
major change to their neighborhood; and
Whereas: Four historical trees were cut down for the project, green space removed and a major play area for children, without consulting the
residents of the area; and
Whereas: The impromptu sit in by Council Member Pridgen and the residents prompted Board of Education staff to immediately stop construction.
Now, Therefore, Bi It Resolved:
That the City of Buffalo investigate the removal of the four trees and whether they were removed according to the laws and regulations of the City of
Buffalo and state of New York; and
Be It Finally Resolved:
That all work should cease and desist until the Buffalo Board of Education addresses the Common Council and residents concerning the Cedar
Street construction project.

WAIVE FEES ASSOCIATED WITH HISPANIC VETERANS MEMORIAL 5K RUN
WHEREAS, the Western New York Hispanic American Veterans Memorial Committee is holding its first annual 5K race in the City of Buffalo on
September 15, 2012 at the Erie Basin Marina; and
WHEREAS, the organizers of the race will have submitted all the appropriate paperwork for the event to the Special Events department ahead of the
race; and
WHEREAS, proceeds raised during the charity race will benefit the Hispanics Veterans Memorial, the only memorial dedicated to the service of
Hispanics on the East Coast; and
WHEREAS, the Ground Breaking ceremony took place on Veteran's Day 2011 and the committee hopes to raise enough money to have it erected
and unveiled to the Community on Memorial Day of 2013; and
WHEREAS, the costs of the 5K race are significant and any reduction in costs will help the fundraising efforts of the Western New York Hispanic
American Veterans Memorial Committee.
NOW, THEREFORE, BE IT RESOLVED, that the Buffalo Common Council waive Special Events fees associated with the Western New York
Hispanic American Veterans Memorial Committee's charity 5K race in the City of Buffalo on September, 15, 2012.
BE IT FURTHER RESOLVED that a copy of this resolution be sent to the Special Events committee and to the Western new York Hispanic
American Veterans Memorial Committee.

THE USA NATIONAL MASTERS CHAMPIONSHIP FLEET FEET 16K RUN INTO BUFFALO
Whereas: The annual Fleet Feet 15K run will take place in Buffalo on Monday, September 3, 2012; and
Whereas: The 2012 race has been designated as the USA National Masters Championship and has attracted runners from across the United
States and Canada; and
Whereas: Starting and finishing on the waterfront at the Erie Canal Harbor, the race which attracts more than 600 runners, takes runners through
downtown Buffalo, Delaware Avenue and the Olmsted Parkways; and
Whereas: Race proceeds support Shoes on Students (SOS), which provides running shoes to local high school athletes. This support helps give
local high school runners the tools they need to compete at their best; and
Whereas: Over 800 pairs of running shoes have been donated to young runners who may not be able to afford high quality training shoes that
improves an athlete's ability perform at a high level; and
Whereas: the City of buffalo, and the Common Council, supports and encourages the commitment Fleet Feet has shown to the community and the
local student runners of Buffalo;
Now, Therefore be it Resolved:
That the Common Council does hereby approve waiving any street closing fees by the Department of Public Works Parks & Street for the USA
National Masters Championship Fleet Feet 15K Run Into Buffalo being held on September 3, 2012; and
Be it Further Resolved:
That the organizers of the USA National Masters Championship Fleet Feet 15K Run follow all rules and regulations as set forth by the Department
of Public Works, Parks & Streets regarding street closings; and
Be it Finally Resolved:
That copies of this resolution be sent to Fleet Feet Sports, the Department of Public Works Parks & Streets and the corporation Counsel.

ORDINANCE AMENDMENT -CH 309 -28 FEES
The Common Council of the City of Buffalo does hereby ordain as follows:
Section 1. That section 309 -28 of the Code of the City of Buffalo be REPEALED.
Section 2. That a new section 309 -28 of the Code of the City of Buffalo be added, to read as follows:
§309 -28. Fees.
A. The fees to be charged and collected by the Commissioner of Parks for the use of golf courses and other recreational facilities under his
jurisdiction are hereby fixed as provide din Chapter 175, Fees.
B. The fees to be charged for all resident and non - resident users of Pierce Field in Mulroy Park shall be equal to or less than those set forth in
Chapter 175, Fees, provided that there shall be, at no charge of any kind, no fewer than 140 hours per year of city resident community_group use of
the improved synthetic surface playing field, and there shall be, at no charge of any kind, 431 hours per year of city resident community_group use of
the improved practice field.
C. For park events that do not generate a profit, the Commissioner shall have the authority to classify the type of event and determine which fee, if
any, should be charged. The Commissioner may waive the fee for the use of the band shell if the event satisfies one or more of the following criteria:
1. For park event:
(a) It is nonreligious and staged within a park or playground, including Niagara Square.
(b) It provides a legitimate public benefit and is free to the general public.
(c) It is initiated by the Mayor's office or other City department or agency.
(c) It is cosponsored by the Mayor's office or other City department or agency.
2. For nonpark event:
(a) It is held as part of a daytime school event.
(b) It does not create overtime costs for the City.
_(c) The Common Council has waived other fees for the event.
Section 3. That section 175 -1 of the Code of the City of Buffalo be added, to read as follows:
§309 -28, use of facilities
With the exception of designated private ice time at skating rinks, City of Buffalo handicapped persons(classified as such by the United States
Department of Health, Education and Welfare) may use any of the hereinafter mentioned recreational facilities free of all charges and fees.

Whereas: the Jefferson Avenue Arts Festival is part of the Jefferson Renaissance Project, that aims to restore Jefferson Avenue and encourage new
business development on Jefferson Avenue; and
Whereas: The Jefferson Avenue Art Festival show cases local performing artist, youth groups, and vendors;
Now Therefore Be It resolved That: This Common Council waives all Tess associated with The Jefferson Avenue Arts Festival; and
And Be It Further Resolved,
That Permission be granted to hang banners at Jefferson Avenue and East Utica and East Ferry Avenue and Jefferson Avenue; and
Be it finally resolved: That a street closing be approved August 26, 2012 on Jefferson between E. Utica and E. Ferry.
