The-proposed building will be approximately 11,000 Square foot pre - engineered featuring concrete block, stucco and painted steel as exterior finishes. The owner will be the only tenant for the new space. The owners plan on using the new space to store warehouse specialty clothing that requires handling after being cleaned and packaged, The site is adjacent to the Wesselman Cleaners current location. New landscaping and a small parking area with new fencing will also be Installed. The project is privately financed in the amount of 425,000 dollars. As a result of this Environmental Review, the Lead Agency has determined the undertaking of this action will not have a significant adverse affect on the quality of the environment. No further environmental review of this action will be conducted prior to project implementation and a Draft Environmental Impact Statement will not be prepared. Reasons Supporting This Determination: The facts and reasons for this decision are as follows: the project will allow a long standing successful business remain in the City of Buffalo as well as enhance the appearance of the property. The identified potential negative impacts appear to be primarily short -term site preparation and construction related activities, and do not appear to be significant in magnitude or effect. There are no actions, which will have a significant adverse impact on the environment. On November 15, 2011, Silvestri Architects on behalf of ttie owner, met with the Linwood Preservation District & Friends Association with the project receiving favorable comments from the group. The Preservation group did ask that any signage that is being proposed be sensitive to the Linwood preservation district that the project immediately abuts to the west. The fisted property is contiguous to a.local Historic district as well as an area that could be nominated to the National Register of Historic Places as recommended by the New York State Office of Parks, Recreation and Historic Preservation Funding will be private with a total cost of $260,000 dollars. As a result of this Environmental Review, the Lead Agency has determined the undertaking of this.action will not have a significant adverse affect on the quality of the environment. No further environmental review of this action will be conducted prior to project implementation and a Draft Environmental Impact Statement will not be prepared. Golombe Ord Amend -Ch 316 Peddling and Dear Council Members, The recent "compromise" proposal for food truck legislation shows that an effort is being made to bring this discussion to a close. In an effort to expedite this process, in the past we asked for a committee to be formed. After one meeting that committee apparently disbanded and a proposal was offered by the "Food Truck" group and then we were encouraged to respond with our own proposal. Finally, the current proposal from Councilman Golombek has been offered. In the past, streets were considered multi -use public spaces, then with the addition of motor vehicles, streets have become solely used as transportation corridors. Mobile vending represents a shif to the multi uses of the past, but must also be balanced with current uses and issues of public interest. I have enclosed an article from the New York Times that gives a fair summary of the positive and negative effects of mobile vending and of the position in which you, as legislators, find yourselves. Our main concern from the beginning has been to address the congestion in the Hertel Avenue and EIn wood Avenue areas of the City. Food trucks will enter these areas and add to this congestion, like any other food business. The City Charter recognizes that food businesses in these defined zones add to problems with congestion, illegal parking and other quality of life and public safety issues. In response to these effects on public health and safety, the City Charter places extra restrictions on food businesses in these areas. While the current proposal offers no response to issues in congested areas, the solution is simple. There is no need to add signs for specific locations, to restrict vendors to definite areas, to add extra permitting processes or to add fees to operate in these areas. The legislation can recognize these areas as congested, apply the geographical boundaries from the zoning laws, apply whatever proximity ban is approved, and limit the trucks to no more than one per block face at the same time in these areas recognized as congested. This will allow "Food Trucks" access to the congested areas, but in a manner that hopefully does not over burden the streets. It will address concerns of all businesses and residents in these areas. The Council is already aware of concerns with congestion on Hertel and Elmwood Avenues as recognized in the City Charter's zoning laws. Further, this limit in congested areas would. encourage the grouping of vendors in areas that are not already congested, something other cities are trying to do now in response to this growing industry's effects on already busy areas. Once these congested areas are recognized and some precaution is taken, the conversation can shift towards the distance of a proximity ban. We have not engaged in that discourse because a proximity ban alone does not solve issues in congested areas. From the beginning, "Food Trucks" have proposed that they stay 100 feet from a restaurant. However, when it comes to a City sanctioned event, 500 feet is the required distance. We do not think it is unreasonable to .request a proximity ban of half as much as the City is giving itself. Therefore the requested distance is 250 feet. While we have heard quite a bit of discussion at public hearings about these issues, we look forward to hearing your discussions and to a resolution to this matter for the year. From Los Angeles to New York, and Portland, Ore. to Atlanta, cities are wrestling with a trend now writ large on their streets, trying to balance the cultural good that comes with a restaurant on wheels against all the bad. Yes, the trucks offer entrepreneurs a way to get started in the restaurant business. Yes, they add jobs and money to a city. The food is.often innovative, relatively inexpensive and convenient. For those willing to stand in line and eat from a paper plate, there is usually a warm personal exchange when the meal is passed from chef to diner. But many restaurateurs are sick of seeing competition literally drive up outside their windows. "It's ignorant of people in the community to think that buying from fond trucks instead of from local restaurants doesn't hurt the community," said Melissa Murphy, who runs two Sweet Melissa Patisseries in Brooklyn. "There's just not enough to go around right now." Trucks present other problems. Streets clog. Parking disappears. The crowds and the diesel fumes that swirl around all those idling buses of gastronomy annoy the neighbors. But civic leaders can't ignore the trend, which is not going the way of raspberry vinegar. Like drive- throughs, which were the subject of many a city council meeting when national fast -food chains embraced them in the lgyos, food trucks are changing the way America eats. "The growth of the mobile restaurant unit is a long -term trend," said Hudson Riehle, senior vice president of the National Restaurant Association. "If you think about growth in the restaurant industry over the past decade, it's basically a question of points of access." It is the rare restaurant chain that isn't looking into the marketing potential of a truck. Taco. Bell and Jack in the Box have them. Tasti D -Lite plans to roll out almost a dozen by next year. Even the Hilton hotel chain is in on the game, promoting its DoubleTree brand by sending a truck filled with free cookies around the country this summer. So what's a city leader to do? Legislate. In New York, truck owners now face a ticket or a tow if they sell food from metered spaces. The Seattle City Council on Monday is expected to decide whether to unleash food trucks onto its streets with fight re ulations on where they can park, In Chicago, which appears on the verge of allowing something more than prepackaged food to be sold from mobile units, competition is the biggest issue. Although Mayor Rahm Emanuel supported the trucks during his recent campaign, the alderman who heads the committee that will consider the p_rQV9 said it won't pass without restrictions that would keep food trucks at least zoo feet away from restaurants. In Raleigh, N.C., the planning commission approved ngw rules last week that would create similar restrictions, as well as prevent trucks from using amplified sound or dominating certain parking spaces. Food vendors, surprised to find themselves civic parasites, are fighting back, pointing out that food trucks are a valuable urban amenity. I was told that there is no time for public comment during the regular meetings of the full Common Council. However, I wondered if it would be pvssibte to make time on a future agenda to allow residents to comment on the NFT s plans to severely reduce bus service in and around Buffalo. I realize that the Common Council does not have any authority over the NFTA, but 1 Doped that the council might hear the concerns of the citizens and lobby the NFTA on our behalf. Personally, I live in the university District and ride the metro rail line frequently and depend on the 204 line to get me to the airport when I need to fly out of Buffalo for business or personal matters. in the past, when I lived in Parkside, I took the 32, 11 and 20 with some frequency: In the past, when I've needed to go somewhere new, I've been pleased to find that other other lines have been available. If ridership is at an atintime high, it seems to rye that the NF rA has some long-term, structural problems relating to their budget that they need to resolve. I don't think consistently raising fees and cutting service is a viable, long -term solution, and I suspect that other riders would agree. One thing I find particularly ridiculous: The public transportation available from the airport to anywhere in Western New York is already limited, and the new service cuts would eliminate direct service from the airport to the city. In addition, while I am lucky enough to own a oar, many residents do not own vehicles and seriously depend on the NFTA to get to work and to enjoy the city. By cutting buses, NFTA will hurt the city's poorest residents, making it even more difficult for people in need to get and keep jobs. Please let me know your thoughts on whether it would be possible for the public to comment on this issue at a future council meeting. I appreciate your consideration of this request. About a year ago, I made the decision to "go green" by selling my car and using NFTA (in Western New York) as my main means of transportation. The NFTA has now decided to eliminate the buses that i use to get to /from work (65 and /or #67) as well as reducing service on the only other bus in my area ( #32). 1 know that I am not the only person in the position of not being able to get to /from work without the buses running. I work in downtown Buffalo, and from my area,.there are no other bus options. These buses also service part of the City of Buffalo which negates all discussions about "suburban only routes ". And this is not just about me. There are many people who ride the bus because they don't own a vehicle. Some of those are people who go to work to pay child support, which they won't be able to do if buses are cut. 1 am requesting that you have the funding reinstated to NFTA in order that those people who use the buses will still have therm available. If these people are not paying their child support, then they will be in jail for the delinquency, and the taxpayers will be paying for each of those incarcerations. Where are students who ride the #67 bus to go to school, if the #67 bus is cut, these students will have to take 1 or 2 buses and then the train to get to school. 'the absenteeism rate in the City schools is extremely high, and the graduation rate is very low. By reducing the bus, many of these students may not go to school on a regular basis, thereby increasing the absenteeism and decreasing the graduation rate, thereby increasing the number of young people who cannot find jobs and need assistance from Social Services programs. This would unnecessarily increase the burden on taxpayers. People have court appearances they must attend. Some must go to Social Services or other government offices, National Fuel, hospitals, etc. Some may be attending classes to get their GED, to improve themselves so they can be more productive members of society. Some may be attending AA meetings. People ride the buses for various reasons and to get to various locations, including shopping in or outside of the city limits. If bus service is reduced, people will get laid off, increasing our already high rate of unemployment in Erie County. This will also decrease the spending ability of those laid off, decreasing the money spent and tax dollars collected for those people. And, once again, this would Increase the number of people on unemployment and /or Social Services, which the taxpayers pay for. The bus going to the. gills' games may also be saving lives. Those who ride the bus do not run the risk of getting a DWI, having an accidont and possibly injuring or killing someone else or themselves. That bus is a lifesaver! The reduction in bus service will hurt the entire community. Many people live and work on bus routes because the bus is their main means of f transportation. If the NFTA is going to reduce 22% of the buses, as proposed, we may as well turn off the lights and shut the city, and much of the county, down! Fontana Council President 0 000(1 By: Mr. Golombek SUBJECT: The Influence of Unlimited Corporate Money On Elections WHEREAS: The U.S. Supreme Court's 5 -4 ruling in Citizens United v. the Federal Election Commission rolled back legal restrictions on corporate spending in the electoral process, allowing unlimited corporate spending to influence elections, candidate selection, and policy decisions, thereby threatening the voices of "We the People" and the very foundation of our democracy; and WHEREAS: Corporations are not mentioned in the United States Constitution and the First Amendment was never intended to let nonhuman business corporations spend unlimited corporate cash to influence our elections; and WHEREAS: U.S. Supreme Court Justice Hugo Black in a 1938 opinion stated, "I do not believe the word `person' in the Fourteenth Amendment includes corporations "; and WHEREAS: Money affects the quality and quantity of speech and is NOT, in itself, speech; and allowing corporations with great wealth to use it as speech effectively drowns out the protected free speech of the People in our diverse society; and WHEREAS: Corporations were already spending considerable amounts of money to influence elections, but Citizens United v. FEC allows CEOs to dip into corporate treasuries and spend as much as they want to buy pro - corporate lawmakers and punish those who stand up for the public interest; and WHEREAS: Most of this new spending will be hidden from the public. Corporate front groups will sponsor cynical advertisements supporting industry - friendly candidates and attacking public servants who stand up to corporations; the public will not know who is funding the ads; and WHEREAS: Corporations are not people. They do not vote, and they should not be allowed to have such an overwhelming influence on elections; and NOW THEREFORE, BE IT RESOLVED: That the Buffalo Common Council supports the adoption of a Constitutional Amendment and other legislative actions ensuring that only human beings, not corporations, are endowed with constitutional rights and that money is not speech, and therefore the expenditure of corporate money to influence the electoral process is no longer a form of constitutionally protected speech. MOBILE FOOD VEHICLE VENDOR "MFVV" : The owner of a mobile food vehicle or the owner's a ent• hereinafter referred to as "vendor." 316 -51 RESTRICTIONS A. It shall be unlawful for anv person to operate a mobile food vehicle within the public rights of way or on public property within the City of Buffalo without first having obtained a valid .mobile food vending license as prescribed in this Article. Operation of a Mobile Food Vehicle on private property shall continue to be regulated and prohibited in accordance with all applicable provisions of the City Code. B. An Mobile Food Vehicle Vendor o eratin within the Special Downtown District shall abide by Article V111 of this Chapter within said District and the restrictions enumerated herein shall only apply to all areas outside of said District. C. It shall be unlawful for a Mobile Food Vehicle Vendor to park, stand, or operate in a location which is adjacent to or within a one hundred (I00') foot radius of the nearest edge of any building or section of a of a building coMprising a licensed food establishment, excluding gny patio, awning or temporaEy temporary enclosure attached thereto the kitchen of which is o en for serving food to patrons. This requirement ma be waived if the application is submitted to ether with the written consent of the DrMrietor of the adjacent licensed food establishment. D. Each and every MFVV must at all times carry on the vehicle a "measuring wheel" with a measuring capacity cqpacity of no less than 500 feet as a condition of its licensure. The failure of any MFVV to Carr such a "measuring wheel" or the proximijy distance restrictions included in this Chapter, shall constitute a violation of this Ordinance pursuant to §316-55 of this Code. l (-- C, � E. G. It shall be unlawful for any Mobile Food Vehicle vendor to operate within 100 feet of any hot dog vendor, licensed to vend hot dogs within the City of Buffalo. H.. All si na e must be permanently affixed to the Mobile Food Vehicle. No accessor si na e shall be placed outside or around the Mobile Food Vehicle. I, All Mobile Food Vehicles must be with trash receptacles of a sufficient capacity cqpaciiy that shall be changed as necessary to revent overflow or the creation of litter or debris, Each Mobile Food Vehicle Vendor shall be responsible for abiding by Section 216 -9 of this Code, any violation of which shall be punished in accordance with Section 21611 of this Code. 316 -52 LICENSE REQUIRED, APPLICATION: A. Any person desiring to operate a mobile food vehicle shall make a written application for such License to the Department of Permits and Inspections Services Office of Licenses. The application for such license shall be on forms provided by the Commissioner of Permits and Inspections Services or his designee and shall include the following: 1. Name, signature and address of each applicant and each corporate officer of the Mobile Food Vehicle Vending Corporation, 2. A valid of all necessary licenses permits or ceztificates required b the Count of Erie the State of New York or any subsidiary enforcement agencies or de ailments thereof including but not limited to: a valid New York State Department of Motor Vehicle Re istration and Certificate of Ins ection and valid Driver's Licenses of all vehicle operators. 3. A signed statement that the vendor shall hold harmless the City and its officers and employees, and shall indemnify and hold harmless the City and its officers and employees for an claims for dama e to propegy or injury to persons which mqy be occasioned by any activit carried on under the terms of the license. Vendor shall furnish and maintain such public liabilit food products liability, and ro girt insurance as will rotect vendor and the Cit from all claims for damage to property or bodily injury, including death which may arise from the operations under the license or in connection therewith. Such insurance shall provide coverage of not less than one million dollars ($1,000,000.00) per occurrence. The policy shall fugher p rovide that it may not be cancelled except upon thin 3Q days written notice served upon the City of Buffalo Office of Licenses. A license issued Dursuant the provisions of this section shall be invalid at any time the insurance required herein is not maintained and evidence of continuing coverage is not filed with Cijy of Buffalo Office of Licenses. 4. All license applicants shall submit to a Buffalo Police Department background check into the moral character of the applicant for convictions related to the proposed activity that would indicate that he or she is not a suitable licensee. A license application mqy be refused b the Commissioner of Permits and Inspections Services or his designee, if in his or her discretion a rior criminal conviction demonstrates that he or she is not a suitable licensee. 316 -53 FORM AND CONDITION OF LICENSE Every Mobile food Vehicle Vending License shill contain the following conditions: A. Each Mobile Food Vehicle Vending License shall expire on April I of every year. . B. The license shall not be transferrable to from p erson to person without the written atmroval of the Director of Licenses. C. The license is valid for one (1) vehicle only. D. There shall be issued to each Vendor a suitable decal that shall be permanently and prominently affixed to the vehicle. 31654 LICENSE FEE All vendors licensed under this Chapter shall pay an annual license fee of One Thousand Dollars (s 1,000.09 316-55 SUSPENSION REVOCATION & FINE SCHEDULE: A. The owner/operator of any Mobile Food Vehicle licensed by the Cit y of Buffalo shall comply with all provisions of federal state and local laws and ordinances. B. The owner/operator of any Mobile food Vehicle licensed by the City of Buffalo shall comply with all notices orders decisions and rules and regulations made by the Department of Permit and Ins ection services Buffalo Police Department or any other City of Buffalo De artment and /or A enc . C. Rivera A IL 74 P 1' RE: Urging the New York State Legislature to adopt .a plan to restore funding to the Niagara Frontier Transportation Authority (NFTA). Whereas: The NFTA is the state's second largest transit provider, and the only provider outside of New York City with a light rail system; and, Whereas: The NFTA's state transit operating assistance has been cut six times for a total of $4.3 million since 2009; and, Whereas: At the same time, workers compensation costs rose 35 %, health insurance costs rose 17 %, and maintenance and repair costs rose over 12 %. These converging trends put the NFTA at fiscal cross roads; and, Whereas: The NFTA had a $15 million deficit just a few months ago, even after implementing $10 million in savings from 2009 to 2011; and, Whereas: To close the gap, the NFTA implemented work force reductions, and other efficiencies to reduce that deficit to $7 million. On December 19, the NFTA Board decided to close that gap with the sane amount of service reductions, without a fare increase; and, Whereas: The NFTA needs additional state intervention to navigate these difficult economic times; and, Whereas: In 2009, the state approved a $2.26 - billion rescue plan for the MTA. Rivera +o MMIM By: Councilmember Pridgen RE: Closing of William Street United Mates Postal Station Whereas: Buffalo is the second largest city in New York State; and Whereas: Buffalo is closer in proximity than any other city in New York State to Toronto, the financial Capital of Canada; and Whereas: The Buffalo Niagara Region has 2 International airports and 5 International bridges in addition to functional rail yards; and Whereas: Hundreds of jobs at the William Street Post Office will be lost if this facility is closed; and Whereas: The loss of hundreds jobs would negatively impact the economy of the City of Buffalo; and Whereas: The proposed changes by the Postal service would result in the elimination of overnight delivery of first -class mail in favor of a two -to -three day delivery process; and Whereas: The City of Buffalo is receiving 1 billion dollars from NY State for development throughout the city as announced by Governor Cuomo along with the expansion of the Medical Corridors in downtown Buffalo which are already underway. Now, Therefore, Be It Resolved That: The federal representation from the City of Buffalo ensure that the William Street location of the United States Postal Service remains open. Now, Therefore, Be It Further Resolved That: The Common Council request that Congressman Brian Higgins organizes a meeting with all local elected officials in the City of Buffalo to discuss a plan to keep the facility open. The Downtown Entertainment Review District as hereinafter limited and described shall be known as the "Downtown Entertainment Review District." B. Limits and Descri tion. The Downtown Entertainment Review District shall include all properties within the area bounded: on the North b the centerline of Tu er Street on the East by all properties fronting on the East Side of Main Street on the West by all p roperties fronting on the West Side of Elmwood Avenue and on the South by the Center line of Seneca Street. C. Le islativc Intent. (1) The Common Council finds that in the Downtown Entertainment Review District there has been an increase in the amount of alcohol- related criminal and violent activities involving individuals under the a e of twenty-one years of age who have been illegalW served alcohol in this district resultin in confrontations and criminal activity within the vublic ri hts-of -wa and o ens aces located within this district. (2) The Common Council further finds that this increase in alcohol- related violent and criminal activity has threatened the vitality of the district and that the balance between the g eneral public's right to use and eniov these nublic s aces and to legall atronize establishments that serve alcohol and the ri ht of those under 21 years of age to use and enjoy said ublic s aces is halo eo ardized b these alcohol related incidents. (3) The Common Council further finds that events which permit co-mingling. of patrons who are under or over 21 years of age without adequate security plans or personnel to insure that those under the age of twent -one are not served or able to consume alcohol has increased the likelihood of criminal activity a ainst pedestrians, motorists and property and resulted in excessive noise annoyance, vandalism and interference with the general, public's right to use and enjoy these public spaces,_ particularly between the hours of 10:00 Dm g at night and 4:00 am the following arming. 1 D. Permitted Uses. Any of the uses which resent) are permitted gursuant to this Chapter of the Code of the Cit of Buffalo or which ma be established or extended as a matter of right pursuant to said Code except those uses herein restricted shall be ermitted uses within the Downtown Entertainment Review District. E. Restricted Uses. Any person licensed to serve alcohol at a particular establishment by the New York State Liquor Authority shall not permit the entry of or continued presence of atrons under the age of 21 years of a e at any such establishment within the Downtown Entertainment Review District between the hours of 10:00 pm at night and 4:00 a.m. the following morning without first having applied for and received a restricted use permit in accordance with this section. F. Avolication for Restricted Use Permit: Any arson seeking to hold a single event,a series of events or a reoccurring event which would ermit the entry or continued p resence of patrons under the age of twent -one on his or her premises, while alcohol is being served to those atrons over the age of twenty-one, between the hours of 10:00 m and 4:00 am the following morning within the Downtown Entertainmont Review District shall file an anolication for a Restricted Use Permit on forms to be supplied by the Cit Clerk at least fourteen da s prior thereto. Said forms shall be filled out by the applicant and approved as to Form by the Department of Permits and Inspections' Office of Licenses. The Cit y Clerk shall forward the application to the Common Council immediately after the filing of the application. G. Said forms shall include the name date and time of the event whether the event is one time only or recurring, how many people are anticipated to attend said event, how many security personnel will be utilized to provide security at said event, any promoter that has been retained to promote said event the proposed times during which the event shall start and end what safeguards will be undertaken to insure that all patrons under the age of 21 ears of a c are easily identifiable as such and anv other information deemed pertinent to City Clerk and included on said Restricted Use Permit Application Form for the Downtown Entertainment Review District. H. Decision by the Common Council. The Common Council may authorize and direct the approval or denial of the issuance of the restricted use pennit on the basis of the effect of such a permit on the public health, safety or general welfare within the Downtown Entertainment Review District. The Common Council shall attach to such ermit such restrictions as are necessary to or desirable in its Judgment to ensure the compatibility of the proposed use with the surrounding area and the overall health, safety, , welfare and development of the community. L Compliance: Any person found in violation of this Section shall be immediately have the premises closed by any Buffalo Police Officer or any officer of the Department of Permits and Inspection Services and shall. not be allowed to reopen until the following business day. J. Revocation: U on submission to the Common Cauneil of a written re ort of the enforcinR official of the Citv that a restricted use pennit holder or any other business owner in the Downtown Entertainment Review District is in violation of this Ordinance or the conditions established a hearing shall be scheduled by the Office of Licenses at which time any Licensee or Restricted Use Permit Holder. in the Downtown Entertainment Review District shall have the opportunity to appear and dispute the char e. The Office of Licenses shall then mike a recommendation to the Commissioner of Permits and Insl2ections Services who shall have the authorit to revoke and/or all licenses issued by the Department of Permits and Ins ections Services. K. Exceptions. This Section shall not prohibit any person from allowing co-mingling on Thursda y nights between 10:00 pm on said Thursday night and 4:00 a.m. Friday mornin within the Downtown.
