Sloma, The recent vote by Niagara Frontier Transportation Authority Board of Commissioners to maintain the current fee structure and to eliminate service is very troubling and simply short sighted. Reducing 22% of the transportation services and 26% of the operational hours will severely affect the residents who desperately need services that are located throughout the county. This action will limit accessibility to our residents and it could potentially limit prospective economic growth that this region desperately needs. As the Director for the Center for Employment Opportunities, an agency that specializes in employment services for low - income, hard to serve residents, this decision will further limit our ability to assist individuals from finding employment throughout Erie County. The current transportation situation is already a tremendous barrier and reducing routes further will only compound our already difficult employment situation locally. The City of Buffalo is no longer the employment hub it once was and today many companies that are looking to hire are now located throughout the region. The struggle to place residents in employment is real and limited transportation will have a direct affect on local unemployment rates, social service costs and even local crime rates. The Buffalo News recently highlighted the even disparity of below poverty residents throughout Erie County, with 48% of those residents residing in the City of Buffalo and 52% living in the suburbs. These figures are coupled with the fact that our current unemployment rate is 7.3% and unemployment rates for those who are hard to serve are much higher. Accessibility is essential for growth and as we develop as a regional economy we must think about how our decisions can have an adverse affect on community. The NFTA can play a central role in our region's recovery, however limiting our residents from employment opportunities, essential community services, or even tourism is counterproductive to our region's redevelopment. Smith of corruption and racketeering; and, WHEREAS: The $1.45- miition dollar lawsuit, currently in settlement discussions, accuses the Mayor and Council Member with an illegal pay -to -play scheme that would allegedly compel NRP to hire the Rev. Richard A. Stenhouse before the city would approve a $12- million housing project, which the Mayor previously supported through a letter of support; and, WHEREAS: On December 10, 2011, The Buffalo Newts reported that "Federal investigators have also asked about a Cleveland developers allegations that there's a `pay -to -play' mentality in City Mall ... " This same article reported that the Federal Bureau of Investigation (FBI) is continuing to investigate the Buffalo Economic Renaissance Corporation (BERG); and, WHEREAS: If a settlement of the NRP case occurs, and the matter does not go to trial, the City of Buffalo could potentially be required to pay a substantial amount of money in settlement costs, in addition to considerable legal fees, if any, all of which must be approved by the Common Council. The city could also be responsible for legal fees and considerable time devoted by the Corporation Counsel's office should the matter go to trial. Any potential settlement of the case, or possible trial of the case would nevertheless be independent of any reported federal investigation probe for potential criminal wrong- doing; and, WHEREAS: The lawsuit by NRP and reported probe by federal investigators raises extremely troubling questions concerning integrity in City Government, and at the very least, could lead to an extremely costly settlement that would be borne by Buffalo taxpayers; and, WHEREAS: Rule 11 of the Federal Rules of Civil Procedure provides for sanctions for frivolous lawsuits, so it may be inferred that prudence would suggest that NRP avoid such a jeopardy; and, WHEREAS: The media has reported that Mayor Brown has hired Terrence M. Connors to defend against the NRP allegations of racketeering and corruption, while Council Member Smith is represented by a city attorney; NOW THEREFORE BE IT RESOLVED: That a copy of the Retainer Agreement with Terrence M. Burvid) Ice Rink as well as other City owned rinks; and WHEREAS, Although the total amount of "open skate" time offered to the public has increased somewhat in recent years, many City residents believe that additional "open skate" time is warranted due to strong public demand; and WHEREAS, In addition, many City residents believe that more convenient time -slots should be utilized for offering "open skating" to the public, and have questioned the suitability of time - slots that are currently being utilized for younger skaters; and WHEREAS, Although the revenue to the City and Rink managers that is realized from renting ice -time to leagues and private parties is significant and needed to keep city owned ice rinks operable, a balance must be shuck between the need for revenue streams and the need to maintain public access to publicly owned ice rinks; and WHEREAS, Establishing set hours for "open skating" for the public, which would apply to all City owned ice rinks, is a straightforward way in which the Common Council could ensure that our City ice rinks remain accessible to the public.
