No. 2 By: Mr. Czajka Salary Ordinance Amendment Various Departments 1996-97 The Common Council of the City of Buffalo does ordain as follows: That Section 35-1 of Chapter 35 of the ordinances of the City of Buffalo is hereby amended to read as follows: 35-1. Salaries. There shall be in the City service the titled offices and positions enumerated under the respective headings and subheadings hereinafter set forth, and the amount or amounts set opposite the respective titles shall be annual compensation, unless otherwise stated. This ordinance shall be effective July 1, 1996. PASSED AYES - 11 NOES - 0 (see attached) IT IS HEREBY CERTIFIED, pursuant to Section 34 of the Charter, that the immediate passage of the foregoing ordinance is necessary. The undersigned, heads of departments and City agencies and appointing powers, each certifies, with respect to any department or City agency of which he is the head, and the undersigned Director of the Budget certifies that the positions created by the foregoing ordinance are each necessary for the proper conduct and administration of the respective department or City agency in which said position is sought to be created and to effectuate the proper performance of essential work of each such department or City agency; and each such head of a department and City agency recommends, with respect to the positions set forth in the foregoing ordinance to which he has the power of appointment, and the Director of the Budget recommends that the compensation for said positions be either fixed and raised, or fixed, as the case may be, at the amounts set forth in said ordinance. It is hereby certified that personnel requisitions containing statements of the duties of all new positions created by the within ordinance, have been referred to the Municipal Civil Service Commission, and that the titles of all new positions created by the within ordinance, as therein set forth, are the appropriate Civil Service titles for such positions. AYES - 11 NOES- 0 No. 3 By: Mr. Czajka Salary Ordinance Amendment 20 - Department of Police The Common Council of the City of Buffalo does ordain as follows: That part of Section 1 of Chapter 35 of the Ordinances of the City of Buffalo, effective July 1, 1995 relating to 20-1 Police Administration under the subheading "001 - Office of the Police Commissioner" which reads: 1 Police Commissioner (83,610) 86,118 is hereby corrected to read: 1 Police Commissioner (83,610) 85,282 and further, the ordinance amendment effective January 1, 1996 that reads: 1 Police Commissioner (86,118) 86,979 is hereby corrected to read: 1 Police Commissioner (85,252) 86,135 and further, the ordinance amendment effective July 1, 1996 that reads: 1 Police Commissioner 86,979 is hereby corrected to read: 1 Police Commissioner 86,135 IT IS HEREBY CERTIFIED, pursuant to Section 34 of the Charter, that the immediate passage of the foregoing ordinance is necessary. WE, ANTHONY M. MASIELLO, Mayor and JAMES B. MILROY, Director of the Budget, hereby certify that the foregoing changes are necessary for the proper conduct, administration and performance of essential services of that department. We recommend that the compensation for said position be fixed at the respective amount set forth in the foregoing ordinance. APPROVED AS TO FORM Edward Peace Corporation Counsel PASSED AYES - Brown, Czajka, Franczyk, Helfer, Lockwood, LoTempio, Pitts, Quintana, Williams, Zuchlewski - 10 NOES - Coppola - 1 No. 4 By: Mr. Coppola Extend 1995-1996 grant-in-aid Contract Parkside Community Association Whereas: Parkside Community Association has requested the extension of the 1995-1996 grant-in-aid contract with the City of Buffalo for an additional six months past the June 30, 1996, contract ending date; and Whereas: Unexpended funds in the amount of $4,094 would be used for the crime prevention consultant position and PCA's administrative expenses. Now Therefore Be It Resolved That This Common Council grants the Parkside Community Association a six month extension of the 1995-1996 grant-in-aid contract past the June 30, 1996, deadline stipulated in their contract, to enable them to continue funding the crime prevention consultant position and PCA's administrative expenses. PASSED AYES - 11 NOES - 0 No. 5 By: Ms. Lockwood South Buffalo Community Association Request To Retain Unspent Grant-In-Aid Funds Whereas: The South Buffalo Community Association continues its long standing tradition of providing human service programs and offering assistance to those in need; and Whereas: There is an existing surplus of $5,790. from the 1995-96 fiscal year for the South Buffalo Community Association; and Whereas: Item 5 of the grant in aid contract between South Buffalo Community Association and the City allows for grantees to retain any grant-in-aid funds not spent; subject to Common Council approval, if returning the money would prove to be a hardship to the organization; and Whereas: The South Buffalo Community Association has appealed to me to ask for Common Council approval so the association can retain the $5,790 and provide much needed summer recreational programming. Now Therefore Be It Resolved: That this Common Council finds it would be a hardship for the South Buffalo Community Association to return the group's 1995-96 grant-in-aid surplus of $5,790; and Be It Further Resolved: That this Common Council approves allowing the South Buffalo Community Association to retain the group's 1995-96 grant-in-aid surplus for use in the coming fiscal year as per item 5 in the 1995-96 grant contract, subject to terms of the contract. PASSED AYES - 11 NOES - 0 No. 6 By: Mrs. LoTempio Discharge Civil Service Committee Sal. Ord. Amend. - Street Sanitation (Item No. 174, CCP, June 11, 1996) (Item No. 119, CCP, June 25, 1996) Whereas, the above item is currently tabled in the Civil Service Committee and Whereas, it is no longer necessary for this item to be considered by that Committee, Now Therefore Be It Resolved, that this Common Council does hereby discharge the Committee from further consideration of this item, and the item is now before the Common Council for its consideration. Seconded by Mr. Czajka. CARRIED. Mrs. LoTempio now moved approval of the above item. Seconded by Mr. Czajka. PASSED AYES - 11 NOES - 0 No. 7 By Mrs. LoTempio Bond Res. $5,381,000 - Reconst. Pkg. Ramps (Item #180, C.C.P., June 11, 1996) That the above item be taken from the table. Seconded by Mr. Brown. CARRIED Mrs. LoTempio now moved that the above item be approved. Seconded by Mr. Coppola. PASSED. AYES - Brown, Coppola, Czajka, Franczyk, Helfer, Lockwood, LoTempio, Pitts, Quintana, Williams - 9 NOES - Helfer, Zuchlewski- 2 No. 8 By: Mr. Quintana and Mr. Pitts Extension of West Side Community Services 1995-96 Grant-in-Aid Whereas: The City of Buffalo approved a Grant-In-Aid of $11,000 dollars to the West Side Community Services Organization (W.S.C.S.) located at 161 Vermont Street; and Whereas: The Niagara District Councilmember has proposed to consolidate programs offered by W.S.C.S. and Concerned Ecumenical Ministries (C.E.M.); and Whereas: W.S.C.S.'s lease and current funding terminates June 30, 1996. The Niagara District Councilmember is fully committed to continuing programs for the community until such time as a consolidation is completed. Now Therefore Be It Resolved: That the Common Council approves the extension of the 1995-96 Grant-In-Aid allocated to the West Side Community Services Center to the City of Buffalo for 1996-97. PASSED AYES - 11 NOES - 0 No. 9 By: Mr. Quintana and Mr. Pitts Extension of West Side Community Services Funding and Lease With the City of Buffalo Whereas: The West Side Community Services Organization's funding and lease at 161 Vermont Street terminates June 30, 1996. The Niagara District Councilmember has proposed a consolidation of programs with Concerned Ecumenical Ministries; and Whereas: In order to not immediately disrupt programs at the W.S.C.S. while at the same time providing for the development of a transitional plan for consolidation, the Niagara District Councilmember is willing to work with both W.S.C.S. and C.E.M.; and Whereas: The Niagara District Councilmember is willing to provide a period of two months to develop a transitional plan; and Now Therefore Be It Resolved: That the Common Council approve the establishment of a Sub Advisory Board comprised of 8 members, 4 from W.S.C.S. and 4 from C.E.M. The Sub Advisory Board would oversee program delivery, as well as policy issues related to the West Side site; and Be It Further Resolved: That the Common Council approves the extension of the existing lease with W.S.C.S. to August 31, 1996; and Further Resolved: That the Common Council approves the allocation of funds from the current Block Grant program to August 31, 1996. PASSED AYES - 11 NOES - 0 No. 10 Buffalo Cable Access Media (BCAM) Proposed Budget Buffalo Cable Access Media (BCAM) as the current provider of public access television services, is requesting the Common Council grant an extension of our services for the period that will commence on July 1, 1996 through December 31, 1996. The city has made provisions for funding to be disbursed to the organization on a quarterly basis from the Public Access Special Revenue Fund. In following these provisions, BCAM is requesting a payment of $36,750.00 be made available immediately upon the Council's approval for the first quarter FY 96-97 (Jul.-Sept.). A second quarter payment of $36,750.00 would be remaining for FY 96-97 (Oct.-Dec.); for a total of $73,500.00- All, requests and allocations are based on a maximum of $147,000.00 provided in the new Cable Franchise Agreement. The organization has been and continues to seek alternative funding and grants, to supplement monies from the city in an effort to update equipment and facility services. BCAM will advise the Council on the success of these various endeavors. BCAM is continuing to provide community and public access services, that have been rapidly increasing. We will also continue to move fourth with our new Community Outreach initiative plans previously submitted to the Council FY (April 96). Mrs. LoTempio moved: That Buffalo Cable Access Media ("BCAM") be, and hereby is, granted an extension for their services for the period commencing July 1, 1996 through December 31, 1996, and that the proposed budget for BCAM for fiscal year 1996-97 be, and hereby is, approved.
