Arthur, President of the Common Council and Councilmembers Amos, Bakos, Bell, Coppola, Higgins, LoTempio, Perla, Pitts - 9 Absent- Councilmembers Collins, Fahey, Franczyk, Zuchlewski- 4 No. 1 Dear Mr. Michaux: Pursuant to Section 30 of the Charter of the City of Buffalo, upon the written request of five Council Members of the City of Buffalo, dated October 29, 1992, presented to you herewith, I hereby call a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on October 30, 1992 at 1:00 p.m. for the following purposes: To receive and take appropriate action on Ellicott Town Center Comprehensive Master Plan dated May, 1992; Land Disposition Agreement between Ellicott Mall Partnership and BMHA; and a request for $2 million of 1992-93 H.O.M.E. Arthur President of the Common Council 1315 City Hall Buffalo, New York Dear Sir: WE, the undersigned, members of the Common Council, hereby request that you call a Special Meeting of the Common Council, pursuant to Section 30 of the Charter of the City of Buffalo, for the following purposes: To receive and take appropriate action on Ellicott Town Center Comprehensive Master Plan dated May, 1992; Land Disposition Agreement between Ellicott Mall Partnership and BMHA; and a request for $2 million of 1992-93 H.O.M.E. Pitts TO EACH MEMBER OF THE COMMON COUNCIL: YOU ARE HEREBY NOTIFIED that, pursuant to Section 30 of the Charter of the City of Buffalo, upon the written request of five Council Members, dated October 29, 1992 the HON. ARTHUR, President of the Common Council, has called a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on October 30, 1992 at 1:00 p.m. for the following purposes: To receive and take appropriate action on Ellicott Town Center Comprehensive Master Plan dated May, 1992; Land Disposition Agreement between Ellicott Mall Partnership and BMHA; and a request for $2 million of 1992-93 H.O.M.E. Pursuant to Rule 2 of the Rules of Order of the Common Council of the City of Buffalo, each of the following named members of the Common Council, to wit: ARCHIE L. AMOS, JR. DAVID FRANCZYK NORMAN M. FAHEY DALE ZUCHLEWSKI hereby states that he received twenty-four (24) hours' notice of the time and purpose of the Special Meeting of the Common Council duly called to be held on October 30, 1992 at 1:00 p.m. STATE OF NEW YORK) COUNTY OF ERIE ) ss: CITY OF BUFFALO) On this 29th day of October, 1992, before me, the subscribers, personally appeared James W. Pitts, Dale Zuchlewski, Norman Bakos, Carl A. Perla, Jr., David Franczyk, Alfred T. Coppola, Rosemarie LoTempio, David Collins, Brian Higgins, to me known to be the same persons described in and who executed the foregoing instrument, and they duly and severally acknowledged to me that they executed the same. PITTS ELLICOTT TOWN CENTER COMPREHENSIVE PLAN WHEREAS: The Ellicott Mall Partnership has developed a Comprehensive Master Plan for the redevelopment of Ellicott Mall. This master plan has been developed in conjunction with the New York State Division of Housing and Community Renewal, and WHEREAS: The Ellicott Town Center Plan is based upon a Turn Key Grant provided by the State Division of Housing and Community Renewal. The Ellicott Mall Partnership will also use tax credits provided through the State to renovate the eight towers at Ellicott Mall, and WHEREAS: The plan will also include town houses for families and a commercial area which will provide needed retail services to residents in the Mall and surrounding neighborhood, and WHEREAS: The submission of this Master Plan is the final step to finally providing for the long awaited renovation of Ellicott Mall! It is a plan which has been produced through the extraordinary support of the Mayor of the City, the Western New York State representatives and the community. The plan ensures affordable housing for low to moderate income persons. NOW THEREFORE BE IT RESOLVED THAT: The Ellicott Town Center Comprehensive Master Plan is hereby approved subject to approval by the New York State Department of Housing and Community Renewal, the Buffalo Municipal Housing Authority, the Buffalo Urban Renewal Agency; and that the terms and conditions of the attached Land Disposition Agreement by and between the B.M.H.A. and the Ellicott Mall Partnership are satisfied. FURTHER BE IT RESOLVED THAT: The Mayor and the Common Council be and hereby are authorized to execute the Land Disposition Agreement and such related documents as may be necessary, subject to approval as to form by the Corporation Counsel. BE IT FURTHER RESOLVED THAT: The Common Council hereby approves the use of $2,000,000 of the 1992-1993 H.O.M.E. funds awarded to the City of Buffalo for Phase I of the Master Plan subject to terms and conditions consistent with the City's Affordable New Housing Construction Program, including income eligibility guidelines to ensure that low and moderate income persons are benefitted by this activity. PITTS EAF- ELLICOTT MALL PARTNERSHIP PLAN WHEREAS: The Ellicott Mall Partnership plan for redevelopment of the Ellicott Mall for low and moderate income housing and the sale of the Ellicott Mall is an unlisted action as defined in 6 NYCRR Part 617.2. The Common Council has approval power over this item, and is therefore an involved agency as defined in 617.2. and; WHEREAS: As part of an uncoordinated review, the Common Council has evaluated an Environmental Assessment form (EAF) on this item which has been completed, and; WHEREAS: Having made an independent assessment of the information contained in the EAF, the Common Council adopts the findings set forth in Part II and, as a results, finds that this proposed action will not result in any significant adverse environmental impacts. NOW THEREFORE BE IT RESOLVED: That this Common Council issues a negative declaration. ADOPTED. No. 4 At 1:27 P.M. Mr. Pitts moved to adjourn. Seconded by Mr. Bakos. Charles L. Michaux, III City Clerk
