Call for Special Meeting
Pursuant to Section 30 of the Charter of the City of Buffalo,
upon the written request of five Council Members of the City of Buffalo, dated
March 20, 1992, presented to you herewith, I hereby call a Special Meeting of
the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New
York, on March 24, 1992 at 1:30 PM. for the following purpose:
(1) To discharge the Special Committee on Budget from further consideration
of Item No. 110 C.C.P. March 3, 1992 - Home Rule Message relating to the
Utility Income Tax, and to receive, consider and take appropriate action on
said item.
(2) To receive, consider and take appropriate action for authorization to
apply to H.U.D. for HOME and HOPE Funding.

WE, the undersigned, members of the Common Council, hereby request that
you call a Special Meeting of the Common Council, pursuant to Section 30 of the
Charter of the City of Buffalo, for the following purpose:
(1) To discharge the Special Committee on Budget from further consideration
of Item No. 110, C.C.P., March 3, 1992 - Home Rule Message relating to the
Utility Income Tax, and to receive, consider and take appropriate action on
said item.
(2) To receive, consider and take appropriate action for authorization to
apply to H.U.D. for HOME and HOPE Funding.
WE request that this Special Meeting be held on March 24, 1992 at
1:30 PM.

YOU ARE HEREBY NOTIFIED that, pursuant to Section 30 of the Charter of
the City of Buffalo, upon the written request of five Council Members, dated
March 19, 1992 the HON. GEORGE K. ARTHUR President of the Council, has called a
Special Meeting of the Common Council, to be held in the Council Chambers, City
Hall, Buffalo, New York, on March 24, 1992 at 1:30 PM. for the following
purpose:
(1) To discharge the Special Committee on Budget from further consideration
of Item No. 110, C.C.P., March 3, 1992 - Home Rule Message relating to the
Utility Income Tax and to receive, consider and take appropriate action on said
item.
(2) To receive, consider and take appropriate action for authorization to
apply to H.U.D. for HOME and HOPE Funding.

Request Council Authorization to Apply for Funding
As you may know, Congress has approved the Housing Act of 1992
which eliminated several U.S. Department of H.U.D. programs. Among those
programs which were discontinued were: the 312 Loan Program and the Rental
Rehabilitation program.
In seeking to provide new and more flexible Housing Development mechanisms for
communities Congress has allocated funding for several new H.U.D. Programs. The
most comprehensive of these new programs are HOME and HOPE.
The City of Buffalo has been notified that $5.4 million has been reserved for
local housing renewal efforts here in our City.
In order to reserve available HOME funding the City of Buffalo must submit a
funding request by no later than Thursday, March 26, 1992.
Staff assigned to the Dept. of Inspections and Community Revitalization are
preparing the funding request at this time. No specific projects/programs
will be obligated at this stage.. It is to the City's advantage to reserve the
funds and to seek approval of as many project/program options as possible. We
also intend to take this approach with HOPE funding when it becomes available.
Common Council authorization for Mayor Griffin to sign and submit funding
request to H.U.D. for the HOME and HOPE Programs is hereby requested.
Please be advised that all the funding request described above will be filed
with the City Clerk for Common Council informational purpose and review.
In terms of specific housing development projects Councilmembers are urged to
contact Dir. J. Gary Rogers, Division of Community Revitalization for program
information and to discuss project/program options.
Mr. Fahey moved:
That the communication from the Commissioner of the Department of
Inspections and Community Revitalization, dated March 17, 1992, be received and
filed, and
That the Mayor be, and he hereby is, authorized to execute and submit
funding requests to the U.S. Department of Housing and Urban Development for
the Home Investment Partnership Act (HOME) program and for the Home ownership
and Opportunities For People Everywhere (HOPE) program, and
That the City of Buffalo Urban Renewal Agency be, and hereby is,
authorized to administer the HOME and HOPE programs for, and on behalf, of the
City of Buffalo, and
That, the projects to be funded under these programs shall be submitted
to the Common Council for approval.
Seconded by Mr. Franczyk.

Message relating to the Utility Income Tax
Whereas: The above item is presently before the Special Committee
on Budget, and
Whereas: It is no longer necessary for this item to be considered by that
Committee;
Now, Therefore, Be It Resolved, that this Common Council does hereby Discharge
the Special Committee on Budget from further consideration of the above item,
and said item is now before the Council.
Seconded by Mr. Bakos.

ASSEMBLY BILL NO. Al0228
SENATE BILL NO. S7379
UTILITY INCOME TAX
(ITEM NO. 110, C.C.P., MAR. 3, 1992)
WHEREAS, the Common Council of the City of Buffalo at a regular
meeting held on the 21st day of January, 1992 adopted a resolution which, among
other things, contained the following resolve:
"That this Common Council memorializes the New York State Legislature to
immediately introduce and enact legislation which would grant to the City of
Buffalo the power to increase the utility tax by 1% to a maximum of 4% ;;and
WHEREAS, there has been introduced in the Assembly a bill numbered
A10228 and in the Senate a bill numbered S7379 which would grant to the City of
Buffalo the requested power to increase its utility income tax; and
WHEREAS, the necessity exists for the enactment of such legislation
because the City of Buffalo does not have the power to enact such legislation
by local law without such enabling legislation:
NOW, THEREFORE, BE IT
RESOLVED, that the City of Buffalo does hereby request the enactment into
law of Assembly Bill No. A10228 and Senate Bill No. S7379 entitled:
"AN ACT to amend the General City Law, in relation to the rate of tax on
utilities authorization for the City of Buffalo."
And the City Clerk is hereby authorized and directed to certify the passage of
this resolution to the State Legislature and to send copies thereof to the
Secretary of the Senate and the Clerk of the Assembly.
