Michaux, III City Clerk City Hall Buffalo, New York Dear Mr. Michaux: Pursuant to Section 30 of the Charter of the City of Buffalo, upon the written request of five Council Members of the City of Buffalo, dated February 27, 1992, presented to you herewith, I hereby call a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on March lO, 1992 at 1:00 p.m. for the following purpose: (1) To receive, consider and take appropriate action on dealing with the City of Buffalo's current fiscal crisis - "Demand Driven Revenue Diversification System." Arthur President 1315 City Hall Buffalo, New York Dear Sir: WE, the undersigned, members of the Common Council, hereby request that you call a Special Meeting of the Common Council, pursuant to Section 30 of the Charter of the City of Buffalo, for the following purpose: (1) To receive, consider and take appropriate action on dealing with the City of Buffalo's current fiscal crisis - "Demand-Driven Revenue Diversification System." PITTS, DALE ZUCHLEWSKI hereby states that he received twenty-four (24) hours notice of the time and purpose of the Special Meeting of the Common Council duly called to be held on March 10,1992 at 1:00 pm. Collins, Dale Zucklewski, Nerman Bakos, Rosemarie LoTempio, Eugene M. Fahey, James A. Pitts, Archie L. Amos, Jr., Brian Higgins to me known to be the same persons described in and who executed the foregoing instrument, and they duly and severally acknowledged to me that they executed the same. FRANCZYK President PRO TEMPORE of the Council, has called a Special Meeting of the Common Council, to be held in the Council Chambers, City Hall, Buffalo, New York, on March 10, 1992 at 1:00 pm. for the following purpose: (1) To receive, consider and take appropriate action on dealing with the City of Buffalo's current fiscal crisis -"Demand-Driven Revenue Diversification System." AMOS CONTRACTING FOR A DEMAND-DRIVEN REVENUE/COST ANALYSIS WHEREAS, the city of Buffalo currently is suffering a significant downturn of revenues, which seems to dictate that the city develop a methodical, longer term approach to its finances; and, WHEREAS, the State of New York has drastically reduced financial aid to the City and it does not appear that such aid will be reinstated within the foreseeable future, with a result being that the City will have to become more financially self-sufficient; and, WHEREAS, it appears that the taxpayers of the City are desirous of the City diversifying its revenue base rather than continuing to rely so heavily on the property tax, utilities tax a'id other forms of taxation; and, WHEREAS, the municipal securities credit rating agencies are reviewing the City's credit rating which, if reduced, would remove many of the City's securities from investment grade rating; and, WHEREAS, it is the apparent desire of the City administration, Common Council and the public that the City retain a reasonable level of municipal services rather than making major cutbacks; and, WHEREAS, the Common Council has been made aware of a systematic and orderly approach to municipal finances which has been devised, perfected and copyrighted by a California local government financial consulting company, Management Services Institute, Inc.; and; WHEREAS, the Common Council has heard Douglas W. Ayres of Management Services Institute describe the experience of his firm in assisting municipalities in diversifying their revenue base and in avoiding financial crises and drastic service reductions; and, WHEREAS, the Common Council desires to have available to it for its subsequent review and decision the revenue tliversification, demand-driven systematic approach to matching service benef its with amounts paid by the public for support of their public services, which systematic approach MSI appears to have perfected and to have been accepted by the public in the jurisdictions served; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COMMON COUNCIL OF THE CITY OF BUFFALO, NEW YORK, as follows: 1. That the Common Council hereby makes a finding that Management services Institute, Inc. (MSI) of Anaheim, California is the sole source supplier for revenue/cost analysis Municipal Business System services due to its copyrighted microcomputer software, forms, text and system, and by reason of its unique expertise and experience; and; 2.. That the Common Council hereby approves a twenty four (24) month contract with Management Services Institute, Inc. (MSI) for the amount of $41,041 per month for a total of $985,000, plus reimbursement of documented travel expenses in an additional amount not-to-exceed $50,000; and, 3. That the Common Council hereby authorizes a City official to be designated by the Mayor to negotiate expeditiously the details of the hereby authorized contract based on the presentation made to the Common Council this date and based on MSI's standard Municipal Business System Proposal; and, 4. That the Common Council hereby authorizes the appropriate City official to sign the hereby authorized contract between MSI and the City of Buffalo; and, 5. That the Common Council hereby authorizes MSI to start working with City officials not later than March 30, 1992, to advise on the 1992-1993 City Budget; and, 6. That the Common Council hereby authorizes MSI to assist the appropriate City officials to present the MSI program, schedule and expected results to Standard and Poor's and Moody's Investors Services during the first week of April, 1992; and, 7. That the Common Council hereby appropriates the amount of $1.1 million from consolidated all-funds unreserved and undesignated fund balances to the Department of Administration and Finance, Division of Budget and Management, Administrative Services Program (account number 06-1-001-570) for the accomplishment of the revenue diversification, service level preservation and cost control program authorized by this Resolution; and, 8. That the Common Council hereby authorizes the Comptroller to determine the relative benefits for each City Fund and to distribute the appropriation made hereby among the appropriate City Funds and accounts in relation to those determined benefits.
