INFO PUBLIC SCHOOL CONSTRUCTION
The City of Buffalo and the Buffalo Public Schools are
undertaking a billion dollars worth of public school
construction-both new and rehab. As these schools are
spread throughout the City, this plan offers us an

unparalleled opportunity to invest in every neighborhood,
create sustainable jobs and redevelop our communities
around our schools.
As you know, Buffalo is a very poor City with a declining
population base and declining property values. Nearly 70%
of our students are living in poverty, and concentrated
poverty is directly linked to poor school performance. The
average age of a school building in Buffalo is 69 years -
against a national average of 40 years. We must create
schools that provide an education equal to that provided in
the suburbs and superior in the level of student and family
support lifelong learning centers that recognize and confront
the urban condition.
I believe that many of HUD's initiatives directly relate to what
we are trying to accomplish and that, with your assistance,
we can take this once-in-a-lifetime opportunity and have an
extraordinary impact on this City and region for generations
to come. I am also confident we will be creating a model of
urban and community development worthy of national
attention.
I am attaching a list of tasks, concepts and possibilities for
which HUD assistance may be applicable and I look forward
to refining this list as we discover ways to work together on
this project.

The City Planning Board at its regular meeting held
Tuesday, September 12, 2000, considered the matter
captioned above pursuant to Section 511-28 E(2) of the
Buffalo Code, Neighborhood Business District Restricted
Uses.
The applicant seeks to construct a new convenience store
with a gasoline island canopy and an automatic car wash
with vacuum cleaners at 1507 Fillmore Avenue. Under
SEQR the proposed store, gas island and car wash are
considered an unlisted action which may be studied through
uncoordinated review.
The Planning Board voted to recommend approval of the
proposed store, gas sales island canopy and car was with
the following conditions:
1.Car wash and vacuum cleaner operations are only allowed
between the hours of 8:00 a.m. and 10:00 p.m. daily.
2.The vacuum cleaners are to be screened on the two sides
facing residential properties sides with a 61 high stockade
fence along with a landscaping mix of species and heights of
plants to soffen the effect of the wood fence.
3.That a 71 high stockade fence be constructed on the north
side of the parcel to mitigate noise generated by the car
wash operations.
4.That dense vegetative screening is incorporated into the
north and east sides of the parcel facing residential
properties.
5.The balance of the site generally following the site plan
approved by the Planning Board.
6.A concrete pad be installed for future use for a bus stop
bench near the corner of the property where the bus stop is
located.
7.That any proposed signage incorporate decorative
architectural features with landscaping with a lower height
theme in mind.

AMEND LEASE AGREEMENT
GRASSROOTS GARDENS OF BUFFALO
ITEM # 12, 5/2/95
In the above referenced item Your Honorable Body
authorized a lease agreement between the City of Buffalo
and Grassroots Gardens of Buffalo. The City of Buffalo

leases certain city owned vacant lots to Grassroots Gardens
for the purpose of combating community deterioration by
designing, developing, establishing and supporting
vegetable, fruit and/or flower gardens.
The term of the lease was for five (5) years, ending October
31, 2000. The lessee provides the City of Buffalo with liability
insurance holding the City of Buffalo harmless from accident
and injury claims which might arise from their use of the
property. There is also a 30 day cancellation clause allowing
either party to cancel the lease.
Grassroots Gardens has been assisting other Community
based non-profit organizations with the designing and
development of gardens in their areas. Grassroots Gardens
has requested that the lease be amended to include the
following city owned vacant lot:

I am recommending that Your Honorable Body approve the
request of Grassroots Gardens, Inc. to amend the lease

USE OF 237 & 241 HUDSON STREET
The Office of Strategic Planning, Division of Real Estate,
has received a request from Pastor Frank Vitello of Arise
Ministries, 118 Tacoma Avenue, Buffalo, New York 14216 to
use the vacant lots at 237 and 241 Hudson Street. They are
requesting to use the vacant lots on September 22, 23, and
24, 2000, for church related services and activities that will
be open to the public.
Arise Ministries has agreed to clean the lot after their use
and have provided proof of liability insurance coverage in the
amount of $1,000,000., holding the City of Buffalo harmless
from any accident or injury which may result from their use of
the property.
I am recommending that Your Honorable Body approve the
request of Arise Ministries to use 237 and 241 Hudson
Street upon the above terms and conditions.

NIAGARA CONSULTING GROUP REPORT
THE BUFFALO MEDICAL CENTER INITIATIVE
For your information and review is the Niagara Consulting
Group (NCG) report on the Buffalo Medical Center Initiative.
Earlier this year, BURA contracted with NCG for the purpose
of reviewing former plans, meeting with stakeholders,
reviewing other communities' medical campus initiatives and
to recommend a strategy to begin the process of creating a
world class Medical Center.
This report, released at the September 14 BURA meeting,
recommends the formation of a strong, adequately funded,
representative 501C3 not-for-profit corporation to lead the
revitalization effort.
At the request of Mayor Masiello, Thomas R. Beecher, Jr.,
recently retired Chairman of Kaleida Health with more than
20 years of volunteer service in the Health Care community,
will take this report back to the key stakeholders to facilitate
the creation of a vehicle to manage this effort. The key
stakeholders will include neighborhood representation from
the Fruitbeit and Allentown communities.
Mr. Beecher has volunteered his services and will be
reporting back within 90-120 days.

REQUEST FOR PROPOSALS (RFP) FOR THE
MANAGEMENT & DELIVERY OF THE REVOLVING
LOAN PROGRAM
Attached for your review is a Request for
Proposals (RFP) for the Management and Delivery of the
Revolving Loan Program released by the office of Strategic
Planning on September 8, 2000. The RFP is a response to
recommendations cited in the report prepared by Human
Service Development (HSD) of Corning, New York. This
consultant team, approved by the Buffalo Urban Renewal
Agency (BURA), was charged with studying and reviewing
both internal (City Hall) and external systems (Community
Based Organizations) along with the various
programs/procedures to determine the best possible way to
deliver program services to the residents of the City of
Buffalo. The ultimate goal of the study was to develop a
comprehensive delivery system that will ultimately stabilize
and create healthy neighborhoods. The RFP is seeking
eligible respondents that will help the City realize this goal
and allow the residents of the City of Buffalo to receive
efficient, effective and quality services. All submitted
proposals will be reviewed by a selected committee(see
attached list) and will be evaluated according to the process
outlined in the RFP (see page 3 of the RFP).

This Item is a request to transfer 233 Fougeron
Street from the Buffalo Urban Renewal Agency to the City of
Buffalo. This project was approved by the Buffalo Urban
Renewal Agency on June 10, 1999.
The impetus for this project came from the announcement by
Nabisco that it was considering either a 60 to 80
million-dollar modernization of their Buffalo Facility or
relocate out of State. The City agreed to street widening to
permit truck traffic along Louisen Street and general
streetscape enhancements. These improvements were
designed to benefit both the commercial and residential
sectors.
The purchase and demolition of the 2 1/2 story wood frame
residence at 23' )
Fougeron was required to create additional space for the
widening of Louisen Street and to accommodate the
required radius for tractor trailers turning left onto Fougeron
Street from Louisen St. on route to the Nabisco Plant.
Federal Block Grant dollars were used to
accomplish this, therefore, we had to take title in BURA
temporarily.
We now respectively request Your Honorable Body approve
the transfer of this property to the City of Buffalo.

intends to acquire, rehabilitate and ren': for income
purposes. The purchaser has provided a plan and estimate
of repair costs to bring the building into code compliance. He
has also provided proof of his financial ability to complete the
cost of purchase and repairs.
The bid price is the amount to be received by the City. The
buyer will be required to pay a ten percent buyer premium to

Cash Realty and Auction.
The Department of Community Development and Division of
Collections have no objection to the sale. There are no
taxes, liens or building code violations owed to the City of
Buffalo by the purchaser.
I am recommending that Your Honorable Body approve the
bid of
Mr. Anthony Pirrone in the amount of Sixteen Thousand
Dollars ($16,000.00). I am further recommending that the
Corporation Counsel prepare the necessary documents for
the transfer for title and that the Mayor by authorized to
execute the same.

A tax and title search will not be provided to the purchaser.

and cost of the legal description; and

RESPONSE TO REQUEST FOR INFORMATION
SEWER LINES - I 11 MULBERRY STREET
PRIOR COUNCIL REFERENCE: (ITEM NO. 92 C.C.P.
SEPTEMBER 5, 2000)
Presented herein please find a comprehensive response to
Item No. 9~Lof the September 4, 2000 Common Council,
regarding a situation involving sewer lines servicing property
commonly known as 111 Mulberry Street (the "Property").
The Common Council received a correspondence from Mr.
Llord B. Brooks, 111, the current owner of the Property,
dated August 22, 2000 requesting assistance with a
perceived problem involving the sewer line servicing the
Property.
The Property was constructed in 1993 by James
Management Company, Inc. and Telco Construction, Inc.
(collectively the "Builder") and originally purchased by
Susette Mines. At the time the Property was completed a
Certificate of Completion (dated September 8, 1993) was
issued to the Builder.
Unfortunately, the Property was foreclosed upon, by
Manufacturers and Traders Trust Company in July 1996. Mr.
Brooks purchased the Property out of the foreclosure, taking
title on July 18, 1997 without any City of Buffalo and or City
agency involvement, whatsoever.
In 1997 the adjacent property, commonly known as 105
Mulberry was conveyed to the owner of property located at
86 Locust Street through the homestead process. It was
determined that based upon the fact that he did not reside at
the Property, Mr. Brooks did not qualify to homestead 105
Mulberry Street. Furthermore, at the time 105 Mulberry

Street was homesteaded to the owner of 86 Locust Street
Mr. Brooks signed-off, agreeing to permit the conveyance.
A thorough review of available records and information has
been undertaken attempting to confirm Mr. Brooks' position
relative to the sewer line situation. It has been confirmed that
the Property is serviced by a sewer connection that
minimally encroaches upon 105 Mulberry Street. However, it
is apparent that the clean-out access points are located
within the City of Buffalo's existing right of way in front of 105
Mulberry Street and that Mr. Brooks would not be prohibited
from gaining access to his sewer line.
Based upon the fact that the City of Buffalo no longer has
any ownership interest in either the Property and/or 105
Mulberry Street, it would be necessary that Mr. Brooks
negotiate an easement agreement with the current owner of
105 Mulberry Street. However, all indications are that such
easement would not be necessitated for any other reason
then Mr. Brooks' own peace of mind.

ASSESSED VALUATION: $4,600.
The Office of Strategic Planning, Division of Real Estate,
has received a request to purchase 762 East Amherst from
Mr. Larry Livingston, 760 East Amherst Street, Buffalo, New
York, 14215. Mr. Livingston intends to use the property for
extra yard space, which is adjoining to his property.
The Office of Strategic Planning and the Division of
Collections have no objection to the sale. There are no
building code violations, taxes or other liens owed to the City
of Buffalo by the purchaser.
An independent appraisal of the property was conducted by
George Ladori of All Points Appraisals, 4506 Abbott Road,
Orchard Park, New York 14127. He has estimated the value
of the parcel to be one Thousand Two Hundred Dollars
($1,200). The Division of Real Estate concurs with the
appraisers estimate of value.
The results of our negotiations are that Mr. Larry Livingston
has agreed and is prepared to pay One Thousand Two
Hundred Dollars ($1,200) for the subject property. He has
also agreed to pay for the cost of the appraisal, transfer tax,
recording fee's and cost of the legal description.
I am recommending thatYour HonorableBody
approve the sale of 762 East Amherst Street for One
Thousand Two Hundred Dollars ($1,200). I am further
recommending that the Corporation Counsel prepare the
necessary documents for the transfer of title and that
the Mayor beauthorized to execute the same.

The Local Franchise Tax on Utilities is authorized by New
York State law which allows any city to exact a local law
imposing a tax of up to three percent on the gross income of
utilities doing, business in the city.
Historically we have found that as energy use declines, or
most recently as alternative lower-cost providers have
become available, there is a corresponding reduction in
gross receipts and a corresponding reduction in gross tax
which could explain the recent decline in utility tax revenue.
While consumers may benefit from the recently announced
sale of NIMO to a London-based company, it is difficult to
project what the sale will mean in terms of local tax revenue
on utility income in the future. It should also be noted that if
the energy costs increase in the near future, that would
result in increases in the gross income of utilities, and a
corresponding increase in local revenues. It would take an
exhaustive, in-depth study of utility accounts over a period of

MUNIS CONCERNS

I am responding to your request in regards to concerns
and problems with MUNIS - the new financial software used
by the City.
Earlier this spring, I instituted a MUNIS Support Committee
headed by City Accountant Anne Forti-Sciarrino and my
Executive Staff Manager Jeffrey Tooke aimed at navigating
the full implementation of MUNIS in our department and
throughout City Hall. The focus of this committee would be
to address problems, concerns and possible solutions
regarding MUNIS and to determine topics for additional
training. The committee is comprised of members from the
Accounting and Auditing Division within the Department of
Audit and Control and Management Information Systems
(MIS, formerly the Data Processing Division).
The MUNIS Support Committee has established a protocol
for reporting MUNIS problems that includes posting
problems in a "MUNIS Errors" public folder on the network in
which all City Hall employees can post and browse for
potential solutions. In addition, several employees in the
Department of Audit and Control and Management
Information Systems are occupied throughout the day
responding to any phone calls from departmental users
asking about particular individualized concerns. Concerns
and problems with MUNIS are then brought to this biweekly
in committee in an effort to investigate any problems that
may be systemic or software oriented in order to assure that
such problems are immediately rectified and that Computer
Center Software, the creators of the MUNIS software
package, investigates any software problems and includes
any resolution to rectified software problems in the new
releases of MUNIS.
At this point, the MUNIS Support Committee is confident that
the operation of MUNIS, while yet to be fully implemented
with additional add-on modules for specialized functions, is
progressing with minimal software problems and prompt

Support Committee is resolved to continue meeting to insure
the continued oversight of the MUNIS software package, to

The City Real Estate Office, the Law Department, the

square feet from 1/15/99 through 9/30/99, reduced to 5,374
square feet from 10/1/99 through 6/30/00 and 5000 square
feet from 7/l/00 to date).
Consequently we are in the process of recalculating the
pro-rata shares and meeting to finalize utility costs. The
parties have agreed that payment should occur once the
calculations are finalized. Accordingly, we will report same to

This is to advise that the owner, Enviro Tire, USA, has
instituted certiorari proceedings on 102 Rapin Place, Buffalo,
New York, regarding the assessments for the fiscal year
2000-01. The assessments were reviewed by this
Department and the owner expressed a willingness to settle
the proceeding.
The final assessment for fiscal year 2000-01 was $433,000.
The owner is agreeable to a settlement which would result in
a reduction to $120,000 on 102 Rapin Place. The taxpayer
would be entitled to a refund of $5,895.49 for the first half of
the 2000-01 year. The 2000-01 City taxes would be reduced
from $16,311.48 to $4,520.50, A revised bill would he send
for the second half
Based upon a review of the current market value of the
property, I feel this settlement would be in the best interest of
the City. I therefore recommend this settlement, in -which the
Department of Law concurs. Please note that this property
was recently purchased for $50,000.
This proposed settlement is subject to approval by Your
Honorable Body. I hereby request that the Corporation
Counsel be authorized to settle the 2000-01 certiorari
proceeding on 102 Rapin Place by reducing the assessment
from $433,000 to $120,000.

On October 14, 1986 the Common Council passed
a local law adopting the provisions of Section 1903 of the
Real Property Tax Law (RPTL) relating to homestead and
non-homestead classifications. The local law took effect with
the 1987-88 fiscal year, following certification by the State
Board of Equalization and Assessment that the City of
Buffalo was an "approved assessing unit". Under the RPTL
one, two and three family units, farmhouses, some mobile
homes and some condominiums along with vacant
residential land less than 10 acres are considered
homestead parcels. All other parcels are classified as
non-homestead. The State of New York provides a detailed
property class code list describing a type of parcel and
assigning a universal three-digit code to that parcel type.
Codes beginning with 2, i.e., 210 (single family), 220 (two
family) and code 311 (vacant residential land) are in the
homestead group. Codes beginning with 4 or a higher
number are classed in the non homestead group along with
codes 330 and 340 that are commercial or industrial vacant
land, respectively.
Attached is a copy of a section from the State Property Class
Code Manual defining the Multiple Use or Mixed Use
parcels. The smaller commercial businesses with owners
residing on premises in living quarters in the back and/or
upstairs and generally found within the residential community
are for the most part included in the 482 classification.
However, by definition the 482 code also includes those
structures that are rented retail with non-owner occupied
offices or apartments in the rear or upper floors. Some
examples are: 220 Delaware, 6 Stories, South Cor
Chippewa; 280 Delaware, North Cor Johnson to Elmwood,

26,000 plus square feet; 496 Main, 4 Stories; 515 Main, 3
Stories; 716 Main at Tupper, 3 Stories, 86,000 plus square
feet. Also included in the 482 class are 251 Grider, retail
business; 1428 Fillmore, auto service, and 2152 Fillmore a
retail service property. By these few examples alone it is
evident that parcels can have the same 482 class code while
being considerably different in size and nature. These
classifications are utilized across the State for a wide range
of uses, for example exemptions.
The small commercial parcel in a residential area where
the owner resides on premises and which is classified as a
non-homestead 482 class code can be changed to a
homestead class by obtaining a change in use permit and
following the building code requirements to eliminate the
commercial space. If the owner follows this process and
meets all the requirements to change the use the state
coding system would allow a change in code to the
appropriate residential class and the parcel becomes
homestead. Any time a property owner inquires about
changing the class code we inform them of the change in
use process and direct them to the permit office. Without that
permit this office can not reclassify the property.
Over the course of the years the issue of converting from
non-homestead to homestead class the small
commercial/owner residing property, which are boarded or
otherwise not used commercially has been examined. One of
the obstacles mentioned relative to an owner's conversion of
the property to strictly residential has been the cost and work
involved in obtaining the permit and meeting the building
code requirements. A secondary issue may be a reluctance
to permanently surrender the commercial potential of this
type property.
One options might be pursue with the State a
differentiation of parcels based on owner's business and
residence in the same location, but this brings into the State
classification process the whole issue of residency and
proving residency when the State coding system is based on
use in general not specific use by certain parties. Out of
96,918 parcels currently assessed in the City, 2,455 are
classed as 482 but there is no current method to determine
how many are owner occupied. Besides the difficulty in
identifying these parcels it is highly unlikely the State would
support such a change to its coding process. A local option
may be to change the permit process, making it less onerous
and costly to change over to the residential classification
with the change in use permit process.

Drink Shields within
City right of way
Mr. Frank Parisi, owner of the SoHo Bar, located at 64
West Chippewa Street, has requested permission to install
drink shields which would encroach City right of way at said
address. Drink shields are made of metal mesh and attach to
the building at an angle along the first floor roofline in order
to prevent drinks or other objects dropped from the second
floor balcony from hitting pedestrians.
The Department of Public Works, Parks and Streets has
reviewed this request pursuant to Chapter 413-67
(Encroachment Regulations) of the City Ordinances and has
no objection to Your Honorable Body authorizing the

Mr. Herb Bellamy Sr., owner of the property located at
1490 Jefferson Avenue, has requested permission to install
a handicap ramp and planter within City right of way at said
address. The proposed handicap ramp would be located
adjacent to the north building face, extend approximately 5
feet into City right of way and measure 30 feet in length. The
proposed planter would be located adjacent to the same
wall, extend 4 feet into City right of way and measure 50 feet
in length. Approximately 9 feet of unobstructed public

Proposed Plaza Plan

The Department of Public Works has been asked by Your
Honorable Body to file a report concerning the objection
made by the Buffalo Preservation Board to the closing and
abandonment of the short portion of Niagara Street between
West Eagle Street and Franklin Street for the proposed
plaza for the new Erie County Court Building.
review of the Preservation Board's letter of July 31, 2000 to
the Erie County Department of Environment and Planning
confirms that the objection is based on the disruption to the
original street plan for the Village of New Amsterdam (later
Village of Buffalo) as proposed by Surveyor Joseph Ellicott,
General Agent for the Holland Land Company. A copy of that
plan is herein attached to this report.
It should be noted that one of the two main focus points of
Ellicott's plan was the intersection, later known as Shelton
Square, which no longer exists. It is also interesting to note
that the focal point in question was the semicircular intrusion

into Main Street (then known as Willinks Avenue and
Vanstaphorst Avenue) on which Ellicott intended to build his
mansion. The semi-cicular intrusion was rejected by the then
Village Fathers and in anger, Ellicott moved the Holland
Land Company headquarters to Batavia, New York.
Over the years, whether for better or worse, several parts of
Ellicott's street plan have been abandoned. Examples are:
Niagara Street from Pearl to Main for Main Place Mall;
Genesee Street from Franklin Street to Main for the
Convention Center and Hyatt Hotel; and Genesee Street
from Niagara Square to South Elmwood Avenue for the City
Court Parking Ramp. Regardless of whether these street
abandonments were good decisions at the time, the result
was the substantial alteration of Ellicott's plan.
In addition, it must be realized that the stair tower for the
building, now in construction, encroaches approximately ten
(10) feet into the dedicated right-of-way of Niagara Street.
Also, the approved entrance stairs and terrace will encroach
into the street right-of-way of Niagara Street. If the building is
completed without the requested plaza, it would be the
opinion of the Department of Public Works that from both an
aesthetic and safety standpoint, the structure will be far too
close to the street pavement of Niagara Street.

it may violate the equal protection clause by singling out a
specific type of property for different treatment. In addition, I
would point out that changing the structure of the property
tax system is the responsibility of New York State, not the
City. It would seem to me that your Honorable Body may
want to contact the state about this proposal. In particular,
you may want to investigate whether the STAR program
-which I believe applies to some owner-occupied small

Last, I would remind your Honorable Body that the citywide
revaluation currently underway will have the effect of
reducing all assessed values that are currently above
market. It would my position that the revaluation can be

property.

I would not support this idea for the following reasons:
1 .Property tax classifications and exemptions are set by the
State of New York; I do not believe that the City has the
ability to change them by itself.
2. I believe that the isolation of a single class of properties
for relief may be unconstitutional as it does not provide equal
protection.
3.Properties purchased at foreclosure have already been
significantly discounted in price; if they had substantial value
they would not need to be auctioned.
4.The assessment of a property purchased at auction would
be lowered to reflect whatever price was paid at the auction;
likewise, bidders would be aware as they decided whether or
not to bid that the bid price, if successful, would be the
assessed value as well.
5.Improvements to properties bought at auction would likely
only be made if they were economically wise-in other words,
if the cost of the improvement would yield an equal or
greater increase in the market value of the property. If they
create a higher market value for the property, they should be
reflected in the assessment.
6.Basing tax assessments on something other than market
value is an issue for the state .
Last, I would remind your Honorable Body that the citywide
revaluation currently underway will have the effect of
reducing all assessed values that are currently above
market. It would my position that the revaluation can be
significantly more helpful- within the tax policy as currently
set by the state--than changes based on a single
classification or process.

Buffalo Sewer Authority is not responsible for the design or
installation of house laterals. These homes were built under
the inspection of the Community Development Department
and the various city departments including plumbing,
electric, etc. Therefore, these departments should help
justify as to why the homes were built with this type of
connection.
Upon inspection it was noted that the clean outs and fresh
air vents are located in what appears to be the City "right of
way". It could not be determined as to how the lateral lines
run from the house to the vents. Everything looks good and
seems to be running properly.
I believe the answer as to where the lateral is located lies
with the Community Development and City of Buffalo
Plumbing Departments. If "as-builts" were kept they would
show how this pipe runs.
We are responsible for the connection to the main sewer and
the maintenance of the same. If any further information is
needed, please do not hesitate to contact me.

The BERC has formed a team to process the Empire Zone
Application. The team members met with the Grants
Committee August 17, 2000 to request assistance with
Office of Strategic Planning, Human Resource and Public
Works departments. The RFP's were announced August 9,
2000. The eligible/ineligible contracts were mailed July 21,
2000 to all councilmembers for review. Currently the letters
of requests has bee compiled to start the first draft of the
new proposed boundaries. Once a draft plan is formulated,
based o Common Council and business recommendations,
we will meet with the Common Council to establish
consensus application for submission to the State. The
deadline for submission is December 1, 2000.

Counsel's Office addressing the publication of public
hearings to include all ordinances, salary ordinance

Previously, the only hearings advertised were petitions to
rezone & use including the Mayor's Hearings on Local Laws.
I estimate that there are approximately 150 ordinances per
year and now including all salary ordinance amendments as
well as local laws, this number could climb to almost
250-300 per year.
During the Charter hearings, I tried to inform the
Commission of the budgetary restraints as well as the
redundancy involved in publishing a public hearing for both
the Council and the Mayor on the same Local Law. In
addition, previously most ordinances & permits were referred
to the Legislation Committee; however, with the additional
publication of salary ordinance amendments and all
ordinances, a separate advertisement and hearing will have
to be addressed to each and every committee where these
items are referred. Right now, lines per ad are running
$6.27-$6.52 per line and $150-$175 per ad.
Due to budgetary considerations, I would appreciate your
review of this requirement and its subsequent removal in
amending the Charter.

Dear Ms. Collin:
I am in receipt of your August 21, 2000 letter to Bob
Sullivan, CSX Director of Corporate Communication and
Public Affairs, regarding the installation of a sound barrier or
fencing along Young Street in the City of Buffalo.
Furthermore, that letter requests the presence of a
representative of CSX at a committee meeting on
September 12, 2000 to address committee concerns. It is my
hope that this letter will serve to address all issues.
First, thank you for your recent letter concerning the
installation of fencing along the CSX railroad right-of-way,
and our apologies for the delay in responding to this request.
While CSX is not opposed to fencing, we have found it to be
an ineffective and costly measure that has minimal impact in
preventing trespassing.
These fences by their very nature have gaps at every
roadway crossing and at every point where we serve a local
business. Trespassers can easily access the right-of-way at
these points. In fact, fences may trap the casual trespasser
on railroad property who entered at a gap but then is unable
to locate an exit point.
Based on our experience and observation, fences also are
easily breached by vandals. Inspection and maintenance of
fences have proven to be a very time consuming and costly
task.
Traditional types of fencing tend to be cut by vandals in a
very short period of time after erection, normally at the same
places that trespassers once used as crossing points,
defeating the purpose of the fence in the first place. The
costs of state-of-the-art security fencing (which cannot be
cut) is $100 per square foot, bringing the costs of fencing a
single mile of track on both sides to a height of 10 feet to
$10,560,000. CSX operates over 1,350 miles in New York
State alone, and 23,000 miles throughout our system, and
the costs of fencing significant portions of this track age
would obviously be prohibitive, even just within the City of
Buffalo alone.
in recent years, calls have been made for sound barriers
instead of fences, but such structures pose an extreme risk
to the safe operation of our trains. Engineers in operation of
our locomotives depend on lengthy sight lines to be able to
properly regulate speeds and braking distances. Such
barrier walls effectively eliminate the ability of our train
operators to see approaching vehicles at crossings or
potential trespassers along other portions of the right-of-way.
After a recent tragic incident in St. Louis, Missouri, the
Federal Railroad Administration noted "the experience of
previous instances in which fencing was used (as a deterrent
to trespassers) do bring into question its effectiveness as a

safety measure." The local police stated that "if you are
going to build a fence, it had better be a long one. They'll just
cross the tracks where the fence ends. It's human nature."
And the representative of the affected railroad observed that
their recent efforts at fencing showed 'the fence was cut or
dug beneath. We haven't found it to be a deterrent."
We at CSX fully understand the concerns articulated by the
Ms. Brown and the petition signers. We too would like
people - especially children - to cease their dangerous and
unlawful trespass on our tracks. To this end, we would be
more than willing to attempt to coordinate an appearance by
our "Operation Lifesaver" educational program in
neighborhood schools.
Finally, we are painfully aware of the tragedy that occurred
last year involving Ms. Bailey. We at CSX are as committed
to and concerned about safety of area residents, as well as
that of our employees. To this end, we further offer to
coordinate efforts between local and railroad police
departments to enhance enforcement of illegal trespass
through a cooperative effort, which have been successful in
reducing the problem in other areas.
In summary, we agree that trespassing is a very serious
safety problem and we want to work with you towards its
elimination. We have found that improved state trespass
laws and the aforementioned enhanced enforcement and
educational efforts are the most effective means of reducing
the problem. I welcome your assistance in this endeavor.

Dear Councilmember Gray:
The work has already started to change the Martin Luther
King, Jr. Park wading pool into a fish pond. We in the
community are totally against such a project. We have stated
our objections many times when the issue has come up over
the last 5-10 years. On Thursday, September 9, 2000,
contractors started this project without the Community's
awareness.
We want this project stopped immediately, the fish pond
will be negative and hazardous to our community. There
was no IMPACT STUDY, no ENVIRONMENTAL STUDY
as we are aware.

from homeowners and residents who are in objection to the

On behalf of the Langston Hughes Institute, I thank you for
your support in responding to an urgent need for capital
development funds. We are requesting $52,000 to address
critical renovation needs that are beyond the funding of our
current New York State renovations grant.
First phase renovations, at our 25 High Street location,
funded at $600,000 are currently underway. Because of the
limitations of this funding, and the extensive scope of work
necessitated by City of Buffalo fire safety and emergency
systems requirements, several aspects of the planned and

bid renovations work were deleted from the final grant
contract. This was necessary when the overall costs based
on bids received exceeded the grant amount.
The items dropped from phase one, but which were in the
original scope of work approved by the City Fire Marshall
included:
HVAC renovations to the existing heating system;

Studio/classrooms (new lighting and wiring);
and
Electronic handicap accessible door opener.
The timing of receiving the grant, its implementation, and
completion prior to the winter of 2000 made it necessary to
proceed by deleting the work referred to, and subsequently
seeking additional funds to complete phase one. Without the
requested funds within the next two months, we will be faced
with these impacts: lack of heat throughout the facility; lack
of lighting in a significant program area; and Finally, a
handicap entranceway that conforms to grade and size, but
which will be inadequate to allow for convenient entry to the
building by those who are wheel chair bound.
We are prepared to implement contracts to cover these
areas of renovation based upon receipt of funds. All
architectural and technical planning has been completed;
bidding of these items was conducted by the State Office of
General Services; and prospective contractors have
identified. Once funds are received we expect a seamless
transition which will bring these tasks to completion with the
other phase one work.

The Common Council of the City of
Buffalo, in the County of Erie, New York, hereby resolves (by
the favorable vote of not less than two-thirds of all the
members of said Common Council) as follows:
Section 1. The Comptroller of the City of
Buffalo, in the County of Erie, New York (the "City"), is
hereby authorized and directed to issue General
Improvement Bonds of the City in the principal amount of
One Million Dollars ($1,000,000), pursuant to the provisions
of the Charter of the City and the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the
State of New York (the "Law") to finance the cost of partial
reconstruction of the JFK Recreation Center located at 114
Hickory Street, to provide for handicapped access, air
conditioning and miscellaneous interior and exterior
renovation, including original furnishings, equipment,
machinery or apparatus required for the purposes for which
such building is used. The estimated maximum cost of said
class of objects or purposes for which the bonds authorized
by this Bond Resolution are to be issued, including
preliminary costs and costs incidental thereto and the
financing thereof, is $1,000,000, as set forth in the duly
adopted Capital Improvements Budget of the City for fiscal
year 2000-01, as amended.
Section 2. The proceeds of the sale of
the bonds authorized by this Bond Resolution, or any bond
anticipation notes issued in anticipation of the sale of said
bonds, shall be deposited in the Capital Projects Fund to the
credit of the Department of Public Works, Division of
Buildings, "JFK Recreation Center Reconstruction, 2000-01",
Bond Authorization Account No. 3000-32, and shall be used
for the class of objects or purposes specified in Section I of
this Bond Resolution.
Section 3. The City intends to finance,
on an interim basis, the costs or a portion of the costs of said
improvements for which bonds are herein authorized, which
costs are reasonably expected to be incurred by the City,
pursuant to this Bond Resolution, in the maximum amount of
$1,000,000. This Bond Resolution is a declaration of Official
Intent adopted pursuant to the requirements of Treasury

Section 4. The following additional
matters are hereby determined and
stated:
(a) The existing building is of Class "A" construction as
defined by Section 11.00 a. 11. (a) of the Law, and the

Bond Resolution are to be issued within the limitations of
Section 11.00 a. 11(a)(1) of the Law, is twenty (20) years.
(b) Current funds are not required by the
Law to be provided as a down payment prior to the issuance

accordance with Section 107.00 d. 9. of the Law.
Section 5. Each of the bonds authorized

prescribed by Section 52.00 of the Law. Said bonds and said
notes shall be general obligations of the City payable as to

irrevocably pledged for the punctual payment of the principal
of and interest on said bonds and said notes. Provision shall
be made annually by appropriation by the City for the
payment of interest on and for the amounts required for the
amortization and redemption of said bonds and said notes.

contested only if:
(a) such obligations are authorized for
an object or purpose for which the City is not authorized to
expend money, or
(b) the provisions of law which should

Section 1. The Comptroller of the City of
Buffalo, in the County of Erie, New York (the "City"), is
hereby authorized and directed to issue General
Improvement Bonds of the City in the principal amount of
Three Million Dollars ($3,000,000), pursuant to the
provisions of the Charter of the City and the Local Finance
Law, constituting Chapter 33-a of the Consolidated Laws of
the State of New York (the "Law") to finance the cost of
demolishing numerous buildings or structures acquired by
the City of Buffalo through tax foreclosure sales which are no
longer of any use or value or have become dangerous or
detrimental to human life, health or safety. The estimated
maximum cost of said class of objects or purposes for which
the bonds authorized by this Bond Resolution are to be
issued, including preliminary costs and costs incidental
thereto and the financing thereof, is $3,000,000, as set forth
in the duly adopted Capital Improvements Budget of the City
for fiscal year 2000-01, as amended.
Section 2. The proceeds of the sale of
the bonds authorized by this Bond Resolution, or any bond
anticipation notes issued in anticipation of the sale of said
bonds, shall be deposited in the Capital Projects Fund to the
credit of the Department of Permit and Inspection, Division of
Housing and Inspections, "Neighborhood
Redevelopment/Clearance Activities, 2000-01", Bond

Authorization Account No. 3000-65, and shall be used for
the class of objects or purposes specified in Section I of this
Bond Resolution.
Section 3. The City intends to finance,
on an interim basis, the costs or a portion of the costs of said
improvements for which bonds are herein authorized, which
costs are reasonably expected to be incurred by the City,
pursuant to this Bond Resolution, in the maximum amount of
$3,000,000. This Bond Resolution is a declaration of Official
Intent adopted pursuant to the requirements of Treasury
Regulation Section 1. 150-2.
Section 4. The following additional
matters are hereby determined and
stated:
(a) The period of probable usefulness
applicable to the class of objects or purposes for which the
bonds authorized by this Bond Resolution are to be issued
within the limitations of Section 11.00 a. 12-a of the Law, is
ten (10) years.
(b) Current funds are not required by the
Law to be provided as a down payment prior to the issuance
of the bonds authorized by this Bond Resolution or any bond
anticipation notes issued in anticipation thereof in
accordance with Section 107.00 d. 9. of the Law.
Section 5. Each of the bonds authorized
by this Bond Resolution and any bond anticipation notes
issued in anticipation of the sale of said bonds and the
renewals of said notes shall contain the recital of validity
prescribed by Section 52.00 of the Law. Said bonds and said
notes shall be general obligations of the City payable as to
both principal and interest by a general tax upon all the
taxable real property within the City without limitation as to
rate or amount. The faith and credit of the City are hereby
irrevocably pledged for the punctual payment of the principal
of and interest on said bonds and said notes. Provision shall
be made annually by appropriation by the City for the
payment of interest on and for the amounts required for the
amortization and redemption of said bonds and said notes.
Section 6. The validity of the bonds

contained in this article shall prevent a municipality from

"Drums Along the Waterfront" took place at Dunn Tire Park;

Whereas: Drums Along the Waterfront, A Drum Corps
International-sanctioned youth activity, is an event that has
been held at Dunn Tire Park for the past four years; and
Whereas: These events have a positive economic and
educational impact on the City of Buffalo, specifically
downtown Buffalo, as a large percentage of the
competitors and their supporters spend their time and money
in the city; and
Whereas: This Honorable Body per CCP 171, February 22,
2000 approved the Waiver of the 5% ticket surcharge by
Dunn Tire Park for Grace Events and the Drum Corps.
International, Inc. for the Drums Along the
Waterfront event held on August 6, 2000; and
Whereas: For the first time since the events inception in
1997, this years edition took place following a Bison
Baseball game and was billed as a "Bison Event";
and
Whereas: There was a separate ticketing/accounting
system in place for the two events held on that day, which
clearly distinguished the difference between Bison patrons
and Drums Along the Waterfront patrons. Wherein Bison
patrons paid the Bison's ticket prices and Drums Along the
Waterfront paid the "Drums" ticket prices; and
Whereas: The Bison's have allowed for the waiving of the
5% ticket surcharge as authorized to Drums Along the
Waterfront by the City of Buffalo.
However, the Bison's are withholding 6.5% of "Drums" ticket
revenue based on the Bison's lease agreement with the City,
which calls for a 12% surcharge on tickets sold for Bison's
Events; and
Whereas: These moneys are being withheld by the Bison's
due to their concern that at a later date, the Bison's may be

EXTEND BANNER DISPLAY
Whereas: At the Common Council meeting of September 8,
1998, the Council approved Resolution 4277, "Display
Banner for Buffalo Ensemble Theatre"; and
Whereas: The Buffalo Ensemble Theatre is asking that they
be allowed to continue to display a banner across South
Elmwood Avenue at the intersection of North Johnson Park
announcing its upcoming season, October, 2000, through
October, 2001; and
Whereas: Buffalo Ensemble Theatre will seek to change the
way the banner is placed only in that it will remain
permanently fixed during the season, with a smaller banner
on either side announcing actual shows and sponsors being
changed as necessary; no change in cable placement will be
needed to accomplish this; and
Whereas: Buffalo Ensemble Theatre assures the Council
that they will continue to maintain the banners, and no
incidents of damage or any other problems resulting from the
placement of the banner has occurred over the past several
years; and
Now, Therefore, Be It Resolved:
That the Common Council grants permission to the Buffalo
Ensemble Theatre to extend the length of time in displaying
their current banner across Elmwood Avenue at the
intersection of North Johnson Park from October, 2000
Through October, 2001 with the only change being a smaller
banner on either side announcing shows and sponsors and
Be it further Resolved:
Buffalo Ensemble Theatre will continue to acquire an insurer
and maintain the banners; and
Be it Finally Resolved:

CENTRALIZED CITIZEN INFORMATION AND REFERRAL
SYSTEM
Whereas: On July 1, 2000 the revised Charter of the City of
Buffalo created an office in the Executive Department to
develop and operate a centralized computer-based
referral system for citizens complaints and requests for
service; and
Whereas: The system was designed to be capable of
providing a written acknowledgment to the inquiring citizen
within three days of receipt of the inquiry, and provide a
monthly report for each appropriate Council Member and the
Mayor, in addition to referring each inquiry to the appropriate
department or agency; and
Whereas: This is an attempt to coordinate the Mayor's
Hotline, the Mayor's Office, all of the various Departmental
complaint lines, and numerous constituent calls to
Councilmembers so that citizens receive an immediate
written response that their call will be investigated by the
appropriate department within a timely manner;
and

Whereas: To date, no reports have been generated for use
by the Administration and District Councilmembers, that may
illustrate trends in complaints for certain areas, to alert
the Administrative and Legislative bodies to respond in a
broader sense; and
Whereas: At the meeting held on Friday September 15,
2000 by Citizens Services, numerous concerns were
expressed by Council staff personnel regarding
insufficient tracking methods, lack of Council recognition in
the written response to constituents, unresolved concerns
pertaining to complaints more than a year old, etc.; and
Now, Therefore, Be It Resolved:
That the Common Council request a Review and Analysis
Report from the
Administration assuring the process of resolution for
multi-district and city-wide Citizen concerns are being
addressed. The report should reflect the time period
July 1, 2000 through September 15, 2000; and
Be It Further Resolved:
That this Honorable Body requests that the Administrative
Department acknowledge the importance of providing the
aforementioned report for review at the Tuesday October 3,
2000 Council Session.
