Interfund Loan
Over the last six years, the City has provided interfund
loans from the City General Fund to The City, Board and
Enterprise Capital Projects Funds to implement financing of
the Capital Improvements Budget. The interfund loans are
repaid when the Bond Anticipation Notes or Bonds are
issued to finance these projects. As of today, we have one
request for money to finance projects and we will not reenter
the bond market at this time. We are requesting that you
approve an interfund cash loan from the General Fund to the
City's Capital Projects Fund in the amount of $1,500,000
against the 1999-2000 Capital Improvement Budget for
Waterfront Redevelopment 00-01 (Webster Block). The loan
will be repaid when Bond Anticipation Notes or Bonds are
issued.

Pursuant to the City's Capital Budget/Debt Management
Policy, the City expects to issue bonds in the amount of
about $23,000,000 for City Projects during the Fiscal Year
2000/2001. Currently, there are eleven (11) City Projects
with outstanding interfund loans totaling $6,252,500*, not
including this project. There is currently $4,350,000 of
interfund loan requests awaiting approval, including the
request listed herein. Should all pending requests be
approved, future projects that can be interfund loaned or
included in the 2000/2001 debt issue will be limited to
$12,397,500.
Please be advised that once an interfund loan has been
approved, the City is committed to the total cost of the
project regardless of the amount advanced. Attached is a
listing of the outstanding interfund loans both requested and
approved by Council.

the Comptroller dated November 28, 2000, be received and
filed; and
That the Comptroller be, and he hereby is authorized to
make an interfund cash loan from the General Fund to the
City's Capital Projects Fund in the amount of $1 ~, 500,000
against the 1999-2000 Capital Improvement Budget for
Waterfront Redevelopment 00-01 (Webster Block). The loan
will be repaid when Bond Anticipation Notes or Bonds are
issued.

to open bids for the demolition of the rear of the existing
Community Center at Hennepin Park on Friday, December
first, 2000. A total of $130,000 has already been loaned
against this account for project design, thus, this project is
already on the active list for bonds to be sold in the next
bond sale.

Charter, that increases in the sums of $643.90 and $555.17
in the estimates for the fiscal year beginning July 1, 2000

Meals & Lodging to meet a contingency which could not
have been reasonably foreseen when the budget was

The above item was referred to this office for a report. I
submit the attached report prepared by Bruna Michaux,
Senior Tax Administrator in the Department of Assessment
and Taxation as a response.
In response to Leonard R. Sciolino's letter to
Councilmember Dominic J. Bonifacio, Jr., first I investigated
his complaint and upon examination of the tax and
assessment records, it has been determined that the small
portion of land assessed as 9999 Brayton and assessed to
Leonard R. Sciolino was not combined with the parcel
assessed as 105 Brayton. Mr. Sciolino states in his
communication that he requested the parcel known as 9999
Brayton be combined with the building he owned "located at
105 Brayton Street." According to our tax records, 105
Brayton, a three-family dwelling, is assessed to Kevin M.
Sciolino and all tax bills are requested and mailed to
National City Mortgage Corp., Murray, Utah.
Second, I spoke to the Assessor regarding Mr. Sciolino's
request to combine the properties in question and, according
to the Assessor, she did not receive nor was she aware of
such request.
Third, with regard to Mr. Sciolino's failure to receive "any tax
bills" for 9999 Brayton, review of the computer records and
files in our office and the Real Property Transfer report filed
with the Erie County Clerk's Office, show that all notices and
tax bills, a total of twelve (12), were mailed to Leonard R.
Sciolino, 105 Brayton, Buffalo, New York, 14213 (see
attached). Our research indicates that neither the notices
nor the tax bills were returned by the Postal Department as
being undeliverable,
However, the Department of Assessment and Taxation
instituted a mail change on June 1, 2000 on our computer
system after we had received a signed request to forward
future bills for 9999 Brayton to 101 Dorchester. As a point of

information, Section 158 of the City Charter requires owners
to file his her name, address (not post office box) with this
office in writing.
Further, on January 12, 2000, the Department of
Assessment and Taxation requested the assistance of the
District Council Members, the at-Large Councilmembers and
the Council President for help in making the owners of
property in their respective districts aware of the pending
foreclosure sale and foreclosure fee to be levied effective
February, 2001. The property was auctioned on October 23,
2000, but since there were no bids, the property remains in
Leonard R. Sciolino's name. In conclusion, the New York
Real Property Tax Law, Section 1102, States that "charges
shall be deemed a part of the delinquent tax for the purpose
of redemption." The term, "charges," includes the $425.00
foreclosure fee. Further, Section 922 of the Real Property
Tax Law reads, "The failure to mail any such statement, or
the failure of any such owner to receive the same, shall not
in any way affect the validity of the taxes or interest
prescribed by Law." Therefore, the $425.00 foreclosure fee
and interest is a valid charge and to waive it is in violation of
the Real Property Tax Law and the Constitution of the State
of New York.

another. In an attempt to bring these properties into
compliance with the Housing Code, a Housing Court Case

was heard by Housing Court Judge Diane Devlin. As it is
impossible for our inspection staff to certify which building is
listing more that the other, and taking into consideration that
his is not an emergency situation. the Housing Court Case
has been dismissed Both property owners were advised that
this is a civil matter and the Department of Permit and
Inspection Services will not be involved unless a Building
Permit is issued for any repair work done in the future. It is

This letter comes at the direction of the Law Office of the
City of Buffalo. We are in the process of filing a legal claim
against the city for damage to our vehicle.
On September 8, 2000 our vehicle, a 1993 Dodge Spirit,
sustained serious damage after striking a raised manhole on
Hanover Street at the intersection of Main Street
approximately 6 feet past the Rapid Transit tracks in the City
of Buffalo.
We are requesting information regarding the unsafe

described location. We have been advised that written
documentation must exist and have been filed with the City
clerks office prior to the incident of September 8, 2000.

A. BARNES PROBLEM GARBAGE PICK UP DELAVAN
GRIDER AREA
Gentlemen, we have a very serious problem with
the garbage pick-up in the Delavan-Grider area. The
residents of the Delavan-Grider area are respectively putting
their garbage out on the curb on Monday evenings, ready for
pick-up Tuesday morning. The problem that we are having is
that the garbage trucks do not pick-up any garbage until late
Tuesday evening. This is causing a tremendous problem in
our area because of the large crow population in search of
food and garbage. They are tearing the bags open 9 and in
result there is garbage all over the street. Our concerns are-
why is the garbage being picked-up so late? and why are
they not picking-up all of the garbage?
The garbage men are searching the bags, picking up some
bags and leaving others, They will not pick-up the bags of
leaves that are left on the curbs. We the Delavan-Grider
Block Club Council would like our councilman to help us
solve this matter.

through which the community may impact the proposed
Peace Bridge expansion. Your committee's dedication to tile
precept of public participation has been invaluable to the
real progress made oil improving this important proposed
project. Now that we are at the starting gate, tile public owes
its opportunity to voice its concerns to you and to your
committee. Many thanks.
Among the questions which ought be examined in the
environmental impact study proposed by the PBA are those
affecting the impact on the local economy, Impact on the
local environmental and impact on public use of greenspace
and park lands. Specifically, the following questions ought
be considered in any environmental review for this project'.
1.Which bridge/plaza combination will best benefit the
immediately Impacted area in terms of business
development, economic rejuvenation and local employment
2.Which bridge/plaza combination will best serve as a
gateway entrance to downtown and to the city of Buffalo?
3.Which bridge/plaza combination will best allow for the
mitigation of pollution to tile surrounding neighborhoods?
4.Which bridge/plaza combination will best enhance public
access to, and encourage regional use of, our waterfront
park system?
Careful consideration of these issues will help to ensure the
selection of the most beneficial bridge/plaza system for
Buffalo's international border crossing. Your inclusion of

PEACE BRIDGE AUTHORITY BEGINS
BI-NATIONAL INTEGRATED ENVIRONMENTAL
PROCESS
BUFFALO, NY FORT ERIE, ONTARIO -- The Buffalo and
Fort Erie Public Bridge Authority (Peace Bridge Authority)
announced today it has begun a BI-national integrated
environmental process that combines the proposed actions
involving bridge capacity expansion, U.S. Plaza
modernization and connecting roads, into a BI-national
integrated process leading to a BI-national solution to relieve
existing congestion.
According to Peace Bridge Authority Chainnan Victor A.
Martucci, the environmental planning process has already
begun. "The Authority's Bi-national Board of Directors has
decided that the quickest and most productive path to
expand capacity and relieve congestion is to comply with
Judge Fahey's ruling," said Martucci. "I want to say clearly
that the Authority is committed to a process that is open and
inclusive and whereby every practical option will be given a
full and thorough review."
"The Peace Bridge Authority cannot go it alone," said John
A. Lopinski, Peace Bridge Authority Vice Chairman.
"Additional Peace Bridge capacity cannot be achieved
without the direct and proactive involvement of the public,
the City of Buffalo, Town of Fort Erie, elected officials, other
jurisdictions, agencies and interested groups," said Lopinski.
"Because the City of Buffalo has discretion over City rights
of way, they have the responsibility to meaningfully
participate in the process."
The Peace Bridge is one of the most important international
transportation and trade links between Canada and the
United States. The Authority has the responsibility for
providing a safe and efficient means of transport of people
and goods over its facilities connecting these international
road systems.
"The Authority has been working over the past several
months to determine how best to proceed," said Martucci.
"Many meetings have been held with Canadian and U.S.
officials, permitting agencies, legal representatives and
community leaders to assess possible paths to a resolution.
As a board with bi-national responsibilities, we have actively
investigated every scenario that would lead to a positive
resolution of this issue."
The Authority will develop this bi-national integrated
environmental process In compliance with all applicable
United States, New York State, City of Buffalo, Town of Fort
Erie, and Canadian Federal and Provincial, laws and
regulations, including but not limited to the Canadian
Environmental Assessment Act (CEAA), National
Environmental Policy Act (NEPA), the New York State
Enviromental Quality Review Act (SEQRA), and the City of
Buffalo Environmental Review Ordinance (CERO).

The Authority's proposed approach is to forge through
cooperative action, initiatives and outreach the following: 1.
A partnering relationship between the Authority, the City of
Buffalo and Town of Fort Erie to:
foster proactive participation and cooperation of the City

and Town,
assure that local needs and local objectives are defined
early in the process,
develop an initial list of practical project alternatives as part
of a scoping process based on achieving the project
objectives,
evaluate alternatives and related environmental impacts,
undertake progress reviews at key milestones,
ensure that the interests, roles and responsibilities of the
City, Town and Authority are respected and fulfilled,
find and define a project solution that is acceptable to the
Town of Fort Erie, City of Buffalo, the public and the
Authority.
2. In conjunction with the partnering relationship, the
Authority expects that the City of Buffalo will actively
participate as the responsible lead agency for CERO. The
Department of Public Works (DPW) as representatives of
the Masiello Administration and the Buffalo Common
Council would share this responsibility.
3. Implementation of a Public Involvement Plan to facilitate,
promote, and achieve public access to information
throughout the bi-national integrated environmental process.
The Authority suggests that committees, focus groups and
special interest groups be organized to facilitate that
information flow. (Attachment 3)
Objectives for a proposed public involvement plan would be
to:
1. Effectively involve the public in the bi-national integrated
environmental process to address broad, regional and
local needs relating to transportation, economic
development and quality-of-life issues.
2. . Consider specific local and neighborhood needs and
environmental issues in specific geographic areas that
may be impacted by alternatives being considered in
the environmental studies as part of the scoping
process.
3. Provide a convenient and effective mechanism to serve
as a public sounding board to provide feedback and
recommendations to the project team for mitigating
and/or solving problems related to project findings and
alternatives being considered. 4. Build consensus in
the development of a preferred alternative. 5. Foster
understanding for why the preferred alternative is
selected.
With respect to outstanding legal issues, the Authority will
not appeal Judge Fahey's decision. Furthermore, the
Authority has written to all permitting agencies requesting
withdrawal of all approved pen-nits for the companion span
bridge. It is anticipated that the decision of the Authority to
proceed as outlined above would be the basis for resolution
of the complaint by the Buffalo West Side Environmental
Defense Fund, Inc.

On November 8, 2000 the City Planning Boar voted to
deny the site plan presented for the new Linwood Church of
Christ at 2523 Main Street i9n Buffalo, NY.
I am writing to request an appeal of this decision, and ask
the Buffalo Common Council to approve this project.
The reason for the dental is based on the area requirements
of the Transit Station Zoning District which requires no more
than one square foot of parking per one square foot of
building area. Although we exceed this requirement, we
comply with all other requirements (if the Transit Station
District Zoning.

I am asking that the Common Council, to the extent that it is
within its purview, investigate the state of Community
Development where it intersects with the development of the
Arts and Culture Community of
Buffalo. I am concerned with the lack of development that
addresses the specific needs of people of color, children,
seniors, and the handicapped, to participate in the
production of art, specifically theatre.
I am asking that the Common Council investigate the
handling, processing, and disposal of U11ma Company,
Inc.'s proposal for the use of the Asbury Delaware Church
as submitted to the Honorable Mayor Anthony Masiello and
Commissioner of Community Development. Joseph Ryan. I
am suggesting that the Council may find significant clues
therein and a prime example of the way in which proposals
for projects that benefit the above mentioned populations
are handled,
Please do not refer me to someone else, I am asking
Council members to take on this charge. I welcome
conversation with individual members and any opportunity to
further explain my concerns.

PROSTITUTION TASK FORCE
REACTIVATION OF OPERATION JOHNNY
I am writing on behalf of the Prostitution Task Force in
support of Buffalo Police Commissioner Rocco Diina's
recent request for assistance from the New York State
Police in reviving "Operation Johnny." As you may know the
Prostitution Task Force has been in existence for over six
years, and has been active in advancing both government
and private efforts to stem street prostitution in the city of
Buffalo. The Task Force is made up of law enforcement
personnel, government officials and neighborhood activists.
All are in agreement that street prostitution has contributed
to the rapid deterioration of several Buffalo neighborhoods.
From 1996 through 1999 the Buffalo Police Department has
accommodated the requests of the Task Force in arresting
"Johns" as well as prostitutes. "Johns" were arrested by
placing undercover female officers on the streets posing as
prostitutes. This was nicknamed "Operation Johnny", and
has been an overwhelming success. This year, however, the
use of under-cover female decoys for "Operation Johnny"
was curtailed, then finally halted. Commissioner Diina has
continued his support for the program, but has been
hindered in his efforts to detail new under-cover officers to
"Operation Johnny. It is our understanding that the police
union has effectively halted the operation through its position
that the use of such under-cover officers violates union
policy.
It is the position of the Task Force that cessation of
"Operation Johnny" at the present time is unacceptable.
Public health and quality of life concerns are paramount.
Furthermore, a fairness criticism has been leveled at the
Buffalo Police for arresting prostitutes while allowing "Johns"
to go virtually unchallenged.
Over the past several months we have met with
Commissioner Diina and his representatives on numerous
occasions. We have asked him to work with other police
agencies, if necessary, in order to revive the operation in
question. We believe that this is in the best interests of the
community. Therefore, we stand behind the Commissioner's
decision to invite the New York State Police to provide
under-cover officers for "Operation Johnny."

Whereas: Three years ago there was an agreement reached
between the Common Council and the Administration to
build a field house in Glenny Park to be used for little league
football, summer league youth basketball, a soccer league,
and a Sunday men's softball league; and
Whereas: The Glenny Park Field House was to be built in

similar fashion to the O'Kell Field House. The Masten
District office secured $150,000 in Capital Bond money to
get the project started. Through the Block Grant Program,
former CounciI member- at-Large Barbara Kavanaugh left
an additional $11,000 towards the project; and
Whereas: These funds were set aside in the Department of
Community Development budget to provide the necessary
funding to start and complete the Glenny Park Field House;
and
Whereas: Representatives and parents of the Inner City
Little Loop Football League and the Trinidad Neighborhood
Association, which helped jumpstart this project, want
assurances that the City of Buffalo will honor its commitment
and build the Glenny Park Field House; and
Whereas: Recently, the Department of Public Works, Parks
and Streets informed this Common Council that the money
that was set aside for this project is gone;

Request to New York State for Removal of Reverter in
Delavan Armory Deed
Whereas: The City of Buffalo is currently the owner of the
former Delavan Armory property located at 1001 West
Delavan Avenue, Buffalo, NY ("Property"), hailing acquired
the Property in a grant of Letters Patent from the People of
the State of New York to the City of Buffalo dated December
20, 1996 ("Letters Patent") anti recorded at
the Department of State on December 31, 1996 in Book of
Patents 99 at page 74.
Whereas: The Letters Patent contained a reverter clause
that provides as follows: "This grant is made and accepted
upon the condition that said premises shall be improved and
maintained for municipal purposes. In the event that said
premises are not improved and maintained for said
purposes, the title hereby conveyed shall revert to the
People of the State of New York and the Attorney general
may institute an action in the Supreme Court for a
judgement declaring a revesting of such title in the state."
Whereas: By resolution of the Common Council passed on
July 11, 2000, the City has agreed to sell the Property to the
Buffalo Urban Renewal Agency ("BURA") to facilitate the
acquisition of the Property by Canisius College on the
condition that the City is provided recoupment of its costs for
environmental investigations, remediation and demolition of
structures on site. By resolution of its Board of
Directors dated November 9, 2000, BURA has agreed to sell
the Property to Canisius and provide the City with
recoupment of its costs.
Whereas: Canisius intends to redevelop the Property by
investing $15.5 million in the construction of a 325 bed

student residence on the site, which redevelopment will
have significant economic impact on the surrounding
neighborhood.
Whereas: The acquisition of the Property by Canisius will
not be for municipal purposes and for that reason, it is
necessary that reverter clause contained in the Letters
Patent be canceled.

That the Buffalo Urban Renewal Agency be and it hereby is
authorized to transfer title to the former Delavan Armory to
Canisius College; and

northerly and along the easterly line of Main Street thirty-one
(3 1.0) feet to a point;

of Main Street one hundred twenty-four and seventy-five

Urge Governor Pataki to Grant Buffalo's Request for a
Second Empire Zone
URGE GOV. PATAKI TO GRANT BUFFALO'S REQUEST
FOR A SECOND EMPIRE ZONE
Whereas: The New York State Empire Zone (EZ) program,
which was created in 1987 as the Economic Development
Zone program, encourages business development in
designated areas by offering targeted incentives and
benefits to new and expanding businesses; and
Whereas: Companies that move to or expand in EZ's are
eligible for wage and investment tax credits, sales tax
refunds, financing assistance, and utility discounts; and
Whereas: Existing EZ's are limited to two square miles and
Buffalo has shifted and reshifted its EZ boundaries to
maximize its EZ space in support of local businesses; and
Whereas: Buffalo, the State's second largest city, with a
"job engine , that is ranked 14th out of the State's 15
metropolitan areas, has only one Empire Zone - the same
capacity as several much smaller municipalities; and
Whereas: Buffalo's industrial and commercial companies
are spread out widely over a 40 square mile area, and the
effect of Buffalo's 2 square mile EZ is far more diluted here
than most of New York's EZ's, which are in far smaller
communities; and
Whereas: In May of 2000, Governor George Pataki signed
legislation that authorized the designation of 6 new Empire
Zones; and
Whereas: With Item # 108, C.C.P. 11/14/00 - "NYS Zone
Application", this Council unanimously endorsed the City of
Buffalo's application for a new 1,280 acre Empire Zone; and
Whereas: This application is the result of a comprehensive
process and it represents a consensus among City
lawmakers; and
Whereas: There is some speculation that the Buffalo area
economy is finally turning the corner and expanded EZ
capacity may provide the immediate boost that is needed to

put the recovery in full gear;
Now, Therefore, Be It Resolved That:
This Common Council urges Governor George E. Pataki
and the Empire State Development Corporation to recognize
Buffalo's importance as the second largest city in New York
State, and to grant Buffalo's request for a second Empire
Zone.; and
Be It Further Resolved That:
The City Clerk be directed to send certified copies of this
resolution to Governor George E. Pataki, to Hon. Sheldon
Silver, Speaker of the Assembly, to Hon. Joseph Bruno,
Senate Majority Leader, to the members of the Western
New York State Legislature delegation, and to Charles A.
Gargano, Chairman of the Empire State Development
Corporation.

Whereas: The mudpies children's museum boasts a
substantial collection of artifacts and objects which are used
to convey concepts and encourage the development of
critical thinking skills to the youth of the City of Buffalo;
Whereas: Over 17,000 children have enjoyed the mudpies
leaming experience this year through a traveling "museum

without walls" exhibit; and
Whereas: In order to provide a permanent venue for its
exhibits, the mudpies children's museum has secured a site
at 173 Elm Street, near Michigan Avenue. This permanent
site, with its 17,000 square feet of exhibit space, will allow
the museum to offer permanent displays and the potential of
attracting up to 100,000 visitors annually; and
Whereas: The mudpies children's museum is an essential
and valuable asset to the Western New York Community;
and
Whereas: Conversion of the former warehouse at 173 Elm
Street into a children's museum is a monumental task that
requires various change of use approvals by the City of
Buffalo;
Now, Therefore, Be It Resolved:
That this Common Council waives all change of use and
permit fees associated with converting 173 Elm Street from
warehouse space to the mudples children's museum.
