APPT. COMMITTEE ON CITIZEN RIGHTS
Pursuant to Article 18, Section 18-21 of the Charter of the City of
Buffalo, I am proud to nominate, for confirmation by your Honorable
Body, Adrian Rodriguez to the Commission on Citizens Rights and
Community Relations. Mr. Rodriguez of 578 Niagara Street, Buffalo
14201 will fill the unexpended term of Dr. Joseph S. DeJames
Maldonado who resigned from the Commission for an employment
opportunity in the Virgin Islands.
Mr. Rodriguez is currently a Welfare-to Work Case Manager for
Greater Buffalo Works (Private Industry Council), and the President of
the Board of Los Tainos Senior Citizens Center. Mr. Rodriguez
formerly worked for the Buffalo Area Council on Alcoholism.
In addition, Mr. Rodriguez is very active in community endeavors as a
Member of the NYS Judicial Commission on Minorities - Eighth
Judicial District, President of the Hispanic Coalition of WNY, and an
organizer for both the March Against Drugs and the Hispanic AIDS
Candlelight Walk.
I have confidence in the abilities of Mr. Rodriguez and I feel that he
brings a wealth of experience, sensitivity, and perspective to this
Commission to assist in promoting better relations in the City of
Buffalo.

2001-2002 Recommended CDBG Budget
I hereby submit my recommendations for the City of Buffalo
2001-2002 Community Development Block Grant Budget of
$29,309,000, which includes HOME, ESG & HOPWA.
In preparing the budget, my staff and the leadership of the Common
Council met, in the spirit of cooperation, to resolve many of the
difficulties that have delayed previous submissions and final
agreements. As you review the attached document, please note many
of the changes that I have accepted from the Council leadership.
As you are aware, we will be releasing the final draft of the city's
citywide comprehensive plan within the next few months for review,
comment and critique by citizens and special *interest groups
throughout the city. Concurrently, we will be receiving a breakout of
the census data for the City of Buffalo. This Information and the
community process that will be ongoing will play a significant role in
helping us define our priorities for the future.
Consequently, I have asked the Office of Strategic Planning and the
Buffalo Economic Renaissance Corporation to meet frequently with
the Common Council's Community Development Committee to ensure
that the knowledge is shared and that the 2002-2003 submission will
recognize and reflect these changes.
I look forward to resolving any differences that may remain in the next
30 days. This will allow us to submit the Consolidated Plan to the
Department of Housing & Urban Development 'in a timely manner and
provide all of the agencies, we will be funding, with money to continue
their programs.

MONTHLY REPORT FROM THE DIVISION OF CITIZEN SERVICES
(MAYOR'S COMPLAINT HOT LINES)

Attached is the monthly activity report fi7om the Division of Citizen
Services, as well as, six month compilation report.
During this initial evolutionary period, it has become apparent that
seasonal condition! affect the types of calls that the hot line receives.

Subsequently, I have included new complaint categories, such as:
snow, recycle abandoned cars, and totes.
Also, this report still continues a sizeable category of "other or misc.",
which represent, about 18% of the complaint calls that we have
received. This 18% is spread amongst 50 to 6( categories, which can
now be accessed through the STS systems in each council office.
Garbage complaints are being addressed within 24 hours, as well as,
a herculean effort to address plowing complaints.
Also, there has been a significant decrease in recorded housing
complaints, over 50%, as the service agents are now able to access
inspection records and give immediate feed back to callers.
As always, I am available to discuss the information in this report and
the excellent cooperation that I am receiving from all city departments
in addressing complaints referred to them.

Tim Hortons, Taco Bell, 3470 Main Street
The City Planning Board at its regular meeting held January 2, 2001
considered the matter captioned above pursuant to Section 511-137 of
the Buffalo Code-City Wide Site Plan Review.
The City Planning Board voted to deny as presented the site plan;
dated, October 3, 2000 for the construction of a 1,929 sq. ft. Tim
Hortons and a 2,432 sq. ft. Taco Bell located at 3470 Main Street at
Capen Blvd Buffalo New York. This site plan did not meet the TS
zoning requirement that requires both a 0 set back and a 1: 1
minimum floor area ratio of one square foot of floor area for each
square foot of lot area. If the Common Council overturns this denial,
the Planning Board would highly recommend the following changes to
the most current site plan: dumpster pick up only between the hours of
7:OOA.M. and 7:OOP.M., eyebrow shape over the front entrance of
Taco Bell in keeping with the theme set by Tim Hortons, 3 V2 ft. tall
privet hedge along Main St and Capen Blvd, pedestrian walkway (to
Tim Hortons) to be added south of the Main St. vehicle entrance
complimenting the Taco Bell walkway. The Planning Board is also
requesting that they approve all signage as part of this site plan
review, when it is presented at a future meeting.
Benderson Development has worked hard to develop this site to meet
both the City of Buffalo TS zoning requirements and the corporate
requirements of both Tim Hortons and Taco Bell. In light of the above,
the City of Buffalo Planning board encourages approval of the current
site plan and elevations presented to the Planning Board. This letter is
not a building permit. It is the responsibility of the owner to see that all
required permits are issued prior to commencement of the actual
work.

That the Common Council does hereby overturn the denial of the City
Planning Board for the site plan of Benderson Development for the

conditions as listed in the above communication. The site plan must
be submitted for site plan review and the signage must be approved by
the Planning Board

The City Planning Board at its regular meeting held Tuesday,
January 14, 2001, considered the matter captioned above pursuant to
Section 413-67 of the Buffalo Code, Encroachment Regulations.
The applicant seeks to encroach the right-of-way with the installation
of handicap stairs and altering the entrance-way at 38 Breckenridge
St. which is the northwest corner of the intersection of Mason and
Breckenridge. The Planning Board voted to approve the
encroachment.

Lease 401 Clinton Street
JFK Community Center to Buffalo & Erie County
Workforce Development Consortium
The Office of Strategic Planning, Division of Real Estate, has
received a request from Ms. Colleen Cummings, Buffalo & Erie County
Workforce Development Consortium, Inc., to lease space at the John
F. Kennedy Community Center. The center will be used to provide
employability development services to resident youth in the Buffalo
Federal Enterprise Community. Attached is a proposed lease
agreement for your review. This lease shall be for a term of four (4)
years.
They intend to occupy and renovate 11,151 square feet of space in the
building consisting of 3,599 square feet on the first floor and 7,553
square feet on the second floor. The tenant will pay Ten Dollars ($10.
00) per square foot for an annual rent of One Hundred Eleven
Thousand Five Hundred Twenty Dollars ($111,520.00) and their
portion of the utilities consumed. In addition the tenant will pay an
additional annual fee of One Thousand Five Hundred Dollars for use of
the gymnasium.
The tenant may be credited for the cost incurred for repairs and
improvements against current and future rent payments. Said repairs
or improvements will require prior approval of the Commissioner of
Public Works, Parks and Streets of the City.
The tenant will also be required to provide general liability insurance in
an amount not less than One Million Dollars holding the City harmless
of and free from any and all liability caused in its use of the premises.
The type and amount to be determined by the Corporation Counsel,
City of Buffalo.
The City of Buffalo shall be responsible for structural and major
non-structural (such as electrical lines, gas and water lines) repairs
and maintenance of common area and grounds in and around the
center.
I am recommending that Your Honorable Body approve the lease
agreement between the City and Buffalo & Erie County Workforce
Development Consortium upon the above terms and conditions. I am
further recommending that the Corporation Counsel prepare the
necessary lease agreement and that the Mayor be authorized to
execute the same

Renew Lease Agreement between the City of Buffalo and
The Bailey Delavan Community Services, Inc. for Use of
2050 Genesee Street

In the above referenced item Your Honorable Body authorized a
lease agreement between the Bailey Delavan Community Services,
Inc. and the City of Buffalo. This lease commenced on January 1,
1998 and expired on December 31, 2000.

The Office of Strategic Planning, Division of Real Estate, has received
a request from Simmone R. Washington, Executive Director of the
Bailey Delavan Community Services, Inc. requesting to renew this
agreement for an additional three (3) year period commencing January
1, 2001 and expiring on December 3 1, 2003.
This office recommends that Your Honorable Body approve the
renewal of this lease for an additional three-year period commencing
January 1, 20001 and expiring on December 31, 2003. The annual
rental will remain at One Dollar ($1.00) per year and all other terms
and conditions shall remain the same.
I am further recommending that Your Honorable Body authorize the
Corporation Counsel to prepare the necessary lease renewal and that
the Mayor be authorized to execute the same.

of Strategic Planning dated January 8, 2001, be received and filed;
and That the Director of Real Estate be, and he hereby is authorized to
renew the lease between the City of Buffalo and Bailey Delavan
Community Services, Inc. for use of 2050 Genesee Street for an
additional three (3) year term commencing on January 1, 2001 and
expiring December 31, 2003. That the Corporation Counsel be
authorized to prepare the necessary lease renewal and that the Mayor
be authorized to execute the same.

Renew Lease Agreement between the City of Buffalo and Lamar
Outdoor Advertising for Various Billboards Located on City
Properties
Item No. 139, C.C.P. 7/21198 Ex.
Pursuant to Item No. 139, C.C.P. 7121/98, Your Honorable Body
authorized a three (3) year lease agreement between the City of
Buffalo and Lamar Outdoor Advertising for use of various city owned
properties for the erection of billboard advertising. This lease
agreement commenced on November 1, 1996 and expired on October
31, 1999.
The Comptroller's Office, Division of Real Estate, submitted a request
to renew this lease for an additional three (3) year period, pursuant to
Item No. 10, C.C. P. 11/16/99. However, this item was received and
filed by Your Honorable Body pursuant to Item No. 132, C.C.P.
4/18/00 due to some concerns of the District Councilmember at the
time.
The Office of Strategic Planning, Division of Real Estate is
resubmitting their request to renew this lease for a three (3) year
period commencing on November 1, 1999 and expiring on October 31,
2002. They have agreed to increase the rental cost for $865 to $900
per poster face for 16 - 12'x 25' billboards and increase from $2,101 to
$2,500 for one bulletin face 14'x 48'for a total of Sixteen Thousand
Nine Hundred Dollars ($16,900.00) per year (which they are currently
paying). All other terms and conditions of said lease shall remain the
same.
This office recommends that Your Honorable Body renew their lease
agreement for an additional three (3) year period to commence on
November 1, 1999 and expire on October 31, 2002. 1 am further
recommending that Your Honorable Body authorize the Corporation
Counsel to prepare the necessary documents to renew said lease and
that the Mayor be authorized to execute the same.

Use of Corner of Broadway and Fillmore
Item No. 121, C.C.P. 3/19/96 Ex.
Pursuant to Item No. 121, C.C.P. 3/19/96, Your Honorable Body
authorized a five (5) year lease agreement between the City of Buffalo
and Mr. Wayne D. Robins, owner of Bet-All Numbers and News, 721
Fillmore Avenue, Buffalo, New York 14212 for use of a newsstand at
the comer of Broadway and Fillmore. This lease was for the period of
March 1, 1996 through February 28, 2001.
The Office of Strategic Planning, Division of Real Estate, has received
a request from Mr. Robins to renew this lease for another five (5) year
period to commence on March 1, 2001 and expire on February 28,
2006.
The current annual rental is $1,608.11 and will increase at a rate of 5%
per annum upon renewal and all other terms and conditions of said
lease shall remain the same.
This office recommends that Your Honorable Body renew their present
lease agreement for an additional five (5) year period to commence on
March 1, 2001 and expire February 28, 2006. 1 am further
recommending that Your Honorable Body authorize the Corporation
Counsel to prepare the necessary documents to renew said lease and
that the Mayor be authorized to execute the same.

Request Quick/Thorough
Cleanup of 383 Babcock St.
Your Honorable Body has requested that this Department
investigate the status of 383 Babcock Street. This Department has
received the Phase II assessment and has forwarded the document to
the New York State Department of Environmental Conservation. DEC
has indicated that it will review the information. To the extent
conditions on site meet or exceed regulatory levels, DEC could:
1) compel the owner to remediate the site;
2) use State Superfund resources to remediate the site and/or;
3) coordinate remedial activities with USEPA in other regulatory
agencies.
This Department will remain in contact with these agencies and will
continue to report to this body on the status of this site.
In addition, pursuant to your request, the relevant information has
been forwarded to the Director of the Division of Real Estate.

The Office of Strategic Planning, Division of Real Estate, has
received a request to purchase 411 Best Street from Mr. Chris
Greene, Attorney at Law, Damon & Morey, LLP on behalf of MDH
Company, Inc., 5982 Seufert Road, Orchard Park, New York 14127.
MDH Company, Inc. own industrial property at 1035 and 1045
Jefferson Avenue. They intend to clean and maintain 411 Best Street
for future expansion. The Office of Strategic Planning and the Division
of Collections have no objections to the sale. There are no outstanding
taxes, building code violations, or other liens owed to the City of
Buffalo by the purchaser. An independent appraisal of the property
was conducted by Frank A. Pirritano, Appraiser, 25 West Royal Hill,
Orchard Park, New York 14127. He has estimated the value of the
properties to be One Thousand Fifty Dollars ($1,050), Thirty-Five

Cents (.35) a square foot. The Division of Real Estate concurs with the
appraisers estimate of value. The results of our negotiations are that
MDH Company, Inc. has agreed and is prepared to pay One
Thousand Fifty Dollars ($1,050). They have also agreed to pay for the
cost of the appraisal, transfer tax, recording fee's and cost of the legal
description. I am recommending that Your Honorable Body approve
the sale of 411 Best Street to MDH Company, Inc. in the amount of
One Thousand Fifty Dollars ($1,050). 1 am further recommending that
the Corporation Counsel prepare the necessary documents for the
transfer of title and that the Mayor be authorized to execute the same.

Assessed Valuation: $4,100
The Office of Strategic Planning, Division of Real Estate has
received a request to purchase 291 Connecticut Street from Mr.
Edward Porto, Trustee for Amici Lodge #255, 295 Connecticut Street,
Buffalo, New York 14213. The Amici Lodge intends to expand the rear
of their building onto 291 Connecticut and the front portion of 291
Connecticut will be used for customer parking in conjunction with their
lodge. The Office of Strategic Planning and the Division of Collections
have no objection to the sale. There are no outstanding taxes, building
code violations, or other liens owed to the City of Buffalo by the
purchaser. An independent appraisal of the property was conducted by
Howard P. Schultz & Associates, 360 Delaware Avenue, Buffalo, New
York 14202. He has estimated the value of the parcel to be one
Thousand Five Hundred Dollars ($1,SOO), Thirty Seven Cents (.37) a
square foot. The Division of Real Estate has investigated the sales in
similar properties in the subject area. Sale prices range from
Twenty-Seven Cents (.27) a square foot to One Dollar and Sixty Cents
($1.60) a square foot.
The results of our negotiations is that Mr. Edward Porto, Trustee for
Amici Lodge #255 has agreed and is prepared to pay Two Thousand
Dollars ($2,000), which is Forty-Nine Cents (.49) a square foot, for this
parcel. Mr. Porto has also agreed to pay for the cost of the appraisal,
transfer tax, recording fee's and cost of the legal description.
I am recommending that Your Honorable Body approve the sale of
291 Connecticut Street to Mr. Edward Porto, Trustee for Amici Lodge
#255 in the amount of Two Thousand Dollars ($2,000). 1 am further
recommending that the Corporation Counsel prepare the necessary
documents for the transfer of title and that the Mayor be authorized to
execute the same.
Mrs. LoTempio Moved: That the above communication from the Office
of Strategic Planning, dated January 17, 2001, be received and filed;
and That the offer from Mr. Edward Porto, Trustee for Amici Lodge
#255, 295 Connecticut Street, in the sum of Two Thousand Dollars
($2,000.00) for the sale of 291 Connecticut Street, be and hereby is
accepted; and That the appraisal requested by the City of Buffalo shall
be paid by the purchaser; and That the transfer tax, recording fees and
cost of legal description shall be paid by the purchaser; and
That the Corporation Counsel be authorized to prepare the necessary
documents for the transfer of title and that the Mayor be authorized to
execute the same, in accordance with the terms of sale upon which
the offer was submitted.

The Office of Strategic Planning, Division of Real Estate, has
received a request to purchase 936 East Delavan Avenue from Mr.
Raymond P. Kelly and Mr. Daniel M. O'Donnell, 156 Seneca Street,
Lancaster, New York 14086. Mr. Kelly and Mr. O'Donnell own a one
family dwelling at 934 East Delavan, which adjoins 936 East Delavan
Avenue. They intend to use the property for extra yard space.
The Office of Strategic Planning and the Division of Collections have
no objection to the sale. There are no outstanding taxes, building code
violations, or other liens owed to the City of Buffalo by the purchasers.
An independent appraisal of the property was conducted by Mr.
Michael Cutting, AMC Appraisal Service, Inc., 2671 Harlem Road,
Cheektowaga, New York 14225. He has estimated the value of the
parcel to be Five Hundred Dollars ($500), Fourteen Cents (.14) a
square foot. The Division of Real Estate has investigated the sales of
similar properties in the area. Sales prices range from Twenty-Three
Cents (.23) to Thirty Cents (.30) a square foot.
The results of our negotiations are that Mr. Ramond Kelly and Mr.
Daniel O'Donnell have agreed and are prepared to pay Eight Hundred
Dollars ($800), Twenty-Two Cents (.22) a square foot, for this parcel.
They have also agreed to pay for the cost of the appraisal, transfer tax,
recording fee's and cost of the legal description.
I am recommending that Your Honorable Body approve the sale of
936 East Delavan in the amount of Eight Hundred Dollars ($800). 1
am further recommending that the Corporation Counsel prepare the
necessary documents for the transfer of title and that the Mayor be
authorized to execute the same.

The Office of Strategic Planning, Division of Real Estate, has
received a request to purchase 1201 East Ferry Street from Mrs. Ruby
Culverhouse, 138 Colorado Street, Buffalo, New York 14211. Mrs.
Culverhouse owns a one family home at 138 Colorado Street, which
adjoins 1201 East Ferry Street. She intends to use the property for
extra yard space. The Office of Strategic Planning and the Division of
Collections have no objections to the sale. There are no outstanding
taxes, building code violations, or other liens owed to the City of

In response to the resolution to the resolution submitted by Mr.

Brown on the subject of "The Selling of Capital Bonds for Masten
District Projects", the bond was sold for one million one hundred
twenty-five thousand dollars. The actual title of the resolution was
"Drug Treatment Facility Development" and this resolution was part of
the 1998-99 capital budget and sold as part of the bond sale for that
capital budget in December of 1999.
This resolution was originally returned to committee because it was
deemed too narrow in scope. It was modified to its present form and
passed in the form attached hereto. The resolution clearly states that it
is to be used to finance the "construction of a drug treatment facility on
a city owned site at 240 Kensington Avenue".
Neither State nor Municipal law allows for bond monies to be used for
a purpose other than the purpose stated in the resolution.
The remaining funds in the account established for this bond
resolution (MUNIS account #34320606-445100) are $923,700.00 as of
1/5/2001. These funds can only be used to finance the "construction of
a drug treatment facility on a city owned site at 240 Kensington
Avenue" or these funds can be used to repay the bond. There is no
other option. If the bond was repaid, new resolutions could be
submitted to address the projects mentioned in the request for
information.

reconstruction and not acquisition of land, therefore, it is not possible
to utilize the identified capital bond funds for the acquisition of land. In

therefore, cannot be simply amended.
The only option open to change the purpose of this resolution from
reconstruction to acquisition would require repaying the bond funds,
fees and interest for this resolution and redrafting a new bond
resolution for the purpose of acquisition within the context of the
Capital Improvement Budget process. This option is only open for the
portion of funds for this project that not have been utilized or
encumbered. This option is a complex process. Should the Council
desire to follow such an option, a greater in depth interaction with the
Comptroller's Office would be required.

Adelphia Cable notified the Common Council that it would increase
its rates to City Subscribers in early January 2001. 1 filed the letter
from Mr. Thomas Haywood; the Area Manager for Adelphia, with the
Council and it has been referred to the Telecommunications Special
Committee.
I have asked the Office of Telecommunications to analyze the rate
increase on order to determine its need. As you know, the Council has
always taken this position and we usually challenge at least the
amount of the increase.
The Council also holds a Public Hearing to allow the Public an
opportunity to voice its concerns about the increase.
With this in mind I am requesting the Common Council to hold Public
Hearing February 1, 2001 at 7:00 p.m. in the Common Council
Chambers.

I am in receipt of your letter dated Dec. 22, 2000, concerning Mr.
Arthur Osuorah's claim for lost wages in the amount of $3,766.00. As I
advised the Common Council through my representatives before the
vote to pay Mr. Osuorah, I am not inclined to issue a check at this time
due to the strong opinion issued by the city Law Department on the
legitimacy of such payment.
The Law Department's opinion, stated in a letter to the Common
Council from Corporation Counsel Michael B. Risman, is that Mr.
Osuorah "is not entitled to backpay for the: time he was not working for
the city." It is the Law Department's opinion, notwithstanding Mr.
Osuorah's reinstatement, that during the period he was not employed
by the City, he did not provide any service for which he could be
compensated.
Since the Law Department has taken the strong position that there is
no legal basis to pay Mr. Osuorah for the period he was not employed,
and that such payment would constitute an illegal gift of public funds, I
feel I must respect that opinion and respectfully decline to issue a
check to Mr. Osuorah at this time. If you have any questions, please

CONCERNS NEWS STORIES CRIME IN CITY VS SUBURBS
Two recent Buffalo News articles about crime in Allentown, once
again highlight crime in the City, which, along with the constant stories
in The Buffalo News highlighting poverty in the City have conveyed the
Image of a dangerous and poverty stricken City. This has taken its toll
in terms of middle class flight to the suburbs.
Isn't it also a worthy story that while the Allentown crimes were few,
occurred after shopping hours and not in the shopping district, the
Walden Galleria and its surrounding area experienced many crimes
during shopping hours. That would be a more balanced story that
would produce less damage to our vulnerable City.
Likewise, if The Buffalo News must concentrate on the City's poverty,
why not explore the reason poverty isn't in the suburbs, namely that
developers, suburban residents, and suburban government officials
are resistant to the creation of low income housing and location of
social service agencies in their towns - not to mention opposition to
extension to the suburbs of the Light Rail Rapid Transit System.
This resistance has resulted in highly segregated Buffalo suburbs -
among the most segregated metropolitan areas in the nation - at the
very same time that studies have confirmed that low income families
who move to suburbs find higher paying jobs. Indeed, the Clinton
Administration has increased the value of section 8 housing vouchers
for the express purpose of affording low-income families the
opportunity to live in suburbs.

The City has placed an alternate parking sign at the side apartment
entrance of 73 Jones Street. The sign is located on Fleming Street
because the building is located on the corner.
Ms. Mary Krajewski who owns the property is disabled and has to park
near the sign in order to enter her apartment. She consistently
receives parking tickets and has tried for quite some time to have the
sign moved or removed. Her reason for moving the sign is not just
because she received tickets. It is also because there are no other
houses on Fleming Street, which makes the sign unnecessary. She
also complains that the city snowplows do not come down her street
unless she calls anyway.
Would you please review this situation and have the sign either

Since 1994 the Preservation Coalition has been on record as
supporting a new courthouse on Niagara Street. We were strong
advocates for it, but always with the proviso that Niagara Street not be
encroached upon. We voiced this opinion at a public hearing in 1994,
and several articles in the Preservation Report before and since.
In late 1998 or early 1999, the Preservation Coalition was the sole
attendee at a required Environmental Impact hearing under the
auspices of the Gorski Administration. We voiced concerns over
encroachments on Niagara Street. I believe a city representative was
present. We were led to believe by that administration that our
concerns would be" addressed."
Dismissed would be more, like it. Foundations were poured and steel
installed in the public right-of-way before the public knew it in fact was
happening. The City should have known, public hearings or not, that
the courthouse itself represented an impact on the city's Joseph
Ellicott Historic District, to say nothing of steps, ramps, and plazas.
Now, according to an article in Saturday's Buffalo News, the Council is
being asked to give an easement for a plaza to occupy section of
Niagara Street. The public does not know whether this thing is neces-
sary, what it going to look like, how it will effect the historic Ellicott
plan, and how it will effect traffic flow. Then it needs time to review and
comment on the plans.
I respectfully suggest the Council not vote on the issue tomorrow, and
that the public have an opportunity to review and comment on the
plans at a convenient time. We cannot afford the steady erosion of our
signature historic street plan.

The Department Of Public Works has investigated the
feasibility of purchasing snowmobiles for use by the City during it
snow emergency.
There are several models of snowmobiles manufactured for various
uses. The model we feel most suited for our proposes is called a
touring model. This type snowmobile is designed for two people and
can he equipped with saddle bags and small trunk for a considerable
storage capacity. These snowmobiles are constructed with a heavy
duty suspension, a long rear track, electric starter, heated grips and a
reverse gear.
Outfitting the driver and passenger of a snowmobile is very important
as well. Since a snowmobile offers in I minimal protection from the
weather special outwear is designed by snowmobile manufactures to
keep the riders warm and dry. Specially insulated parkas, snow pants,
gloves. boots and a D.0.T. approved helmet are necessities for the
driver and passenger.
Although a special license is not required by the Department of Motor
Vehicles to operate a snowmobile several local snowmobile Clubs
offer rider safety Courses. These courses are mandatory for operators
under the age 18. Adult operators are not required by law to attend
these courses. The cost of this course is minimal and we would
require our operators to attend.
Should the City of Buffalo decide to proceed with the purchase Of the
snowmobiles and accessories the Purchase Division will need to seek
formal bids. However, below listed is breakdown of the approximate
costs:

Performance and Payment Bonds
The provisions of the Buffalo Code relating to bonds and retention
on City public works contracts need to be updated. Section 96-4 of the
Code requires performance bonds on public works contracts. Section
137 of the State Finance Law requires a payment bond in addition to a
performance bond on public works contracts. A payment bond, which
is also known as a labor and material bond, protects subcontractors in
the event a contractor refuses to pay its subcontracts for labor and
materials. The current City bond form and Code requirement appear to
be outdated by requiring only a performance bond. A recent State
Supreme Court decision from Justice Patrick NeMoyer upheld the
applicability of State Finance Law Section 137 to the City of Buffalo.
In addition, Section 106-b of the General Municipal Law provides that
a City may only require five percent (5%) retention on a public works
project where a performance and payment bond is required. Section
96-8 of the Buffalo Code provides for ten percent (10%) retention on a
City public works project. This appears to be outdated under current

law and should be reduced to five percent (5%). In a recent decision,
Supreme Court Justice Patrick NeMoyer ordered the City's retention
on a project be reduced from ten percent (10%) to five percent (50,/0).
These changes have been reviewed by Commissioner Joseph
Giambra and City Engineer Daniel Kreuz. They agree with the need for
the proposed changes. A consultation with the Buffalo Board of
Education has revealed that they require a performance and labor and
material bond as well as only five percent (5%) retention.
An ordinance amendment has been prepared which will update City
requirements to meet current state law.

I am in receipt of the above stated Common Council
Communication and wish to supply your Honorable Body with the
following information. On February 26, 1999 Building Inspector Robert
Barrali was dispatched to the aforementioned property. At that time
Building Inspector Barrali wrote a notice of violation citing six (6)
exterior violations. This notice was sent to Babcock Warehouse at
1284 Clinton Street in the City of Buffalo. A tittle search was requested
and received. On May 14, 1999, Building Inspector William
Manuszewski sent a notice of violation to three individuals listed on the
title search. On June 2, 1999 a re-inspection was performed and no
progress on any of the violations cited on two (2) different notice of
violation were corrected. At that time Building Inspector Manuszewski
issued a summons and complaint for Housing Court. The next
scheduled Housing Court appearance is for March 30, 2001. As this
court case i~ in the jurisdiction of the Housing Court of the City of
Buffalo, we will provide the necessary inspections for a conclusion and
proper disposition to this problem property. It is my sincere hope that

Road in Sardinia, provided this information. The figures listed above
are based on prices for current year and could change when new
model is released in March. The owner discussed a couple models,
but believed for the purpose the City would use them that this was the
best vehicle available. To get a more expensive model would be a
waste of money.

work on various projects. They have also spent thousands of dollars of
their own funds to Save Hennepin Park which is being threatened with
a building project in the park.

promised reimbursements for expenses over the past years.

Hennepin Park from Walden Heights Project (money from sale of lots -
over $350,000.00 - was promised for Lovejoy District Parks but was
placed into a building project.) $1300.00 - due to the Iron Island
Society from Year 24 of Community Development Block Grant
(Contract #CD209-24). (This money was to be transferred to Year 25,
however, it was put into another account by the Lovejoy
Councilmember.) $1.2 million - taken from Lovejoy neighborhood
funding and used to purchase 'Wyoming County campground. (No one
went after this money which was to be returned to the city.)
$129,000.00 - used to pay architects for plans for business & office
building in Hennepin Park, the only green space in the area. (Taken
from $450,000.00 in city funds that was supposed to be used for the
park itself.)
$321,000.00 - the remainder of the $450,000 promised by city for park
restoration. $8208.00 - replacement of Medina Sandstone at Hennepin
Park that was illegally removed. (As Medina Sandstone is no longer
available, Indiana Limestone will have to be used. Price based on
$475.00 per ton x 16 tons + tax.) $5739.00 - wages of union masons to

I must communicate my extreme frustration with our local cable
company, Adelphia. As a city of Buffalo resident, I feel that I should
have a choice of television programming and not be forced to
purchase programming from a company who holds a monopoly in our
community. The citizens of Buffalo and the surrounding areas are held
captive to the rising costs of one company. I am sure you have seen
the new pricing plan which will be in effect as of February.
I have endosed a copy of a letter addressed to Mr. Tom Haywood,
Regional Manager of Adelphia expressing my dissatisfaction and the
problems I have encountered as a cable customer.
As Common Council President I felt you should be aware of the
problems which can be experienced and the displeasure of a resident.

near future.

Peace Bridge Expansion Project- Specialty Consultant Procurement
Description: The Buffalo and Fort Erie Public Bridge Authority has
decided to undertake a bi-national integrated environmental process
considering a proposed action that involves bridge capacity expansion,
U.S. plaza modernization and connecting road improvements leading

to a bi-national solution to expand traffic capacity and relieve
congestion at this major international bridge crossing over the Niagara
River between Buffalo, NY and Fort Erie, Ontario. The Authority has
designated a Project Management Consultant to coordinate and
manage the overall project and have two other Consultants under
contract who are responsible for the U.S. and Canadian Plazas. To
complete the technical team for the project, the Authority seeks to
retain the services of the following Specialty Consultants: Bridge
Designer/Architect; Environmental Consultant; Traffic Consultant; and
Public Involvement Consultant. These consultants will contract directly
with the Authority, and will have management and reporting
responsibilities according to the Authority's Project Consultant Team
Organization Chart. The roles and responsibilities of the four
Consultants sought in this procurement are as follows:
Bridge Designer/Architect Consultant - The Bridge Designer/Architect
Consultant's role will be to conceive, develop and assess bridge
options from concept plan through preliminary design. The Peace
Bridge is a 3-lane, 1,063 in long, 75-year old steel bridge that crosses
the Niagara River and Black Rock Canal. It has 5 spans over the river
and crosses the Black Rock Ship C anal with a 30 in vertical
clearance. Due to increasing traffic volumes at this important
international crossing, at least three additional lanes are needed.
Previously identified options include rehabilitation/widening,
parallel/twin structure and a replacement structure on new alignment.
A full range of medium and long-span structure types (truss, arch,
cable-stayed, box girder, etc.) and materials (steel, concrete, etc.) will
be evaluated. Due to its age, location and high visibility, the Peace
Bridge is a local and international landmark and is considered to be a
gateway into both the United States and Canada. Therefore, structure
aesthetics and architecture will be a key consideration. The scope of
services will include Conceptual Design and Preliminary Design of
Selected Alternatives to a level needed to prepare reliable cost
estimates and evaluate impacts. Final Design services will not be
included, but may be added at a later date at the Authority's discretion.
Due to the Bi-national character of this project, United
States/Canadian involvement is preferred. However, single point
responsibility will be required. The Consultant must have proven
bridge architecture and design experience on major architecturally
significant medium and long-span bridges in the United States,
Canada or around the world. Experience with a wide range of bridge
types is required, including steel, concrete and suspension/cable
stayed bridges.
Environmental Consultant -The consultant's specific responsibilities
will be to conduct the full range of detailed social, economic and
environmental analyses as required by applicable U.S. and Canadian I
aws and regulations, including NEPA, SEQRA, CERO and CEAA. The
Environmental Consultant will review, revise, update and expand as
necessary the earlier analyses that were made for the separate project
components, to incorporate the combined project and new project
alternatives that will be identified. The Consultant will be responsible
for participating in the definition of the project's purpose and need,
alternative definitions and evaluations, and for assembling the
analyses and producing the binational integrated Environmental
Impact Statement/Canadian Environmental Assessment documents.
Due to the Bi-national character of this project., United
States/Canadian involvement is preferred. However, single point
responsibility will be required. The Consultant must have proven
environmental analysis experience on major projects in the United
States, Canada or around the world, with special emphasis on social,
historical and community impacts.
Traffic Consultant - The Consultant's specific responsibilities will
include cross border traffic volume forecasts, approach roadway
capacity analyses, maintenance and protection of traffic with respect

to detours and all off-plaza traffic issues including local accessibility
and circulation. The Traffic Consultant will need to coordinate with and
support the other Consultants responsible for the U.S. and Canadian
Plazas and the River Bridge with respect to circulation, lane
requirements, overall traffic capacity of the facilities, bridge operations,
tolling and customs/immigration issues. The Traffic Consultant will
review, revise, update and expand as necessary the earlier analyses
that were made for the separate project components, to incorporate
the combined project and new project alternatives that will be
identified. Traffic evaluations and analyses must consider traffic
volume peaks, including the bridge passenger and commercial traffic
peaks and the traffic peaks on the connecting roadways. Due to the
Bi-national character of this project, the Consultant must have proven
traffic engineering experience in the United States and Canada, with
special emphasis on international border or river crossing projects.
Public Involvement Consultant - The Authority's goal is to establish
ongoing, inclusive, and meaningful two-way communications with the
public throughout the bi-national integrated environmental process.
The Authority seeks to retain the services of a Public Involvement
Consultant to assist the project team in developing and implementing
an effective Public Involvement Plan with the following objectives:
Provide accurate, useful, and timely information to the news media
and community throughout the study.
Proactively reach out and involve the public to participate in the
bi-national integrated environmental process in a meaningful way.
Assure that specific local and neighborhood needs and environmental
issues are identified early in process and are considered in the
development of alternatives. Build consensus in the development of
alternatives and foster understanding for how an alternative is
eventually selected.
Due to the Bi-national character of this project, United
States/Canadian involvement is preferred. However, single point
responsibility will be required. The Public Involvement Consultant must
demonstrate public involvement abilities and with specific knowledge
and expertise working in the Buffalo Niagara Region in the United
States and Canada, as well as experience working in multi-lingual
communities (English, Spanish and other languages). Successful
experience with large, high-visibility projects with often intense and
conflicting views held by the various stakeholders is essential, both for
the Public Involvement Consultant firm itself as well as the key staff
members being proposed to lead its efforts.
Evaluation Criteria: Qualified Consultants are invited to submit an
Expression of Interest (EOI) briefly summarizing their firm's
qualifications, resumes of proposed key staff and descriptions of the
firm's and key staff's relevant experience. Interested firms may obtain
an information package and list of EOI requirements from the contact
person listed below. There are no format requirements for EOI's, but
they must be limited to 50 pages, including resumes. Twelve copies
are requested. An evaluation committee will evaluate EOI's based on
the following criteria: 1. Experience of the Firm = 25%. 2. Experience
and Availability of the Proposed Manager and Staff = 35%. 3. Project
Familiarity and Approach = 30%. 4. Knowledge and Familiarity with the
Area = 10%. All EOI's received will be evaluated by a Review Team.
The Review Team will select a short list of firms to be interviewed from
the list of respondents based on initial ratings. The Review Team will
recommend to the PBA Board one of the top three firms or teams. The
recommended firm or team may not have the highest numerical rating.
The anticipated selection schedule is as follows: Advertisement

The recent Buffalo News article on the renumbering of Altruria Street
was of great interest to me.
As the Computer Systems Engineer Coordinator for the Buffalo Public
School's Transportation Office I also have problems with the current
number system. We use a computerized bus routing system which
assigns a student to a bus stop closest to their home address. This
system does not recognize the "A" designation in the house number.
Therefore, students living closer to Hopkins are assigned to a stop on
South Park instead of Hopkins because the system uses the non "X'
address. Our parent notification letters, which gives the pickup and
drop off stop locations and times, are either delivered to the wrong
house or returned to us as "Addressee Unknown7. You can imagine
the confusion this causes when we make a change to a bus route and
the parents don't receive the change notice.
I can understand the reluctance of some residents for not wanting the
house numbering changed. A compromise could be changing only the
"N' designated addresses and help them with any legal costs.
I support your efforts in this matter. Please include the Transportation
issue as another reason for making the change. If you wish to contact

Thank you once again for your assistance with the renumbering of
Altruria and Willink Street proposal.
Per your request, here are the few basic requirements of postal
customers:
REQUIREMENTS:
Affected customers would be required to renumber their house,
either by removing the "A" designation, or by adding a "'I" or "2", or by
changing numbers completely as directed and assigned by the City of
Buffalo. Most hardware stores sell house numbers at relatively modest
costs.
Second, all residents would have to contact their correspondent
about their new mailing address. This is not a "change of address," so
no one needs to submit a change of address card to the Postal
Service.
There are a number of ways for residents to contact their
correspondents:
By phone, by mail using statements or invoices they return to the
mailer, or by using our customer notification cards, which we would
provide free of charge to every resident.
Our plan is to give everyone a starter supply of 25 customer
notification cards, with postal prepaid by the Postal Service. They
simply complete the card and mail it to their correspondent. We will
also provide a list of common business correspondents to each
resident to remind them about whom to contact. Most correspondents
will change their address list upon receipt of the card, or within 4 to 6
weeks if it is a publisher..
What about mail that still comes in with the former number? How long
do residents have to change their address with their correspondents?
The Postal Service asks residents to complete and send the cards as
soon as possible. Even if the correspondents do not change the
address immediately, the post office will deliver mail with the former

number for six months after the change goes into effect. After that
point, we will evaluate how much mail is still coming in with the former
number and decide a plan of action. Eventually, we will do what we do
in every other situation of misaddressed mail: we will return the mail to
sender with an endorsement, "no such number," or other appropriate
reason, which then gives the mailer an opportunity to correct their
address list by contacting the resident about the correct mailing
address.
Note: The Postal Service has a lot of experience in these sorts of
situations. Locally, for example, we have changed ZIP Codes for
literally thousands of residents in Amherst, Orchard Park and
Hamburg. We acknowledge that change is difficult for some people,
and we sometimes have to initiate a change in the interest of the
"greater good." We do all we can to minimize the amount of
inconvenience, and we ensure that we deliver the misaddressed mail
to the resident during the transition period, which is always a
reasonable amount of time. We have been very successful in each of
these cases, and most residents come away from the experience with
a renewed appreciation for the value and support provided by the
Postal Service.

I have read with interest the expected almost billion dollars going
toward public school rehabilitation and new development. Economic
development of our community is a major initiative of the NAACP
movement.
African-Americans make up over 30% of the Buffalo population and
African-American students are over 500/a of the school population.
Based upon these demographics, we would be especially interested in
knowing what are the City's plans for including minority architects,
developers, journey persons, suppliers, apprentices in the distribution
of this billion dollar funds reported for this multi year development.
The Buffalo News did report on a "trainee" program, but if this is a
public works project, then is it not true that those "trainees' must be
paid the prevailing wage. Have these details been worked out? What
are the total number of skilled workers (journey workers) to be utilized
and in what skilled areas are the needed?
What will be the process for selecting an architect(s)?
What will be the process of selecting the developer(s)?
What will be the process of selecting those persons who will be
providing the goods and services to the project?
In summary what will be the role of the Buffalo minority community in
the development of this school project to insure that the minority
community benefits economically from a projects that impacts most
heavily upon: them?

I would like to thank the members of the Common Council who had
the foresight to hold a public forum today, January 17, 2001, for the
purpose of creating a shared vision for Buffalo's waterfront. Only
through the input of the public will a general consensus be met on the
important issue of Buffalo's waterfront redevelopment during this first
decade of the Twenty-First Century
I also wish to commend the members of this council, as well as Mayor
Anthony Masiello, County Executive Joel Giambra, and the members
of the Preservation Coalition of Erie County for their tireless effort to
ensure that the Erie Canal once again plays a central theme in the
redevelopment of Buffalo's Inner Harbor. The history of Buffalo is also
a grand part of the history of the United States. Buffalo's Inner Harbor,
through the Erie Canal and the "Commercial Slip," was an entrance
point to the west for many new immigrants to our nation. By ensuring
that the legacy of the past would not be destroyed by the
redevelopment plans of a few, the citizens of the world will once again
stand on the foot of Main Street. However, this time these visitors will
not be here to start a new life in a new world, but to instead relive the
past while viewing the scenic beauty of our waterfront.
With that in mind, I believe that it is important to recognize the past in
its true form. The Canal District of the past was a rough and tumble
world. If the plans for tomorrow call for the restoration of a portion of
the District, we must honor the true history of the District. While
"Dug's, Dive" may have been a final stop on the Underground
Railroad, it is equally as important to note that it also was part of a
larger economic and social District.
As we rebuild the Commercial Slip to ensure the continuation of the
past, I believe that we must also note that while the Canal District of
the 1800s was a burgeoning economic center of the United States it
also had a dark side. To glorify the foundations of Dug's Dive, or any
other taverns or houses of ill-repute that may be unearthed, would
revise the true history of the District. A revisionist version of history is
not history, but an incomplete, and sometimes fictional, view of the
past. Therefore, while I believe it is essential to bring to life a by-gone
era as part of the development of the Inner Harbor, let us recreate the
past as it existed. A true historical representation of the District should
be our goal. To only detail the brighter side of life would do a
disservice to the thousands of residents who lived in the District, and
who built the City.
With regard to the Outer Harbor, as a resident of South Buffalo it is
especially exciting to see the redevelopment of the old Union Ship
Canal from an environmentally contaminated industry relic to a
multi-use recreational facility. This development, along with the
planned transformation of Gallagher Beach, opens up Lake Erie to a
new generation of Buffalonians. However, development of the Outer
Harbor must not stop there. The City of Buffalo is extremely lucky that
vacant waterfront land exists adjacent to the Outer Harbor. This land,
extending south from the Pier Restaurant, must be made accessible to
all residents through recreational or parkland uses.
Very few cities on the Great Lakes can lay claim to vacant prime

waterfront real estate. The City has lived for many years with the
mistakes of its past. We have averted another mistake by deciding to
restore the Commercial Slip, rather than build a "replica." It is essential
that a viable plan for development of this Outer Harbor waterfront
property be integrated into the vision for development as proposed by
this Council at the public forum.

There is growing concern that the East Side Transfer Station will be
turned over to the County. Also, that the County will in turn use a
private company to haul the garbage to landfills.
This operation was given to a private company twenty years ago and
returned to the City after they had reaped the benefits and literally
destroyed the facility at Squaw Island. The building at the East Side
was not in much better condition.
There is the need for a new facility that could handle not only the
garbage and trash of Buffalo, but also facilitate the transfer of waste to
landfills for the suburbs.
This is an opportunity for Buffalo to use this project to include the
future of recycling. and a proper garage to maintain and store their
fleet of vehicles.
We have people within our Union with the knowledge to assist in
preparing the groundwork. The City gave this facility away years ago
and found themselves held hostage by a private concern. What makes
anyone think this time will be different. If there is any more information
we could provide, please call.

Whereas:A traffic signal has existed on Poultney and Kensington
Avenue for decades until it was unwisely removed by the
determination of the then Council Member and the Department of
Public Works; and
Whereas:The residents' protests, thousands of signatures on petitions
and complaints began immediately after the traffic signal was removed
without a public hearing or anynotification of the City's intent
relayed to the residents; and
Whereas Numerous life-threatening accidents have already occurred
and continue to occur on a frequent basis and which have caused a
'notice of hazard condition to be filed with this honorable body; and

Whereas:Several public hearings were held in the Council Chamber
and at room 1417 where residents spoke quite passionately of the
need to reinstall the traffic light; and
Whereas: The Department of Public Works affirmed that the traffic
light would be reinstalled once money was found and allocated by this

Whereas:Due to the budget cap and limitations on budget year 27 and
including year 31, this Council Member will be unable to secure
funding for this project.

This Common Council approves the reinstallation of the traffic signal

The Common Council of the City of Buffalo does hereby ordain as
follows:
That Chapter 96 of the Code of the City of Buffalo be amended to read
as follows:
96-4. Performance and labor and material bonds.
A.A performance and labor and material ' bond shall be in the
penal amount of the contract price if based on a lump-sum price or of
the unit-price bid multiplied by the number of units estimated in the
plans and specifications if based upon a unit price and shall be
conditioned for the faithful and complete performance of the contract
for the work or improvement or the furnishing of the materials, supplies
or equipment in strict compliance with the provisions of the contract
documents. [The] A labor and material bond shall also be required and
the bond shall contain a clause that the bidder entering into the
contract with a city agency will pay for all services rendered and
materials used in the execution of the contract and that a person
rendering services or furnishing materials in or about the execution of
the contract may maintain an action to recover for the services
rendered or the materials furnished against the obligors in the bond as
though the person were named therein, provided that such action shall
be brought within one (1) year after the cause of action accrued. The
obligors in the bond shall be liable and may be sued accordingly.
Notice of the commencement of the action and of all proceedings
therein shall be given to the Corporation Counsel, and in default of
such notice, no recovery shall be had in the action.
B. The right of a person rendering services or furnishing materials to
maintain an action on such labor and material bond shall be subject,
however, to the prior rights of the City of Buffalo against the obligors in
said bond.
96-8. Provision for manner and time of payment required;
exceptions.
A.When work or improvement is proposed to be purchased,
the plans and specifications therefor shall, among other things, specify
the manner and times of payment.
(1) Where the cost of the work or improvement exceeds the sum of
five Thousand dollars ($5,000.), payment shall be made upon monthly
estimates of the officer of the city agency charged with the
supervision of the work or improvement and upon the certificate of the
head of the city agency charged with the execution of the work or
improvement as the work or improvement progresses, based on the
value of the labor and materials incorporated in the work or

Bond Resolution of the City of Buffalo, New York, authorizing the
issuance of $1,400,000 General Improvement Bonds of said City, to
finance the fiscal year 2000-01 portion of the City's funding
commitment for the conversion of the Frederick Douglas Towers into a
new housing development, pursuant to the Stipulation of Settlement
and Amended Consent Decree 'in the case of Comer v. Cuomo, et.
al., as approved by the United States District Court, Western District of
New York, at the estimated maximum cost of $1,400,000.
The Common Council of the City of Buffalo, in the County of Erie, New
York, hereby resolves (by the favorable vote of not less than two-thirds
of all the members of said Common Council) as follows:
Section 1. The Comptroller of the City of Buffalo, 'in the County of Erie,
New York, is hereby authorized and directed to issue General
Improvement Bonds of said City in the principal amount of One Million
Four Hundred Thousand Dollars ($1,400,000), pursuant to the
provisions of the Charter of said City and the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of
New York (the "Law"); to finance the fiscal year 2000-01 portion of the

resolution, or any bond anticipation notes issued in anticipation of the
sale of said bonds shall be deposited in the Capital Projects Fund to
the credit of the Department of Community Development, Division of
Development, "Conversion Frederick Douglas Towers, 2000-01 ",
Bond Authorization Account No. 3 000-60, and shall be used for the
specific object or purpose specified in Section I of this resolution.
Section 3. The City intends to finance, on an interim basis, the costs or
a portion of the costs of said improvements for which bonds are herein
authorized, which costs are reasonably expected to be incurred by the
City, pursuant to this Bond Resolution, 'in the maximum amount of
$1,400,000. This Resolution is a declaration of Official Intent adopted
pursuant to the requirements of Treasury Regulation Section 1. 150-2.
Section 4. The following additional matters are hereby determined and
stated:.
(a) The period of probable usefulness applicable to the class of objects
or purposes for which the bonds authorized by this resolution are to be
issued, within the limitations of Section 11.00 (a) 33 (a) of the Local
Finance Law, is five (5) years.
(b) Current funds are not required by the Law to be provided as a
down payment prior to the issuance of the bonds authorized by this
resolution or any bond anticipation notes issued in anticipation thereof
in accordance with Section 107.00 d. 9. of the Law.
Section 5. Each of the bonds authorized by this resolution and any
bond anticipation notes issued in anticipation of the sale of said bonds
and the renewals of said notes shall contain the recital of validity
prescribed by Section 52.00 of the Local Finance Law. Said bonds and
said notes shall be general obligations of the City of Buffalo payable
as to both principal and interest by a general tax upon all the taxable
real property within said City without limitation as to rate or amount.
The faith and credit of said City are hereby irrevocably pledged for the
punctual payment of the principal of and interest on said bonds and
said notes. Provision shall be made annually by appropriation by said
City for the payment of interest on and for the amounts required for the
amortization and redemption of said bonds and said notes.
Section 6. The validity of the bonds authorized by this resolution or any
bond anticipation notes issued in anticipation of the sale of said bonds
may be contested only if
(a)Such obligations are authorized for an object or purpose for
Which the City of Buffalo is not authorized to expend money, or
(b)The provisions of law which should be complied with at the
date of the publication of this resolution are not substantially complied
with,
and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication,

original appointees shall be appointed to two (2) year terms. All
subsequent new appointments and reappointments shall be for a term
of three years. The members shall not include the Local Empire Zone
Certification Officer, and shall include a representative of organized
labor, financial institutions, local educational institutions, community
organizations, two (2) local business representatives, two (2) residents
of the Empire Zone and two (2) Common Council members chosen by
the Common Council. The Chairperson of the Board shall be the
President of the Buffalo Economic Renaissance Corporation. The
Local Empire Zone Administrative Board shall perform all duties
required of it pursuant to Section 963(b) of the General Municipal Law.
Section 2. Insofar as the provisions of this local law are inconsistent
with the provisions of any other local law or act, the provisions of this
local law shall be controlling.
Section 3. This local law shall take effect immediately upon filing in the
office of the Secretary of State as provided by Section 27 of the
Municipal Home Rule Law.

to offer one thousand new and needed jobs to area residents to assist
in the revitalization of Buffalo; and
Whereas: Among The Common Council's concerns over the present
agreement is the City of Buffalo's waiver of the annual ground rent at
the HSBS Arena and for the City to absorb the cost of providing an
environmentally clean site for the proposed Adelphia Operations
Center;

and the Joint School Construction Board; and
Whereas: Minority student enrollment in Buffalo Public Schools is over
70% and The minority population of the City of Buffalo is Over 50%
and
Whereas: There are currently no adopted goals for MBE/WBE
participation; and
Whereas: Establishing reasonable goals for minority/ female workforce
hiring and MBE/WBE participation is an important part of insuring that
economic: benefits are maximized for all city residents; and
Whereas: This initiative has the potential to spawn new businesses,
employ many residents and create economic opportunities for many;
and
Whereas: This is a matter of social and economic justice, backed by
federal law-, that can have a major impact on community morale and
economic stability;

That this Common Council requests the Buffalo Public Schools and
the Joint School Construction Board to establish reasonable goals for
minority and female workforce hiring and MBE/WBE participation for
the New School Construction and Rehabilitation in the City of Buffalo;

blight and become a public eyesore for residents; and

complaints about unclean City streets; and
Whereas: A proactive attempt to alleviative this burden to residents
should be established; and
Whereas: The City of Buffalo has developed a snow removal plan but
has not to this Council's knowledge, developed and presented in
written form, an effective Street cleaning plan;

Whereas: Mr. Redd intends to bring the property up to code and utilize
the dwelling as a residential home; and
Whereas: Mr. Redd is financial adept to purchase and repair the

Whereas: The removal of vacant properties from city rolls and the
rehabilitation of homes in the Masten District is highly favored by
this office and I fully support and endorse this endeavor;

SUBJECT: Opposition to the Permanent Relocation of the Youth
Detention Center
Whereas: In December 2000, the Erie County Youth Detention Center,
located on East Ferry Street, in the City of Buffalo, was ordered tom
down by New York State citing run down and unlivable conditions at
the Center; and
Whereas: At that time, the youth housed in that facility were moved to
a secured location at the Alden Penitentiary property; and
Whereas: It was understood by area residents and local elected
officials that this move would be temporary, and the youth would be
returned to a new East Ferry Street Detention Center; and
Whereas: In an article appearing in the Friday, January 12, 2001,
Buffalo News, many learned for the first time, that a committee was
looking at permanently moving the site from Buffalo to Alden; and
Whereas: There is strong opposition to this move from several elected
officials in the City, specific Erie County Government's
Representatives, and from many concerned City of Buffalo residents;
and
Whereas: The concerns include: the negative effects on City of Buffalo
parents with limited transportation who want to visit their children; the
uncertainty of what will be done with the site on East Ferry Street
when the detention center is torn down; the emotional and
psychological impact on the juveniles exposed to the adult prison
environment; the change of existing the education process, which is
now provided on-site by the Buffalo School System; and
Whereas: Some Alden residents also oppose this pen-nanent move.
In a letter appearing in the January 19, 2001, Buffalo News, an Alden
resident refers to security problems at the temporary Alden facility and
the potential of over concentration of penitentiaries in the area;
Now, Therefore, Be It Resolved:
That the Buffalo Common Council opposes the Youth Detention
Center's permanent move from the East Ferry Street site to a location
outside the City of Buffalo; and
Be It Further Resolved:
That this Honorable Body requests that the City Clerk send certified
copies of this resolution to the Erie County Legislature to record the
Common Council's opposition to the permanent move of the Youth
Detention Center to a location outside the City of Buffalo; and
Be It Finally Resolved:
That the Buffalo Common Council also requests that the Erie County
Legislature keep this Council informed of all developments in regard to
the Erie County Youth Detention Center.

Re: Status of Lakeview Hope VI Phase 11
Whereas: The Buffalo Municipal Housing Authority submitted a
"revised" HOPE VI Revitalization Plan for Lakeview Homes to the
Buffalo Common Council in August, 2000; and
Whereas: The Buffalo Municipal Housing Authority requested the
Council's approval for the revisions to Phases II and III of the
Revitalization Plan by November 1, 2000;and
Whereas: The Buffalo Common Council, after holding a series of
public meetings with tenants of the Lakeview Projects, staff and
members of the Board of Commissioners of the Buffalo Municipal
Housing Authority, did authorize the BMHA's Hope VI Project, Phase

11 in November, 2000; and
Whereas: The Developer, Roziman Associates filed design and site
plans for the Hope VI, Phase 11 Redevelopment Project, on January
4, 2001 with the City Planning Board, which was subsequently
reviewed and tabled by the City Planing Board for two weeks on
January 16, 2001; and
Whereas: As a result of the actions taken by the City Planning Board
on January 16 th, MS. Sharon M. West, Executive Director of BMHA,
held an emergency tenants' meeting with residents of the Lakeview
Housing Projects on January 18th, to review the above referenced
design and site plans for the Hope VI Project, Phase 11; and
Whereas: To date, the Buffalo Common Council has not received the
design and site plan for the construction of Phase II of the Lakeview
Housing Redevelopment Project, or any other information regarding
the current status of the Hope VI, Phase 11 project;
Now, Therefore, Be It Resolved That:
This Common Council requests that the Buffalo Municipal Housing
Authority and the Project Developer for Hope VI, file with the City
Clerk, all pertinent materials and information needed, to update the
Buffalo Common Council on the current status of the Hope VI Project,
Phase II; and
Be It Further Resolved That:
The Common Council requests that the Hope VI Developer, Mr.1srael
Roziman, President & Owner, Roziman Development, Inc., and
Ms.Sharon M. West, Executive Director of BMHA, to attend the next
meeting of the Council's Committee on Community Development, to
be held on Wednesday, January 31, 2001 at 4~ff A - M ., to further
update the Common Council on the status of the Hope VI Project,
Phase II.
