Rev. Msgr. John R. Gabalski, residing at 127 Townsend Street, Buffalo, New York 14212 and Herbert L. Bellamy, Jr., residing at JHB Professional Bldg., 395 E. Ferry Street, Buffalo, New York 14208, as members of the Buffalo Sewer Authority for a term commencing immediately and expiring June 30, 2004. REFERRED TO THE COMMITTEE ON LEGISLATION, DIRECTOR OF COLLECTIONS, CORPORATION COUNSEL AND THE COMPTROLLER FROM THE MAYOR - EXECUTIVE DEPARTMENT FROM THE OFFICE OF CITIZEN SERVICES Page 2 01-0710-SS0702.txt NO.2 Monthly report from the Division of Citizen -Services (Mayor's Complaint Hot Line) Attached is the June, 2001 activity report from the Division of Citizen Services, as well as, a year end report. The division's first year of operation recorded over 37,000 calls and responded to over 100,000 calls for information. In analyzing the calls, the recent city-wide expansion of the garbage tote program accounted for 20% (7,433) of our reported calls. The majority of calls, 53.2% (19,731), were related to activities performed by the Division of Streets and Sanitation. Other trends included, the Niagara and Fillmore districts logging the most housing violation and police calls. The University and South districts having the most forestry calls. The most rodent complaints came from the Fillmore and North districts and the University and Delaware districts had the most legal claim complaints. The division hopes that the Council found this information to be useful. RECEIVED AND FILED FROM THE CITY PLANNING BOARD NO. 3 Noco motors Fuels 1055 Genesee Street Accessory Pole Sign Item No. 107, C.C.P. 6/26/2001 The City Planning Board at its regular meeting held Tuesday, July 3, 2001, considered the matter captioned above pursuant to Section 387-19 of the Buffalo Code, Application for billboard, ground or pole sign permits. The applicant seeks to erect an illuminated 6.2fx7.5lx221 pole "ID" sign, to be located at 1055 Genesee Street. Under SEQR the proposed sign is considered an unlisted action which may be studied through uncoordinated review. The Planning Board voted to recommend approval of the proposed accessory pole sign conditioned on the maximum overall height of 181 and the area at the base of the sign to be landscaped. Giovino 1463 Hertel Ave. Sidewalk caf6 encroachment Item No. 102, C.C.P. 6/12/01 The City Planning Board at its regular meeting held Tuesday, July 3, 2001, considered the matter captioned above pursuant to Section 413-59 and 511-59 of the Buffalo Code, Sidewalk cafes and Hertel Avenue Business District, respectively. The applicant seeks to place a 9.3' x 49' sidewalk caf6 to be located in the right-of-way at 1463 Hertel Avenue. The Common Council voted to approve this item at their June 26, 2001 meeting. The Planning Board voted to receive and file the sidewalk cafe encroachment request. RECEIVED AND FILED NO. 5 K. Pratt 926 Main St. Sidewalk caf6 encroachment Item No. 42, C.C.P. 5/19/01 The City Planning Board at its regular meeting held Tuesday, June 19, 2001, considered the matter captioned above Page 3 01-0710-SS0702.txt pursuant to Section 413-59 and 511-57 of the Buffalo Code, Sidewalk cafes and Allen Street Business District, respectively. The applicant seeks to place a 8'x18' sidewalk caf6 to be located in the right-of-way at 926 Main Street. The Common Council voted to approve this item at their June 12, 2001 meeting. The Planning Board voted to receive and file the sidewalk cafe encroachment request. RECEIVED AND FILED FROM THE OFFICE OF STRATEGIC PLANNING NO. 6 Results of Negotiations 127 Northland, 270' W Jefferson Vacant Lot: 30' x 1201 Assessed Valuation: $1,700 The Office of Strategic Planning, Division of Real Estate has received a request to purchase 127 Northland Avenue from Mr. Amos Smith, Jr., 125 Northland Avenue, Buffalo, New York 14208. Mr. Smith operates a day care center at 125 Northland and intends to use 127 Northland for a play area for the day care children. The office of Strategic Planning and the Division of Collections have no objection to the sale. There are no outstanding taxes, building code violations, or other liens owed to the City of Buffalo by the purchaser. An independent appraisal of the property was conducted by Thomas M. Wolf, Appraiser, 2875 Union Road, Buffalo, New York 14227. He has estimated the value of the parcel to be Three Hundred Dollars ($300), Eight ($.8) a square foot. The Division of Real Estate has investigated the sales in similar properties in the subject area. Sale prices range from Twenty cents (.20) a square foot to Forty Cents ($.40) a square foot. The result of our negotiations is that Mr. Amos Smith, Jr. has agreed and is prepared to pay Seven Hundred Fifty Dollars ($750-00), Twenty Cents (.20) a square foot, for this parcel. Mr. Smith has also agreed to pay for the cost of the appraisal, transfer tax, recording fee's and cost of the legal description. I am recommending that Your Honorable Body approve the sale of 127 Northland Avenue to Mr. Amos Smith, Jr. in the amount of Seven Hundred Fifty Dollars ($750). 1 am further recommending that the Corporation Counsel prepare the necessary documents for the transfer of title and that the Mayor be authorized to execute the same. REFERRED TO THE COMMITTEE ON FINANCE NO. 7 Permission to file grant applications for funds from the NYS Office of Parks, Recreation and Historic Preservation The City of Buffalo is intending to submit the projects summarized below for funding under the New York State Office of Parks, Recreation and Historic Preservation Clean Water/Clean Air Bond Act and Environmental Protection Fund program. I am requesting that your Honorable Body authorize Mayor Anthony Masiello to file the application for funds from the NYS Office of Parks, Recreation and Historic Preservation in accordance with provisions of Title 3 of the Clean Water/Clean Air Bond Act of 1996. Each project will be will be for an amount not to exceed $500,000. Upon approval of said request, the City will enter into and execute a project agreement with the state for such financial assistance for these projects. These reimbursable grants require the City of Buffalo to match State funds awarded at a ratio of one-to-one or higher. Project Summaries: Page 4 01-0710-SS0702.txt Foot of Porter Waterfront Rediscovery Project To compliment and support public access to Buffalo's waterfront, this project will allow for the necessary capital improvements to create a public waterside deck at the foot of Porter Avenue. The project will tie together the rehabilitation of LaSalle Park and the planning for the Buffalo State College/West Side Rowing Club's Great Lakes Laboratory and Wright Boathouse Project in addition to providing much needed public access to one of Buffalo's finest assets, the Niagara River. The project is also supported by the TEA-21 funded Corridor Management Plan currently underway. Martin Luther King, Jr. Park Rehabilitation The eastern half of this Olmsted-designed park has been long neglected. This project proposes to rehabilitate pathways, recreational facilities such as tennis courts and the historic greenhouse building. Rehabilitation of these facilities is called for in the Master Plan for MLK, Jr. Park which is nearing completion and will give area residents much needed and well maintained greenspace. Delaware Park Lily Pond Restoration The Buffalo Olmsted Parks Conservancy is submitting an application for the restoration of the Lily Pond area of Delaware Park. This project will bring back an important historic feature of the park in addition to helping to alleviate a longstanding drainage problem at the northern edge of the park's meadow. PASSED AYES - 12 - NOES - 0 NO. 8 Buffalo Niagara Renewal Community In December, 2000, President Clinton signed the Renewal Communities Act of 2000 into law. This Act, designed to expand jobs and stimulate economic development, calls for the designation of 40 "Renewal Communities" nationwide which will be eligible to receive federal tax breaks and to provide a framework for State and local governments to offer incentives and other benefits. To become a Renewal Community(RC), an area must demonstrate high unemployment, pervasive poverty and general economic distress using only 1990 census data. To meet that criteria, Buffalo has joined forces with the City of Niagara Falls and the County of Erie to submit a regional Buffalo - Niagara Renewal Community application. Twenty of the 40 communities designated must be Federal Enterprise Communities (FEC). Buffalo received its FEC designation in 1994. Our application will highlight both Workforce Investment and Tax Incentives for Businesses. Benefits such as Wage Credits, including the Renewal Community Employment Credit and the Work Opportunity Tax Credit (WOTC), will offer a powerful incentive to employers who hire Renewal Community residents. Special Tax Incentives for participating businesses will also play an important role. Examples of the types of benefits available are explained below: The Renewal Community Employment Credit offers up to $1,500 during each year of this federal designation for all existing employees and every new hire living in the RC. The Work Opportunity Tax Credit is a credit of up to $2,400 against federal taxes for businesses for each new hire from Page 5 01-0710-SS0702.txt groups that have high unemployment rates or other special employment needs, including youth ages 18 to 24 and summer hires ages 16 to 17 who live in an RC. Increased Section 179 deduction - Allows a business to claim an increased Sec. 179 deduction (up to $35,000) if it qualifies as a Renewal Community Business Commercial Revitalization Deduction - provides accelerated deduction period for commercial real property located in a Renewal Community. Zero Percent Capital Gains Rate for RC Assets - the holder, for a minimum of five years, of an RC asset acquired between January 1, 2002 and December 31, 2009, will not have to include in its gross income any qualified capital gain from the sale or exchange of the asset. Our strategy includes working with all identified partners, including the Buffalo Employment Training Center(BETC) and the Workforce Investment Board (WIB), to link eligible residents from targeted areas to qualified business to ensure employment preparedness, opportunity and placement. We will also be identifying eligible businesses and informing them of the tax credit benefits that come with participation in this program. Using the strict HUD guidelines required for the application, the City and its partners have identified proposed census tracts, which meet the stringent economic indicators and are contiguous to the other eligible census tract and the region's common natural boundary, the Niagara River. A referral to the Common Council's Regional Governance Committee would be ideal to review this important proposal. Attached hereto are copies of purchase offers for the above units. Unit 803 at $155,000, Unit 901 at $85,000 and Unit 1201 at $192,600. Passed AYES - 12 - NOES - 0 NO.10 TRANSFER TITLE 1556 MAIN STREET CITY OF BUFFALO TO BURA The office of Strategic Planning, City of Buffalo has received a request from the Buffalo Urban Renewal Agency to acquire title to the above mentioned property. The property consists of a 1,500 square foot, two car garage, situated on a lot 74' x 174' The property was acquired by the City in November of 1999 through tax foreclosure; and us vacant. The Buffalo Urban Renewal Agency will enter into a lease of the Page 6 01-0710-SS0702.txt property with the Ujima Theater Company, for storage of equipment. I am recommending that your Honorable Boy approve the transfer of title to BURA. I am further recommending that the Corporation Counsel prepare the necessary documents for the transfer of title and that the Mayor be authorize to execute the same. PASSED AYES - 12 - NOES - 0 NO. 11 Transfer Title From BERC to City of Buffalo 300 Amherst Street East Vacant Lot: 253'x 178' Assessed Value: $47,900 The Buffalo Economic Renaissance Corporation acquired the above captioned property in 1997 on behalf of the City of Buffalo as part of B.E.R.C.'s contribution to the Main/LaSalle redevelopment project and expansion of McCarthy Park, The B.E.R.C. demolished the building and the property was part of a voluntary dean-up which was coordinated with the New York State Environmental Conservation and the clean-up has been completed. B.E.R.C. is now ready to quite claim the property to the City of Buffalo for One Dollar ($1.00). I am recommending that Your Honorable Body approve the transfer of 300 East Amherst Street from the Buffalo Economic Renaissance Corporation to the City of Buffalo for the Main LaSalle Redevelopment Project and Expansion of McCarthy Park. The interfund loans are repaid when the Bond Anticipation Notes or Bonds are issued to finance these projects. As of today, we have one request for money to finance projects and we will not reenter the bond market at this time. Currently, there are nineteen (19) City Projects with outstanding interfund loans totaling $5.388 million, not including this project. There is currently $2,500,000 of interfund loan requests awaiting approval, including the request listed herein. *Please be advised that once an interfund loan has been approved, the City is committed to the total cost of the project regardless of the amount advanced. June 26,2001 I believe that given our serious budgetary concerns, we should take this opportunity to save important city dollars by leasing Dunn Tire Park to Erie County as proposed by the administration. Dunn Tire Park has steadily lost money for the city, and we do not have the financial resources at this time to pay for the capital improvements and maintenance necessary for the stadium to operate successfully in the near future. As I noted in my comments about the latest audit of Dunn Tire Park filed last October, the stadium continues to be a financial liability for the city under the present operating agreement. Dunn Tire Park posted a net loss of $211,265 for the year ending March 31, 2000. The net loss for the previous year was $204,739. The actual loss from facility operations for the year 2000, according to the audited financial statement, was $1,356,623, but was offset by contributions from the General Fund, including debt service payments, of $1,043,616. The actual loss from operations as defined in the agreement has grown steadily since 1992-93 when Dunn Tire Park's net income showed a profit based on the agreement of $8,797. Since then, under the agreement, losses have steadily grown reaching $496,200 for the year ending March 31, 2000. As a city, we are facing serious cash flow concerns at this time. Leasing Dunn Tire Park to the county would help our cash position at this time and in the near future. RECEIVED AND FILED FROM THE PRESIDENT OF THE COUNCIL NO. 19 Hickory Woods Concerned Homeowners Association Citizens Environmental Coalition We are writing to express our concerns with the EPA's proposed sampling plan of the Hickory Woods neighborhood. Within the "Site Quality Assurance Project Plan June 2001 Sampling" it says, "NYSDOH and ATSDR also recommended that arsenic levels on residential properties adjacent to Boone Park be investigated further, since arsenic contamination in surface soil at elevated levels was detected in the park. This sampling plan has been prepared to address both of these recommendations." While we do agree that there are alarming levels of arsenic within the neighborhood, unfortunately arsenic is not the only chemical that is of concern that has been found on residential lots. The EPA should not only sample for arsenic but for Page 11 01-0710-SS0702.txt all other chemicals in the Hickory Woods neighborhood that have been found to exceed the Department of Environmental Conservation's soil cleanup objectives (Technical Administrative Guidance Memorandum 4046). We also are concerned with the fact that this sampling is being done as recommended by the Department of Health's Health Consultation which has yet to be finalized and peer reviewed. In the DOH's Health Consultation, the DOH found residential yards and play areas in Hickory Woods to be contaminated with cancer-causing PAHs. Some levels of PAHs were found over 100,000 parts per million. Levels of toxic mercury in Hickory Woods have been found to be 460 times above state soil cleanup guidelines (DEC TAGM 4046). Levels of cadmium have been found to be 40 times above TAGM. Levels of benzo(a)pyrene have even been found to be 39,000 times above TAGM. In addition to these chemicals, ash, black fill material, brick, cinders, coal, coke, concrete, fly ash, glass, and slag wood have been found beneath approximately 90% of the Hickory Woods residential lots investigated. Within the next few weeks the Peer Review Process will begin, giving independent scientists an opportunity to comment on the DOH's Health Consultation. We are very concerned that the EPA and the DOH are moving forward with carrying out the actions recommended in the Health Consultation while the Peer Review session has yet to begin. If the EPA is going to move forward with more testing, we request that these tests survey all harmful chemicals including arsenic, PAHs, mercury, cadmium, benzo(a)pyrene, etc. These chemicals should be tested at the residential lots surrounding Boone Park. Another inadequate sampling is not enough for the residents of South Buffalo. We also request that the residents of Hickory Woods be provided with an opportunity to comment on this proposed project because it is the residents that will be most effected by the test results. REFERRED TOT HE COMMITTEE ON LEGISTATION AND THE CITY PLANNING BOARD NO. 36 STREETS DIVISION GARAGE This department has been exploring possible alternatives to staying in and remodeling the existing Broadway Garage which houses the Streets Division of the Public Works Department. We investigated two existing buildings, one located in the E.Ferry/Fillmore area and the other in the Tonawanda/Ontario are at the request of the current property owners, I cannot reveal the exact locations. We employed the architectual and engineering firm of Trautman Associates to look at each site to determine if the operations currently taking place on Broadway could be re-located and the cost to renovate each site. The size and configuration of the building in the Tonawanda/Ontario site restricted its use for this facility. Attention was therefore focused on the Ferry/Fillmore area site. The preliminary cost estimate to acquire this site, remodel it to house vehicle maintenance and storage areas (both interior an exterior), refueling stations and a salt storage facility is $22 million. The preliminary cost estimate to demolish the Broadway Garage including asbestos abatement and environmental cleanup is $3 million. The total estimated project cost is thus $25 million. This estimate includes 20% soft costs (i.e. legal and design fees, etc.). A previous study looked at the cost of repairing the Broadway Garage. This study looked at repair only and did not look into expansion for vehicle maintenance, refueling stations or salt storage. Updating those costs to current construction cost is estimated at $13 to $15 million. Trautman Associates feel that we could acquire a site and build a new facility that exactly fits our needs for $25 million. OF LICENSES" ITEM # 30, C.C.P. 6/26/01 In response to item #30, C.C.P., June 26, 2001, the Department of Permit & Inspection Services, Division of Licenses has the following response to the "Audit Recommendations": Elimination of two- (2) bingo Inspector positions. While the department agrees that there has been a decrease in bingo and games of chance revenue due to circumstances beyond the control of the City of Buffalo such as non-smoking laws and Canadian bingo, we respectfully disagree with the recommendation to eliminate two (2) bingo inspector positions. The bingo inspector position is not only responsible for inspecting and auditing organizations to insure that all bingo games meet New York State laws and regulations, but they also conduct seminars for bingo organizations, to help maximize profits to themselves and in turn the City of Buffalo. This department's opinion is that any elimination of bingo inspector positions would further decrease bingo revenues. Adding one- (1) License Inspector position. The department is in agreement with the audit recommendation, additional personnel is needed in the Division of Licenses. The department's first priority would be to fill the clerical position that has been vacant since December of 1998 due to an early retirement. Filling this vacancy would allow the Division of Licenses to expedite license applications and to better monitor present license accounts. The Division of Licenses will request that Accounting Division review Peak System License Types with Munis Revenue Accounts to insure proper recording into city revenue accounts. The recommended excel spreadsheet in "attachment A" has not yet been provided to the License Division, upon being provided with said spreadsheet, the division will utilize it. The Division of Licenses is presently working with Munis personnel to interface the Peak System daily input to Munis Treasury and general ledger. This is a subject of great concern to me and to many of my colleagues in the New York Senate. There has been legislation introduced this year that addresses this problem. Senate Bill 4 1, which I co-sponsored, provides mandatory imprisonment for persons convicted of committing any crime with the use of a firearm. This bill has been referred to the Senate Codes committee. Other bills that have been introduced in the Senate which would require mandatory penalties or increase penalties for offenses using firearms include S340, S2725, S4456, S4561 and S4572. All of these bills have also been referred to the Senate Codes Committee. FRANCIS INCIDENT DARTMOUTH AVE 6/17/01 On June 17, 2001 Buffalo Police Officers Wishman and Calendra aimed their guns at my 12-year-old brother and then forced him and three of his friends to lay facedown in the street. The officers were searching the Dartmouth Avenue neighborhood for a man with a gun. My brother and his friends, none older then age 13, did not fit the description of the suspect. In the wake of such incidents as Amadou Diallo and Abner Louima, I am concerned about the! extensive use of force in this unfortunate incident. They shouted at the parents to mind their business and go inside, they threatened them with arrest and they did not treat them in the courteous manner that as law-abiding citizens they deserve to be treated. My brother, Kevin B. Cox 11, was traumatized by the incident and was in tears shortly after the officers left. If you have a 12-year-old son or grandson you might be able to imagine the fear and outrage this incident caused to all involved. Kevin Cox is a 7th-grader at Westminster Community School with a 90 average. He attends United Methodist Church on Eggert Road. He is growing up to be a gentleman and scholar and did not deserve to be treated in such a manner. I am demanding that the officers issue a formal apology to him and my mother for their horrendous treatment of both. In addition, in the hopes of creating an opportunity for growth and learning out of such a negative experience, I am asking that my brother along with the three boys be allowed to shadow the two officers for a day. Maybe if the officers and the boys spend the day together the boys can learn what a stressful job the officers have and be more understanding of their seemingly incomprehensible rage and the officers can learn the stress of being boys in a sometimes cruel society. I do not want my brother or the young men to grow up hating and fearing police as so many (other black men do today. Hopefully, the young men and officers can learn from one another in their day together and such incidents can be avoided in the future. The new owners, I'm sure.. are not aware of its existence However, they are talking that in the future they will want to expand out the back of the premise to add a dinning room. Any digging for a foundation would surely disturb this tank, I hesitate to mention this tank to them, as they seem to be at a lack for money to even get this business up and running. Our street floods when we have considerable downpours, backing up both sewer and drain water to our basements. (The last time was August 26, 1999 and we had 3 feet of water in the basement). The budget pages, at the conclusion of the document, have not been altered since 1998. Ujima Company, Inc. made its first attempt to acquire the Asbury Delaware Church in 1991. In 1996, when the church was in danger of being demolished, Ujima presented itself as a viable end-user and renewed the quest. The! Executive Director and President of the Board of Ujima Company expended a great deal of time and energy in the pursuit of this project between 1996 and 1998. The Company is re-submitting this proposal with the full knowledge that much has changed over the last three to five years but we regard the acquisition, renovation, and restoration of this church as a very time sensitive issue. In the interest of reopening discussion and encouraging serious consideration, we ask that you read this proposal and collaborate with us on future revisions. A. Purpose Ujima is a Swahili word meaning "collective work and responsibility". In keeping with our central philosophy of Ujima, we intend to create a universally accessible theatre arts institute. This requires that we acquire a building that can be renovated/designed to serve people of all sizes, all shapes, and all levels of physical and mental ability. The acquisition of the Asbury Delaware Church would allow Ujima to expand its operations and evolve as the UJIMA THEATRE ARTS INSTITUTE (working project title). The Asbury Delaware Church is actually two churches joined at the "hip". Thesmaller building was constructed in 1871 and is a two story structure with a full basement. The larger building was constructed in 1875 consists of a large sanctuary on the first floor, a full basement and towers. The imposing sandstone exterior gives the structure the appearance of being much larger than it is. In fact, the two buildings provide approximately 29,000 square feet of floor space. The layout of the space is simple and very open which makes it ideal for this proposed use. The ceiling heights of the two sanctuaries are ideal for performance space and there are no obstructing structural or marble columns. The structure is adjoined by a forty-one car parking lot which would allow for easy arrival and departure of children, seniors and handicapped clients. Most importantly, the church occupies the corner of Delaware and Tupper which is at the threshold of the Theatre District and easily accessible via large avenues and the expressway. There are currently no cultural institutions led by or dedicated to the artistic accomplishments of people of color in the theatre district. There are no universally accessible performing arts institutions providing performance and production opportunities to children of color, seniors and the handicapped in all of Buffalo. Ujima Company, Inc. is uniquely qualified to program a universally accessible arts institute. Ujima has an unparalleled twenty-three year history of excellent theatre presentation and educational programs for youth. The Company is generally regarded as an essential element in the cultural tapestry of Buffalo and has earned the love and respect of the entire community. Buffalo has at least eight arts and cultural institutions that the City and the County of Erie regard and support as Cultural Cornerstones. The creation of a Cultural Cornerstone based in the cultural values and sensibilities of African Americans is long overdue. We regard this project as a golden opportunity for Buffalo, Erie County and New York State, to take positive action and model the behavior that is Page 47 01-0710-SS0702.txt appropriate in a multi-cultural society. B. The Facility 1. Performance Spaces: There will be two performance spaces, a 150 seat theatre and a 400 seat theatre. The resident theatre company, Ujima Company, Inc., would use one of the two theatres throughout the season. Therefore one of the two theatres would always be available for presentations by the participants of Institute programs, other small arts and cultural organizations, and various not - for-profit community institutions. In recent years, Ujima has been in conversation with individuals from the Latino and Native American communities who are interested in starting culturally specific theatre companies. Ujima has committed to assist in this effort as it is in keeping with our philosophy of collective work and responsibility and our responsibility to our community. 2. Office Space: Offices for central administration of the resident theatre company and institute programs would be adjacent to meeting space. 3. Classrooms: Four classroom or workshop spaces are essential. Two of these spaces should provide floor space equal to the size of the two stages in order to accommodate rehearsals. C. The Components 1. Ujima Company, Inc.: Ujima Company, Inc. will be the resident theatre company and present its traditional season of five plays. Three will be presented in the 150 seat theatre and two will be presented in the 450 seat theatre. Company members will provide instruction and guidance for the Daytime Programs. 2. Daytime Programs: These programs will be dedicated to the segments of the population that are traditionally under-represented in theatre production: senior citizens, youth, and the handicapped. The two theatres will be used by these program participants for presentations to the general public. All of these programs would be partnerships with other institutions or agencies. These partnerships would allow us to seek funding through the New York Foundation for the Arts as well as human service funding sources. YOUTH a) Early Childhood Learning: ages 6-8 We have already begun a relationship with the King Urban Life Center. Beginning in the Spring of 1997 Loma C. Hill began serving as a guest artist at School #90/ the King Urban Life Center Early Childhood Learning Program. This program has been funded by the New York Foundation for the Arts and the KUL. The goal is to be able to provide programming for the KUL at the Ujima Theatre Arts Institute. b) Adopt-A-School: Herman Badillo The Herman Badillo school is within walking distance of the proposed Ujima Theatre Arts Institute. Principal David Caban has been very receptive to the idea of programming designed for his students. Ujima's purpose would be to bring Latino performing arts to the center stage of the Buffalo Arts and Culture Community. c) High School We have hosted the Planned Parenthood teen theatre workshop for students 12-17 years of age over the past few years. Loma C. Hill provided artistic direction for this workshop and it had been located at TheaterLoft, the home of Ujima since June 1997. We are no longer hosting this program but would like to offer similar services to other agencies serving teens. Baker Victory has requested a program for their residents, to be offered at our facility. We are unable to meet this request at our current site. Ms. Hill formerly directed the Student theatre Outreach Program for the Martin Luther King Institute (headquarters in Albany, NY). While the MLK Institute was disbanded by Governor Pataki, it provided a successful model for nonviolence training through theatre. We would like to clone this program at the Institute. d) After School Program Page 48 01-0710-SS0702.txt An after school program would be available between the hours of 2:30pm and 6:00pm. Ideally we would be able to provide placements for a few men and women on Workfare who have school aged children and are required to work in not-for-profit agencies. These parents would be able to fulfill their work requirement and have their schooled children participate in the Institute, thus avoiding the childcare dilemma. We have discussed this idea with Social Services and it was well received. We would not compete with Trinity Daycare for clients. I am writing as a resident of the Buffalo waterfront and as a member of Citizens for Common Sense in order to draw your attention to -the situation at the location formerly known as Crawdaddy's Restaurant. It is my understanding, based upon articles in the Buffalo News (October 13, 2000; October 21, 2000; November 9, 2000; May 9, 2001) and a. visit and phone calls to the Department of Permits and Inspection Services, that construction of a restaurant to replace Crawdaddy's is on hold for at least six months, there have been several delays initiated by Specialty Restaurants prior to this last one, Mayor Masiello has promised to take the site back under City control if construction is not begun by "the end of July," a permit to I.-mild has been filed by Specialty Restaurants of California but not processed because the permit fee has not been paid, once the fee is paid construction can begin using the plans submitted with no further public input. We strongly support the Mayor's efforts to regain control over that site. It is clear from the number of delays initiated by Specialty Restaurants that completion of this new restaurant is not a project high on their list of priorities. It is also clear, from the outlines of the building they propose to construct, that they have no strong interest in Buffalo, or in its slowly evolving renaissance. The drawings presented in the Buffalo News demonstrate no appreciation for, or attention to, our history or culture. Specialty Restaurants proposes an establishment which many in the city can not afford. We share in your hopes and vision for Buffalo's waterfront, but the site which is that area's centerpiece should represent us as a City, and must offer the possibility of access for all who live here. We believe this can be accommodated in several ways. First, by taking back the site and encouraging local business people to submit plans. This could reopen the possibility for public input into the design of the structure and draw on the experience of local restaurateurs who know our tastes and culinary specialties. At the CANAL CONVERSATION last October several speakers commented that visitors come to a locale to enjoy the culture of THAT locale. We should not allow a businessman in California final say over the menu in a restaurant that will represent Buffalo to tourists and business people from all over the world. Second, by requiring a 25 foot setback from the water which would allow at least minimal public access to the site. The public could enjoy the views and sunsets, if not the food and decor, as they stroll along what would now be an expanded waterfront walk. A walkway along the water through that site would also provide parents with a safe place to allow their children to watch boats being launched mid retrieved, Most important, however, a setback and walkway allows for further placement small bistros and cafes on either side of the new restaurant which could cater to less expensive tastes. As is being stated more regularly by residents, representatives and visitors, Buffalo is a city with much to offer. It is important that we protect and nurture these resources. The proceeds of the sale of the bonds authorized by this resolution, or any bond anticipation notes issued in anticipation of the sale of said bonds shall be deposited in the Capital Projects Fund to the credit of the Department of Permit and Inspection Services, Division of Housing and Inspections, "Neighborhood Redevelopment/Clearance Activities, 2001", Bond Authorization Account No. 6500 and shall be used for the class of objects or purposes specified in Section 1 of this resolution. Section 3. The City intends to finance, on an interim basis, the costs or a portion of the costs of said improvements for which bonds are herein authorized, which costs are reasonably expected to be incurred by the City, pursuant to this Bond Resolution, in the maximum amount of $3,500,000. This Resolution is a declaration of Official Intent adopted pursuant to the requirements of Treasury Regulation Section 1. 150-2. Section 4. The following additional matters are hereby determined and stated:. (a) The period of probable usefulness applicable to the class of objects or purposes for which the bonds authorized by this resolution are to be issued, within the limitations of Section 11.00 (a) 12-a. of the Local Finance Law, is ten (10) years. This list of ongoing projects has been growing rapidly, and presents this Council with a major opportunity to strengthen Buffalo's neighborhoods by assuring that upcoming construction jobs and business opportunities are equitably and aggressively spread throughout the City's neighborhoods; and Whereas: Many of these construction projects are seen as "Magic Bullets"., and are getting huge public subsidies in the hope that they will turn our City's fortunes around. However, the "magic" only works when the economic benefits of these projects are maximized at the neighborhood level, resulting in improved housing stock, revitalized commercial strips, and renovated infrastructure; and Whereas: Stable neighborhoods depend upon strong local institutions such as churches, stores, specialty shops, libraries, schools and community centers, that provide services for families and children. These institutions in turn depend upon families who are supported by jobs that provide a living wage, adequate benefits and employment stability; and Whereas: The construction opportunities outlined above present Buffalo with an enormous opportunity to reverse a legacy of racism, discrimination, segregation, exclusion and cronyism, and it is imperative that this chance be seized and utilized to reconstruct the social fabric of our fair City; and Whereas: The Black Chamber of Commerce has developed the following comprehensive 10 point plan to assure that the African American community gets a fair share of the benefits from the school construction program. These same points should be applied to all the upcoming, publicly funded construction activity:  Require a firm commitment to utilizing 35% African American owned businesses and a commitment that African Americans will make up 35 % of the labor force  Implement an incremental bonding program that increase the bond capability of African American businesses and enables them to handle larger contracts  Implement training programs that will permit contractors who are awarded contracts to provide training to additional employees who may be needed  Require that the Construction Manager select and train an African American company in construction project management  Implement a policy that will assure that smaller contractors will be able to bid and have a better chance of winning the contracts by breaking out smaller portions of larger bid packages  Implement a program to provide startup financing for successful bidders who may require additional capital to purchase supplies and make payroll  Require the Prime Contractor to actually use the African American companies that are agreed upon in the written contract Require the Prime Contractor to pay subcontractors every fifteen (15) days Provide the Black Chamber of Commerce of Western New York (BCCWNY) with copies of all RFQ's and RFP's for distribution Implement an aggressive policy for monitoring the utilization of African American owned businesses and laborers on the project. Troopers and the E.C. Sheriff s Department has ceased, effective Sunday, July 8, 2001 at 2:00 a.m., many citizens have expressed concerns regarding the decrease in the provision of Law Enforcement Services; and Now, Therefore, Be It Resolved: That this Honorable Body requests Buffalo Police Commissioner Rocco J. Diina to address the following community concerns: 1. What were the specific roles and responsibilities of the New York State Troopers and The Erie County Sheriff's Department with the Buffalo Police Department during the recent crime prevention partnership? 2.
