The City Planning Board at its regular meeting held
Tuesday, June 20, 2000, considered the matter captioned
above pursuant to Section 511-67 of the Buffalo Code,
Buffalo Coastal Special Review District.
The applicant seeks construct a 62,000 s.f., 45' high,
building addition for a records storage facility at 100 Bailey
Avenue. Under SEQR the proposed building is considered
an unlisted action which may be studied through
uncoordinated review.
The Planning Board voted to approve the issuing of a
Negative Declaration and the proposed building addition with
the following conditions:
1.All conditions set by the Common council with regard to
the
abandonment and sale of the portion of Old Bailey to Iron
Mountain be
met.
2. The river side of the building incorporated neutral colors
opposed to
conflicting colors on the building fagade.
3. The river side of the building include additional plantings,
as
needed, to fill any areas devoid of trees.
4. All new trees be a minimum 311 caliper.
5. Any grassy areas on the river side of the building be from
natural
growth and not turf.
6. The pathway being provided for access to the river be
landscaped and
maintained.

In response to the directive requiring the Comptroller to
file audit reports with the Common Council, I hereby submit
copies of the Broadway Market Capital Improvements for the
period July 1, 1986 to May 31, 2000.

We note that the above bonds approved for 1999-2000 and
totaling $1 million have yet to be sold by the City as of May
31, 2000 and are therefore currently unavailable. Also, it is
incumbent that the Broadway Market Management (BMMQ
reimburse the City the above Save-A-Lot monies totaling
$6,488 and for the City to deposit this reimbursement back
into the bond fund account in order to be available for future
renovations and/or rehabilitation of the Broadway Market.

REPORT OF AUDIT
BUFFALO WATER BOARD
REVIEW OF THE FINANCIAL RESULTS OF
OPERATIONS
In response to the directive requiring the Comptroller to file
audit reports with the Common Council, I hereby submit
copies of the Buffalo Water Board, Review of the Financial
Results of Operations, for the period July 1, 1997 to June 30,
1999.
Summary
The Board has lowered water rates, reduced the overall cost
of operating the water system, and is in the process of
transitioning to a fully metered water distribution system.
However, the Board's financial position has deteriorated
during the last two fiscal years, as reserves and fund equity
have been depleted. Further, the Board, although meeting its
debt service covenant, was precariously close to not doing
so at June 30, 1999.
The status quo or continued weakening of the Water Board's
financial position could lead to the suspension or withdrawal
of the credit ratings and reports cited above. This would
have an adverse effect on the Water Board's ability to
finance debt and in the worst case, the System could find it
to be prohibitively expensive to enter, or be shut out of, the
short and long term borrowing markets.
The Board, besides needing sufficient cash flow to finance
its short term day to day operations and capital
improvements, must also cope with ever changing
technology, edicts of the Environmental Protection Agency
(the EPA), and unforeseen events such as costly broken
water mains.
The Board must strive to maintain adequate Debt Service
Coverage, sufficient reserves, and Fund equity to provide a
cushion, should annual operating revenues and expenses
not conform to projections.
While there may be additional factors contributing to the
financial position of the Water Board, their options are
essentially limited to reducing costs or increasing water

rates. Therefore, a pro-active approach to establish a sound
and prudent, short and long term fiscal plan is an essential
step to ensuring fiscal stability of the Water Board. The
Board, the Authority, the Operator, the Rate Consultant and
Consulting Engineer, must jointly agree on a plan which
must strive to balance keeping water rates at their lowest
levels, providing sufficient capital funding to maintain the
system, maintaining reasonable reserves and fund equity to
sustain investor confidence, and developing monitoring
systems to enable corrections and improvements to occur
more timely.
These efforts will not only create a healthier fiscal position,
but will improve fund equity and restore investor and
ratepayer confidence.

BALCONY OVER RIGHT OF WAY
Mr. Michael Sherk, owner of McMonkeys Bar, located at
77-791/2 Chippewa Street, has requested permission to
install a balcony which would encroach City right of way at
said address. The proposed balcony would measure 50 feet
in length, extend 5 feet from the building face into City right
of way and be 14 feet above the public sidewalk.
The Department of Public Works has reviewed this
application pursuant to Chapter 413-67 (Encroachment
Regulations) of the City Ordinances and has no objection to
Your Honorable Body authorizing the Commissioner of
Public Works to issue a "Mere License" for said installation
provided the following conditions are met:
1.That the applicant obtain any and all
other City of Buffalo permits necessary for said
installation.
2.That the balcony be installed exactly as shown on
drawings submitted to and approved by the
Department of Public Works, Division of Buildings.
3.That no portion of the balcony be less

4.That, as per chapter 413-67 F of the City
Ordinances, in the event that the Commissioner of
Public Works determines the encroachment must

encroachment.
5.That the applicant supply the Department of
Public Works with a certificate of insurance, in an
amount deemed sufficient by the Corporation
Counsel, which will indemnify and save harmless
the City of Buffalo against any loss or damage
caused by the installation, use and/or removal of
said balcony.

REPORT OF BIDS - FRANCZYK PARK
DRAINAGE IMPROVEMENT PROJECT
On Wednesday, June 7, 2000, the Department of Public
Works received and opened public bids for the Franczyk
Park Drainage Improvement Project. The following bids were
received:
SLC Environmental Services $159,200.00
C.Destro Development$279,500.00
Environmental Products and Services $336,897.56
Based on the bids received I recommend that your
Honorable Body authorize the Commissioner of Public
Works to award a contract to SLC Environmental Services in
the amount of $175,120.00 (base bid $159,200 + $15,920
(10% unit price increase) = Total award $175,120.00).
This work is being done in cooperation with the New York
State Department of Environmental Conservation
(NYSDEC), Community Development, Environmental
Management Commission and the Parks Department. The
engineer's estimate for this work is $185,000 and funds are
available in Capital Project Accounts #30440806 and
30331906.

branch libraries. Once completed, this information will be
submitted to Your Honorable Body.

Mr. James W. Ragland Jr., owner of the newsstand
located at the northeast comer of Jefferson Avenue and East
Utica Street, has requested permission to expand same. The
existing newsstand measures 10 feet in length and 4 feet in
width. Mr. Ragland proposes to extend the existing structure
to 23 feet in overall length. Although the newsstand has
been locate( at this intersection for over thirty years no
license exists.
The Department of Public Works has reviewed this
application pursuant to Chapter 289 (Newsstands) and
Chapter 413-67 (Encroachment Regulations) of the City
Ordinances and has no objection to Your Honorable Body
authorizing the Commissioner of Public Works to issue a
"Mere License" to encroach City right of way provided the
following conditions are met:
1 .That the applicant obtain an annual newsstand
license from the Division of Licenses as described in
Chapter 289 of the City Ordinances.
2.That the applicant obtain a building permit and any
and all other City of Buffalo permits necessary.
3.That the applicant obtain written permission from the
owner of the property which abuts the right of way which the
newsstand occupies.
4.That the newsstand does not exceed 23 feet in
length or 4 feet in width.

PAYPHONE APPLICATION
Mr. Jay Alberti of Pay-Tel Corporation, 45 West Tupper
Street, has requested permission to install a public
payphone within City right of way as described in Chapter
441 (Telephone Facilities) of the City Ordinances. The
proposed payphone location is at 199 Allen Street, northwest
corner of Elmwood Avenue. The payphone would be
adjacent to the building face of the Just Pizza Pizzeria on the
Allen Street side.
The Department of Public Works has reviewed this
application and has no objection to the installation of said
payphone. However, before a license may be issued, each
individual proposed location must be approved by Your
Honorable Body in accordance with Chapter 441-4 of the
City Ordinances as revised (C.C.P. #136 of December 26,

sidewalk cafe which would encroach City right-of-way at said
address. The proposed cafe would measure twenty feet (20')
in length and project eight feet (8') from the building face into
City right-of-way.
The Department of Public Works has reviewed Ms.
Semeraro's application pursuant to Chapter 413-59
(Sidewalk Cafes) of the City Ordinances and has no
objection to Your Honorable Body authorizing the
Commissioner of Public Works to issue a "Mere License" for
said sidewalk cafe provided the following conditions are met:
1.That the applicant obtain any and all other City of Buffalo
permits necessary.
2.That the sidewalk cafe be installed exactly as shown on
plans submitted to and approved by the Department of
Public Works, Division of Buildings.
3.That the sidewalk cafe does not exceed twenty feet (20') in
length or extend more than eight feet (8') from the building
face.
4.That no portion of the sidewalk cafe be permanent in
nature or permanently affixed to the main building or public
sidewalk.
5.That the sidewalk cafe be completely removed from City
right-of-way from November 15 to April I each year.
6.That the applicant be assessed the annual fee of $1.35 per
square foot of City right-of-way occupied by said sidewalk
cafe as described in Chapter 413, Article IX, Section 59
(Sidewalk Cafes) of the City Ordinances.
7.That the applicant supply the City of Buffalo with a five
thousand dollar ($5,000.00) construction in street bond or
certificate of insurance which will indemnify and save
harmless the City of Buffalo against any and all loss and
damage arising out of the construction, maintenance, use
and removal of said sidewalk cafe.

SALE, ABANDONMENT AND

DEARBORN STREET
The Department of Public Works has been notified that the
City of Buffalo has received an offer to purchase that section
of present DEARBORN STREET (66 ft. wide) between the
southeast line of WAYNE STREET and the west line of the
CONTRAIL right-of-way.
A review of our records indicates that the City of Buffalo
does not have a deed to the right-of -way of Dearborn Street.
However, Dearborn Street is a dedicated public street under
Section 180 (Streets Deemed Dedicated) of the Charter of
the City of Buffalo in that the street was shown in R.
Chapin's 1830 map of the Parish Tract which is on file in the
Erie County Clerk's Office.
The Department of Public Works has no objection to the
closing, abandonment and sale of the above described
portion of DEARBORN STREET, subject to the following
conditions:
1.The final closing and abandonment of the street will
not become final until the deed of transfer is filed in
the Erie County Clerk's Office.

2.Acceptable easements or other agreements shall be
made between the purchaser and any public or
private utilities that presently have legal overhead or
underground lines, mains or cables within the
right-of-way.
Permission is requested from Your Honorable Body to
approve a resolution authorizing our department, in
conjunction with the Division of Real Estate, to abandon,
close and offer for sale or lease for further development at
said market value that section of Dearborn Street between
the southeast line of Wayne Street and the west line of the
Conrail right-of-way.

Request Ordinance Prohibiting the
Private Possession of Dangerous and
Exotic Animals
Item No.272, C.C.P., 6/13/00
You requested that the Law Department draft an
ordinance prohibiting the private possession of dangerous
and exotic animals. This Department currently is
researching and drafting such an ordinance. We conferred
with the New York State Department of Environmental
Conservation (the state agency authorized to permit
possession within the state of certain venomous animals
under the New York Environmental Conservation Law)
and we are reviewing ordinances from Rochester and
New York City. When we complete a satisfactory draft
ordinance, we will submit it to the Council.
The keys to a successful ordinance here are the
definitions of the animals under its scope and providing for
necessary exceptions from the prohibition. We need to
clearly define what is a "dangerous" animal or an "exotic"
animal subject to this ordinance. Such definitions can not
be too vague, which may create a constitutional infirmity
to the ordinance. The defined animals must be inclusive of
all animals that may pose a danger to persons within the

City but not be over inclusive to sweep in otherwise less
dangerous or harmless animals. Rochester's ordinance,
for example, list various species of "wild animals"
prohibited in that city. Rochester Code 3025,30-26.
Exceptions should be placed to allow scientific or
zoological possession of dangerous animals, veterinary
treatment facilities for such animals, as well as owners who
are transients through our City (for example, a traveling
circus, scientific exhibition, or an animal handler who is
merely passing through the City). For example, see
Rochester Code 30-28. The prohibition should be clearly
against possession of dangerous or exotic animals in
residential areas.

Text: The City of Buffalo has received a request to
enter into a PILOT Agreement by the owners of 101
Bakos Blvd, a.k.a. Walden Park Senior Housing.
The property is a low income senior housing facility,
originally funded by the New York State Housing Finance
Agency. It has 126 units, consisting of 114 one bedroom
and 12 two bedroom units.
The owners have agreed to the PILOT terms jointly
approved by this honorable body, as well as the Erie
County Legislature.
Attached you will find the application narrative for the
PILOT Agreement. NOTE: While the City's Law
Department has reviewed this application, and has no
objectives, it should be noted that one of the General
Partners, Stuart Alexander, is currently under contract as

Response to #255, C.C.P. June 15, 2000, "Maintaining
City Owned Vacant Lots"
The Department of Street Sanitation currently has 2
crews to do lot maintenance. Each crew consists of two
cutters, a high lift, a dump truck, and a broom. In addition,
there is a street flusher that works with both crews to flush
the areas that have been cleaned. As weather permits,
these crews maintain lots on a daily basis during the
spring, summer and fall months.
As you are aware, there are more than 8,000 lots that
need to be maintained by this Department. This number
continues to grow as the number of demolitions increases.
When considering the number of lots, and the equipment
that is available to do this maintenance, you can see that
regular maintenance is problematic. In addition, the rain
we have experienced recently limits our ability to clean
lots. When the lot is too wet, equipment will get stuck
and/or create large ruts that will need to be repaired
creating added work.
The Department will continue to work with

Councilmembers to address specific lots that need
attention. At the same time, we will continue to maintain
the inventory of lots that we have at this time. If you

Response to #237 C.C.P. May 30, 2000, "Proposal
Disposal of Abandoned
Tires"
The Department of Street Sanitation currently provides
four (4) tire collection days per year. These collection days
provide residents the opportunity to dispose of old tires
that they may have. In addition to these collection days,
the Department collects tires as needed when vacant lots
are cleaned. The Department regularly cleans and cuts
vacant lots in the City. If there are tires in the lot, these are
collected, and brought back to Broadway for proper
disposal. If a load of tires has been found illegally dumped
(50 or more) the Department contacts our vendor, Huron
Recovery, to pick these tires up.
It costs the City nearly $1.00 per tire per disposal, not
including the collection costs. Residents should be
encouraged to dispose of tires when they purchase new
ones. Every tire dealer provides this service at a nominal
fee. Even when tires are not purchased, residents have an
opportunity to dispose of their tires with tire dealers. This
is the preferred method for residential disposal of tires,
since increasing the current services would only mean an
increase in personnel and disposal costs.
Our Department will work with the Council if specific tire
problems arise, and will continue to provide the tire
collection and disposal services that we have been to
date. If you should have any questions, please contact me

Quality of Life Ordinance"
Please be advised that the Charter and Ordinances of
the City of Buffalo - Chapter 78Article IV - Control of Dogs
- 78-20-Noise already addresses the J. Laird Complaint.
This is a valid complaint, one that the City Animal Shelter,
City Clerks Office, and the Buffalo Police Department deal
with on a daily basis. Unfortunately because of staffing
constraints and high priority calls, these complaints too
often take a back burner.
Our recommendations would be to better inform the public

of the resources available to them. Also, we recommend
updating the ordinances to include a curfew for dogs. Dogs
must be taken in the house by 10:00 p.m. at the latest. The
present ordinance does not contain a time that the dogs
must be taken into the house. This addition to the
ordinance would eliminate dogs being left out all night and
could allow us to better enforce the ordinance.

"POSSIBLE SECOND CABLE TV FRANCHISE" # 183,

American Broadband Inc. (ABI) has begun formally
seeking authority to build and operate broadband service
networks to deliver competitive, bundled communications,
entertainment and information services in Buffalo and other
cities. The company's goal is to pass two to three million
households in medium-sized, metropolitan markets in the
eastern United States.
ABI has not built any cable systems to date, but is currently
in the process of getting permission to construct a $170
million broadband communications network in Rhode Island.
ABI has secured $50 million in equity capital from Great Hill
to launch this initiative in Rhode Island and is finalizing
commitments for additional equity and debt capital for a total
of $225 million
ABI wishes to provide competitive cable television services
as well as high-speed Internet access services in Rhode
Island, and is also applying for authority to provide local and
long distance telephone services. For a long time, second
cable franchises, known as "overbuilds," were considered

unprofitable by cable companies. However, the landscape is
changing across the country with cable's broadband now
providing new revenue streams with high-speed data and
telephony. In addition, there is more available capital at this
time, while the costs of acquiring existing cable systems
have increased dramatically. Direct cable competition in the
past had usually resulted in one of the companies going out
of business. However, today it is widely believed that there
will be enough demand for broadband services for more than
one cable company to survive in an area that has high
population density and heavy telecommunications usage.
ABI was co-founded by Edward T. Holleran Jr. and Great Hill
Partners in October 1999. Mr. Holleran previously served as
both Vice President of Broadband Data Services and Vice
President of New Product Business Development for
MediaOne and its predecessor company, Continental
Cablevision. Great Hill Partners is a private equity
investment firm. Great Hill's managing and founding partner,
John G. Hayes, is also chairman of ABI.
We have had preliminary discussions with ABI
representatives, and they are anxious to begin negotiations
with the City. They pointed out that, unlike some
overbuilders who seek to "cream-skim" the most lucrative
areas of a municipality, ABI intends to deliver service to all
residential areas in Buffalo.
Since ABI is a start-up company without a proven track
record, we are particularly interested in determining its

INTERIM BUFFALO TV ADVISORY COMMITTEE
We have asked the following individuals to serve on an
interim committee to advise this Office regarding the City of
Buffalo's Public, Education, and Government television
operations until a more formal advisory body can be
established. These are individuals that this Office has
worked with in the past, and we believe that they possess a
wide range of knowledge and technical skills that can play a
significant role in the success of this undertaking. We think
that their involvement will contribute significantly to our
efforts to start up operations at the Buffalo Municipal
Telecommunications Center at the former Apollo Theater.
Again, we have informed these individuals that this will likely
be an interim arrangement, and that city officials have
expressed a desire to eventually establish a more formal
body through ordinance to determine policy regarding
municipal TV operations.
This is intended to be an advisory technical board that will
focus on issues related to equipment purchases, policies
and procedures, and related matters. Various other
representatives of local broadcast stations and other
institutions have also volunteered to provide technical
assistance on specific issues.

We have met with Metricom representatives regarding
their desire to obtain permission from the City of Buffalo to
use the City's Right Of Way to provide service. They wish to
offer wireless data and Internet service by installing wireless
radio devices on utility poles. The representatives say that
the radio transceivers are the size of a shoebox, and will
need to be mounted on about 200 to 400 poles, depending
on topography. They are also seeking permission to provide
service in the surrounding municipalities.
We have requested that Metricom provide some additional
information, as well as a sample contract they have used in
other municipalities. After that time we would attempt to
develop a draft contract for the City of Buffalo that we would
submit for your consideration.

This letter is a follow up per our conversation requesting

assistance in eliminating the drug traffic being done around
our church facility, at 1365 Main Street, including West &
East sides of Main Street as well as Utica Street.
We are concerned for the health and the -welfare of our
members, children, and students. During after school hours
we have a tutoring program that approximately 30 children
attend as well as a number of tutors from the University of
Buffalo.
Also, we have made a considerable investment to be a
positive influence in the community. I am sure it is not the
intentions of our city's leaders to make the theater district
safe and allow Main Street, seven blocks away, to be
unsafe. There are new businesses that are revitalizing this
area of Main Street. It would be a tragedy to see those
businesses close because of the illicit activities going on.
Please advise me in reference to what our city leaders are
prepared to do to rectify this problem.
If I can be of assistance please let me know. I look forward

J. BARNACK RECONSTRUCT KENSINGTON EXPY
This is in response to your May 31, 2000 letter regarding
reconstruction of the Kensington Expressway. We welcome
the City's input and awareness that this expressway is vital
to the motorists who travel on it.
We are willing to work with the City on a number of issues to
make this highway safer. We appreciate your recognition
that proper police surveillance and enforcement are key to
calming motorist behavior. We look forward to reviewing the
Buffalo Police Department's ideas and action plan on how to
accomplish this.
We are also taking many steps to improve the safety for the
motoring public. We are in the process of improving signing
for the Route 33/198 interchange and fencing at various
points to prevent rocks and debris from being thrown onto
the expressway. Again, reasonable police action is needed
to curtail this activity.
A Capital Project (PI N 5512.36) from Elm/Oak to Fillmore in
the City of Buffalo is scheduled for the 2002 construction
season. We are looking at various improvements (signing,
pavement markings, etc.) to assist motorists traveling on this
section of the expressway.
Our maintenance forces are doing their utmost to keep up
with the constant maintenance needs of this highway and
are making improvements wherever possible. Our Traffic
Engineering and Safety Group continually reviews this
highway to determine whether additional safety measures
can be incorporated into various projects.
As a member of the Niagara International Transportation
Technology Coalition (NITTEC), we are ready to start a
project that will enable the NITTEC Traffic Operations Center
(TOC) to reduce congestion on the Kensington Expressway.
Our $7.OM project will install
cameras and detectors along the entire expressway so that
police, fire, and other emergency service providers can react
quickly to incidents, thereby reducing delays and accidents
on this highway. As you know, the City of Buffalo is a
member of NITTEC and your input on how we can improve
our operation of the TOC is always welcome. We
selected this highway for our first Intelligent Transportation

Systems (ITS) project, because we realize its importance to
the City and the overall transportation network.

COMPLAINT CDBG YR 26 BUDGET
We the administrative board of the Buffalo Minority
Faith-based Collaborative, hereby file a formal complaint
regarding the proposal for block grant money from the
C.D.B.G, Year 26 budget. Our complaint is as follows:
1 . Our proposals we filed in the Community Development
office on October 29, 1999 and stamped received, from the
Buffalo Community Development Room 920 at 4:41 p.m.
(enclosed is a copy). We understand by looking at the
proposed budget that our proposal was not entered into the
budget to be considered for funding approval. Due process
demands that a respond as to whether our proposal was
accepted or rejected for any and all caused should have
been submitted to us in writing. In keeping with the spirit of
Buffalo we are riot asking for a new program be funded but
rather as a Faith-based non-for-profit Corporation we to can
participate in the Community Development and renewal
program that are on going in Buffalo, New York.
2. According to Section 3, Title VI and Title I we find the city
In violation of our civil rights as a minority non-for profit
corporation. Title I states that the intend and purpose of
entitlement funds to a community must be done with the
community: A. Participating in the process. B. Benefiting

TO WHOM IT MAY CONCERN:
I have written this letter in order to express my objection to
the proposed change to Alternate Parking Type One that has
been proposed by Councilman Coppola. I believe that such
proposed changes will significantly contribute to the further
demise of the Central Park neighborhood. I have lived in that
neighborhood since 1954 and have witnessed insult after
insult being imposed on that area of the city. I live on Beard
Avenue in close proximity to Parker Avenue. I live in an area
that is on the leading edge of Central Park.
On May 31, 2000, an article appeared in the North Buffalo
Rocket. The article concerned the proposed changes to
Alternate Parking Type One that were being fostered by Mr.
Coppola. I have enclosed a photocopy of the article.
The basis for the article was a resolution that was apparently
submitted for consideration to the Buffalo Common Council. I
have enclosed a photocopy of the said resolution.
The resolution contemplates changing the current Alternate
Parking Type One parking restrictions to parking restrictions
that permit parking of motor vehicles on residential, tree
lined streets in an alternate fashion from 7:00 p.m. Monday
to 7:00 p.m. Thursday (a total of 72 hours) and from 7:00
p.m. Thursday to 7:00 p.m. Monday (a total of 96 hours).
I wish this letter to serve as a vehicle for me to voice my
opposition to the proposed change of the day and time
restrictions as to alternate side parking in the City of Buffalo.
As I indicated previously, I reside on Beard Avenue, which
runs between Starin Avenue and Hertel Avenue. As recently
as 1995, the residents of Beard Avenue were surveyed by
the City traffic engineer regarding the parking restrictions on
Beard Avenue. The residents of Beard Avenue
overwelmingly voted in support of the current time and type
of parking restrictions on Beard Avenue. I have enclosed a
photocopy of the survey results.
In 1997, there was also an effort to change the parking re-
strictions in regard to alternate side parking. It seems that a
regular assault is being made on the Central Park area by
the city officials. Apparently they cannot stand to see an area
survive the continued insults that have been thrown at this
area over the past 15 or 20 years. As a long time resident of
this area, I have watched this community struggle to
maintain itself as a thriving neighborhood. I have watched
public works projects, dreamed up by nameless and
unaccountable individuals create havoc in our community. I
have watched public policies destroy parts of the city. I do
not need to recite the litany of public works projects and
court mandated programs that have undermined our
neighborhoods. While there are individuals who might not

believe that something as simple as parking restrictions
could have a negative effect on a neighborhood, I would ask
those same individuals to try to think and imagine more
expansively than they might normally do.
Beard Avenue intersects with Parker Avenue. Parker
Avenue intersects with Amherst Street. At the corner of
Amherst and Parker is an NFTA train station. Prior to the
institution of the current parking restrictions on Beard and
Parker, the street segments of Beard and Parker Avenues
were subjected to long term (8 to 12 hours) of
bumper to bumper parking of motor vehicles on the streets
of
Beard and Parker by users of the NFTA light rail system.
When the
environmental impact study was done for this area in regard
to the
building of the NFTA rail system, one of the impact s on the
area
that was predicted by the said study was the parking
problem.
Such parking created congestion on the narrow streets of
Beard and
Parker Avenues. These streets were never designed to be
used as
a parking lot for users of public transportation. Despite this
fact, this is precisely what Mr. Coppola's change in the
current
parking restrictions will cause. Central Park is a residential
neighborhood; it is not a long term parking lot. Before the
cur
rent parking restrictions were put in place, the long term,
bumper
to bumper parking caused the complete obstruction of sight
lines
of pedestrians and motor vehicle operators. The resulting
inability
to view oncoming traffic on the said streets, created a
dangerous,
hazardous, and life threatening condition for drivers and
pedestrians.
The said congestion also seriously with the free flow of
motor vehicle traffic, including emergency vehicles.
The said parking prevented the residents of this, area and
their family, friends and visitors from parking their motor
vehicles on the said streets.
One of my many concerns with regard to the proposed
parking time and day changes as regards alternate side
parking on a citywide basis, is that such change will not
properly accommodate the additional two(2) hour parking
restriction that exists on Beard and Parker Avenues. I
believe that the proposed change will in fact
cause the removal of or diminution of the effectiveness of the
two(2) hour parking restriction. The present combined
parking restrictions that are in effect on Beard and Parker
Avenues are in concert with each other. I believe that the
proposed change in the alternate side parking times and
days will cause the two(2) hour parking restriction to be less
effective, and possibly to be eliminated.
I recall how difficult it was to convince the public officials in
this community, people like our Common Council members,
traffic engineer, public works commissioner, and others to
place certain parking restrictions on Beard and Parker
Avenues in order to prevent the area from being turned into

a parking lot for people using the NFTA rapid transit system.
I recall the absurd and ridiculous arguments that were put
forth by the public officials in the face of clear, obvious,
logical, and lawful reasons for such restrictions. I recall how
public officials tried to dissuade those in this area from trying
to protect the character and nature of the neighborhood.
The Beard Avenue area is adjacent to a commercially zoned
area and proximate to the NFTA train station. There is a
church at the corner of Beard and Parker. There is a mosque
at the corner of Parker and Amherst. The current parking
restrictions serve the present needs of the present needs of
the aforesaid streets, while also protecting the neighborhood
from the encroachment of long-term, bumper to bumper
parking. Such parking causes congestion, interferes with
snow removal, interferes with the removal of trash, garbage,
leaves, and brush trimmings, and creates dangerous, life
threatening, and hazardous conditions for pedestrians and
motor vehicle operators. The current parking restrictions on
Beard and
Parker Avenues do not eliminate parking on the indicated
street segments. However, the restrictions do prevent the
said streets from being converted to long term parking lots.
The current parking restrictions allow the shared use of the
streets for both residents of the area and visitors thereto. Mr.
Coppola's proposed changes would destroy the present
balance and favor commuters over the local residents. I also
hasten to add that the streets in question are regularly used
by contractors and their trucks, mailmen, landscapers, and
other persons who provide services to the residents of Beard
and Parker Avenues. Many, if not all of the above named
individuals, use vehicles that are not easily or practically
parked in the driveways of the people that they are servicing.
Without the current parking restrictions, prevention of the
use of the area streets for parking by the residents, and
abuse of the proposed parking rules by users of public
transportation would prevail.
For those who will argue that people will not change their
parking habits just because the parking restrictions are
changed, I suggest to you that people who must locate a
parking space for their vehicle on a daily basis, are
constantly on the look-out for more safe and more
convenient parking locations. People would rather park all
day in a quiet, residential, tree-lined neighborhood, rather
than a parking lot.
The current parking restrictions that are in effect on Beard
and Parker Avenues, strike the proper balance between use
and abuse of the residential streets for the parking of motor
vehicles. Changing the time and the days of the alternate
side parking restrictions that are presently in effect on Beard
and Parker Avenues
without incorporating and maintaining in a proper, correct,
and appropriate manner the two(2) hour parking restrictions
that presently exist is unfair, shortsighted, discriminatory,
and irresponsible. Any change to the current parking
restrictions should not eliminate protection to the said
streets, but rather should insure that at least the same
protection that presently exists should continue. Moreover, it
is unfair, shortsighted, and irresponsible to initiate parking
restriction changes in an area where the current parking
restrictions are providing the necessary and desired
protection for the residents and taxpayers of the
neighborhood.
Please note that the riders of the NFTA are not only

residents of the City of Buffalo, they are also residents of the
communities that surround the city. There are some persons
who would have us believe that only city residents will be
able to park on the residential streets.
It has also been argued that the current two(2) hour
restriction that is in effect on Beard and Parker Avenues
could just be linked with the proposed change that Mr.
Coppola wishes to impose on this neighborhood. In a
personal conversation that I had with the current traffic
engineer of the City of Buffalo in 1995, 1 was informed that
there could be no guarantee that if the parking restrictions
are changed, then the two(2) hour parking rule would also be
linked to the new restriction.
You are hereby placed on formal notice that if changes are
made to the parking restrictions that presently exist on Beard
and Parker Avenues, and if such changes result in, cause, or
contribute to the loss, change, or ineffectiveness of the
two(2) hour parking restriction
on Beard and Parker Avenues, and if such parking restriction
changes encourage, entice, promote, enable, support, or
contribute to the parking of motor vehicles on Beard and
Parker Avenues in such a manner that creates, enables,
promotes, or contributes to the creation of a hazardous,
dangerous, or life threatening condition to residents,
pedestrians, or motor vehicle operators, or interferes with the
removal of snow, leaves, garbage, trash, clippings, or other
refuse items, or with the free flow of traffic and emergency
vehicles, then I and other persons will hold the City of
Buffalo liable for all damages that may result from such City
created conditions.

On June 13, 2000, 1 received a letter in the mail that I had
been dropped from the rolls (terminated) from the Buffalo
Police Department pursuant to Article VIII, Section 8.4 of the

Collective Bargaining Agreement as of 0001hrs on June
12,2000.
May 12th, 2000, 1 called to speak to Lt. Carl Terranova
about taking off without pay, but he was not in. I then called
to speak to the 911 Lt. that was on duty. It was Lt. Kaska. I
asked if I could take off without pay, because I had no more
leave time available to me.
On the schedule I was marked "P" for leave without pay, not
AWOL.
On October 21, 1994, I lifted boxes of reports at work, which
caused a hernia in my left groin. I was order off work by my
physician and paid and carried, by the Buffalo Police
Department as Injured on Duty. In May of 1995, 1 returned
to work full duty. While on duty, with my gun belt on, I had a
pain in my right groin. I went to see Dr. Dugald Lewis who
confirmed that I had two hernias. I was ordered off work and
received bilateral hernia surgery in September of 1995. 1
was in such excruciating pain that I was bent over for
approximately a week and a half. I returned to work in
December of 1995 only to report off again in January of 1996
because of back and groin pain. My IOD claim was first
denied, but then reinstated, and then denied again. I had to
take several leaves without pay because of the pain and
pressure in my back and groin, in relation to my on the job
injury. Several doctors have relayed the pain to nerve
entrapment from the surgery, but the city still refused to pay
me so I continued to take leaves w/o pay, from the pain
caused by my on the job injury.
I spoke to Nancy Forrest on a few occasions:
On May 18th, 2000 Nancy Forrest called and left a message
asking how my visit with Dr. Gosy went and to see if I
needed authorization for anything. I returned her call. I
explained that Dr. Gosy prescribed Baclofen and I was going
to take the prescription to Walgreens and she should expect
a call for authorization. She asked if Dr. Gosy set up a follow
up appointment, I told her no, but I'd be seeing Dr. Chia.
On June I st, 2000 1 spoke with Nancy Forrest. I told her that
I had been to Dr. Suttons office and expressed to Dr. Riggles
that the Baclofen and motrin was not stopping the pain. Dr.
Riggles prescribed Acetaminophen w/codeine for the pain. I
told Nancy that I needed authorization for the medication.
I talked to her again on June 7th, we talked about the
medical report sent by Dr. Gosy. I told her that I had been off
for approximately 3 weeks and wanted to know if I'd be
getting paid soon, since Dr. Gosy said that my pain was
related to the surgery of the original on the job injury. She
said that she'd look into it and get back to me. I called her for
the next two days to no avail. I called Joyce to find out if I
had been transferred back to IOD status, or not, but she
would not return my calls either.
On June 13, 2000, someone named Nancy from Dr. Gosy's
office, phone number 6269900 ext. 19, called and asked if I
had talked to Dr. Gosy about being off work. When I asked
why she wanted to know she replied that she just wanted to
know. I feel that Nancy Forrest asked her to call me. Dr.
Gosy agreed that my pain is in relation to the surgery.
I feel that I was wrongfully terminated. I also feel that I was
terminated because:
It was determined, that my pain was relevant to the sugery
from my original injury. If I were given Injury on Daily status
then the next step would have been to pay me dating back to
1996. 1 feel that the Buffalo Police Department should have
a qualified physician handling their medical affairs, rather

than allow Deputy Police Commissioner, George Loncar,
play doctor. How can he determine anything when he denies
seeing any medical reports sent to him. Does he read his
mail? How is he qualified to go against what three different
specialists have said? If the city is going to let any
unqualified person determine my health status, then what's
wrong with choosing the custodial worker or the auto
mechanic? They would be just as qualified to put on a
bandage or read a report.
I wish to be reinstated to my position as a Police Officer
along with full benefits, and retroactive monies due to me.

LAKES/GE CAPITAL
First I must thank you for the great job you've done for our
city. I am a 44 year-old African American father of seven
born and raised here in Buffalo. I filed a charge of
discrimination with the EEOC against my employer Great
Lakes Collections a division of GE Capital on May 25 2000. I
have worked here for almost seven years as a Debt
Collection Specialist, Last year I made almost 70k. Out of
the 1500 plus employees here I finished in the top ten last
year. My job is very stressful, my employer won't admit it but
due to the nature of our business we tend to use" any means
necessary " to get debtors to pay their bills. Compliance has
become a major concern of our company but we the
collectors and managers who have to survive by collecting
money are able to get around most of the monitoring. I am
older than most of my co-workers who consider me old
fashion because of my ways. This has also put me at odds
with my current managers on several occasions. I have
never been a problem employee during the almost 7 years
that I have worked here until now.
I'm sure you are aware of the history of my company
regarding discrimination, unfair labor practices and
allegations that were made public by former white recruiters
that my employer has a history of denying minorities equal
employment opportunities. As I write to you today there are
no minorities in upper level management. I was denied here
when I first applied although I had a degree and was working
full-time as a 91 radio announcer for WBLK 93,7FM. I have
also held similar positions at WKBW 1520am where I was
the 1st African-American radio announcer in 1980, NVUFO
1080am, CfNG Energy 108ftn in Burlington Ont, where I
made Canadian history as the I st African- American radio
announcer to work there and get #I ratings for a year in my
time slot (7p- 12p) right after being hired. I have also worked
for IATUF FM931/ WJYZ Smooth Jazz 92.9. 1 overcame
discrimination there after I was initially turned down by them
although they had 4 openings and I was referred to them by
my good friend Brian Rusk who had been contacted by the
general manager of the station who was seeking help. was
the I st African American radio announcer to work there.
They fired me after 3 years because I started complaining
about the double standards they used regarding me. I sued
them and accepted an out of court settlement.
I have put up with the problems here at Great Lakes
because I have been addicted to the money, but I have had
enough. There has always been a double standard here at
Great Lakes regarding handouts and favoritism shown to

some employees. Because of the lack of rules concerning
accounts we the collectors are pitted against each other, I
am amazed that we have not had any serious incidents. One
of my co-workers who is African-American and the top
collector in my area was always using the word "nigger" in
conversations with me and my co-workers who are mostly
white, right out on the collection floor. This made me
uncomfortable because I consider myself a professional. I
talked with this person about this several times at work also
If We Went Out for drinks after work to no avail. I eventually
talked to my immediate managers one is Caucasian and the
other African American I had no success. I then spoke with
the vice president he ignored it so I went and talked to our
CEO who said he would look into it. I also told my CEO that I
had written a letter to the chairman/CEO of GE Capit#1 lack
Welch. This was in April. Word got out that I was a "snitch"
most of my co-workers now avoid n,4. Almost 2 weeks later
that same person called a white girl a "bitch" in front of
several witnesses, she went to human resources to complain
who in turn sent her back out to our vice Jeff Hauser who
swept it under the rug and took no further action. During the
past 2 weeks I have been threatened with termination twice
by our vice president Jeff Hauser. The first time one of my
managers had made a mistake regarding an account. He
was on vacation I was told by Mr. Hauser that if this
manager could not confirm what I had told them I would be
fired. When he came back he cleared it up they never
apologized. Then I was called into Mr. Hauser's office May
24, 2000 with one of my managers who had went to him and
complained about an account of mine. The first words out of
his mouth were " you must be tired of working here, am I
going to have to fire you". I was completely caught off guard
I asked what was he talking about he said that it was about
some comments that I had put on one of my accounts that
they had taken and given to my co-workers. At that moment I
turned around and walked out because I didn't believe that
he had called me in there for that, I was truly offended-
I went and talked to our CEO Jeff Wahl who assured me that
no one could fire me without his approval. I left his office to
get back to work when f found out that Mr. Hauser was
taping my calls for an hour. He had also run a phone report
on me to see who I was calling because he was aware per
Mr. Wahl that I had written a letter to Jack Welch CEO-GE
Capital in Fairfield Conn, regarding my concerns. Mr. Hauser
also ordered a copy of my payment journal and gave it to
one of my co-workers, this has never happened to me
before, During the almost 7 years that I have worked there I
have never had anyone monitor my phone for that amount of
time especially a vice president. These things that they did
that day have led me to believe that they are trying to get rid
of me. I found out recently that 3 of my co-workers Elsie Hall,

filed discrimination claims against Great Lakes.
Your Honor I have never written to you before, I honestly
believe that you are a fair person who cares about the
residents of our city. As a taxpayer and property owner here,
I do not feel that it is fair that a company such as mine
should be allowed to pull the wool over the eyes of people
such as yourself while continuing to display an obvious
pattern of discrimination and racism- If someone did a drug
test on the employees here this place would be a ghost
town, this includes the executives. I know of a former

employee who carried a pistol to work everyday because he
had a permit. I also know of 2 people who work here both
Caucasian who carry guns in their cars. There is also
someone that writes racist comments on the bathroom walls
all the time. One of my managers who are married fathered
a child out of wedlock with another manager here, he is the
one giving me the most difficult time, I have no problem
when it comes to respecting those of authority, but when the
playing field is not level and my income is being affected I
must speak out, I realize that my company has a contract
with the city I am asking you to please have someone
investigate my allegations. I have kept a journal and I have
witnesses to back up my claims. I intend to pursue this
through the FEOC because there are some issues that need
to be addressed,
As I write to you today I haven't been to work June I st or
2nd. I fear for my safety because once my allegations are
proven to be true there may be retaliation from my
co-workers. My income went up an average of l0k every year
since I have been working here. My goal was to make 85k
this year, with what's going on now I will be lucky to make 5
5k this year. I honestly feel that my employer -is intending on
finding a reason to fire me because I have been complaining
about what I feel is not right. 1 am positive your intervention
may help bring about a change and hopefully create a better
working environment.

last years (1999) financial audit for the Polish Community
Center of Buffalo (PCCB).
As outlined in the audit, the PCCB employs sound fiscal
practices to maintain financial and programmatic stability
and accountability. The agency stands as a citywide model
in this regard.
On behalf of the PCCB Board of Directors, I reiterate our
disappointment and concern with the process adopted to
acquire this document. At the June 6, 2000, Finance
Committee hearing, it was established that the PCCB is the
only city-funded, community-based agency that the Council
asked to submit this document. While our agency is
singled-out to meet this demand, an increasing number of
city-funded agencies are in serious financial trouble.
Ironically, none of these agencies have been asked to meet
the same scrutiny as the PCCB.

Dear Mr. Pitts:
Recently, the City of Buffalo, City Clerks Office, issued an
RFP (Request for Proposals) for a new telecommunications
system. In response to the RFP we submitted a bid. We are
a City of Buffalo business located in the City of Buffalo
downtown corridor area and have been at this location for
two years and have a staff of twelve employed at this
location
On Tuesday, May 16, we were notified via mail from the City
Clerk's office that the telephone system was going to be
awarded to another company. We respectfully request that
this award be reconsidered based on the following facts:
Originally our bid was low, however we have been informed
that the vendor who is receiving the award was given a 2 nd
opportunity to bid on this job. We were not given that
opportunity.
We are based in the City of Buffalo and have employees,
including myself, who reside, support, pay taxes and
patronize business' in the City of Buffalo.
We are currently under contract to the City of Buffalo
(Informal Price Agreement #0117, INSTALLATION OF LAN
DROPS), which was awarded on May 10, 1999 and
applies to all City of Buffalo Departments, Agencies and
Authorities with regard to new and/or rerouting of all LAN
drops. Our service on this contract has been excellent, with
many of the drops being installed within a twenty-four hour
period or less.
We have excellent references with the City of Buffalo
working closely with Phil Nasca, Peter Barone, Pat
Sucharski and other staff in City Hall.
We are aware of the many offices being moved in City Hall,
due to the new charter; therefore, we are working to ensure
that all the LAN drops are in place to allow all necessary
moves to go forward in a timely fashion.
We stated in our proposal that we believe The City of Buffalo
would save over $20,000.00 over a five year period due the
comprehensive 5 year equipment warranty that comes with
our equipment, compared to present Maintenance and
Service contracts that the City of Buffalo continues to renew
on presently installed systems. These contracts are renewed
without bidding, even though we employ many certified
Toshiba technicians, who, including myself, installed many of
these same systems in the City of Buffalo.
Our equipment warranty also covers failures caused by
external causes including lightning, power surge, flood, fire,
tornado, earthquake, abuse or misuse.
We would like to believe that being a City based company in
this period when so many companies leave the City for other
parts of Western New York, or even move to other states
would have some bearing on how contracts are awarded by
the City of Buffalo. Other municipalities consider location of
vendors when awarding various contracts put out to bid.
I am available to discuss this matter with you or any member
of your staff. Again I appreciate any consideration you may
give to me in this regard.
I believe the City of Buffalo needs to work as partners in the
City for the City in order for the City of Buffalo to continue its

rebirth. It certainly would be a shame, that in this exploding
period of technology, that the City of Buffalo did not support
one of the few interconnect companies located in the City.
In closing, I would like to thank you for your consideration of

us, but I believe you will understand our total frustration in
the award of this contract, since we presented the original
low bid.

Dear Mr. Michaux:
Enclosed for filing with the Common Council of the City of
Buffalo is a request from County Executive Joel A. Giambra
to the County Legislature to undertake a study of the
feasibility of sending sewage from the County's Southtowns
facility to the Buffalo Sewer Authority (BSA) for treatment.
The purpose of the study is to analyze the cost effectiveness
of making the sewer connection. It has the potential to offer
many benefits to all involved parties, including the City of
Buffalo. Some of the potential benefits include:
A new pipeline would open up undeveloped land along
Route between Southtowns and Buffalo, including some in
Buffalo for redevelopment, such as the Bethlehem, LTV, and
Union Ship Canal properties.
The additional revenue received from Southtowns for
treating sewage would help the BSA to offset their operating
costs.
This alternative offers much more industrial treatment
capacity than that which currently exists, as well as better
environmental protection against industrial discharges to the
two existing treatment plants at Southtowns and
Lackawanna.
This alternative would remove a sewage plant adjacent to
Woodlawn Beach State Park and therefore, offer additional
environmental benefits and safeguards to the bathing public

This alternative would also eliminate a sewage plant from a
residential neighborhood in Lackawanna.
Before such a project can become a reality, a cost effective
analysis is needed to analysis the alternative. An economic
analyst is being proposed to evaluate sending sewage from
Southtowns Sewage Treatment Agency's plant to the BSA. A
connection to the BSA could provide a lower cost for treating
the sewage to both parties. However, the alternative has to
be compared against the capital cost of sending the
Southtowns sewage to the BSA.

A.The festival shall be conducted on Hertel Avenue from
July 12 through July 16, 2000, between the hours of 10:00
a.m. and 10:00 p.m. with Monday, July 10 from 6: 00 p.m.
and Tuesday, July I I to be used only as set-up days, and
Monday, July 17, 2000 to be used only as a breakdown day
with traffic to recommence by 6:00 a.m. of that day. Games
of chance and amusement rides shall be shut down at 9:00
p.m. each day of the Festival; and
B.Hertel Avenue, between Crestwood and
Tennyson Avenues, shall be closed to vehicular and bicycle
traffic, and dogs and other animals shall be prohibited during
the festival. In addition, cross streets bounded by Colvin,
Linden, Delaware, and Tacoma Avenues, including those
boundary streets, shall be part of the festival area subject to
its rules and regulations. Pern-tittees with the cooperation of
and at the direction of the Police Department will furnish and
locate barriers to be placed at the beginning time of the
festival and to be removed at the end of the festival. Banners
and security will also be maintained at Wilbury Place,
Shoreham Parkway and Cheltenham Drive; and
C. That the city-owned residential parking lot,
located behind 1180 Hertel shall be closed to general use
and shall be reserved solely for those residents of Hertel
Avenue residing within the festival area, and this restriction
shall be enforced strictly by the city and festival committee;
and
D. That the festival committee be, and hereby is,
authorized to erect
appropriate banners and fittings on street lamp
posts on Hertel Avenue from the easterly side of Colvin to
the westerly side of Delaware, and a banner across Hertel at
Tennyson and at Crestwood, all within conditions specified
by the Department of Public Works; and
E.Permittees shall furnish to the City of Buffalo
proper liability insurance as determined by the Special
Events Committee and the Corporation Counsel; and

F.Permittees shall assure complete responsibility
for removing barriers, pennants, decorations, barricades,
stands, equipment and any trash or debris in the are arising
out of the festival; and
G.Permittees shall assume complete responsibility
for conducting the festival in compliance with all laws and

city departments, including Police, Fire, Street Sanitation,
Transportation and Public Works; and
H.Permitees will retain 18 (eighteen) additional security
personnel (off-duty
Buffalo Police Officers to patrol the event area bound by
Colvin, Linden,
Delaware and Tacoma from 7: 00 p. m. to 11: 00 p. m. for
the five (5) days of
the Festival. One additional officer will be stationed in
Hertel Alley from
5: 00 p. m. to 10: 00 p. m. for the five (5) days of the

Whereas:Delaware Park's Hoyt Lake is a
wonderful asset to the City of Buffalo both historically and
aesthetically; and
Whereas:It would behoove the city to encourage increased

Historical
Society and, seasonally, Shakespeare in the Park, the

condition of Hoyt Lake is unacceptable. The lake emits an
execrable odor and is filled with debris and litter; and
Whereas:The trash rack for the lake has been declared an
engineering mistake because its location coupled with
certain weather
conditions invites an inundation of garbage; and
Whereas:The heavy precipitation this spring, especially
during Mid-May, caused the Scajaquada Creek trash rack to
overflow into Hoyt Lake;

WHEREAS, on July 27th 1982, C.C.P. No. 212, the
Common Council of the City of Buffalo adopted the New
Buffalo Industrial Park Urban Renewal Plan to reindustrialize
major portions of the abandoned railroad yards of the Far
East Side Community; and
WHEREAS, the public development of the New Buffalo
Industrial Park has been substantially completed and almost
the entire 200-acre project has been privately redeveloped
and the Plan has succeeded in dramatically revitalizing the
project area; and
WHEREAS, the Urban Renewal Plan's Building Coverage
Standards require a minimum coverage of 25% of a parcel,
by the principal building; and
WHEREAS, one of the few remaining sites available for
private redevelopment within the Project Area is Parcel 92A,
a small residual parcel, 4.85-acres in size (3.75acres net of
easements), which borders the City's East Side Garbage
Transfer Station; and
WHEREAS, the redevelopment of this unique parcel will
require a waiver of the Plan's 25% Building Coverage
Standard in order to allow for an undeveloped "bufferarea"
adjacent to the East Side Garbage Transfer Station; and
WHEREAS, the City Planning Board, gave its unqualified
approval, at their meeting of May 23rd 2000, to Amended the
New Buffalo Industrial Park Urban Renewal Plan, to
authorize the Vice Chairman of the Buffalo Urban Renewal
Agency to waive the 25% Building Coverage Standard for
Parcel #2A;

B. Any person, firm, entity or corporation docking at a

punishable by a Class E fine in the amount of $105. The
Commissioner of Police and the Commissioner of Public
Works shall possess concurrent jurisdiction in the
enforcement of this provision.
C. Any vessel docked at a City-owned property without
permission shall be towed away by the Commissioner of
Public Works and the cost of such towing shall be charged to
the owner of the vessel.

INVESTIGATE INCREASING FEE FOR GRASS CUTTING
Whereas:There are well over 700 vacant parcels of land in
the City of Buffalo in which the Department of Streets and
Sanitation, Division of Neighborhoods and the Mayor's Task
Force on Housing has cut between June 1999 to the
present; and
Whereas:The Department of Streets and Sanitation
forwards a five (5) day notification letter to property owners
advising them to take care of their vacant parcel(s) of land or

be charged a minimal fee of $52.50 should city crews have
to do the work; and
Whereas:Various Departments within the City of Buffalo
continue to extend themselves by cutting down overgrown
vegetation and clearing debris from vacant lots on a rotating
basis and often charge a fee of only $52.50. This fee reflects
only a fraction of the cost that could be charged for the
amount of time, manpower and energy extended to do such
work; and
Whereas:There is current legislation that allows the City of
Buffalo to charge a rate conducive to the amount of work
done on such vacant lots in order to assure its cleanliness
and that the overgrown vegetation is maintained on an
ongoing basis;
and
Whereas:A review of the current manner in which specific
fee rates are determined to ensure that maximum penalties
are imposed particularly in abusive and neglectful situations
should be conducted; and
Whereas:Encouraging property (vacant land) owners to be
more accountable in maintaining their properties will allow
for the various departments within the City of Buffalo to
dedicate more time on dealing with issues specific to the
various departments.
Now, Therefore, Be It Resolved:
That this Honorable Body request the Department of Streets
and Sanitation, Division of Neighborhoods and The Mayor's
Task Force on Housing give a full report on the vacant lots
that have been cut between June 1999 to the present; and
Be It Further Resolved:
That this Honorable Body requests the Department of
Administrative Adjudication give a detailed report on the fees
levied against owners of vacant parcels. This report should
include the number of property owners who have not paid
the fees associated cleaning their property as well as what
perameters are in place to collect the outstanding fees; and
Be It Finally Resolved That:
The Corporation Council's Office research the necessity to
raise the minimal fee charged to correct the noted violations
as cited by city personnel or the actual cost of the work.
