July 9, 2002 were approved.

RE- APPOINTMENT AND APPOINTMENT OF MEMBERS
TO THE BOARD OF HEATING EXAMINERS
Pursuant to the powers vested in me by Section 238 -17,
Article 11, Chapter 238 of the Buffalo Code, I hereby reappoint
and appoint the following individuals to serve as members of
the Board of Heating Examiners.
REAPPOINTMENT: Uly Hankerson 102 Alma
Buffalo, 14216
Mr. Hankerson's reappointment is a continuance of his term
and the new term will expire April 30, 2007.
APPOINTMENT: Robert P. Moffett Jr. 449 Crescent
Ave. Buffalo, 14216
Mr. Moffett is currently the Acting President of Colgate Heating
Corporation. He has served with the company since 1987,
which his father, now deceased and a former member of this
board, founded in 1972. A licensed heating contractor, Mr.
Moffett has completed many permitted installations for the
industrial, public works, commercial and institutional customers
in WNY.
Mr. Moffett, a lifelong resident of Buffalo, graduated from
Canisius College in 1987 with a B.A. in History and
Economics. Mr. Moffett's term will commence immediately and
expire April 30, 2005.
Daniel G. Granville 112 South Street Buffalo, 14202
Mr. Granville had previously served as New Construction
Manager and Supt. of Maintenance for Buffalo Urban Renewal
and as the Chief Engineer for the Hyatt Regency Hotel. Mr.
Granville also worked as an engineer for Memorial Auditorium
and Pilot Field. Mr. Granville's term will commence immediately
and expire on April 30, 2003.

I hereby certify that the above named individuals are fully

This communication will correct the one filed June 10, 2002. By
charter, the terms of these appointments must be staggered in
one, three and five year terms. I apologize for any

ACQUISITION OF 364 BARAGA
Under a contingent "Order on Consent" submitted to Federal
District Court Judge Elfvin, LTV and Hannah Furnace will
transfer $16.5 million and 220 acres of land to Steelfields LLC
to remediate this former plant site in Buffalo under NYSDEC
oversight.
Under the comprehensive clean up plan, it is necessary for the
remediating party (Steelfields) to acquire Feine Steel at 364
Baraga Street. The remediating party has experienced difficulty
in its initial efforts to acquire 364 Baraga Street. The purpose of
the acquisition of this property is to facilitate the remediation of
220 acres of contaminated land in the City of Buffalo at the
expense of the responsible parties.
At this time, the Common Council is requested to authorize
BURA to act as its agent and to take all steps reasonable
and /or necessary to acquire the Feine property (364 Baraga
Street) pursuant to Section 204 of the Eminent Domain
Procedure Law, or otherwise. The property upon acquisition
may be transferred to the remediating party.
Mrs. LoTempio moved:
That the above communication from the Mayor dated July 22,
2002, be received and filed; and
That the Common Council does hereby authorize the Buffalo
Urban Renewal Agency to act as its agent and to take all steps
reasonable and /or necessary to acquire the Feine Steel
property at 364 Baraga Street pursuant to Section 204 of the
Eminent Domain Procedure Law, or otherwise. The property
upon acquisition may be transferred to the remediating party.

The Arts Commission -has reviewed the attached text
proposed to be inscribed on the pedastal (rear) of the Spirit of
Womanhood sculpture in Delaware Park.
The Arts Commission has no objection to the proposed
inscription to be executed by Galle Memorial at no cost to the
city.

Commission dated July 17, 2002, be received and filed -, and
That this Common Council approves the inscription as listed in
the above communication to be executed by Galle Memorial for

PERMISSION TO ENGAGE CONSULTANT
ART CONSERVATION SERVICES
Concurrent with the ongoing task of caring for public artwork
in the City of Buffalo, the Arts Commission has identified one
(1) work in need of conservation treatment, and twenty- five(25)
works as in need of preservation treatment.
A detailed request for proposals (RFP) was issued to
conservationists specializing in the restoration and preservation
of sculpted artwork. Two (2) responded with or without
proposals for the above mentioned pieces. A summary of the
proposed costs is attached.
The RFP was structured to enable the selection of one or more
conservators to work on one or more pieces. The Commission
has endeavored to select the conservator best qualified for the
particular works as listed below:

For conservation of "Chopin" and preservation of "The Hiker,"

" "Samuel Welch, " "Dortmund plaque, " "Busti plaque, " "Gen.

" "Commodore Perry, "
"Untitled 1 & 2, "Pulaski, Eagle," "Centaur," and "Gates Circle
(urns and lampstands)" at a cost not to exceed $59,425.00.
The Arts Commission voted to recommend to Your Honorable
Body that the above listed consultant be engaged under
contract for the work prescribed and the costs listed above.
Funding is available through the percent for art capital budget
allocation from account # 36321006.
Thank you for your consideration and we are always available
to answer any questions regarding this matter.

MONTHLY REPORT FROM THE DIVISION OF CITIZEN
SERVICES (MAYOR'S COMPLAINT HOT LINE AKA HELP
LINE JUNE, 2002
Dear Members of Buffalo's Common Council:
Attached for your information is the monthly report of service
calls processed by the Division of Citizen Services for June
2002
June concludes the second fiscal year of the division's
existence.
Of particular interest is a comparison of the calls for the fiscal
years of 2001 and 2002.
Service calls for 2002, totaled 37,698 verses 37,086 for 2001 a
modest increase of less than 2 %.
Comparisons of major categories are:

(Increase primarily due to December record snow fall of 7+
feet)

(Increase due to first full year of program services - includes
size changes, stolen totes and broken totes).
• Rodents 766 297 -61.2%
• Recycles calls 993 723 -27.2%
it is very notable to acknowledge the significant decreases in
calls relating to services provided by the Division of Streets and
Sanitation, where rodent calls decreased by over 60 %; garbage
collection by over 30 %; and recycle calls by over 27 %.
Although lot maintenance calls are a hot topic, a review of calls
pertaining to vacant lots, not listed, appeared to be about the
same over the past two years, even with the city's record
Spring rainfall.
The biggest obstacles in reducing calls pertaining to
maintenance of vacant lots are the need for more grass cutting
equipment by the Division of Streets and Sanitation and the
need to have Private lot owners maintain their lots.
The city is attempting to get HUD approval to use CDBG
dollars to buy grass cutting equipment and the city has
increased costs for private lot owners from $52.50 to $2 10. - if
the city cuts their lots.
Subsequently, if the city can purchase more grass cutting
equipment and private lot owners become more responsible,
through the sting of much higher charges - more progress and
a realistic maintenance schedule can be developed.
Finally, the division's analysis of calls between 2001 and 2002,
shows significant improvement in all city services, based upon
service calls received.
Fiscal year 2003, will provide another opportunity for the
Division of Citizen Services to become more sophisticated in
tracking and reporting services calls, as it works with all city
departments and the Common Council, always striving to
improve the delivery of city services.

The Office of Strategic Planning, Division of Real Estate, has
received a request from Robert Boreanaz, Attorney, on behalf
of Buffalo Laborers' Training Fund to purchase the above
captioned properties. They would like to purchase said
properties in order to expand and improve their training facilities
and parking.
The parcels in question are blacktopped lots that have been
neglected and have weeds growing through the cracks of the
pavement. The property is under the jurisdiction of the Dept. of
Public Works, Parks & Streets. This office has contacted the
Dept. of Public Works, Parks & Streets, the City Planning
Board and Land Use Planning and they have no objections
and /or conditions in reference to the abandonment and sale of
the 1336, 1338, 1340 & 1342 Seneca Street.
Your Honorable Body may authorize the abandonment and sale
of the property in accordance with Article 27, Section 27 -5 of
the City Charter. Should you approve the abandonment and
sale the purchaser is required to retain a real estate
appraisal(s) at their own expense, for the purpose of fixing the
value of the interest of the City in such property. The City will
provide a list of appraisers established by the Appraisal Review
board of the City. They results of our negotiations will be filed
with Your Honorable Body for final approval.
I am recommending that Your Honorable Body approve the
abandonment and sale of the 1336, 1338, 11340 & 1342
Seneca Street to the Buffalo Laborer's Training Fund.

Strategic Planning dated July 16, 2002 be received and filed;
and
That the City of Buffalo does hereby abandon 1336, 1338,
1340 and 1342 Seneca Street in accordance with Article 27,
Section 27 -5 of the Charter of the City of Buffalo; and
That the Director of Real Estate be, and he hereby is
authorized to negotiate a sale with Robert Boreanaz, Attorney,
on behalf of the Buffalo Laborers' Training Fund and report
back to the Common Council with the results of negotiations for
final approval of the sale of a portion of 1336, 1338, 1340 and
1342 Seneca Street.

and Findings of the Public Hearing for your review which have
been prepared by Special Counsel for the Board of Parking.
in accordance with Section 204 of the Eminent Domain
Procedure Law, a brief synopsis of the Determination and
Findings shall be published in two consecutive issues of the
Buffalo News and two consecutive issues of the City Record.
Therefore, I am recommending that Your Honorable Body
approve the Determination and Findings and direct the City

This is to advise your Honorable Body that one proposal was
received by Malcolm Pirnie, Inc. for the above referenced
project on July 17, 2002 for the following vendor for mechanical
flocculation equipment:
Shrier - Martin Process Equipment
The equipment was sole source by the City of Buffalo Water
Board for the purposes of standardization of equipment.
Standardization of equipment was completed for the purposes
for operation and maintenance including standardization of
spare parts. Similar equipment is currently in use in the
Facility's South Flocculation Basin. The proposal is based on
$422,168.00 for the Mechanical Flocculators, and $144,339.00
for the Variable Frequency Drives for a total of $566,507.00.
The equipment was sole source following a resolution by the

This change order was necessitated due to the presence of a
Niagara Mohawk high voltage line in the area where the
contractor was digging. Niagara Mohawk required the trench be
hand dug to avoid possible contact with the high voltage line.

EXTENSION OF CONTRACT: AMERICAN WATER
SERVICES
At their meeting of July 10, 2002, the Buffalo Water Board
authorized an extension of their contract with American Water
for a period not to exceed six months. The contract is for the
operation of the Water System. During the time of the
extension, the Board has asked the Commissioner of Public
Works, Parks & Streets to continue talks with the Erie County
Water Authority, and to simultaneously negotiate a new
long -term contract with American Water.
In accordance with section 9.2 of the amendment to the
Operation Agreement between the City of Buffalo and the
Buffalo Water Board dated August 1, 1997, the board may not
extend their contract with American Water without the approval
of the City. The Board has therefore requested that I seek
approval of the Common Council for this extension.
The extension would commence September 1, 2002.

Hazardous Waste Collection E -vent for the City of Buffalo
residents in conjunction with the County of Erie. Attached

Buffalo and the Erie County Environmental Education Institute,
Inc. for the Household Hazardous Waste Collection Event
scheduled for September 7, 2002 from 9:00 a.m. until 3:00
p.m. at the Division of Engineering Garage, 1120 Seneca
Street. Wastes being accepted include pesticides (no aerosol
cans), oil -based paints, selected paint thinners and waste
solvents, used motor oil, dry cell and lead acid car batteries,
and two tires (without rims) per vehicle. It 'Is respectfully

There are many small classes throughout the District funded
by Federal and State Reduced Class Size Grants.
I responded directly to the members of the Martha Mitchell
Community Center on July 9, 2002. The text of the letter
follows:
Thank you for writing to me concerning the issue of class size
in the Buffalo Public Schools. As the Superintendent of Buffalo
Public Schools, I understand your concerns regarding over
crowded classrooms. I have long been a proponent of reduced
class sizes because I know that children learn best when the
class size is 20 or less. Research also supports the benefits of
smaller learning communities in each classroom.
However, given the current budget problems facing the Buffalo
Public Schools, it is not possible to reduce class sizes for the
coming school year. Despite the support received from the New
York State Delegation, the district had to eliminate over $25
million in staffing and programs for the 2002 -03 school year.
This is on top of the $28 million, which was taken from the
2001 -02 school year.
Our entire region and state is facing fiscal problems of
monumental proportions. You can help the situation by writing
to Congressmen, Senators and the President asking for
additional support for the BPS. If enough money is provided for
this purpose by the Federal Government, I would be happy to
grant your request.
Once again, thank you for taking the time to share your
concerns with me. Have an enjoyable summer.

from the State Archives and Records Administration
(SARA) in the amount of $74,824.00. This is 100% of the
amount we applied for. The grant funds will allow
Records Management to purchase shelving units for our
proposed Inactive Records & Research Center.
it is our hopes that we can find a City Owned Facility to utilize
for City of Buffalo Inactive Records Storage & Research
Center. The City of Buffalo desperately requires a facility as the
current conditions of the Records Center located on the 16th
floor of City Hall is filled to capacity. Our off -site facility is also
filled to capacity. It is time for the City of Buffalo to make a
move if we are to save the integrity of our historical and archival
records.

B. DAVIS -H. LEADER - PURCHASE 707 WASHINGTON
I wish to purchase the property at 707 Washington Street for
the expansion of my business. The matter was discussed on
July 16, 2002 at the Finance Committee meeting and is being
sent to the Buffalo Common Council on July 23, 2002 for
consideration. Due to the limited time, no decision was reached
by the Finance Committee.
There were many speakers, all from the Fire Department, who
expressed interest in keeping this underutilized building. I
listened closely, because what is of utmost importance is the
safety of the City. If it was in the City's interest to rehabilitate
and reuse this property for some definite function that could not
be performed elsewhere, that is what should be done. While
their concerns and wishes were well presented, I did not hear
any compelling ideas that could not also be performed in other
empty City buildings.
Listed are the highlights that seemed pertinent to me and my
business.
1 . Commissioner Worthy estimated between $350,000 to
$500,000 to rehabilitate this building. While I am not a
contractor, from past experience (like the Apollo Theater
and the two new Police Stations), that seems like a
modest sum to meet the City's standards. There are
asbestos tiles on the floor and some asbestos on the roof
(so I was told by Carmody Roofing). This building has
been vacant for over 6 years. The roof is in need of repair
and the mortar needs repointing. If this building is not
maintained properly, I am sure that the sum needed to
reuse it will increase just from more deterioration. The
commissioner is now in favor of the sale.
2. The most compelling discussion was from a gentleman
from the Haz -Mat Unit of the Fire Department. He stated
that last year there was money in their budget that could
have been used to reuse this building. If this was really
THE NEED, the money would have been used for that
purpose. In the discussion, it was determined that there
are other options open. It is always good to have ideas,
but it is action that counts. Is the City ready to get into
action to invest and rehabilitate this building NOW?
3. Mr. John Hannon, Director of Real Estate, brought up that
a fire study was done over 6 years ago when it was
determined to close two stations and build a new station
at Elmwood and Virginia. He also stated that both stations
were to be sold (this and one on Jersey). The one on
Jersey was sold at that time. If the decision to sell the
building on Washington Street was made 6 years ago,
why not sell it now? It has sat empty and even had boats
and cars stored in it until it was partially used for the
Physical Agility Tests. That need is minimal now, as there
are only 15 tests left.
Printing Prep needs a location close to its present location to
function properly. Our business needs to expand in order to
stay alive. If it was possible, all operations would fit into our
present building. Our business at present is soft, and will stay
soft without investment. It is my intention to get this business
going again with new equipment, to try to turn it over to the
employees to manage (and eventually own), and for me to
partially retire. I have put a deposit on a machine that is
bleeding edge technology. It will be the second machine to be
installed in the world. If successful, it will enhance our
company and allow us to get work from outside New York
State. We are willing to make the investment if we can get a
building to meet our needs. Time is of the essence. The
machine will be ready to install in September. If we wait too
long, we will lose our edge.
We are not asking the City to give us anything. We are willing
to pay the price that was determined by a City- approved
appraiser. To me, it seems like a win -win. The City relieves
itself of a building. The responsibility for maintenance becomes
Printing Prep's. Jobs will be added in the City. A company is
allowed to stay in Buffalo and hopefully continue to flourish in
the City.
Printing Prep was started in Buffalo in 1968 by me. It will
remain in Buffalo as Icing as I am in charge. I am a
lifelong supporter and live in North Buffalo, which is
where I was born. I am a product of the Buffalo Public
School system and learned to love my trade at Bennett
High School. Though at times I get very discouraged with
some of the actions in this. City, I intend to always be a
resident of Buffalo and to support this City. I do not
believe in confrontation but will be outspoken to protect
my City.
The City has been so helpful in my pursuit to keep my business
viable in Buffalo. All the support I have received, from New
York State Senator Byron Brown, the BERC, the Mayor and his
staff, and Council Member Brian Davis has been fantastic. I
would appreciate your considering to add your support to my
request to purchase 707 Washington Street. If you wish, I
would be honored to give you a tour of Printing Prep. Thank

DISTRICT VENDING PROGRAM
On Friday, July 12, 2002, five city licensed hot dog vendors
were shut down in the Chippewa Entertainment District. The
reason given by officials was that these spots were not
designated city vending sites in the Special Downtown District
Vending Program.
Over the past six years, I have worked the Chippewa strip with
the consent of property owners and the appropriate health and
vendor permits without any problems. This approach has been
the precedent with the other licensed vendors. Many patrons
and visitors to the city have stated to me that the hot dog
vendors add charm to the atmosphere of the Chippewa 9trip.
We have received numerous compliments about our service to
the community.
On July 12, while speaking with Councilman Brian Davis,
Patrick Sole, Supervisor of City Licenses and Morgan Smith,
an official from Buffalo Place, Morgan suggested that the other
licensed vendors and I apply for an annual site permit in the
Special District Vending Program for the five locations we
currently work. He went on to say these sites would have to be
approved by the Common Council. I agree with this approach
to set up these five locations under the Downtown Special
District Vending Program. However, I am fearful that the two
out of the five locations I have established and worked diligently
at for the past several years may be lost to me if an open lottery
system occurs. I imagine my three colleagues share my
concern.
Therefore, I propose the Common Council approve the five
sites and place them on the Downtown Special District Vending
Map, designating these sites to the vendors who are currently
working these sites.
I have been a food vendor in the City of Buffalo for the past 11
years. I have been able to pay my way through college and buy
a home in the city where my family and I reside. Currently, I
employ others who have families; and attend school in our city.
Many people's futures are at stake. We are all living in difficult
financial times. We need to have the Common Council act
immediately on this issue. We city - licensed vendors, with little
warning' have been put out of work temporarily until this issue
is resolved. By the Common Council's quick action on this
issue, we can have two positive outcomes. First, having jobs
restored. Secondly, creating more monies for our city by
requiring licensed vendors to pay for the site permits.
Council member, we are asking you to stand behind the hard
working men and woman who have families and act quickly to
restore our jobs. Please contact me at the above phone

I am writing this letter because of my
discouragement here in the city of Buffalo. I purchased a new
home in Buffalo in the Fruitbelt area against the wishes of my
family and friends in December 2001. My boyfriend also
purchased a new home in March 2000 in the Frultbelt area. I
have been loyal to the city and feel I am a valued tax - paying
citizen who in return is receiving unfair unjust treatment.
I have called the Mayor's complaint line to many
times to count since the purchase of my home to complain
about issues that do not seem to get any better. The curb in
front of my home at 114 Locust Street is broken and barely
existent. There is mud and dirt run off leading into the drain
next to my home and clogging it up. I spoke with the head of
that department and he stated he rode past my home saw the
damage but could not tell me when the curb could be
addressed and it would be a costly project. I have three trees
on the city owned property right next to my home, which I have
been homesteading because the city has cut the grass once
since I've lived in my home. The three trees have huge
branches hanging right over my roof and a branch fell on my
roof over the winter. I spoke with the head of that department
on numerous times and he told me he has rode past my home
and knows the trees are in bad shape and all three trees should
be removed but the money is not in the budget at this time. I
have called the complaint line about the abandoned house
behind my house that people use as a drug house. I have been
told it is scheduled for demolition but no one knows when.
I understand the city is in a financial crunch I have
been patient with the city and a stark advocate of living in the
city and enjoying what the city has to offer. Unfortunately at this
time my patience is wearing thin and surrounding suburbs are
looking much more appealing. I ask for your assistance to have
these items be addressed promptly.

Myles Sr. Mr. Myles is expressing his concerns in
regards to the treatment of homeowners in the Fruitbelt
area of the City of Buffalo.
I am writing this letter because I am very
disappointed with the treatment of new homeowners 'in the
Fruit Belt area. Other homeowners and myself face a great deal
of challenges of owning a home for the first time, but we also
face a great deal of challenges dealing with the city of Buffalo. I
invested a great deal of money and risk owning a new home in
areas in the first stages of development. I would like the city to
assure me that I am being part of the solution and not the
problem.
On March 22, 2000 1 closed on my house on 57
Peach Street. In November 2000 a tree branch fell on my
house doing $300.00 of damage to my gutters, I called the
mayor's complaint line and informed them. The city came and
cut down the tree early spring 200 1. In the process of the city
cutting down the tree, they cracked my sidewalk and dug a hole
in front of my house. I called the mayor's complaint line again
and I was told that the city would come back and repair the
damages. Now, I applauded the mayor's complaint line for
responding to the dead tree in a timely manner. But, I was very
disappointed how they handled my crack sidewalk and hole in
front of my house. It is now 2002 and I have not heard anything
from the city regarding the damages of my gutters or my
sidewalk. I feel very discourage living in the city because, any
problems that involve the city I am alone in trying to get it
resolved. I should not have to feel this way because I pay
property taxes, I work and shop in the city. I am one of the few
recent grads that did not leave the city of Buffalo. I feel the cost
of living is affordable and the development is a positive step in
improving the Eastside image. So please give me some
assistance on how to work with the city to get my problems
solved.

The Executive Board of the Buffalo Fire Historical Society
would like to thank the Common Council for allowing us time to
discuss the "Fire House" matter at our General Meeting on July
17, 2002.
However, we voted not to continue our interest in the
"Fire House" at Washington and Tupper. There were many
reasons, but cost of the repairs was the primary reason.
Please keep us informed of any other buildings that
may be available. We may be interested in bringing our
Museum downtown if the City would offer us a suitable building
at a nominal fee.
Our belief is that we have much to offer the City in
its quest for Downtown Re- Vitalization. Our Fire Museum is
worth a fortune in artifacts and memorabilia. It is interesting
and educational. It is this "Opportunity" that we offer to the City
of Buffalo. Buffalo would benefit greatly if our Fire History was
brought to the center of the City. Children would learn adults
would be interested and tourists would be fascinated. This
would also enhance Fire Safety.

reconstructed under Contract No. D259114 is hereby
designated as a Restricted Highway. Designation of restricted
highway shall expire on April 30, 2003.
Pursuant to Section 1625 of the Vehicle and Traffic
Law all movement of vehicles, persons or animals on such
highway is h restricted and regulated in accordance with the
determination of the Commissioner of Transportation as
evidenced by posted signs, sign barriers placed along said
highway and /or by directions by an authorized representative of
the Commissioner of Transportation.
Any action taken by the Commissioner of Transportation
pursuant to Section 1625 of the Vehicle and Traffic Law shall
supersede other provisions of the Vehicle and Traffic Law
where inconsistent or in conflict with respect to the following
enumerated subjects:
1. Establishment of maximum and minimum speed limits at
which vehicles may proceed along any such restricted highway.
2. Weights and dimensions of vehicles.
3. Use of such restricted highway by pedestrians, equestrians,
and animals.
4. Parking, standing, stopping and backing of vehicles.
5. Control of persons and equipment engaged in work on such
highway.
The provisions of the Vehicle and Traffic Law with
respect to registration shall not apply to vehicles and equipment
engaged in on such restricted highways.
When used on such restricted highways, all traffic
control devices shall be considered as official traffic control
devices and conform to the manual and specifications for a
uniform system of traffic control devices adopted by the
Department of Transportation.

Jr. Expressway ". Both the Senate and the Assembly passed
this legislation. I was the prime sponsor in the Senate and
Deputy Speaker Arthur 0. Eve was the Assembly sponsor. The
next step is for Governor Pataki to sign this legislation into law.
During this process the State Department of Transportation is
asking for a list of supporters of this name change. I have
included your name on this list. The Department might contact
you regarding your support to insure that the community is
supportive of this ceremonial name change.

Concerning the residents of Flower Street 'in the University
District.
We the people of Flower street demand new renovations to be
done to the street. We have no curbs from 70 Flower to the
end, and 'in some areas of the street the black top is broken
into the center of the street. Furthermore houses 79 -85 -89 and
93 had in their contracts, to have new curbs and street when
built 40 years ago. This demand for a new street comes from
the lack of maintenance over the last 30 years, as far as the
homeowners that have been here that long, they say the city
paved only up to 70 flower and stopped. And ever since that, all
the city has done is Just patched some spots on the street. It
-maybe very important to know that this letter comes from a
lack of return phone contact over the last two years. In addition
the deterioration of the street maybe the cause of mechanical
problems on some of the residents vehicles. As a courtesy, the
Flower Street residents would appreciate it if someone from the
city could please contact us in regards to this letter.

and some yellow paint were on the vehicle. It appears that a
City truck may have inadvertently backed into his vehicle.

On April 24, 2002, Sharon E. Ross was driving on Central Park
Avenue when she hit a pothole. She has filed a claim for

occasions previously. Moreover, the Mayor's Complaint Line
had received a complaint about a week earlier. In addition, Ms.
Ross called the Public Works Department and was advised by
them that the City of Buffalo had planned to fill in the hole the
week before her accident and due to various circumstances

POLICE SERVICE WITHIN THE CITY OF BUFFALO
Whereas: The City of Buffalo Police Department is
experiencing staffing shortages due to the city's current
financial constraints, and
Whereas: Although it is often said that the department and its
personnel, non - uniformed included, are the victims of
budgetary cuts, and rightfully so, other victims of such cuts are
the residents and taxpayers of the City of Buffalo; and
Whereas: City of Buffalo residents fall victim to budgetary cuts
when services are diminished and strategies are not put in
place or working sufficiently to mitigate the impact of budget
cuts on services; and
Whereas: Police services are of the most critical services to
the City of Buffalo, its residents, visitors, and businesses, and
Whereas: When the above stakeholders lose, or begin to lose
confidence in the city's ability to keep order, mitigate crime,
and above all, preserve the quality of life, severe repercussions
can emerge, and
Whereas: Repercussions will include, but are not limited to,
city residents relocating outside of the city limits, loss of
businesses through closing or other related reasons, further
decay of the city's tax base, and ultimately further budget cuts"
and
Whereas: Although it is fully appreciated and understood that
in this time of financial crisis the city is forced to find ways to
save money through cutting expenses, it must be
acknowledged that in departments such as police, the ends
may riot justify the means and
Whereas: Since the inception of the 2002 -2003 budget on July
1, 2002, there has been repeated concerns to response time to
911 calls, as well as, sufficient response to non - emergency
concerns that require police action and /or attention; and
Whereas: The Commissioner of Police, his deputies, and
chiefs have been very accommodating in responding to the
council regarding these concerns before and during the budget
process; and
Whereas: It is understood that their policing strategy for the
city seems to be a "work in progress," in particular as it relates
to the budgetary constraints in the department, further
discussion of this issue is necessary.
Now, Therefore, Be It Resolved:
That this resolution be sent to the Police Reorganization
Committee for the purpose of discussion with the
Commissioner of Police and his staff at a September meeting.

permission to hang a banner across Seneca Street; and
Now, Therefore, Be It Resolved: That the Buffalo Common
Council grant permission for the Seneca Babcock Community
Center to display this banner for the Music Festival from July
23 to September 1, 2002. Persuant to the conditions
established by the Commissioner of Public Works, the
Corporation Council, and the Special Events Advisory
Committee; and
Therefore Be it Finally Resolved: That permission be
granted to hang this Music Festival Banner.

SELF - INSURANCE PLAN
WHEREAS: The City of Buffalo owns the historic Broadway
Market, a municipal asset at 999 Broadway that significantly
contributes to the quality of life of the region, and,
WHEREAS: The Broadway Market has worked hard to
maintain itself as a viable, competitive enterprise in the
wider community, and is in fact the main anchor of the
Broadway - Fillmore neighborhood; and,
WHEREAS: The Broadway Market is improving and
streamlining its operations to make it more successful, but has
recently been hobbled by excessively onerous fire and liability
insurance premiums, which have increased over sixty -eight
percent this year alone; and,
WHEREAS: The fire and liability insurance premiums at the
Broadway Market skyrocketed from $52,000 in fiscal year 2001
to $87,400, a $3 5,400 jump for fiscal year 2002- -
NOW THEREFORE BE IT RESOLVED:
That the City of Buffalo explore the possibility of absorbing the
Broadway Market into its self- insurance plan in the interest of
strengthening the Market's ability to shore its fiscal integrity
and continue to serve the public for at least another 5- years,
the current age of the Broadway Market.

CHANGING MONTROSE AVENUE TO A ONE WAY
STREET.
WHEREAS: The residents at Montrose Avenue have
endured car traveling at a high rate of top speed using
Montrose Avenue as a quick route to Kenmore Avenue from
Main street; and
WHEREAS: The residents lives are put at risk due to these
speeding cars whose drivers do not stop at the strategically
placed stop signs; and
WHEREAS: Over 65% of the residents of Montrose Avenue
have signed a petition supporting the change of Montrose one
way north from Englewood to Kenmore Avenue. The petition is
included as part of this resolution,
NOW, THEREFORE, BE IT RESOLVED THAT:
This Common Council an emergency declaration to change
Montrose Avenue to one direction traffic.
BE IT FURTHER RESOLVED THAT:
This Common Council adopt this resolution immediately to
ensure the safety of residence of Montrose Avenue,

ORDINANCE AMENDMENT
CHAPTER 437 - TAXICABS AND LIVERIES
The Common Council of the City of Buffalo does hereby
ordain as follows:
That Section 437 -14 of Chapter 437 of the Code of the City of
Buffalo be amended to read as follows:
§ 437 -14. Rates and charges.
A. No person shall charge a greater sum for the use of a
taxicab or livery than in accordance with the following rates:
(1) Hourly rates: [eighteen dollars ($18.)] twenty -one dollars
21. per hour for one (1) or more passengers.
(2) Mileage rates: [one dollar and eighty cents ($1.80)] two
dollars and thirty cents ($2.30) the first one -sixth (1/6) mile
or less; thirty cents ($0.30) for each additional one -sixth (1/6)
mile or less; [thirty cents
($0.30)] thirty -five cents ($0.35) for each one (1) minute of
waiting
time, including time lost in traffic delays. Upon producing
certification issued by the Mayor's office as to senior citizen
status, persons shall be entitled to a ten - percent reduction in
the amount of the fare.
(3) Hand baggage: free.
(4) Trunks: one dollar ($I.) each.
(5) Large boxes: one dollar ($1.) each.
B. No additional or extra charge shall be made for carrying
more than one (1) passenger, but
all passengers up to the seating capacity of the vehicle shall be
carried for the same fare as that
above prescribed for one (1) passenger.
C. Upon demand, the driver of a taxicab or livery shall furnish
to the passenger a receipt for the fare paid, showing the name
and badge number of the driver.
D. All disputes as to the lawful rate of fare shall be determined
by the police officer in charge of the police station nearest to
the place where the dispute arises or occurs; and a failure to
comply with such
determination, provided that it be in accordance with the rate
herein fixed, shall 13e a violation of this chapter.
E. The rate charged in the City of Buffalo shall be subject to
review and renewal by the Common Council after a period of
one (1) year from the effective date of such rate change.
During that one -year period, taxicab and livery service
providers shall work with the Common Council on improving
the quality of service in the City of Buffalo. The amount of
improvement and eytent of cooperation by the taxicab and livery
service providers may be considered in the decision to renew
the rate for an additional period of time.
F. Effective August 1, 2000, a person may charge a temporary
gasoline surcharge of fifty cents ($0.50) on each fare for a
period of nine (9) months, expiring on April 30, 2001.
It is hereby certified, pursuant to Section 3 -19 of the Charter,
that the immediate passage of the foregoing ordinance is
necessary.

A LOCAL LAW amending the Charter of the City of Buffalo in
relation to the elimination of one at -large Council seat and one
district Council seat
BE IT ENACTED BY THE COMMON COUNCIL OF THE
CITY OF BUFFALO AS FOLLOWS:
Section 1. That Article Three of the Charter of the City of
Buffalo, adopted pursuant to law, is hereby amended as
follows:
§ 3 -2. Composition of the Common Council.
The common council shall consist of [nine] district council
members, [three] two council members -at -large and a president
of the common council.
The common council shall be deemed a continuous body
notwithstanding any, change of membership.
§ 3 -3. Council Districts.
The city is divided into [nine] eight council districts, the
boundaries of which are set forth in Section 1 -4 of this charter.
§ 3 -5. Election and Terms of Common Council Members.
The terms of office of tile council members as of the effective
date of this charter shall continue until the installation of council
members chosen in general elections in accordance with this
section.
At the general election in the year 2003 a president of the
common council shall be elected by the electors of the entire
city for a term of two years. At the general elections in the year
2005 and at the general elections held every fourth year
thereafter a president of the common council shall be elected
by the electors of the entire city for a term of four years. At the
general election held in the year 2003, [three] two council
members -at -large shall be elected by the electors of the entire
city for a term of two years. At the general election held in the
year 2005 and every fourth year thereafter, [three] two council
members -at- large shall be elected by the electors of the city for
a term of four years.
At the general election in the year 2001 one district council
member shall be elected by the electors of each council district
for a term of two years. At the general election held in the year
2003 and every fourth year thereafter, one district council
member shall be elected by the electors of each council district
for a term of four years.
The persons elected to the common council shall take office on
the first day of January following the general elections in which
they were elected, and shall be eligible for re- election.
Section 2. Insofar as the provisions of this local law are
inconsistent with the provisions of any other local law or act, the
provisions of this local law shall be controlling.
Section 3. This local law shall not become operative unless it is
approved by an affirmative vote of a majority of the qualified
electors of the City of Buffalo at the next general election or at a
special election if not less than sixty days after its adoption an
authenticated
petition is filed with the City Clerk requesting the submission of
the local law at a special election pursuant to Section 23 of the
Municipal Home Rule Law.
