CITY TAKE -HOME VEHICLES
Attached for Your Honorable Body's information and review, please find a list of all City take -home vehicles.
This list reflects a 41 % reduction of take -home vehicles used by City of Buffalo employees called for by my office. The significant
reduction follows an extensive internal analysis over a period of months, which included meetings with city department heads.
Through meetings with the city's Law Department it was determined that 15% of the city's previous 85 take home vehicles were
mandated by contractual obligations.
Prior to my office's mandated reduction, 82.3% of the City's take -home vehicles were for public safety. After the reduction, 88% of
the vehicles will be dedicated to public safety activities, such as police and fire vehicles.
In fiscal year 2007 -2008, the total cost for fuel for all city -owned vehicles was $2.9 million. Of that $2.9 million, $231,958 was for
take -home vehicles, or 8% of the entire fuel budget for the City of Buffalo. Of that 8% fuel budget for take -home vehicles, 85% of
the budget for fuel was for public safety vehicles, 58% went to the Buffalo Police, and 27% went to Buffalo Fire.
Take home vehicles for the Buffalo Police Department will be reduced by 40 %, 11 police vehicles are mandated as take -home
vehicles, 6 are for Inspectors per the Buffalo PBA contract, 4 are mandated to the K -9 units, 1 is for the Narcotics unit, per a
memorandum of understanding between the Buffalo Police and the FBI.
It should also be noted that previously, the city's Fuel Master tracking system provided monthly reports to the Division of Inventory
and Stores. I have directed that the reports now be made on a weekly basis, providing information on who puts in fuel into a
vehicle, how much fuel is put into a vehicle and at what time. The CitiStat Buffalo panel will now also track this information, and as
this is an evolving process, my administration will continue to monitor and reduce vehicles as necessary.

APPOINT BRIAN REILLY COMMISSIONER OF ECONOMIC DEVELOPMENT,
PERMIT & INSPECTION SERVICES
In accordance with §17 -1 of the City Charter, I hereby appoint Brian Reilly Commissioner of the Department of Economic
Development, Permit & Inspection Services.
Mr. Reilly has served as the City's Chief Economic Development Officer since February and was previously Director of the City of
Cleveland, Ohio's Economic Development Department, a 106 - member department with a $13 million annual operating budget.
Reilly was responsible for strategically deploying $40 million of incentives for business growth, administering a 300 -loan portfolio
and overseeing the city's federally funded workforce system.
Prior to his two -year experience in Cleveland, Reilly spent seven years in Milwaukee, Wisconsin's Department of City
Development, where he led the city's efforts in its industrial and mixed -use district, the Menomonee River Valley. The location is
Milwaukee's largest and most successful remediation and redevelopment initiative.
To build on the progress we have made over the past 2Y2 years, the City's economic development functions will be streamlined
under Brian Reilly with an emphasis -on implementing development plans quickly, establishing clear and predictable timetables for
business project approvals, accelerating the city's demolition and redevelopment program, strengthening residential
neighborhoods & commercial districts, improving preservation efforts, and creating and connecting more jobs to Buffalo residents
I respectfully request that Your Honorable Body confirm Mr. Reilly at your earliest opportunity. Mr. Reilly is available to meet with
the Common Council at your convenience.

Description: John Meyer Consulting on behalf of Target Corporation is proposing • remodel and expansion of the south side of the
existing building on the property located at 2626 Delaware Avenue Buffalo New York. The proposed project will include the
demolition of the existing weight watcher building. The expansion to the existing store is approximately 18.296 sq. ft. The
remodel /expansion is intended to improve the visual quality of the site end the shopping experience of the customers. The project
will also include the expansion of the front sidewalk area to provide better pedestrian access, additional landscaping and a new
sidewalk that will connect the Target Store with other retailers on site as well as provide better and safer pedestrian end bicycle

renovation of a semi vacant four -story (109,000 sq. ft.) structure located on the Buffalo Niagara Medical Campus. Renovation
activities included in this project scheduled to take place in the interior areas of the building include the following: replacement of
the HVAC system, electrical infrastructure upgrades, reconfiguration of non -load bearing walls,
placement of water equipment, lighting upgrades, renovation of bathroom facilities, additional
administration infrastructure (video conferencing, data, security and communications), floor
refinishing, elevator upgrades, installation of a freight elevator, construction of new stairwells as required, lobby upgrades,
infrastructure necessary to deliver emergency power and construction of wet lab infrastructure. Renovations activities included in
this project scheduled to take place to the exterior of the structure include: a new roof, construction of a roof - located penthouse to
house mechanical equipment, replacement of windows, light shelves on new windows, street level pedestrian amenities (building
mounted architectural lighting and building signage). Limited facade repairs and replacement of the glass curtain wall on the
southeastern facade of the structure. Renovation activities ancillary to the project are scheduled to take place on property
owned by Buffalo Niagara Medical Campus adjacent to the project site at 821 Washington Street
(currently a surface parking lot). These improvements include the placement of emergency
generators and the construction of a loading dock. Historic Considerations: This building is adjacent to Trice Building #1 at 624
Ellicott Street, an historic structure, but this project would
involve a building considered to be a non - contributing structure. The maintenance and
improvement of this structure would serve to highlight and enhance the surroundings of the
historic structure. There are no known Archaeological Resources in the area. In accordance with
Section 14.09 of the New York State Historic Preservation Act, the New York State Office of
Parks, Recreation, and Historic Preservation ( "OPRHP ") has been consulted. The project
received a determination of =No Effect" from OPRHP as discussed in a letter dated April 7, 2008.
There would be no deterioration of service in transportation as a result of this project, even with full occupation of the structure.
With the introduction of updated HVAC systems, the energy
efficiency of the building would likely be improved. The project would not result in noise or odor surrounding the site; short -term
construction noise impacts would be mitigated according to City of Buffalo noise regulation requirements. This project involves
the renovation and improvement of an existing structure. Being in a highly urbanized site, there would be no impact on land, water
or air. There are no important habitats surrounding the site, nor are there agricultural resources.
There would be no impact on recreational resources in the area, nor and critical environmental areas near the project site. The
project is funded with Empire State Development Corporation ( "ESDC') through Round 1] of the Restore NY Communities
Initiative Municipal Grant Program (Restore New York) in combination with private financing. The estimated cost being
approximately 4.5 million dollars.
As a result of this Environmental Review, the Lead Agency has determined the undertaking of this action will not have a
significant adverse affect on the quality of the environment. No further environmental review of this action will be conducted prior
to project implementation and a Draft Environmental Impact Statement will not be prepared.

aesthetic impact from this project as a result of the improvements to the site and the revitalization of an underutilized building.

Medical Campus. The project is in accordance with the BNMC's Master Plan and the Oak Street Urban Renewal Plan and will

AMEND LEASE AGREEMENT BETWEEN THE CITY OF BUFFALO AND DREAMCO DEVELOPMENT 2930 BAILEY
UNIVERSITY DISTRICT
The above lease agreement between the City of Buffalo (Lessee) and Dreamco Development Corporation (Lessor) will expire
on January 14, 2009. The City of Buffalo uses the facility to house Engine 23 for the Fire Department. The renewal clause in the
current lease requires the City of Buffalo to notify the Lessor (Dreamco) 180 days prior to the expiration of the lease of the City's
intention to renew or quit the lease. The renewal as stated in the lease is for a five -year period.
The Division of Real Estate has been notified by the Department of Public Works that construction of the new facility for Engine
23 to be located at the corner of Bailey and Hewitt will commence by December 2008 and should be completed by December of
2009.
The Division of Real Estate has informally advised the Lessor that a renewal for five years will not be necessary and that the City
is requesting to continue the current lease beyond the expiration date of January 14, 2009. The Lessor has agreed to amend the
current lease agreement and extend the current expiration date to January 14, 2010 upon the following agreed terms and
conditions:
1. The current monthly payment of $2,172.08 will increase to $2,607.46 commencing on January 15, 2009 and the lease will
expire on January 14, 2010.
2. The City of Buffalo will have the option to renew the lease for an additional six months beyond January 14, 2010 by giving the
Lessor 90 day written notice of it's intention to do so. The monthly rental during the six -month renewal period will be $2,737.83.
3. The City of Buffalo will have the right to quit the lease during the option period
by giving the Lessor a 90 day written notice.
4. All other terms and conditions of the lease shall remain in place during the
renewal and option periods.
I am recommending that Your Honorable Body approve amending the current lease agreement between the City of Buffalo and
Dreamco Development Corporation upon the above terms and conditions.
I am further recommending that the Corporation Counsel prepare the necessary agreement and that the Mayor be authorized to
execute the same.

Your Honorable Body is hereby requested to approve a PILOT agreement between the City of Buffalo, the County of Erie and
Community Action Organization of Erie County, Inc., Inc. inform and substance to the attached Agreement.
This Project known as the St. Martin Village consists of the development of 60 units of housing and a small community service
facility on the former Diocesan
Education Campus at 564 Dodge Street in the Ellicott District of the City of
Buffalo. The proposal calls for the rehabilitation of two existing three story
buildings into 24 two bedroom units, the new construction of 24 three bedroom
townhouses, the new constructionof 12 four bedroom townhouses and the rehabilitation of the Chapel intoa community building
and community service facility.
All of the units will be affordable for households at or below 50% of the area
median income. Nineof the units will be set -aside for households with an
individual with a mental illness and /or in recovery, with support services provided by Cazenovia Recovery Systems, Inc.
The project will create 36 new townhouse units for large families, and 24 two bedroom units for small families. After 15 years,
there will be a tenant buy -out option so that residents have an opportunity to purchase the homes that they rent.
The total project will cost $14,945,424.
The project will redevelop a large, long vacant site that has a blighting effect on the neighborhood, provide quality, affordable
housing for large families, create homeownership opportunities for very low income households and bring close to $15 million in
additional resources to the neighborhood.
The amount of the PILOT payments was calculated based upon the City's PILOT policy, which provides for payments in the
amount of 3% of gross rent assuming a 5% vacancy. Payments will increase by three percent per yea— for
the duration of the 15 -year Pilot.

"City "), in the County of Erie, State of New York (the "State ") HEREBY CERTIFY AND • REPORT, that pursuant to the powers
and duties delegated to me, the acting chief fiscal officer of the City, pursuant to Resolution No. 194, duly adopted on the 4th day
of October, 1945, and pursuant to Resolution No. 160, duly adopted on the 1 st day of November, 1994, which resolutions are in
full force and effect and have not been modified, amended or revoked, and subject to the limitations prescribed in said
resolutions, I have made the following determinations:
1. Authorization, P— Amount, Maturity Schedule Issue Date and
Designation: (a) Serial bonds of the City (the ,Bonds" or the "Obligations ") in the respective principal amounts as set forth in
column 8 in Appendix A (which is hereby made a part hereof), for each purpose as set forth in column 1 of such Appendix shall
be issued pursuant to the bond resolutions duly adopted and amended by the Common Council on their respective dates as set
forth in column 3 of such Appendix, and shall mature, with substantially level or declining debt service, on February 1 in the

2. Interest Rate. Dates and Medium of Payment. The 2008 -A and 2008 -B

2009, August 1, 2009 and semiannually thereafter on February 1 and August 1 in each year to maturity, payable in any coin or
currency of the United States of America which at the time of payment is legal tender for the payment of public and private debts.
Interest shall be paid on each interest payment date by Manufacturers & Traders Trust Company (the "Fiscal Agent ") to the
person in whose name the bond is registered at his address shown upon the books of the City kept for the purpose at the offices
of the Fiscal Agent, as of the close of business on the fifteenth day of the month preceding each such interest payment date.
3. Bonds Subject to Prior Redemption. The 2008 -A and 2008 -B maturing on
or after February 1, 2019 will be subject to redemption prior to maturity at the option of the City
On February 1, 2018 and thereafter on any date, as a whole or in part, as specified by the City, in such order of maturity as may
be determined by the City (selected by lot within a maturity), at par, plus accrued interest to the date of redemption.
Notice of redemption shall be given by mailing such notice to the registered
holders of Bonds to be redeemed at their respective addresses as shown upon the registration books of the City maintained by
the Fiscal Agent, and to Assured Guaranty Corp. (as defined below), at least 30 days prior to the date set for any such
redemption. If notice of redemption shall have been given as aforesaid, the Bonds so called for redemption shall become due and
payable at the applicable redemption price on the redemption date designated in such notice, and interest on such Bonds shall

insured by a municipal bond insurance policy to be issued by Assured Guaranty Corp. ( "Assured Guaranty ") simultaneously with
the delivery of the Bonds. The amount payable to Assured Guaranty as premium for the policy on the Bonds will be paid to
Assured Guaranty from the proceeds of the Bonds at the closing on July 9, 2008.
5, Denominations, Numbers and Letters. The Bonds maturing in each year
shall be issued as fully registered bonds in denominations of $5,000 or any integral multiple or which includes the authorized
multiple, not exceeding the aggregate principal amount of Bonds of each series maturing in such year. Purchasers will not receive
certificates representing their interest in the Bonds.
The General Improvement Serial Bonds - 2008 -A shall be lettered AR, and shall be
numbered separately from one (1) consecutively upward in the order of their issuance. The School Serial Bonds - 2008 -13 shall be
lettered BP., and shall be numbered separately from one (1)
consecutively upward in order of their issuance. All of the Bonds shall be transferable and exchangeable as provided herein.
6. Book -Entry System. The Bonds when issued shall be (i) registered in the
name of Cede & Co., as nominee of The Depository Trust Company, New York, New York ( "DTC "), and (ii) deposited with DTC
to be held in trust until maturity. Only one Bond will be initially issued for each maturity of each series in the aggregate principal
amount of such maturity. DTC. is an automated depository for securities and clearinghouse for securities transactions, and will be
responsible for establishing and maintaining a book -entry system for recording the ownership interests of its participants, which
include certain banks, trust companies and securities dealers, and the transfers of the interests among its participants. The DTC
participants will be responsible for establishing and maintaining records with respect to the beneficial ownership interests of
individual purchasers in the Bonds. Individual purchases of beneficial ownership interests in the Bonds may only be made
through book entries (without certificates issued by the City) made on the books and records of DTC (or a successor depository)
and its participants in the denominations of $5,000 or any integral multiple thereof not exceeding the aggregate principal amount
of Bonds of each series maturing in such year. Beneficial owners of the Bonds will not receive certificates representing their
interest in the Bonds. Principal of and interest on the Bonds will be payable by the Fiscal Agent by wire transfer or in
clearinghouse funds to DTC or its nominee as registered owner of the Bonds pursuant to the Blanket Letter of Representations
dated December 1, 1995 between the City and DTC. Transfer of principal and interest payments to participants of DTC will be
the responsibility of DTC; transfer of principal and interest payments to beneficial owners by participants of DTC will be the
responsibility of such participants and other nominees of beneficial owners. The City will not he responsible or liable for payments
by DTC to its
participants or by DTC participants to beneficial owners or for maintaining, supervising or reviewing the records maintained by
DTC, its participants or persons acting through such participants.
7. Discontinuance of Book Entry- System In the event that (a)DTC
determines to discontinue providing its service with respect to the Bonds by giving notice to the City and discharging its
responsibilities with respect thereto under applicable law, and the City fails to appoint a successor securities depository for the
Bonds, or (b)the City determines to discontinue the system of book -entry transfers through DTC (or a successor securities
depository), then bond certificates shall be delivered to the beneficial owners upon registration of the Bonds held in the beneficial
owners name. After such registration the beneficial owners shall become the registered owners of the Bonds. In such event, the
Comptroller of the City shall execute a Supplemental Certificate of Determination which will set forth the terms, form and details of
issuance of such bond certificates.
8. Fiscal Agent. Manufacturers & Traders Trust Company, Buffalo, New
York is hereby appointed as Fiscal Agent for the Bonds pursuant to, and to act in accordance with, applicable provisions of the
Law and the Enabling Resolution of the City of Buffalo, adopted by the Common Council on March 8, 1977.
9. Execution of Bonds. The Bonds shall be executed in the name of the City
by the manual signature of the Comptroller, and shall have the corporate seal of the City, or a facsimile thereof, affixed, imprinted,
engraved or otherwise reproduced thereon.
10. Transfer of Bonds. Each Bond shall be transferable only upon the books
of the City, which shall be kept for such purpose at the Fiscal Agent, by the registered owner thereof in person or by his attorney
duly authorized in writing, upon surrender thereof together with a written instrument of transfer satisfactory to the Fiscal Agent
duly executed by the
registered owner or his duly authorized attorney. Upon transfer of any such Bond, the City shall issue in the name of the
transferee a new Bond or Bonds of the same aggregate principal amount and maturity as the surrendered Bond. The City and the
Fiscal Agent may deem and treat the person in whose name any Bond shall be registered upon the books of the City as the
absolute owner of such Bond, whether such Bond shall be overdue or not, for the purpose of receiving payment of, or on account
of, the principal of and interest on such Bond and for all other purposes, and all such payments so made to any such registered
owner or upon his order shall be valid and effectual to satisfy and discharge the liability upon such Bond to the extent of the sum
or sums so paid, and neither the City nor the Fiscal Agent shall be affected by any notice to the contrary.
11. Regulations With Respect to Exchange and Transfers. In all cases in
which the privilege of exchanging or transferring Bonds is exercised, the City shall execute and deliver Bonds in accordance with
the provisions hereof All Bonds surrendered in any such exchanges or transfers shall forthwith be cancelled by the Fiscal Agent.
For every such exchange or transfer of bonds, the City or the Fiscal Agent may make a charge sufficient to reimburse it for any
tax, fee or other governmental charge required to be paid with respect to such exchange or transfer, and may charge a sum
sufficient to pay the cost of preparing each new bond issued upon such exchange or transfer, which sum or sums shall be paid
by the person requesting such exchange or transfer as a condition precedent to the exercise of the privilege of making such
exchange or transfer. The City shall not be obliged to make any such exchange or transfer of Bonds between the fifteenth day of
the month preceding an interest payment date and such interest payment date.
12. Sale of Bonds. The Bonds are hereby sold at private sale to DEPFA First & Leach, Inc. and Loop Capital Markets, LLC
(collectively, the "Underwriters ") for which DEPFA First Albany Securities, LLC will be acting as Managing Underwriter pursuant
to the Purchase Contract dated June 26, 2008, between said Underwriters and the City, for the purchase price of $31,363,979.01
plus accrued interest, if any, from the date of the Bonds (July 9, 2008) to the date of delivery of and payment for the Bonds. The
aggregate initial offering price for the Bonds will be $31,471,541.30 plus accrued interest, if any. Pursuant to Section 54.30 of the
Local Finance Law, constituting Chapter 33 -a of the Consolidated Laws of the State of New York, as amended, the terms and
conditions of such sale are subject to the approval of the State Comptroller. Delivery of the Bonds to the purchasers thereof shall
be effected on or about July 9, 2008, upon (i) receipt by the City of the purchase price of the Bonds, and (ii) deposit of the Bonds
with DTC to be held in trust until maturity.

THIRD QUARTER GAP
My office has reviewed the Third Quarter Gap Sheets and has concluded that they
fairly and accurately reflect the city's revenues and expenditures to date and we conclude that the projected $10.01 million positive
variance for the fiscal year is reasonable. There are continuing concerns with police and fire overtime and I'm encouraged that the
Fire Department is taking steps to reducing overtime and that the Police Department's third quarter numbers show an
improvement from the second quarter. As noted, my office did not find it necessary to do any short -term borrowing, thus saving
$4 million in the debt service lines. The city as a whole is continuing its recovery and I'm encouraged by the way the city is
conducting its business.

By letter of February 6, 2006, Ms Sharon Hanson of Time Warner Cable wrote to Buffalo Council Chairman David Franczyk that
Time Warner will commence billing him for cable television service in the Common Council chambers at Buffalo City Hall.
Since that time your company has commenced billing members of the Common Council for cable television services in the Buffalo
City Hall regardless of whether service is available.
Ms. Hanson's letter claims to base her letter and your corporate decision on a Federal rule that prohibits the provision of free cable
television service to Federal officials. That regulation has no application to the City of Buffalo, nor the offices for which you claim
payment.
Pursuant to the Franchise Agreement between the City of Buffalo and TCI of New York, Inc., TCI (and Time Warner as successor
to the franchise agreement) are required to provide cable television service at no charge to the Buffalo City Hall.
Since the inception of the Franchise Agreement Adelphia Cable and Time Warner have provided a cable drop to the Buffalo City
Hall, and the City has, within its rights under the Franchise Agreement, cabled internally within City Hall to install cable service to
television receivers at various locations within the building.
This is consistent with the Franchise Agreement and has been acquiesced in by your predecessor, Adelphia, and by your
Company.
We deem the charge for service at Buffalo City Hall to be a breach of the Franchise Agreement. Your unilateral action has no basis
in contract or in statute. The City of Buffalo insists that Time Warner Cable give immediate notice to the City of Buffalo that all bills
for service within Buffalo City Hall are immediately and retroactively cancelled. The City further insists that regular service be
continued to the Buffalo City, at no charge to the City of Buffalo, as required by the Franchise Agreement.

This correspondence is in response to the Common Council's request for comments and /or recommendations concerning item
# 48, CCP February 5, 2008 regarding information concerning second hand dealer licensing.
The Department of Economic Development, Permits & Inspection Services has the following comments, recommendations and
concerns with regards to the aforementioned communication filed by the Common Council:
Chapter 254 "Junk Dealers and Pawnbrokers" requires a city license for any establishment "buying, selling, storing, collection,
distribution or dealing in" any used items including but not limited to second hand books. License applications are referred to the
Zoning Office to ensure that the property has "legal use" and is located in an appropriately zoned area. License applications are
also referred to the Fire Prevention Bureau and the Building Inspection Office to ensure the building is in compliance with all New
York State Building & Fire Codes in order to protect the health, safety and welfare of the neighborhood. A Police Record Check
and Police approval are also required for license applications to ensure that the applicant is of sound moral character and the
business location has not been the subject of past numerous criminal activities.
Should the Police Record Check indicate felony arrests, the applicant is required to provide a final disposition
of the felony charges to ensure that the felony arrests do not indicate a pattern of disregard for laws related to
personal property, there or receipt of stolen property.
If a Police Record Check makes reference to another municipality it is necessary for the applicant to obtain a record check from
that municipality in order for the Office of License to ascertain whether or not the charges against the applicant were pertinent to
the granting of the license. Police Record Checks are now only required with a new application and not upon the renewal of the
license.
The Buffalo Police Department provides recordkeeping forms to licensees in order for the reporting of goods bought and sold to
assist Police in making the sale of stolen property more difficult, help in a recovery of identifiable property and conform reporting
requirements to the experiences of those law enforcement officials charged with the responsibility of carrying out the provisions of
said chapter. This is a vital tool for our Police Department in conducting investigation of stolen property, although reporting forms
for the sale of only used books may not be as necessary.
It is the opinion of the Department of Economic Development, Permits & Inspections Service that a new license category for
"book sellers" is not necessary or merited. This department suggests that your honorable body consider requesting Corporation
Counsel to review and draft an ordinance amendment to Chapter 254, specifically, Chapter 254 -12 "Report of Articles acquired
for Sale; exceptions ", "(F) Exceptions" and possibly exempt licensees who sell only used books from some or all of the reporting
guidelines in Chapter 254.
Finally, the Department of Economic Development, Permits & Inspection Services will cooperate and work with the

Dear Mayor Brown:
On Friday, May 30, 1 received the attached notice from Trautman Associates; a fifty year old well respected Buffalo based
architectural firm and our Associates on the Buffalo Schools Project, stating that we were not selected as Architects on the Phase
IV Buffalo Schools Reconstruction project. Having been passed over as Architects for Phases 11 and 111, 1 believe because I
criticized the Program Manager, Ciminelli, for proposing to design schools with an out of town architect, Hilliers (see attached
letter), this is extremely disappointing, especially after having successfully completed the Phase I Frank A. Sedita Academy. Our
firm may not be around for Phase V If there is no resolution to this.
This is even more disappointing in that, as a 45 year old Buffalo -based minority owned firm, and as an licensed architect for 50
years, I am the only African - American architect in private practice in the City of Buffalo, and only the second African - American
architect who has had a practice in the history of Buffalo, the first being John Brent, described in the attached biography, who
designed the now - demolished Michigan Avenue YMCA, the home of black culture in Buffalo for almost a half century.
Also disappointing is the fact that many are saying that because of the lack of African - American firms in the area, they will have to
start growing them. You don't have to look further than 321 Humboldt Parkway, where my firm is now officed in the contemporary
residence that I built in 1961, just around the corner from your residence, and only several blocks from the acclaimed Frank E.
Merriweather Library designed by our firm.
Because we are an African - American firm, we find it almost impossible to secure commissions in the suburbs, and our work, by
necessity, is focused on public, urban projects. Over the years, these have been substantial and have included the Alumni Arena
(the Health, Physical Education and Recreation Complex) at the Amherst Campus, and Bacon Hall (the Educational Office
Building) at the Buffalo State College Campus. Our Buffalo public school projects include Elementary School 40, considered to be
the most energy efficient school in the system; Alterations and Additions to Burgard Vocational High School; Frank A. Sedita
Academy; and, in association with Cannon Design, Public School 90, the Charles Drew Early Childhood Center.
It takes a long time to grow an architectural firm, African - American or otherwise. The editor of Architectural Record comments on
this in the attached editorial, "Room for all our Talents" As the Senior Fellow of the Buffalo Chapter of the American Institute of
Architects and recipient of that organization's highest awards, and with 45 years of experience, I am ready to continue to serve this
community. I hope that you will assist our firm in doing that. A copy of this letter is being sent to our State Representatives and
Associate Superintendent Mel L. Alston, who worked with out firm for ten years.

It has been approximately three months since our first letter regarding the adoption of floodplain management regulations to adopt
the new Flood Insurance Rate Maps for Erie County. Please be advised that continued eligibility in the National Flood Insurance
Program (NFIP) is contingent upon the City of Buffalo establishing enforceable floodplain management regulations and submission
of all required documents. If the new local law is not adopted and received by us, so that we may inform FEMA of your status, by
the map's effective date of September 28, 2008, FEMA will suspend your community from the NFIP. FEMA will grant no exceptions
to this deadline.
In order to avoid any chance of program suspension, we should receive a copy of the adopted local law, filed with the New York
State Department of State, along with signed local law filing forms at least one month prior to the map's effective date. An electronic
version of the law can be emailed to you if required.
So we may update our records, please call and provide a status of your local law within two weeks of this letter. Should you have

I just wanted to write a short email describing my visit yesterday (June 26, 2008) to the Clerk's office. I had to get a copy of my
grandson's birth certificate and dreaded the visit to the 13th floor. Going into the impressive building with the dark lobby and dealing
with the bad rep the city has, I was not looking forward to dealing with the apparent beauracracy displayed from the outside. No one
at the information booth, the dark interior of the lobby, my 5 year old granddaughter who was with me clutching my hand, we headed
up. When we went into the proper office for birth certificates I was impressed with the cordiality of your employees. Everyone was
helpful AND efficient and we had the birth certificate in hand in a matter of minutes. We then headed up to the observation deck
(which could use some publicity and work) and enjoyed a beautiful view.
Please extend my thanks to your staff for a job well done and for helping to erase the trepidations I had before my visit.

I would like to file the attached information for the next Common Council meeting to be held on July 8, 2008.
Dear South Buffalo Resident:
I am pleased to announce that funding for the South Council District Roof Replacement Program has been secured and finalized.
Due to a variety of temporary logistical obstacles which were beyond my control, City of Buffalo approval of this program took longer
than anticipated; so, I wish to thank you for your patience during this lengthy process, and assure you that I am eager to proceed
with this important program, as I believe it will greatly improve safety and strengthen the value of our housing stock in South Buffalo.
Enclosed please find a South Council District Roof Replacement Program Application. Program terms, including contractor
requirements, are noted in this application. This form is to be completed by you and returned to my office, as soon as possible. The
program will be operated on a first come, first serve basis- this refers to the first 75 completed roofing jobs.
No application will be approved unless the following documentation is submitted to my office, by the end of business on Friday
August 31, 2007:
• Complete and signed application form
• Copy of deed or other evidence of home property ownership
• Proof that you are a resident of the property for which you are seeking funds
• Verification that all City of Buffalo and County of Erie taxes, water and sewer
bills, and user fees for all property that you own are current (no applicant shall be
approved if said applicant has any outstanding parking tickets, demolition liens or
other obligations owed to the City of Buffalo, its departments, boards or agencies)
• Copy of contractor estimate and work specification from a contractor licensed to
work in the City of Buffalo
If your application is approved, a Notice to Proceed and subsequent Program Release Form will be issued and sent to you. Both
documents will need to be completed (signed and notarized) and returned to my office before work may begin.
In addition, it will be necessary for the hired contractor to obtain the work permit, not you, the homeowner. If you have any specific
questions regarding licensed contractors or roofing codes, please contact City of Buffalo Building Inspector Dave Zafuto at

Approved applicants will receive $1,000.00 upon verification that program guidelines have been met and work is completed. This
money will be paid directly to yon, the home property owner, as reimbursement for expenses incurred and payments made to a
licensed contractor, once work has been completed All work must he completed by Wednesday April 30, 2008.
Furthermore, funds will not be released to you until you have submitted the following documents, certifying that work has been
completed, to my office:
• Copy of finalized Building Permit
• Certificate of Compliance from the City of Buffalo Division of Inspections
• Copy of contractor's Release of Lien /Lien Waiver

STRENGTHEN BROADWAY MARKET
RE: Item 124 CCP June 24, 2008(Strengthen Broadway Market)
As and for comments and recommendations to the above -filed item, we make the following:
1. Although the words of support are welcome, the Broadway Market cannot survive without monetary support
2. Therefore, the first priority of any resolution should be establishment of a dedicated funding source for the Broadway Market.
These funds then could be properly budgeted to provide opportunities to strengthen the Market's future. In addition any "Task
Force" should be created only on the condition that the million - dollar bond be sold and the funds be delivered immediately to the
Market.
3. Any Task Force appointment must be neutral without political axes to grind. The current resolution states that David Franczyk as
Common Council President would be the sole appointee power. Clearly, Mr. Franczyk has stated his agenda of replacing the
current Market Board with his own political appointees. Some of the names put forward by Mr. Franczyk have previous personal
problems with the Market. Christopher Byrd resigned from the Board after losing the election for President. Martin Biniasz was
removed from the Board from violating the Constitution for missing Board meetings. Greg Olma was part of the Board that sent the
Market into nearly $362,000 (three hundred and sixty -two thousand) dollars in debt. In fact Mr. Franczyk was also a Board member
on that past discredited Broadway Market Board.
4. Mr. Franczyk's planned "Task Force" does not include any vendors. Last time, Broadway Market vendors were excluded from
Broadway Market Management; the Broadway Market was negligently allowed to sink into $362,000 (three hundred and sixty -two
thousand) dollars of debt which almost forced the Market to close.
5. Furthermore, the Broadway Market Board has only recently had African - American representatives be appointed to the Market
Board. The timing of Mr. Franczyk's resolution seems peculiar since none of his appointees to the Market Board or to his proposed
"Task Force" are African - American.
6. The Common Council should not force itself into the City /Market lease negotiations. Lease negotiations are always sensitive
under the best of circumstances. Placing the negotiations into the media almost ensures the negotiations not succeeding. Whatever
initiatives the Council wishes to accomplish can be achieved without needless involvement in the negotiations.
7. A further priority of any "Task Force" should be to evaluate whether the Market should be moved to the Historic Corridor being
created on the Waterfront. At this time, a Market is planned as part of the Waterfront development. Therefore, moving the Market
from its current location could be beneficial to all parties and should be considered.

RICHARDSON OLMSTED COMPLEX MASTER PLAN
The New York State Urban Development Corporation, d /b /a Empire State Development Corporation ( "ESDC "), proposes to serve as
lead agency for the environmental review process to be carried out under the New York State Environmental Quality Review Act
( "SEQRA ") and its implementing regulations (6NYCRR Part 617) in connection with the development of the Richardson Olmsted
Complex Master Plan in Buffalo, New York.
The proposed action has been classified as a Type I Action under the implementing regulations for SEQRA, given that in addition to
meeting other thresholds, the project site is listed on the State and National Registers of Historic Places (S /NRHP). It involves the
use of funds administered by ESDC to undertake a master plan with the objective of restoring /rehabilitating the Richardson Olmsted
Complex (i.e., the former New York State Insane Asylum /Buffalo Psychiatric Center, designed by H.H. Richardson, with grounds
designed by Frederick Law Olmsted). A not - for - profit organization, the Richardson Center Corporation (RCC) is spearheading this
project (see www.richardson- olmsted.com). RCC is receiving $76.5 million in State funds to assist in its efforts. A portion of these
funds have already been provided by ESDC to undertake necessary planning, design, and environmental review efforts. The
balance of the project funding would be provided once documentation under SEQRA is completed.
The overall master plan process is currently in initial data collection activities such as a structural conditions and historic buildings
assessment. A public process will be conducted by RCC to identify and evaluate alterative restoration /reuse scenarios. While the
specifics of these efforts are not yet formulated, the master plan would likely call for reuse of all or parts of the complex as a mixed -
use, multi - purpose civic campus of public and private activities. In addition, ESDC and RCC are consulting with the NYS Office of
Parks, Recreation, and Historic Preservation ( "OPRHP ") in accordance with Section 14.09 of the NYS Historic Preservation Act
with regard to potential effects to resources on or eligible for inclusion on the S /NRHP.
If within thirty (30) days from the mailing of this notification there are no comments, it will be assumed that your agency has no
objections to ESDC serving as lead agency for the environmental review of the project. A reply form is enclosed for your
convenience.

BOATING RETURNS TO HOYT LAKE
This morning, the Buffalo Olmsted Parks Conservancy proudly returned boating to Hoyt Lake near the Marcy Casino in Delaware
Park. Assemblyman Sam Hoyt and Olmsted CEO, Thomas Herrera - Mishler, celebrated the long- awaited launch of boats on the
Lake.
"We want people to enjoy the their parks and this a great way to do it ", said Herrera - Mischler
With the energetic efforts of Marti Gorman and her Buffalo Homecoming program, interest in retuning the boats to the lake became
a priority. The Conservancy enthusiastically embraced the idea and with the Buffalo State College Maritime Center director, John
Montague, arrangements were made to refurbish the boats and bring them back.
I am pleased that boating is returning to Hoyt Lake as a recreation option for park visitors, the boats will offer yet another way to
experience the beauty of Delaware Park. I know my father would be proud to see boats returning to the waters he worked so hard to
conserve, " said Assemblyman Hoyt.
The Hoyt Lake is named in honor Sam Hoyt's father, William Ballard Hoyt II, Whose vision, dedication and concern for the
environment helped beautify and preserve the lake for the people of Buffalo. He served, as the Delaware District Councilman from
1970 -1974, and New York State Assemblyman from 1975 -1992.
The regular summer boating schedule runs Tuesdays — Sundays from 11:00 am to 7:00 pm through August 31. Boats are rented by
the Y2 hour or hour for $10 and $15, respectively and are available on a first -come basis. Group reservations may be made by
calling 838 -149 ext 11. Street vendors Cool Rayz Italian Ice and Risa's Deli & Catering will be available for park -goers and boat
users all summer.
The six vintage style, 16 foot boats were designed specifically for the lake by John Montague. They were built by students from the
Police Athletic League, (PAL), Maritime Center volunteers and PAL mentors in 2002.
Delaware Park is the centerpiece of the 1200 =acre Buffalo Olmsted Park and Parkway System designed by renowned landscape
architect, Frederick Law Olmsted. His vision has to have a park entirely devoted to a natural landscape of rolling meadows, wooded
areas penetrated by winding paths, and a large lake perfect for leisurely boat rides. Pictures dating back to the 1870% show the
lake filled with rowboats in the summer and ice skaters in the winter. The Conservancy hopes to keep this summertime activity
going for years to come as recommended in the recently released Olmsted Park Plan for the 21 sc Century.

Pursuant to Section 104a of the Highway Law the following described highway:
A portion of NY Route 198 from Interstate 190 to NY Route 33 in the City of Buffalo in Erie County.
which is being reconstructed under Contract No. D260856 is hereby designated as a Restricted Highway. Designation of Restricted Highway shall expire
on September 20, 2008.
Pursuant to Section 1625 of the Vehicle and Traffic Law all movement of vehicles, persons or animals on such highway is hereby restricted and regulated
in accordance with the determination of the Commissioner of Transportation as evidenced by posted signs, signals or barriers placed along said highway
and /or by direction by an authorized representative of the Commissioner of Transportation.
Any action taken by the Commissioner of Transportation pursuant to Section 1625 of the Vehicle and Traffic Law shall supersede any other provisions of
the Vehicle and Traffic Law where inconsistent or in conflict with respect to the following enumerated subjects:
1. Establishment of maximum and minimum speed limits at which vehicles may proceed along any such restricted
highway.
2. Weights and dimensions of vehicles.
3. Use of such restricted highway by pedestrians, equestrians, and animals.
4. Parking, standing, stopping and backing of vehicles.
5. Control of persons and equipment engaged in work on such highway.
The provisions of the Vehicle and Traffic Law with respect to registration shall not apply to vehicles and equipment engaged in work on such restricted
highways.
When used on such restricted highways, all traffic control devices shall be considered as official traffic control devices and shall conform to the manual
and specifications for a uniform system of traffic control devices adopted by the Department of Transportation.

RESOLUTION DECLARING THE INTENT OF THE CITY OF BUFFALO COMMON COUNCIL TO ACT AS LEAD AGENCY PURSUANT TO THE STATE
ENVIRONMENTAL QUALITY REVIEW ACT
Project Name: Proposed Improvements to 481 -487 Delaware Avenue
Project Description:
Stillwater Holdings, LLC. is applying for a restricted use permit to use the interior of 481 -487 Delaware Avenue (combined as 483
Delaware Avenue) as a restaurant /nightclub (under reservation of rights) within the Special Delaware Review District. The
application also requests a restricted use permit to use a 3500 square foot portion of the parking lot located behind 381 -387
Delawar Avenue for a restaurant /"garden patio."
The garden patio restricted use permit is in connection with a request for a Certificate of No
Effect /Exception /Appropriateness from the City of Buffalo Preservation Board /Common Council to allow for the alteration of the
existing parking lot to provide for the construction of a masonry wall adjacent to Virginia Place, additional iron gating around a
3500 square foot area behind the 381 -387 Delaware Avenue and the installation of stamped concrete and masonry pavers and
vegetation.
The Special Delaware Review District requires the issuance of a restricted use permit for uses including both dance halls and
nightclubs and eating and drinking places (City Charter and Code §511- 58(D)). Additionally, the location of the property within the
Allentown Local Preservation District and contiguous to the Allentown National Register of Historic Places District, and the
Allentown National Register Historic District makes it subject to review by the City of Buffalo Preservation Board and the Common
Council.
483 Delaware Avenue (combined address for 481 -487 Delaware Avenue), Buffalo, New York ( "Site ").
WHEREAS: The City of Buffalo Common Council ( "Council ") is empowered by §511 -58(D)
of the Code of the City of Buffalo to authorize the issuance of restricted use permits within the Special Delaware Review District;
and
WHEREAS: The Applicant intends to construct a 3500 square foot garden patio behind 481 -487 Delaware Avenue and use it for
restaurant purposes; and
WHEREAS: Pursuant to Article 8 of the New York Environmental Conservation Law, Chapter
43 -B of the Consolidated Laws of New York, as amended (the "SEAR Act ") and the regulations adopted pursuant thereto by the
Department of Environmental Conservation of the State of New York, being 6 NYCRR Part 617, et. seq., as amended (the
"Regulations" and collectively with the SEQR Act, "SEQRA "), the Council must satisfy the requirements contained in SEQRA for
this Project; and
WHEREAS: The Project is being treated as a Type I action under SEQRA and is receiving a coordinated review;
NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE CITY OF BUFFALO COMMON COUNCIL AS
FOLLOWS:
1 st Resolve. The Council proposes to conduct a coordinated review for this proposal and will treat it as a Type 1 Action. The
Common Council submits that it is the entity with primary responsibility for the Project, that it is in the best position to investigate
all impacts associated with the Project, and has the authority to impose any and all appropriate mitigation measures. Thus, the
Council declares its intent to act as lead agency for the Project.
2"d Resolve. The President of the Council, Council Staff and its Counsel are hereby authorized and directed to distribute
appropriate Notice of this Resolution to all potential interested and /or involved agencies and to do such further things or perform
such acts as may be necessary or convenient to implement the provisions of this Resolution.
3 rd Resolve. This Resolution, which was adopted by a majority vote of the Council on July 8,
2008 shall take effect immediately.

Whereas: The New York State Legislature created the Environmental Protection Fund (EPF) in 1977 to provide a reliable,
dedicated source of funding for a variety of key environmental and coastal resource programs in New York State; and
Whereas: The New York Department of State annually solicits grant applications from local government sponsors for the
Environmental Protection Fund for Local Waterfront Revitalization Programs; and
Whereas: The City of Buffalo is seeking funds to create and assist with the implementation of the city's Local Waterfront
Revitalization Program, including establishment of the Buffalo River Historic District Park and a feasibility study for a community
boating facility; and
Whereas: The City of Buffalo is applying to the New York State Department of State for a grant under the Environmental
Protection Fund for assistance with implementation of the city's Local Waterfront Revitalization Plan, including a new public
access park project and a community boating feasibility study. The park will be accessible by both land and water and will
promote economic development and viability in the new Cobblestone District;
Whereas: As a requirement under the rules of this program, the applicant must obtain the a resolution from the governing body
in which the project will be located;
And Whereas: The City of Buffalo Common Council endorses the application for funding through the Environmental Protection
Fund;
Now, Therefore be it Resolved:
That the Mayor is hereby authorized to execute any and all documentation necessary to apply, accept and administer said grant
funding.

the sport of football, under the coaching of Mr. Bill Bergstrom, who later became Charles' role model; and
Whereas: Mr. Dingboom enrolled in the United States Marine Corps and later moved on to study physical education at the
University at Buffalo where he also played football; and
Whereas: In 1959, Mr. Dingboom was appointed at Riverside High School where he coached swimming, track & field, tennis,
baseball and his beloved sport of football; and
Whereas: Mr. Dingboom retired from coaching football in 1989 at Riverside High School compiling an impressive record of 1 17
wins, 60 losses and 9 ties; and
Whereas: After retiring from head coaching at Riverside High School, Mr. Dingboom continued to support high school football in
Buffalo and was inducted into the Harvard Cup Hall of Fame Inaugural Class of 2002; and

REQUEST FOR THE SUBMISSION OF ALL TRAVEL EXPENSES DATING
BACK TO JULY OF 2006
WHEREAS, A resolution was approved by the Common Council requesting that all City Departments, and the Buffalo Urban
Renewal Agency ( "BURA ") on behalf of the agency and its sub - contractors, prepare a list, by name, of all present and past
employees and agents who participated in business related to travel on behalf of the Department or Agency and its sub-
contractors, for the period July 1, 2006 to date, that included an explanation of the purpose of such travel, the destination of such
travel, and the cost of such travel; and
WHEREAS, BURA, after numerous Common Council requests, did finally submit its response to the City Clerk for presentation
to the Common Council at their meeting scheduled for July 8, 2008; and
WHEREAS, After a careful review of the information submitted, it is clear that additional information is required to clarify the exact
nature and specific costs related to certain travel expenses, as it appears that in certain instances Buffalo Economic Renaissance
Corporation ( "BERC ") funds may not have been utilized as efficiently as possible given that certain travel expenses were reported
as being:
• Incurred for non -BERC employees (ref: Buffalo Night in Washington and ICSC
Conferences); and
-Incurred for non -BERC initiatives (ref: CitiStat meeting); and
-Incurred by T. Wanamaker when a more appropriate City representative should have
attended (ref: DC WIFI conference); and
• Incurred by multiple staff members attending the same conferences when a "trainer"
approach could have been utilized, whereby an individual in attendance would be responsible for sharing information gained with
those not in attendance (ref: ICSC, Brownfield and many other conferences); and
WHEREAS, Monies reported as being utilized by BERC to fund travel expenses were furnished from the City's Community
Development Block Grant (CDBG) program and are intended to support community development projects rather than
administrative perks; and
WHEREAS, Monies aggregating $36,928.74 were utilized by BERC for travel expenses while entities such as CRUCIAL, the
Broadway Market and numerous other Community Based Organizations continue to struggle to find creative ways to deal with
shrinking Block Grant allocations.
NOW THERFORE BE IT RESOLVED,
That the Common Council requests that BURA on behalf of and with the assistance of BERC, shall
furnish a full and transparent accounting of all travel
expenses reported to date by supplying copies of
conference and meeting literature, airline tickets, and detailed lodging and miscellaneous expense receipts associated with the
amounts reported thus far.
NOW THERFORE BE IT FURTHER RESOLVED,
That BURA on behalf of and with the assistance of BERC, shall furnish copies of the travel policies that governed the expenditure
and reimbursement of travel expenses for the period July 1, 2006 to date.

Whereas: West Side resident Anthony Capozzi was wrongly convicted of a crime and was sentenced to 35 years in prison; and
Whereas: While in prison, Anthony Capozzi maintained his innocence and was not eligible for parole because he did not show
remorse for the crimes he did not commit; and
Whereas: In 2007, it was found that another man, Altemio Sanchez, had actually committed those crimes and Anthony Capozzi
was released from prison after serving 22 years; and
Whereas: As a result of Anthony Capozzi's ordeal, the New York State Legislature approved "Anthony's Law" which gives priority
to claims for those who have been unjustly convicted and imprisoned and was signed into law on July 3, 2007; and
Now, Therefore, Be It Resolved
That the Common Council of the City of Buffalo approves the installation of a trailblazing sign proclaiming a portion of Jersey St.
"Anthony Capozzi Way."

CITY OF BUFFALO'S POLICY REGARDING COMPOSTING OF YARD WASTE CLARIFICATION
Whereas: The reduction of the amount of solid waste and the conservation ofrec3clable materials are
important public concerns; and
Whereas The separation and collection of newsprint, paper, cardboard, glass, aluminum containers, metal cans, plastic
containers, vegetative yard waste and other material for recycling from residential users in the City, will protect and enhance the
City's physical and visual environment, as well as promote the health, safety, and well -being of persons and property within the
City by minimizing the potential adverse effects of land filling through the reduction of the need for landfills and conservation of
existing landfill capacity, facilitating the implementation and operation of other forms of solid waste management, conserving
natural resources and ensuring conformance with New York State Solid Waste Management Plan; and
Whereas: The ability to compost yard waste instead of land filling or incineration has been a
cornerstone to the Buffalo Recycling Plan since 1988, when the first loads of leaves were delivered to the West Side transfer
Station as part of a Pilot composting project; and
Whereas Although the public has responded to recycling positively, and has made great efforts to separate recyclable materials,
the success of the Squaw Island program indicates that there is no reason for any yard wastes to be mixed in with regular
garbage pick -ups and disposed of at great expense to the City; and
Whereas: It would be beneficial to the City of Buffalo and its residents to establish clear policies and
guidelines for the disposing of compostable yard waste in the City of Buffalo.
Now, Therefore, Be It Resolved That: the Commissioner of the Department of Public Works review his
department's handling of yard waste removal and the policies that are currently in place for yard waste removal and disposal; and
Be It Further Resolved; That the Commissioner of Public Works report back to this Common Council by
July 17, 2008 with a written policy that will be used by his department for yard waste collection and removal within the City of
Buffalo, to clarify for the residents of Buffalo the proper procedure for disposing of yard waste; and

Whereas:
Success beyond the completion of a High School Education is highly contingent upon the successful completion of High School;
and
Whereas:
Good attendance establishes a pattern of responsibility and commitment that will serve students throughout their lives - including
college and the workplace. In addition, high levels of attendance in school are necessary to the successful completion of school
and academic success. and
Whereas:
It has been found that Truancy is a high indicator of gang involvement including but not limited to loitering, assault, battery,
murder, underage drinking, consumption and sale of illegal substance. To that end the residents of the City of Buffalo find
problems associated with youth gangs a problem facing the City; and
Whereas:
The City of Buffalo does not have current legislation to deal with truancy; and
Whereas
Curbing Truancy would not only increase attendance and thereby increase the student success rate but it would also decrease
gang activity and the crimes associated therewith; and
Now Therefore, Be It Resolved:
That the Common Council adopts the following legislation to deal with the City of Buffalo Truancy problem:
Title Truancy Ordinance:
For the purposes of this section, "regular school hours" are the hours of the full -time school which the minor would attend in the
school district in which the minor resides, on any day for which school is in session, or, if such school in the school district of
residence is unknown, "regular school hours' are the school hours of the Buffalo School District on any day for which school is in
session.
A minor who is at least six (6) years of age and under eighteen (18) years of age and who has not completed the 12 grade may
not be upon any street, highway, park, alley, or other public property during regular school hours except while attending school as
required by applicable provisions of NYS Education Law, unless such minor is:
a. Absent from the school with the school's permission, but not including students who have been suspended or expelled; or
The minor is accompanied by his or her parent(s) or legal guardian or a responsible adult selected by the parent or legal guardian
to supervise the child; or
Engaged in a lawful pursuit or activity that requires the minor's presence somewhere other than school during regular school
hours which is authorized by the parent, guardian, or other person having legal care and custody of such minor; or
d. Exempt from compulsory school attendance pursuant to
the applicable provisions of NYS Education Law; or
e. Have already graduated from High School prior to
attaining 18 years of age.
No parent or legal guardian of a minor between the ages of six (6) and eighteen (18} years of age shall knowingly or negligently
allow a minor to violate division (b) of this section.
It shall be an affirmative defense to this division that the parent or legal guardian has initiated the jurisdiction of the Juvenile court
against the minor prior to the time that the minor was found violating division (b) of this section.
If a police officer has reasonable suspicion to believe that a minor is in violation of this section, the officer is authorized to stop
and detain the minor and make reasonable inquiry regarding a potential violation of subsection B of this section.
If a police officer has probable cause to believe that a minor is in violation of this section, the officer is authorized to take the minor
into protective custody pursuant to the applicable provisions of the Family Court Act.
f. A minor detained for the purposes of this law will only be
released into the custody of his or her parent or legal guardian.
Any minor who violates division (b) of this section is subject to on the first occasion a warning. On the second occasion a fine of
no more than fifty dollars ($50) or 8 hours of community service. On the third occasion and every occasion thereafter a fine of no
more than seventy -five dollars ($75) and no more than 25 hours of community service.
Any parent or legal guardian who violates division (c) of this section on the first occasion shall be issued a warning. On the
second occasion they shall be found guilty of a minor misdemeanor and be issued a fine of no more than $100. On the third
occasion and any occasions thereafter they shall be issued a fine of no more than $300.
Be it further Resolved:
That a copy of this Resolution be sent to the Buffalo Board of
Education and to Corporation Counsel for further review.
Be It Finally Resolved:
That upon clearance by the Buffalo Board of Education and Corporation Counsel, the Buffalo Common Council approves
this
resolution and enacts the aforementioned.

REQUEST NEW YORK STATE TO ISSUE A MORATORIUM ON NEW /ADDLTIONAL LOTTERY OUTLETS IN THE CITY OF BUFFALO AND REVAMP THE
PRIZE PAYOUT
State Assemblywoman Crystal Peoples, Senator Antoine Thompson and various Community Leaders have called for a
moratorium on new lottery outlets and revamping prize payouts; and
Critics of the government- operated lottery system claim the lottery pays the least in prizes for the games most popular in the
poorest neighborhoods and lottery players in poor, minority neighborhoods generally lose more than other lottery players because
they more frequently play online numbers games that, by law, pay out less than the scratch -off tickets popular in other
communities and called upon elected officials in government "to look at the numbers and come up with a game plan of how do we
inform and protect the weakest in our community "; and
In a letter and "Losing by the Numbers," a series in The Buffalo News, Gordon Medenica, Lottery Director, substantiated claims
that online numbers games have lower payouts than instant scratch -off games, people in poorer, minority communities play more
online numbers games than instant games. The News also found that numbers games accounted for nearly two - thirds of lottery
sales at outlets on Buffalo's East Side and an average of 10 lottery outlets per square mile on the East Side, the most in the
county; and
State law specifies the percent of total sales that must be returned as winnings for each lottery game
Now Therefore Be It Resolved That:
The Common Council of the City of Buffalo requests the State to issue a moratorium on additional or new lottery outlets in the City
of Buffalo as well as an investigation, overhaul and equalization of the prize payout rates.
Be It Further Resolved That:
A copy of this resolution is sent to all members in the Western New York State Delegation.

JUDGE RULES AGAINST SENECA NATION ON BUFFALO CASINO

A federal judge today ruled against the Seneca Nation's Buffalo Creek Casino, saying that casino gambling cannot legally take
place on the nine -acre site on Michigan Avenue.
U.S. District Judge William M. Skretny, in a 127 -page decision, vacated the earlier decision by the commissioner of the National
Indian Gaming Commission to allow gambling.
It was not immediately clear whether Skretny's ruling will halt construction on the $333 million permanent casino, but it is clear
that the temporary casino no longer has the legal right to operate.
Skretny ruled that the parcel is indeed Indian country.
"However, the court finds that the (National Indian Gaming Commission's) July 2, 2007, determination that the Buffalo parcel is
gaming - eligible ... is arbitrary, capricious and not in accordance with the law."
The Senecas have operated a small temporary Buffalo Creek Casino in a blue metal building on the nine -acre site since July 3,
2007. It was the third Seneca casino, following openings in Niagara Falls and on the Allegany territory in Salamanca.
Late last month, the Senecas issued an update to their 2005 study of the tribe's effect on the local economy, mostly through
gambling. They cited 1,100 new jobs and said the Senecas are pumping more money into Western New York than the Buffalo
Bills and Buffalo Sabres combined.
Despite the lack of amenities, more than 400,000 people have come to the temporary casino to gamble while work continues on
construction of its larger $333 million permanent casino and hotel.
The temporary casino opened after Philip N. Hogan, chairman of the National Indian Gaming Commission gave the go- ahead,
and Senecas moved slot machines into the building in the dead of night.
The question answered in today's ruling is whether the land on Michigan Avenue, bought by the Senecas in 2005,

legally considered sovereign Seneca territory. The lawsuit claimed the Senecas can only operate a casino on
land considered sovereign,
The land was purchased with funds from the 1990 Seneca Nation Land Claims Settlement Act, which settled the question of
longterm leases in the city of Salamanca.
The Senecas said the settlement act gave them the right to expand their territory. John J. LaFalce, who co -wrote the legislation
while a congressman, said the act never was intended to legitimize gambling casinos off the reservation.
While the Senecas are not a party to the federal lawsuit -- Citizens for a Better Buffalo is pitted against the U.S. Justice
Department -- they filed motions as a friend of the court. The Senecas argue that treaties, federal law, state law and past court
rulings say the federal agency was correct in saying the casino could operate there.
"(We) will continue to aggressively challenge anyone who attempts to limit or misinterpret our tribal sovereignty for their own gain
or agenda," Seneca President Maurice A. John Sr. said in November 2007.
Cornielius D. Murray, the Albany attorney representing Citizens for a Better Buffalo, has repeatedly warned the Senecas that the
they are building the new casino at their own risk.
"While there is no dispute that the Senecas own the land," Murray said in response to John, "mere possession of title does not
give them the right to violate the laws of the state unless they can prove that the land is no longer subject to the jurisdiction of the
state of New York."
"Soverignity and title are not the same thing," Murray argued. "There are compelling legal arguments that Congress never
intended to carve out a parcel of property in the heart of a maj or American city and designate it as "Indian land."
Erie County was originally part of the suit, saying the casino would be an economic drain on the local economy, but County
Executive Chris Collins dropped the lawsuit after he took office.
Buffalo Mayor Byron W. Brown is also a supporter of the Buffalo Creek Casino and, like Mayor Anthony M. Masiello before him,
argues that the casino will help revitalize Buffalo.
"The nation has proven itself as a very important part of our local economy," Brown said.
Citizens for a Better Buffalo is led by its president, Diane Bennett, a retired attorney, and includes public officials, religious
leaders and community activists. The group is largely funded by the Margaret L. Wendt Foundation. The Baird Foundation and a
private donors have also helped fund the lawsuit, which has cost more than $1 million.
The nation and its gambling arm have invested nearly $27 million to date on land acquisition, planning and construction of its
Buffalo venue. More than $10 million of that went into the original construction, and then expansion, of the temporary slots -only
casino that opened last July.
In documents filed with the federal Securities and Exchange Commission, the Senecas estimated another $10.8 million on site
preparation and construction of the permanent casino through the end of March.
Other major expenditures include: $2.7 million for acquisition of the properties along Michigan Avenue that compose the nine -acre
sovereign territory, plus another $631,000 to buy a one -block section of Fulton Street from the city. The street formerly bisected
the casino site.
The gambling corporation has also acquired three other nearby properties, spending another $1.7 million.
The temporary casino, which opened with 109 slot machines a year ago, was expanded to accommodate 244

machines. In its first six months of operations, it generated more than $12 million in revenues.
In June 2006, the Senecas unveiled designs for a $125 million permanent casino, then upped the ante in October 2007 with
blueprints for a $333 million casino complex. It's billed as the largest privately- funded construction project in Buffalo's history.
Plans call for a 22 -story, 206 suite hotel tower, to complement a 90,000- square -foot casino, with 2,000 slot machines and some
45 table games. The complex would also house four restaurants, a spa and include a 2,500 - vehicle parking deck.
The facility is expected to employ more than 1,000 and generate some $7 million a year in revenues to the host community.
Buffalo and Erie County are squabbling over each's share.
Construction crews have been installing pilings and foundations since early February, and the first load of structural steel was
due for delivery in the next two weeks.

Whereas A Bill has been introduced in the New York State Assembly #A07181 -A-"An Act to amend the vehicle and traffic law, in
relation to establishing a demonstration program imposing mandatory monetary liability on the owner of a vehicle for failure of an
operator thereof to comply with traffic control indications in Nassau and Suffolk counties and in the cities of Yonkers and Buffalo ;"
and
Whereas This Bill would amend Section 1111 -a of the Vehicle and Traffic Law to authorize the City of Buffalo to adopt a local law
or ordinance to implement a demonstration program to install photo violation- monitoring devices at intersections in the City of
Buffalo; and
Whereas Aggressive driving, including running red lights poses a risk to the public health, safety, and welfare as red light running
accidents are often the worst type of accident as they often involve speed and right -angle impacts, which can lead to the most
severe injuries; and
Whereas In New York State, 30% of reported vehicular accidents in 1998 occurred at signalized intersections, of which 244
involved fatalities. Of more than 18,000 pedestrian accidents occurring in the same period, 33% were at signalized intersections;
and
Whereas Many cities in the United States have already successfully implemented photo- enforcement for catching red light
runners, including New York City, Los Angeles, San Francisco, San Diego, Baltimore, and Washington D.C.; and
Whereas In addition, the implementation of photo - violation monitoring devices in the City of Buffalo is expected to yield
approximately $3.5 million in annual revenue; and
Now, Therefore, Be It Resolved:
That the City of Buffalo hereby goes on record in support of Assembly Bill #A07181- A - "An Act to amend the vehicle and traffic
law, in relation to establishing a demonstration program imposing mandatory monetary liability on the owner of a vehicle for failure
of an operator thereof to comply with traffic control indications in Nassau and Suffolk counties and in the cities of Yonkers and
Buffalo ;" and
Be It Further Resolved:
That the City Clerk be hereby directed to forward certified copies of this Home Rule Message to Governor David Paterson,
