Franczyk Common Council President 1315 City Hall Dear Council President Franczyk: I am writing to request that a Special Meeting of the Common Council be convened prior to December 31, 2009 for the purposes of extending the Assessment challenge process until January 15, 2010. My office has consulted with Commissioner Kennedy and his office can accommodate this extension. I have been further advised that, in order to meet all necessary requirements, this would be the longest extension his office can accommodate. Mr. Gerald Chwalinski, City Clerk Commissioner Martin F. Bail, Assistant Corporation Counsel RECEIVED AND FILED NO. 3 EXTENSION OF ASSESSMENT APPEALS DEADLINE WHEREAS: Article 28 ( "Taxes and Assessments ") of the City of Buffalo Charter puts into effect provisions of the New York State Real Property Tax Law which provide for an annual assessment appeals process for those who perceive themselves aggrieved by the assessed value of their real property; and WHEREAS: Real Property owners in the City of Buffalo are notified by the city of changes to their assessment during the month of December; and WHEREAS: The deadline for filing an appeal with the city is usually within the same month (December) that notices are received by real property owners; and WHEREAS: This year, many taxpayers have reported being surprised by changes in their assessments and have requested that they be given additional time in which to file an appeal; and WHEREAS: December is a busy month for most people and the City of Buffalo allows taxpayers only a short period of time in which to compile the necessary information to mount a credible challenge to their assessment; and WHEREAS: By extending the assessment challenge deadline, the City of Buffalo could increase the likelihood that taxpayers who wish to examine their assessment and research the fair market value of their home are provided with ample time to do so, as well as to ensure that their appeal, should they chose to file one, is prepared correctly and submitted to the city in a timely manner. NOW, THEREFORE BE IT RESOLVED: That the Common Council extends the City of Buffalo's assessment challenge deadline for the current fiscal year until Friday, January 15 20 1 0. Michael J.
