Based upon the City of Buffalo Comptroller's recommended debt limits, the 2010 Capital Budget consists of $22.7 million in funding for City of Buffalo projects and $4.9 million for Buffalo Public Schools projects. In recommending individual expenditures, my administration has thoroughly reviewed the recommendations of the Citizens Planning Council (CPC). My administration is greatly appreciative of the difficult task performed by the CPC in evaluating more than $125 million in requests. As is evidenced by the attached budget, I have adhered closely to the recommendations of the CPC. My recommended Capital Budget contains a wide variety of capital improvement projects including more than $3.1 million in funding for City parks. This increased funding is necessary given the County of Erie's decision to return management of the parks to the City of Buffalo. M fig , 5 RESOLUTION SPONSOR: Mr. LoCurto RE: EXTENSION OF ASSESSMENT APPEALS DEADLINE WHEREAS: Article 28 ( "Taxes and Assessments ") of the City of Buffalo Charter puts into effect provisions of the New York State Real Property Tax Law which provide for an annual assessment appeals process for those who perceive themselves aggrieved by the assessed value of their real property; and WHEREAS: Real Property owners in the City of Buffalo are notified by the city of changes to their assessment during the month of December; and WHEREAS: The deadline for filing an appeal with the city is usually within the same month (December) that notices are :received by real property owners; and WHEREAS: This year, many taxpayers have reported being surprised by changes in their assessments and have requested that they be given additional time in which to file an appeal; and WHEREAS: December is a busy month for most people and the City of Buffalo allows taxpayers only a short period of time in which to compile the necessary information to mount a credible challenge to their assessment; and WHEREAS: By extending the assessment challenge deadline, the City of Buffalo could increase the likelihood that taxpayers who wish to examine their assessment and research the fair market value of their home are provided with ample time to do so, as well as to ensure that their appeal, should they chose to file one, is prepared correctly and submitted to the city in a timely manner. NOW, THEREFORE BE IT RESOLVED: That the Common Council extends the City of Buffalo's assessment challenge deadline for the current fiscal year until Friday, January 15 "', 2010.
