Casey, Deputy Mayor Nicole Drye, Save Our Streets Coordinator DATE: January 8, 2007 SUBJ ' City of Buffalo Save Our Streets Program — Resolution #97 Pursuant to reviewing Resolution #97 concerning "Addressing Quality of Life Issues Caused by Irresponsible Tenants and Landlords" proposed by Mr. Kearns, I am sending information regarding programs implemented by the City of Buffalo Save Our Streets Program and its' components. • Landlord Training Sessions • Sessions have proven to be an effective tool in providing knowledge to property owners regarding evictions, inspection requirements, crime prevention through environmental design, fair housing, leases and tenant selection and screening, lead prevention, the role of the police and identification of drug activity, funding sources, changes in the City of Buffalo Housing Court, diversity training, presentations from Belmont, Section 8 and Social Services. • Landlords have volunteered for this valuable training; however some are court mandated by City Housing Court Judge Henry Nowak to attend the sessions that are offered three times a year. • Advanced workshops are offered to homeowners that have previously attended the all day session regarding the courses mentioned above. These meeting are brought about from police reports and complaints received by the Mayor's Resolution line. Property owners are required to meet with the Task Force and are notified of the activities occurring on their property. They are then directed to proceed with certain actions that will benefit the community at large by providing eviction or directives for their current tenants to abide. I wish to inform you that the name change is only ceremonial in nature. This did not change the official name of the subject highway. Under existing New York law, municipalities may only set aside spaces on city streets for a "public purpose" or otherwise be open for public use. Richard Fontana Buffalo Common Council 1414 City Hall Buffalo, NY 14202 Dear Councilmember Fontana: In the Btgalo Nezes article of Wednesday, January 3, "City's living wage likely to rise to $9.59," the piece concludes with the compliance coordinator of the City's Living Wage Commission calling into question the stance of the Buffalo Niagara Partnership and other business organizations regarding the "living wage" and associated cost -of -living adjustments (COLAs). I would like to extend to you some information on which the business community bases its interests in this debate. The compliance coordinator's assertion that Living Wage laws in other cities have not had an impact on costs is an interesting twist on the facts -- and. Buffalo's own current situation is a good example of why. If the Common Council passes this COLA adjustment to the Living Wage Ordinance mid -year, while many contractors are in the midst of their contracts, and contracted duties, they will not be able to renegotiate to include the additional cost of personnel. They will be forced to adhere to higher costs, and in other cities, employers have responded to that increase in several ways: • By hiring more skilled employees and displacing the lowest - skilled workers (who the Living Wage Ordinance was supposedly intended to help) • By cutting the hours of the entry -level workforce -or by cutting their jobs entirely • By automating job functions By increasing the cost of labor, Living Wage mandates provide an incentive for employers to find alternatives to entry -level workers bylaw earning more potentially than their production value. A well-known 2002 study by Michigan State University Professor David Neumark, which looked at 36 U.S. cities, found that Living Wage laws - with a wage rate 50% above the minimum - reduce employment among low-wage workers by seven (7) percent. Since enforcement of the city's Living Wage Ordinance has been shaky in the past, a move to increase and enforce an even higher rate may do n harm to lower- skilled workers. Moreover, you can be certain that once contracts expire and are renewed or re- awarded, the Living Wage rate and the COLA increase will be reflected in new agreements with the City of Buffalo, thus increasing costs to the city and, as a result, taxpayers. That means that any salary increase to current city employees is a dint increase in cost to taxpayers - a dangerous maneuver to make outside of the annual budget process, at a time when the costs can not be offset. Ultimately, this is why we believe the Buffalo Fiscal Stability Authority will stop the amendment, and one of the reasons the business community be lobbying it to do so. To suggest that forcing employers doing business with the City of Buffalo to pay higher wages to entry -level employees does not affect the city's - and taxpayers' - bottom line is a misrepresentation of the facts. We believe that there is a clear correlation between raising the wage mandate and the cost to taxpayers - and sadly, all at the expense of the people that on paper the Living Wage Ordinance is designed to assist. I have enclosed, for your review, an article written by the Business Council of New York State's Public Policy Institute in 2002 that details the damage Living Wage ordinances can have on low-income workers and the community as a whole. The piece contains more detailed information on the Neumark study mentioned above. The project, between Colvin and Starin, on an abandoned rail bed has a number of clear environmental issues that have not been addressed by any of the site plan materials provided to the BEMC. I believe that the Planning Board invited Dennis Sutton, BEMC staff, to the last meeting to review and comment on environmental issues related to this development, and the development plans were tabled, according to Mr. Sutton. In addition to Mr. Sutton, BEMC members reviewed the plans at our December 20, 2006 meeting and the following environmental issues were discussed. We have not seen a copy of the EAF or any plans for an environmental impact study for this project. There are a number of clear environmental issues which should result in a positive declaration of environmental impact. Thus, under the City Charter, BEMC should review the EAF and EIS materials as part of the process to consider this development. Our most immediate concerns relate to the soil at the site. We recommend a series of actions below to deal with those questions. Further, we have not seen any meaningful analysis of traffic (we have seen no alternatives to the proposed single street with stop signs and crosswalks that would mitigate potentially significant traffic safety issues), quantification of the amount of greenspace converted to impervious surfaces, vegetation and habitat, erosion, flooding, leaching or drainage issues, aesthetic resources and neighborhood character, utility- related impacts (e.g., sewer capacity and potential to increase CSOs off - site) and construction- related impacts. No meaningful analysis of subdivision plat/site plan alternatives and/or mitigation measures have been presented to our knowledge. At a minimum, with respect to soil issues, the BEMC believes that this project should not go forward unless or until: * if fill material is to be left on site, it should be properly characterized - this means a systematic soil sampling and analysis program that will delineate the extent laterally and horizontally from discrete sampling locations. The analysis should involve a full suite of EPA standard priority pollutants, heavy metals and elemental analysis, semivolatile organic compounds (SVOC), including polycyclic aromatic hydrocarbons (PAHs) and polychlorinated biphenyls (PCBs) and volatile organic compounds (VOCs). * no site plans should be approved, no permits issued, no development should take place until analytical results are obtained and compared to the NYSDEC TAGM 4046 Soil Cleanup Guidance Values. All information should be submitted to the City for review and approval. New York State DEC and DOH should be called to partner on this project, given the history of use of the site and the potential contaminants that are present. * If all fill material is to be removed from the property, the City should request that the contractor generate a soil management plan to quantify the amount of material and indicate how the material is to be Room 920, Buffalo City Hall, 14202 4 Buffalo Environmental Management Commission removed, transported and disposed or reused. This is to prevent the material from being used or disposed of improperly. The soil management plan should be submitted to the City for approval prior to any excavation activities and before any permits issued or any site plans approved. * After removal of the material the contractor should obtain confirmatory samples and have the samples analyzed to insure that the material left on -site is suitable for use in residential redevelopment. The analytical values of the confirmatory samples should be compared to the NYSDEC TAGM 4046 Soil Cleanup Guidance Values. * No backfill material should be brought on site unless it can be documented that it was obtained from a "clean" source and documentation is provided to the City, or, chemical analysis of the backfill material is obtained and indicates acceptable use in the project. * if all fill is to be removed, once removal is complete the contractor should provide a Project Closeout report, signed and stamped buy an Engineer licensed in the State of New York, indicating that all fill materials were removed, transported and disposed /reused according to the soil management plan. We remain concerned that other potentially significant environmental impacts have not been or will not be properly evaluated. Potential impacts should be evaluated and quantified in accordance with SEQR, and the SEQR process (whether a Conditioned Negative Declaration is issued or whether it goes to an EIS) must be completed prior to any approvals are granted including preliminary and final subdivision plat approval. Any action/approval associated with this project should be tabled until all of the potential impacts are properly evaluated and the substantive and procedural requirements of SEQR have been met, and all documentation is submitted by the applicant in accordance with the City Charter. On behalf on the Buffalo Local Action Committee (BLAC) of the Millions More Movement, we are writing this letter to request that the Common Council pass legislation banning the use of hydrogenated oils in restaurants within the City of Buffalo. Trans fatty acids are the unnatural, artificial and toxic fat that results from the process of adding hydrogen to otherwise healthy oils. By this process, the oils become solid at room temperature, which significantly lengthens the shelf life of the food manufacturers' products, as well as giving foods, particularly baked goods, an appealing taste and mouth -feel. But while hydrogenated oils may be a boon for the food industry, they are deadly for the consumer. Once promoted to be a healthy alternative to saturated fats, hydrogenated oils are now understood as making a much larger contribution to heart disease than the former. Moreover, they have been implicated in a host of other chronic and degenerative diseases, from the national explosion of obesity to the causing of cancer. They offer absolutely no nutritional value; indeed, the Institute of Medicine has maintained that there is no safe level of trans fat consumption. Recently, the New York City Commissioner of Health took the extremely courageous and responsible position of severely restricting the use of partial hydrogenated oils in restaurants within the city. One of the fundamental functions of government is to protect its citizens. Years ago, municipal, county and federal governments all responded appropriately to the dangers of cigarette smoking, albeit they did so slowly, to ensure that the public was shielded from the destructive effects of tobacco smoke. Increasingly, the evidence is becoming irrefutable that the harm caused by trans fats is nearly pernicious as that which is caused by smoking. While the number of deaths directly attributable to trans fats is difficult to determine with certainty, it has been conservatively estimated that 30,000 die annually from consuming the trans fats in hydrogenated oils. In contrast, the FDA has banned the use of ephedra, which, in 1994, was connected to 155 deaths. Chicago is the next large city that is that is seriously contemplating the passing of a ban similar to that which New York City has recently passed. Demark already has a national prohibition on the use of trans fats, and, as early as 1977, the Who Health Organization has a proposed a global prohibition against their use and consumption. Not only are an increasing number of governments and agencies responding to the health threat, but as consumer awareness of the danger of trans fats grows, corporate America, anticipating the shifting consumer demands, has also responded. Lays, KFC and Wendy's, among others, have changed their oils in the US and Canada. In 2002, McDonald's has announced that they, too, would soon introduce a healthier alternative, although to date they have not fulfilled their promise. O d n a Although unfortunately ignored in too many instances by too many, good health is something that every one of us has a personal investment in preserving and maintaining. And it is one of the issues that the Millions More Movement is committed to address. Toward that end, in our Mission Statement, we pledge, "to educate our people on healthy dietary and exercise habits." Government can play an invaluable role in increasing the public's awareness of the dangers of that which can potentially ill affect its' most personal and individual quality -of -life question and quest: a long, vibrant and robust life free from crippling disease and illness. The relationship between a good diet and the prevention of degenerative and chronic diseases is now an indisputable and established scientific fact. As the city of Buffalo's political leadership has taken steps to protect its citizens from the disturbing rise of violent crime, protecting an unsuspecting public from the dangers of an insidious and deadly "food" is just as important, if not more so. Moreover, it cannot be overstated that the burden on the already stretched public treasury, and well as private finances, would be significantly eased when its citizens are sufficiently armed with the knowledge of the principles of sound diet and health. The BLAC is placing itself at your disposal, to help facilitate in any moral, ethical and legal way that you deem appropriate the establishment of the ban. It is our hope to establish a collaborative effort to the check the unnecessary descent of the peoples of this city into an avoidable death march. January 2007 Environmental Cleanup Activities Continue at Buffalo Color Plant Site NYS Department of Environmental Conservation Site # HW915184 INTRODUCTION The New York State Department of Environmental Conservation (DEC) is pleased to update you about continued environmental cleanup activities at the Buffalo Color Corporation (BCC) Plant site, located at 100 Lee Street in the City of Buffalo. (See map at right.) Cleanup activities are currently underway in areas A, B, C and E of the site. Area D was cleaned up previously. SITE HISTORY The BCC plant occupies approximately 42 acres of land adjacent to the Buffalo River. The area surrounding the BCC site is zoned for heavy industry. For more than one hundred years, the BCC facility has been involved in the continuous production of dyestuffs and organic chemicals. BCC is currently in the process of Chapter 7 bankruptcy. INTERIM REMEDIAL MEASURE To address contaminated groundwater that was found at the site during environmental investigations, Honeywell (a potentially responsible party) has completed a cleanup effort at the site called an Interim Remedial Measure (IRM), also referred to as an Interim Corrective Measure (ICM) in the previous fact sheet. An IRM is an environmental cleanup action that can be undertaken without extensive investigation and evaluation, in order to reduce potential exposure to environmentally impacted areas of a site. IRM activities at the BCC Plant site began in May 2006 and are nearly completed. So far, cleanup activities at the site have included: • installing a groundwater extraction system in Area A to control the migration of groundwater to the Buffalo River ; • controlling the discharge location of groundwater in Areas B, C and E; • repairing a breach in the sewer sheet pile in Area E for proper water drainage at the site; • performing stream bank erosion control in Area A; and • properly disposing of all materials generated during cleanup at an off -site location. Cleanup systems will continue to be monitored through an Operation, Maintenance and Monitoring Plan that has been approved by DEC. BULK CHEMICAL REMOVAL In December 2005, Honeywell began voluntarily removing chemicals (tanks, drums, etc.) from the site that were abandoned by Buffalo Color. Removal efforts are still continuing. Currently, approximately 90% of all the bulk chemicals found on site have been removed. NEXT STEPS In June of 2006, Honeywell entered into an Order on Consent with DEC to prepare an environmental investigation called a Remedial Investigation/Feasibility Study (RI /FS). An Order on Consent is a legal agreement between DEC and potentially responsible parties, in which the parties agree to undertake environmental investigation. The work plan for the investigation is currently under review, and field work is anticipated to begin during January of 2007. The RI /FS will result in further investigation of soil and groundwater contamination at the entire site. Fact sheets, similar to this one, will be sent to keep you updated on the project's progress. RECEIVED AND t' 000 3 ",1) January 8, 2007 To the Common Council of the City Of Buffalo RE: New Law Passed in November to fill vacancies on the Common Council My name is Roberta Rzeszutek; I am a resident of the City of Buffalo and would like to voice my opinion about the new law that was passed in November on filling vacant positions in the Common Council. I agree with this new law that was voted in by the people for the people to have a fair chance of holding an office on the Common Council. A meeting will be held January 9, 2007 where the council will interview all people with interest in the seat of Masten District Councilperson according to the new law. But is this meeting for fairness of the law or because the law states you must do it? My point is Saturday January 6, 2007 the television news reported that Demone Smith was going to be filling the vacancy of the Masten District Council seat. In the Sunday paper January 7, 2007 there was a large article that Demone Smith received strong backing and nomination from the Democratic Committee of the Masten District. The nomination was seconded by the new Senator Antoine Thompson. The article also went on to say Historically, Council members have honored the will of district committeemen when filling vacancies. Then it states Smith makes the move to Common Council seat that pays almost $10,000 more then the Legislature and terms are four years instead of two like the Legislature. Monday January 8, 2007 the noon news on television were talking about the County Legislature and announced that Demone Smith will be resigning his position on County Legislature to fill the position of Masten District Councilman. Where does this leave the three other people who are interested in this position? They are cut out of the procedure before they even have a fair chance to get interviewed. I don't feel this is the way the people intended this law to work when they voted it in. I feel it is time for this Common Council to step up to it's full potential and put this new law into effect in the way the people trusted you to follow it. Give the people a fair chance at filling the office without following the old History. Please follow the peoples wish for fairness and interview and listen to all the candidates for this position and review and fairly pick the next Masten District Councilperson. Don't make up your mind before the interview; don't just keep doing what always has been done in the past. PURPOSE The purpose of the Public Hearing is to give the public an opportunity to provide oral or written comment on the Department's proposal to amend portions of Parts 700 - 704 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR). The proposed revisions are necessary to add, revise, and delete water quality standards, and to add and or revise standard - setting procedures and related regulations, based upon the most current scientific information. Substances included in the proposal are: ammonia (new standard for marine waters), acetaldehyde (new standard for fresh waters), carbon disulfide (new standard for fresh waters), formaldehyde (new standard for fresh waters), iron (delete standard for fresh waters) and metolachlor (new standard for fresh waters). It also adds a narrative freshwater standard for the parameter "flow." The triennial review of the state's water quality standards is required by section 303(c)of the Federal Clean Water Act, and it's implementing regulations at 40 CFR Part 131. The purpose of the public information meetings is to provide the public an opportunity to learn and ask questions about the proposal. B. License application and issuance; conditions. A. Application for a taxicab or livery license shall be made to the Commissioner of Permit and Inspection Services by the owner, in writing, duly sworn to, upon forms to be furnished by the Commissioner of Permit and Inspection Services, and shall show the owner's name and address, the motor number and make of the vehicle, the year manufactured, the New York State license number attached thereto, the size of the tires used and the make, type and number or other descriptive designation of the taximeter, together with an accurate and complete statement of the color of said taxicab or livery and, if more than one color, a description of the color design thereof. An application for a livery license shall indicate if said vehicle operates through a dispatcher and, if so, the identification of said dispatcher service. The Commissioner of Permit and Inspection Services may require such further information as he deems necessary. B. The Commissioner of Permit and Inspection Services shall cause the motor vehicle described in the application to be inspected and the taximeter attached thereto to be tested. If the motor vehicle is found to be clean and in proper condition for the safe transportation of passengers and the taximeter attached thereto, upon test, is found to register correctly, the Commissioner of Permit and Inspection Services shall issue a license for such vehicle, and the taximeter attached thereto shall be sealed. The owner of any licensed taxicab or livery shall securely affix to such licensed taxicab or livery on the outside thereof at the rear of the vehicle, in a conspicuous place, a metal plate, showing the number assigned to such taxicab or livery. The licensing of such vehicle should be subject, however, to the following conditions: (1) If it shall appear that the color design stated in the application for the license of any taxicab or livery, if said taxicab or livery is of more than one color, or if it appears at any time, upon inspection of any taxicab or livery, that the color design thereof is so similar to the color design of other taxicabs or liveries as to be liable to deceive the public, then the Commissioner of Permit and Inspection Services is authorized to withhold a license to said. applicant or to revoke or suspend the license thereof until the color design of said taxicab or livery has been changed or altered so as not to resemble the color design of any other taxicab or livery operated under separate ownership and so as not to deceive the public. Any applicant for a license for a taxicab or livery of more than one color shall be entitled to use the color design thereof, provided that such applicant establishes to the satisfaction of the Commissioner of Permit and Inspection Services that such applicant was using said color design upon his taxicab or livery at the time of the enactment of this chapter and was the first to continuously use said design in the City of Buffalo or, in case of a new design, that the same is not being used by any taxicab or livery owner. After being licensed, no color design of any taxicab or livery shall be changed without the written approval of the Commissioner of Permit and Inspection Services. (2) An owner who drives his own cab or livery exclusively may place the words "owner driver" on the outside of the front doors thereof immediately below the windows in letters contrasting strongly with the color of the vehicle, not less than two inches high. However, taxicabs or liveries so marked must be operated by no one other than the licensed owner, under penalty of having the license suspended or revoked. (3) No person shall drive or operate upon the streets of the City any passenger automobile with a seating capacity in the interior thereof for seven or fewer passengers and registered as an omnibus by the State of New York, while such vehicle has a taximeter or unusual or distinctive equipment, device, design, color, numbers or lettering liable to deceive the public that such vehicle is a licensed taxicab or livery as above provided, unless such vehicle is duly licensed under this section. A livery shall not have a dome light or other lights located on the roof of the vehicle or the words "taxi," "taxicab" or words of similar import on the vehicle. (4) The mileage rates fixed by this chapter shall be displayed on each taxicab and livery so as to be readily visible to passengers entering the vehicle. The rates shall be painted in a contrasting color on both rear doors of all licensed taxicabs and liveries in letters and figures which shall be not less than 3/8 of an inch in height. (5) A taxicab or livery may have illuminated advertising billboards, placards or similar devices, no larger than 18 inches high by four feet six inches long, attached securely to the roof or trunk of the vehicle, not to exceed the length or width of such roof or trunk. The advertising displayed upon livery vehicles shall not include the words "taxi" or "taxicab" or words of similar import. (6) Effective May 1, 2007, the maximum allowable vehicle age in order to obtain a taxicab and /or livery vehicle license shall be fifteen (15)-model-year ge from the most current licensing year. (7) Effective May 1, 2008, the maximum allowable vehicle age in order to obtain a taxicab and /or livery vehicle license shall be twelve (12)-model-year ge from the most current licensing_ year. (8) Effective May 1, 2009, the maximum allowable vehicle age in order to obtain a taxicab and /or livery vehicle license shall be ten (I0)- model -year age from the most current licensing year. C. Tentative budget and capital program by county executive. On or before the 15th day of October of each year the county executive shall submit to the county legislature a tentative budget for the ensuing fiscal year, a financial forecast for the two (2) subsequent years, a capital program for the next six (6) fiscal years, and an accompanying message. Intent. It is essential that the proposed and adopted budgets be presented in a form which is both usable and understandable by the citizens of the County. The company moved to Hamburg in the 1950's and renamed Zur Industries in the 1970's. In 1982, the company was renamed Hydro -Air Components, Inc.; and Whereas: Charles Rittling has been a trailblazer in the HVAC industry for over 50 years. Rittling has patents for "twin tube" and base -board residential and commercial heating products, that continue to make Hydro -Air the industry leader in innovative and sophisticated heating and cooling systems; and Whereas: Hydro -Air's new corporate headquarters, a 150,000 square ft. building currently under construction along Abbey Street is the initial project near the former Steelfields site that will see significant future private investment. The $10 million project is bringing 300 jobs to the city; and Whereas: Currently, Abbey Street runs from South Park Avenue and comes to a dead end near the railroad right of way. Abbey Street, from Tifft Street to the railroad right of way is currently being constructed. Sunday services are currently held at Potts Deli- Banquet Hall each Sunday morning at 10:30am. Services are contemporary and family - friendly; and Whereas, On October, 12, 2006 an October Storm hit Western New'York'by surprise. Leaving the City of Buffalo in devastation and in a State of Emergency; and ` Whereas, Thousands of homes were left without power and thousands of, trees` were left destroyed. Many residents allover, the City was left with branches hanging from wires; and Whereas, Kaisertown Community Ministries SBC, rose to the occasion and called the Southern Baptist Chain Saw Crew, to come to the rescue, of residents of this City. , This Southern Baptist Crew began to cut down branches that were hanging and pulling loads of debris from back yards. This ministry helped hundreds of Constituents all over this great City. Therefore Be It Resolved: that this Honorable body applauds the efforts and sacrifices made by Kaisertown Community Ministries and the Southern Baptist Conference.
