Reasons Supporting This Determination: Control of the properties by the Buffalo Urban Renewal Agency will prevent the establishment of incompatible land uses in the area, and provide for the orderly, and appropriate, future redevelopment of the sites. The impacts that are likely to occur as a result of the project appear, on the whole, to be beneficial and not significant in magnitude or effect, and will not, either individually or as a whole, have a significant adverse impact on the environment. The potential impacts resulting from any future redevelopment of the area cannot be assessed and are purely speculative at this time since project plans are unknown. However, prior to the approval and implementation of any future development activities affecting the property, BURA shall comply will all the New York State, and if applicable Federal, environmental review regulations and procedures. The identified potential negative impacts appear to be primarily short-term site preparation and construction related activities, and do not appear to be significant in magnitude or effect. There are no actions, which will have a significant adverse impact on the environment. With regard to the issuance of licenses, we already require a collections check for many license when they are issued for the first time, but not on the occasion of renewals. I would support the requirement that all license renewals and all new licenses must show that no funds are owed to the City of Buffalo. I would strongly recommend that the applicant be required to obtain proof of no debt owed and be required to submit this information to the License division. I do not believe this collection requirement should be applied to those who seek building permits. While the issuance of a license to conduct lousiness involves the granting of a privilege to the applicant, a permit has a different status. Many permits are required to bring property into code compliance often as the result of actions in Housing Court, The City should not place new impediments in front of people who wish to bring their property into code compliance or to improve their property. The issuance of a construction permit will lead to new investment in the City. Even if back taxes are owed, the new investment improves the City's position if it eventually has to foreclose on a property, but in fact, most likely is an indication that the owner will make payments in the future. Now another hopeful step in the project's resolution is reportedly being presented to various interested parties. It would move the 100,000 - square -foot megastore down the river to the southeast, so that virtually all of the Central Wharf area would be open to the water, is move that would be more 117 keeping with the wishes of Buffalonians who took part in previous public reviews that stressed the public and historic nature of the project. What is important about this latest version of the plan, which could yet be modified, is that it shows how the Erie Canal Harbor Development Corp. has not set its ideas in stone and dared all those who oppose them to throw a fit, or file a lawsuit. In fact, the commission has maintained all along that what it was revealing was a work in progress. As has been argued in this space previously, Bass Pro and all that might surround it remain a work in progress. The discussions 4e have been about a $25 million public investment that would put up the building, an exterior design compatible with the historically Chemed project, while Bass Pro built the interior and put up $310,000 annually in common use fees that would support an adjoining museum. Calculations are that the store would also generate some $3 million a year in sales taxes, as well as draw other businesses that would also help fill the public till. No substantive new retail has landed in downtown Buffalo in the last 30 years. Nor would it now, without the dedication of Bob and Mindy Rich, who are friends of Bass Pro owner Johnny Morris. Mayor Byron W. Brown found out that securing a Bass Pro is coveted by cities throughout the nation, for what the company draws in other retailers and entertainment venues, and the life they all pump into a dead downtown. Conceptually, the project, public subsidy and all, is a vital leg up for a city and a neighborhood that need all the help they can get. But, like all human endeavors, there is little doubt that an idea can be improved by more thought, more discussion and the preservation of open minds as well as open space. While there may be some who will never be satisfied until the "historic waterfront" again becomes home to drunks, thugs, prostitutes and rats, there is still an opportunity to create something that will provide both the commerce we need and the beauty we deserve. The NYSDOT design as$ktnics thatall access will be off from the maid boulevard, and does not lntcgrate pcd strians or urban development: into its design. Instead, our proposed cross section shown in Figure _6 Would result in a facility that will. provide adequate capacity for the moderate volumes of through traffic, and also provide an excellent stage for redevelopment. The plans for a bicycte facility along the Oaater lartior could be integrated into the boulevard desigp through the areas of focused urban dcvelopnient, in a way that will p.rcavide meaningful transportation altcrnatives, as well as provide an outstanding attraction for both residents and -,,asitors to conic to the Outer Harbor without their cars. The investment in this facility will influence every facet of how the Outer Fbirbor area grcm' and develops, and it is critical. to develop a proven urban design that will mc;et the multiple goals of this facility. The NYSD(Yr plan is too fat tilted for providing capacity and service for through traffic. This is not surprising, as their mission is. first an.cl foremost tr insportat:ion. Because the Route. S/Fuhrmann Avenue corridor is also a focus of creating a vibrant urban environment, the design of this facility must consider a much b.roadcr range Of values. Grade Level. Bridge Connection to the Outer Harbor Without having an opportunity to visit the site and discuss some of the design complexities with knowledgeable people, it is difficult to maize any specific mcorrisilendations about whcre the new }trade level bridge would work best. We would also life to see the modeling results of NYSD0'1"s analysis of Scenario 8, which was an alternative variant that included all of the basic.c.lem -'nts of our preferred alternative. NYSIJ(.)`I' rejected this lternativc clue to high traffic volumes it would divert to Ohio Strcct, but this may b.c clue to assuariptioils that the new bridge would not have sufficicnt'capac;ity. Figure 8 shows two possible locations for a four lade lift bridge that would coniaect to downtown Buffalo in the most direct manner. It is simply notprudcnt for NYSDOT to expend funds to construct an alternative that is designed around the Skyway Bridge continuing in operation before file review is completed and released to the public. 2) Get NYSDOT to change the preferred alternative to the "Boulevard Alternative ". 'Phis alternative is concluded to he feasible by NYSDOT in the 50t1t11townS Connector HIS. It is also readily n stdaprable to a sceario in which the Skyway Bridge is .renxovcd and a new gl-ade -level bridge constructed to connect the Outer Harbor with downtown Buffalo. 'fhc lower design speeds make it rnorc appropriate for urban rcdcvelopmcnt 3) Redesign the Boulevard. Alternative. The Boulcvard Alternativc should be redesigned to imj?rovc its multi -modal functions and to serve local access to Outcr l larbor development as well as through- traffic. The current "boulevard" design is really just a "dressed -up" arterial design with a wide median. The "Boulevard" alternative is far superior to the "Modified Improvement' alternative because it can easily be adapted to the removal of the Skyway Bridge, building a new grade -level bridge connection to downtown Buffalo, and reconfiguration of the Fuhrnnann AvenLI&Route ) corridor into a multinnodal street. Because the Skyway Bridge is currently under study to determine options for its future, which should include an exploration of "downsizing" to an at - grade facility, it would be prudent for NYSDOT to pursue the Boulevard alternative at this time, as it is most adaptable to a range of strategies for the Outer Harbor. In the Boulevard alternative, Route 5 transitions from the Skyway.13ridge into a single h- lane boulevard. This plan is highly compatible with removing the Skyway Bridge and constructing a new at-- grade bridge, which could be-'in one of several possible locations. As attending; this conference costs the City money, I sought to reduce the cost involved by applying for a scholarship offered by NLC. In January 2004, I became the chief of staff to the nine mem- bers of New York's Buffalo Common Council. Before arriv- ing, a control board was institut- ed due to serious fiscal concerns, a wage freeze was implemented and hundreds of jobs were being eliminated. Friends and family told me that l was crazy to leave my safe civil service position with the county to become the appointed chief of staff for a two -year term. However, 1 viewed my appoint - ment as a tremendous opportu- As chief of staff, I lead a staff of seven individuals, with- out any ability to hire or fire, which resides with the nine council members. In assuming my position, I came into an office where individuals had been in pl from five to 25 years and set-in their ways as to how things were done. In addi- tion, every two years staff members were subject to being removed, as council members changed leadership positions arid. Jobs on the council staff shifted. viduals and myself came on board in the latest staff reorgan- ization. Being a fan of business writ- ers such as Torn Peters and Marcus Buckingham,, I cane into City Mall with an attitude and enthusiasm for change, encouraging staff members to be proactive, bring up ideas and implement there. Having read Buckingham's book "First Break All the Rules: What the World's Greatest Managers Igo Differently," I met with each staff member to find out their goals, interests and pas- sions. For the most part, I am a quiet person who loves to read and learn, often isolating myself with books or the computer. I know that I need to move beyond my own comfort zone and interact with staff members as an involved coach. I learned that I had to dead by example. I had to show that being proactive and taking ini- tiative was not going to get you fired. instead of waiting foi which they appreciated and wel- comed. Change makes people uncomfortable. I had to learn patience and build up trust before people were willing to follow. I gave each of my staff members Peters' book "Brand You," which I love but some thought was completely insane. The boob let them know my vision, as crazy as it was to some. Together we worked on an office mission statement, which at times was challenging to do. Not everyone saw the value in developing a mission state- ment. Our new mission statement is to serve as a "laboratory for new ideas." The Buffalo Common Council officially adopted our mission statement and it is prominently displayed on our letterhead. I also use it as a tag line on all of my e- mails. People in City lull frequent- ly joke about sending requests up to our crazy lab. We do not wear white lab coats or use shared brand for our office. Requirements_ of Taxpaver a. The construction and development of the Project will be carried out in compliance with the reasonable requirements of the Planning Board of the City of Buffalo. b. The "Pilot Agreement Period" shall mean the period of time commencing on the first tax status date following completion of construction of the Project (as evidenced by the issuance of a final certificate of occupancy) (the "Commencement Date ") and expiring 15 years from such date, provided however, that the Pilot Agreement Period shall expire earlier in the event the Project is no longer "affordable housing" (as previously defined). C. Transfer of title to the Land and improvements comprising the Project will not be allowed during the term of this PILOT Agreement without the prior written consent of the City or County, which consent will not be unreasonably withheld. d. The Taxpayer shall utilize City services for the Project at rates comparable for similar properties. e_ The Taxpayer shall provide sixty (60) days written notice to the City and the County of its intent to change rental rates for any and all units in the Project. f. The Taxpayer shall provide the City and the County such information concerning its operations and the operations of the Project in form and substance as may from time to time be reasonably requested. Such information shall include but shall not be limited to the annual financial statements of the Taxpayer from the calendar year immediately preceding the fiscal year in which payments are due. g. The Taxpayer shall permit the Comptroller of the City and County to audit its books and records within thirty (30) days after receiving a written request from the City or County. 4. Taxing Authorities and Amounts a. Effective the first tax status date following completion of the construction of the Project and continuing each year thereafter throughout the term of the Pilot Agreement Period, the Taxpayer shall make annual payments in lieu of local and municipal real estate taxes, including school taxes but not including assessments for local improvements and special assessments on the land and buildings constituting the Project (the "PILOT Payments ") as set forth on Exhibit A attached hereto and made a part hereof. b. at the expiration of the Pilot Agreement Period, this Agreement will cease to have any effect on the taxes due with respect to the property and the property will be taxed in accordance with applicable law. In addition to any other remedies available to them for the collection of delinquent real property taxes, including, without limitation, in rem proceedings, the City and County may exercise any other remedies available, and such remedies shall be cumulative and the exercise of any remedy shall not be an action of remedies under law. 6. Effect of Fulfillment of the Requirement Once having paid the amounts required by this PILOT Agreement when due the Taxpayer shall not be z �• required to pay any real property taxes for which such payments in lieu of taxes have been made, except special district assessments and other special assessments permitted by law. 7. Events of Default and Termination of Tax Exemption. a. An event of default ( "Event of Default ") shall be defined as (1) failure of the Taxpayer to make any payment required under the PILOT Agreement when due, (2) the Taxpayer's failure to provide any notice as required by this PILOT Agreement to the City or the County, (3) Taxpayer failure to qualify, or continue to qualify, for a real property tax exemption for the Project pursuant to Article XI of the PHFL, (4) failure of Taxpayer to provide any of the information required by Section 3(f) or 3(g) of this PILOT Agreement, (5) the transfer of title or beneficial ownership of any portion of the Project or the Land; provided, however, that a transfer of title or beneficial ownership of any portion of the Project or the Land to an entity approved as a housing development fund pursuant to Article XI of the PHFL by the City shall not be an Event of Default, or (6) failure of the Taxpayer to maintain affordable housing as defined above. b. Upon the occurrence of an Event of Default as defined pursuant to Section 7(a) above, the Taxpayer shall have (i) ten (10) days after the receipt of written Notice from the City or County regarding a monetary default or (ii) thirty (30) days after the receipt of such Notice of a non- monetary default, to cure such Event of Default. C. In the event the Taxpayer has not cured such Event of Default(s) within the time period set forth in this PILOT Agreement, then the exemption from real property taxes described herein shall be deemed to have been terminated as of the immediately preceding taxable status date of the City's immediately preceding taxable status date. d. Upon a termination of the exemption from real property taxes set forth in Section 7(c) above, the Taxpayer shall be liable for real property taxes on a pro -rata basis from and after the City's taxable status date immediately preceding the Event of Default and the statutory lien applicable to such real property taxes shall be deemed in effect as of the lien date normally applicable to such year's real property taxes, unless a separate basis for a real property tax exemption then exists for the benefit of Taxpayer. e. Any such termination of the real property tax exemption applicable to the Project shall not void the liability of the Taxpayer for any unpaid payments in lieu of taxes required by this PILOT Agreement prior to such termination. 8. Waiver No failure on the part of the City or County to exercise, and no delay on the part of the City or County in exercising, any right, E ' ) power or remedy hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of such right, power or remedy by the City or County preclude any other or further exercise thereof or the exercise of any other right, power or remedy. 9. Currently rehab projects are underway at 537 Glenwood, 38 Glendale, 227 Peach, 106 Hubbell and 449 Breckenridge, with new builds at 128 & 132 Chester, and 380 & 386 Cornwall all within the City of Buffalo; and Whereas. LoCurto, Michael Kearns and Richard Fontana Re: Proposed Resolution for City of Buffalo Common Council Regarding the Living Wage and Contracting Procedures Whereas: This Council passed a Living Wage Ordinance unanimously in 1999 and amended it unanimously in 2003 and 2007 as a means to alleviate poverty, reward work, and strengthen Buffalo's neighborhoods and economy; and Whereas: The City became a covered employer as of August 2003, subject to the requirements of the Ordinance; and Whereas: Various City employees, including "seasonal" laborers, crossing guards, and various interns are not currently receiving the living wage of $9.59 with health benefits or $10.77 without health benefits; and Whereas: The wage freeze imposed by the Buffalo Fiscal Stability Authority was lifted as of July 1, 2007; and Whereas: The City's contracting processes are not clear, not centrally organized, and have been subject to abuse, leading to criminal charges and loss of public confidence; and Whereas: Diverse groups such as the Buffalo Niagara Partnership and the City of Buffalo Living Wage Commission have called upon the City to centralize contracting; processes and make them more transparent, accountable, and fair; and Whereas: The Buffalo Public School District is not covered by the City's Living Wage Ordinance; and Whereas: The City Comptroller has recommended that the School District adopt a living wage policy like that of the City and has noted that over 1,300 School employees earn less than a living wage, over 98% of whom are City .residents; and Whereas: School food service workers earn as little as $7.52 per hour and School bus aides earn as little as $7.66 per hour; and Whereas: The food service program is paid with federal money and generally results in a large surplus for the School District (nearly $1 million in 2004 - 2005); and Whereas: The City of Buffalo provides the School District with roughly $70 million per year in tax revenue; and X Whereas: The over 150 living wage policies around the country have shown that paying a living wage increases productivity, reduces turnover, decreases poverty, reduces the reliance on public assistance, and helps struggling neighborhoods to revitalize; Now therefore be it resolved that: The City of Buffalo should begin immediately to pay all its employees a living wage, as required by Buffalo City Code § 96 -19. This includes "seasonal" laborers, crossing guards, and any interns who are not receiving course credit and are not covered by the youth exemption at Buffalo City Code § 96-19 (H), 2. The City of Buffalo should centralize all contracting in one department, using sealed bids that are publicly opened. The Law Department should prepare charter and/or ordinance changes to centralize contracting and make it more transparent, accountable, and fair.
